While rumors have been circulating surrounding the shooting in Red Square during Milo Yiannopoulos’ event and protests on Jan. 20, one thing is now for certain: the suspected shooter is a UW undergraduate, age 29.

In a bit of a slip-up, UW Police Department (UWPD) Major Steve Rittereiser said “the Student Conduct Code office has been notified” regarding the incident. The Community Standards & Student Conduct (CSSC) office would not be notified if the shooting didn’t involve a student, and the victim’s attorney, Sarah Lippek, confirmed Tuesday that her client does not go to the UW.

The investigation, conducted primarily by UWPD and aided by some Seattle Police Department investigators, is ongoing. The Daily will not name the suspect because charges have not been filed.

The suspected UW shooter turned himself in to UWPD the night of the incident. He and another person were released, which UWPD attributes primarily to the recommendation of the prosecuting attorney’s office. But Dan Donohoe, the prosecuting attorney, said in an email Jan. 24 that the case wasn’t forwarded to his office. In addition, he stated, “a person can only be held for 72 hours pending a charging decision,” even though the suspect was released within a few hours.

The victim, who asked to remain unnamed for fear of harassment, has been in and out of the intensive care unit three times and has undergone multiple emergency surgeries. UWPD hasn’t been able to talk to the victim because of this, and because his head isn’t clear enough to be interviewed under the medications.

Since the suspected shooter is a UW student, that means he will undergo an administrative investigation for breaking the Student Conduct Code. Criminally, a person can only be charged with a misdemeanor in Washington for bringing a firearm on K-12 school grounds. There is no such charge for college campuses. But there are enough witnesses to charge the suspect with a crime if it was committed, and should the prosecuting attorney decide it’s needed.
