THE TRIPLE MURDER VICTIMS were Casimir Sucharski (a.k.a. Butch Casey), owner of Casey's Nickelodeon bar in Pembroke Park FL; and Sharon Anderson and Marie Rogers, who were chatting with Casey in his home early on a Sunday morning after his bar closed. It was June 26, 1994. The murders were captured on video by a camera Sucharski had installed in his living room. Prosecutors alleged that a gunman disguised by a hat and sunglasses was Penalver. Penalver turned himself in on Aug. 3, 1994. The first trial resulted in a hung jury, and the second resulted in a conviction. He was sent him to Death Row. That conviction was overturned by the Florida Supreme Court. The sequestered jury deadlocked at 10-2 after six days, when two jurors refused to deliberate. With the consent of both sides, Judge Thomas Lynch replaced the jurors with alternates and the deliberations started again.

Guilty Verdict has been reached in the “American Sniper” murder Chris Kyle and Chad Littlefield Trial. The Jury found Eddie Ray Routh Guilty of murder for Chris Kyle and Chad Littlefield. Eddie Ray Routh was sentenced to life in prison. This video is of inside the courtroom when the verdict was read by the Texas Judge and reaffirmed from each juror that the guilty verdict was their decision. The jury had three options to choose from, “Guilty”, “Innocent” or “Innocent by reason of insanity”. The jury deliberated for just a couple hours before reaching the decision in the Chris Kyle “American Sniper” killing trial. Taya Kyle (Chris Kyle's wife) was not present in the court during the verdict. During the closing arguments from the defense Taya stormed out of the court room. Taya was disgusted when hearing about Eddie's mom knowing that he had violent tendencies and didn't tell Chris Kyle to warn him about. Chris Kyle "American Sniper" author was a Navy Seal sniper is the most lethal sniper in U.S. history. Chris Kyle and Chad Littlefield were with Eddie Ray Routh on their way to a gun range to help Eddie overcome PTSD. Eddie was ridding int he back seat of Chris Kyle's truck and Chad Littlefield was the front seat passenger. Chris and Chad were texting each other warning each other of how Eddie was nuts and to watch each others back or "watch my six" which is the Navy Seals lingo for watch my back. Title: Korea′s Constitutional Court rules adultery law unconstitutional We begin with a historic ruling,... Korea′s Constitutional Court says... the adultery law is unconstitutional. The decision, out Thursday, comes as the controversial law is seen as infringing on an individual′s privacy and sexual freedom. The law had said... an extramarital affair is a criminal offense punishable by up to two years in prison,... but not many of the people deemed guitly were jailed, sapping the law of its legal authority. The decision has raised the question of whether some of the roughly 55-hundred people charged with infidelity will file for a retrial or a suspension of the indictment. Experts, meanwhile, have raised the concern that Korea needs a stronger alimony system to decrease the number of extramarital affairs. Title: Parliamentary health committee passes law revision for cigarette packaging Tobacco companies in Korea may soon be forced to cover more than half of the surface of their cigarette packs with warning messages and pictures showing the harmful effects of the habit. The parliamentary health committee voted to pass a revision to the law today. The full assembly is scheduled to vote on the measure next month. Here′s Sohn Jung-in with more. Anti-smoking messages cover just 30 percent of cigarette packs sold in Korea and are only written warnings,... which are easy to ignore. In line with the government′s tougher policy on smoking, the National Assembly′s Health and Welfare Committee voted for passage of a revised law that forces cigarette companies to use pictures showing the harmful effects of the habit and written warnings that together should cover more than 50 percent of the packaging. The law also seeks to penalize tobacco firms found to be breaking the rules. They would face monetary fines of up to 9-thousand U.S. dollars, be banned from doing business or put company officials behind bars for up to a year. The revised law will become final if it gains the approval of the full parliament in a session scheduled for March third. The revision is in accordance with a recommended standard for cigarette graphic warnings issued by the World Health Organization. As of last July, 179 countries had adopted the measure, with Korea being one of them, but the rules have yet to be put in place. If the law is passed in Korea, the visual warning system will become mandatory after a grace period of 18 months. Officials in favor of the move say such warnings are one of the most effective anti-smoking measures across the world. Brazil for instance, saw its smoking rate plunge by 10 percentage points to 22 percent one year after the law was implemented. Live from Seoul, I′m Kang Chery. Korea′s Constitutional Court rules adultery law unconstituional Korea′s Constitutional Court has struck down the law making adultery a crime. The law punished cheating husbands or wives with a maximum sentence of two years behind bars. Our Shin Se-min reports on what′s prompted the move against the decades-old law. Having an affair will no longer be a criminal offense. That′s the ruling issued by Korea′s Constitutional Court on Thursday,... following four previous appeals, with the last being in 2008. The ruling is based on the argument that the law infringes on an individual′s right to privacy... and that extramarital affairs should be regulated by civil law... not criminal law. "The decision has raised the question of whether some of the roughly 55-hundred people charged with infidelity since 2008 will file for a retrial or compensation. And