    Wallace’s position here is wild.

    This apparently is a hard truth that so many whites struggle to accept. But I I was driven to write abt lynching to address precisely this truth: that this racial terrorism was so often perpetrated,cheered & watched by ordinary white men & women of all ages in both north & south.

    Your occasional reminder that a failed effort to replace a swing justice (Powell) w/ an extreme candidate (Bork) while not holding the Senate (!), followed by unanimous confirmation of a less extreme conservative candidate (Kennedy) is normal, healthy politics under divided govt.

    The approach I urge certainly doesn't evade discretion, which is impossible, but it has well-developed analogues in well-functioning judicial systems around the world. The US is the outlier. I encourage all to read both the book & the review and reach their own conclusions. (2/2)

    I very much appreciate 's review, though naturally I disagree in a number of respects. Hard to summarize in this medium, but it boils down to my view that prevailing US practices are considerably more chaotic, unjust, & arbitrary than I think is implied here. (1/2)

    What would constitutional law look like if SCOTUS applied a "proportionality" approach to constitutional adjudication. I don't think it would be pretty. Or very protective. My review of 's excellent book, When Rights Went Wrong via

    The Article III question is whether the person was subject to a sex classification. This does not depend on how they define their gender.

    The thing that I can never get over about modern-day confirmation hearings is that we have an ENTIRE DAY of members giving speeches followed by a brief statement by the nominee, and then the day ends, all before anyone has asked a question of anyone.

    Late to an important doctor’s appointment because of a trucker convoy protest in NE DC. Driver said he would only let me by if I swore to him that my appointment wasn’t for an abortion.

    Still got it!

    I distinctly remember the weird feeling of being older than a pro athlete when Kobe Bryant entered the league. With Tom Brady's retirement, I cross the other threshold. Kind of poignant as I think back on how young I felt in locker rooms as a very junior reporter. Time flies.