one uncertainty that′s been expressed is that affairs could become more prevalent." "Adultery is still illegal. It is still a civil case. The criminal court is leaving the matter to the parties directly involved. What′s worrisome is the low alimony payments for people getting a divorce because of an affair,... as people might come to think of the destruction of a household as a minor offense." Under the law, an extramarital affair was a criminal offense punishable by up to two years in prison. But only a small percentage of those deemed guilty were jailed, as infidelity is difficult to prove, and enforcement of the law has waned in recent years. The plaintiffs would use the law as leverage to get a higher divorce settlement. Kim Kwang-sam, a former prosecutor, believes that abolishing the law would not lead to a rise in the number of extramarital affairs. "In other nations that have struck down anti-cheating laws such as France or Germany,... they didn′t go through problems caused by sexual disorders. In other words,... if you don′t punish those who commit adultery as criminals, it won′t lead to problems that will spoil the society." Prosecutors alleged that Lee had discussed plans to blow up major facilities in South Korea last year,... such as communication lines and railways,... with 130 members of the underground group. The top court also found Lee guilty of sympathizing with North Korea, which is a violation of South Korea′s National Security Law... banning any anti-state activities. However, the court ruled that there was not enough evidence to prove that the Revolutionary Organization actually existed. The court said the evidence was solely based on the testimony of informants. Right after the ruling was issued, both the ruling Saenuri Party and the main opposition New Politics Alliance for Democracy said they respected the court′s decision. However, the ruling party said Lee should have been found guilty of both sedition and conspiracy,... while the opposition party said the court′s decision should have come before a ruling last year that disbanded the Unified Progressive Party. Lee was a member of the UPP,... which was indicted on charges of conspiring with members of the Revolutionary Organization. Fresh crackdown on supporters of Egypt's ousted president Mohamed Morsi: A court has handed down death sentences to 22 more people. The defendants, who can appeal the verdict, were convicted of taking part in a July 2013 attack on a police station on the outskirts of Cairo, in which one police officer lost his life. The deadly incident took place on the same day that then-army chief and current president Abdel Fattah el-Sisi ousted Morsi, Egypt's first democratically elected president. Since then, Cairo has been cracking down on those loyal to Morsi and the Muslim Brotherhood movement. Hundreds of people, including the leader of the movement Mohammed Badie, have been sentenced to death and many more are also jailed. The death sentences, often given in speedy mass trials, are criticized by rights groups. An Egyptian court adjourned until March 25 the trial of two Al Jazeera television journalists after hearing witness testimony on Thursday. The pair are charged with aiding a terrorist organization, a reference to the Muslim Brotherhood. Mohamed Fahmy, a naturalized Canadian who has given up his Egyptian citizenship, and Egyptian Baher Mohamed were released on bail last month after spending more than a year in detention. Investigation Ends in 7 Children Taken from Parents During "Miracle" Treatment Chemical Search HOT SPRINGS, AR - The parents of seven children wrapped up in a DHS and court dispute have reason to celebrate. Their youngest four children got to come home Wednesday (3/18) afternoon. We're told this is all as a result of an agreement between attorneys for the parents and DHS that they made Tuesday during a day-long mediation. The attorneys negotiated the return as part of a 60-day trial period. According to DHS, this means the Stanleys will still be considered foster parents of their own children until an official decision can be made. The woman accused of using a Craigslist ad to lure a pregnant woman to her home to steal her unborn child is expected in court on Thursday. The suspect, whose name has not yet been released, was arrested Wednesday at Longmont United Hospital. In both common law and civil law legal systems, courts are the central means for dispute resolution, and it is generally understood that all persons have an ability to bring their claims before a court. Similarly, the rights of those accused of a crime include the right to present a defense before a court.
The system of courts that interpret and apply the law are collectively known as the judiciary. The place where a court sits is known as a venue. The room where court proceedings occur is known as a courtroom, and the building as a courthouse; court facilities range from simple and very small facilities in rural communities to large buildings in cities.
The practical authority given to the court is known as its jurisdiction (Latin jus dicere) -- the court's power to decide certain kinds of questions or petitions put to it. According to William Blackstone's Commentaries on the Laws of England, a court is constituted by a minimum of three parties: the actor or plaintiff, who complains of an injury done; the reus or defendant, who is called upon to make satisfaction for it, and the judex or judicial power, which is to examine the truth of the fact, to determine the law arising upon that fact, and, if any injury appears to have been done, to ascertain and by its officers to apply a legal remedy. It is also usual in the superior courts to have attorneys, and advocates or counsel, as assistants, though, often, courts consist of additional attorneys, bailiffs, reporters, and perhaps a jury.
