Reminder Notice: Underground Storage Tank 2022 Operating Permit

Hafa Adai! The Guam Environmental Protection Agency (Guam EPA) reminds owners and operators of Underground Storage Tanks (USTs) containing regulated substances that they are required by the Underground Storage of Regulated Substances Act, as amended, Chapter 76 of Title 10, Guam Code Annotated, Public Law No. 30-36 and 32-195, to apply for a UST operating permit with the Agency. 

The annual permit fee of two hundred fifty dollars ($250.00) per tank shall be remitted to this Agency no later than December 31, 2021. In addition, the following shall be submitted with the permit fee:

  1. Guam EPA Appendix III – Application for Underground Storage Tank Renewal Permit for each UST location;
  2. A copy of the financial assurance for the UST at each location; and
  3. A check payable to Treasurer of Guam c/o Guam EPA UST-LUST Fund for each UST containing a regulated substance at each location.

Failure to obtain a permit for your facility by January 31, 2022, may result in a fine of up to Sixteen Thousand Dollars ($16,000.00) for each day of non-compliance after January 31, 2022. Notice of 45-Day Public Comment Period and Public Hearing: Ordot Dump – Draft Post Closure Care Permit

The Guam Environmental Protection Agency (Guam EPA) wishes to notify the general public and other interested parties of the availability of the Draft Guam Solid Waste Permit for Ordot Dump, Post Closure Care Permit (PCCP). The public comment period for the Draft RCRA D Permit for the Ordot Dump, Guam PCCP begins Tuesday, November 9, 2021 and closes on December 27, 2021.

PUBLIC HEARING: Wednesday, December 1, 2021, 5:00 p.m. at Agueda I. Johnston Middle School Dining Hall, 192 Dero Road, Guam, in accordance with 5 GCA §9301(a).

APPLICANT: Guam Solid Waste Authority (GSWA) – The Ordot Dump was used as disposal area by the Japanese during the Japanese occupation of Guam from December 8, 1941 to July 21, 1944. Following the liberation of Guam, the U.S. Navy continued to use the site as a disposal area. Ownership of the Ordot Dump was transferred from the U.S. Naval Government of Guam to the Government of Guam in 1950 under the Organic Act. The dump was an unlined disposal facility and few to no control system systems to manage landfill gas, leachate, surface water, erosion, and sedimentation, or vectors.
The Department of Public Works had been operating the Ordot Dump as a municipal solid waste disposal facility until Federal Receivership was imposed on March 17, 2008. The Ordot Dump was officially closed on August 31, 2011, and closure construction was completed on March 26, 2016. The Post Closure Care Permit is required to outline the long-term activities needed to monitor and maintain the waste containment systems, the groundwater monitoring network, methane gas collection and surface water run-on and run-off management systems to ensure that waste from the site does not impact the surrounding environment.

Public Notice – December 6, 2019

The Guam Environmental Protection Agency (Guam EPA) reminds the general public that a NOTICE OF ARRIVAL MUST BE FILED WITH GUAM EPA ten (10) days prior to the importation of any pesticides or pesticide devices, in accordance with the Guam Pesticides Act, codified in 10GCA §50112, which states: An importer desiring to import any pesticides or devices as defined in this Act into Guam shall submit to the Administrator a completed Agency’s Notice of Arrival form prior to the arrival of the shipment. Upon receipt, the Administrator shall complete said form, indicating the disposition to be made of the shipment of pesticides or devices upon its arrival in Guam and shall return the form to the importer or his agent. Pesticide means any substance or mixture of substances intended for preventing, destroying, repelling or mitigating any pest; any substances or mixture of substances intended for use as a plant regulator, defoliant or desiccant. Examples of pesticides are insecticides use to kill bugs on plants, rat poisons, mosquito coil, disinfectants, bleach, and repellants. Pesticides are not all chemicals they can be made from natural materials such as animals, plants or bacteria. The Notice of Arrival (NOA) Form must be completed by anyone whether for personal, business use or for resale no later than ten (10) days prior to the arrival of shipment. This requirement also applies to any point of origin and any amount. Public Notice – November 29, 2019 & December 6, 2019

The Guam Environmental Protection Agency (Guam EPA) would like to remind owners and operators of Air Pollution Emission Sources that they are required, unless exempted, by the Air Pollution Control Act, Chapter 49 of Title 10, Guam Code Annotated and Title 22 Guam Administrative Regulations, Division 1, Chapter 1, to apply for an Air Pollution Control Permit with the Agency. Annual fees shall be paid in full within sixty (60) days after the end of each calendar year and within thirty (30) days after the permanent discontinuance of an air pollution emission source. Additionally, a late payment penalty of five percent (5%) shall be added on the first day of each calendar month any part of the annual fee or any part of a late penalty fee remains unpaid. Until further notice, Guam EPA is waiving all late fees and penalties in an effort to have all regulated emission sources come into compliance with the Air Pollution Control Standards and Regulations. Failure to obtain a permit for your facility or to pay the annual emission fees may result in a fine of up to Ten Thousand Dollars ($10,000.00) per day, per violation of non-compliance. NOTICE IS HEREBY GIVEN pursuant to the Clean Water Act (CWA) Section 401 and in accordance with 22 GAR §5106. The Administrator of the Guam Environmental Protection Agency (GEPA) intends to issue four (4) §401 WQCs and approve four (4) outfall mixing zones in support of the U.S. Environmental Protection Agency (USEPA) National Pollutant Discharge Elimination System (“NPDES”) permit, required under §402 of the CWA for wastewater discharges to Waters of the United States, to the following applicant:

Meeting Notice – April 18, 2019

Pursuant to Guam Executive Order 95-07, a meeting will be held to establish the State Emergency Response Commission (SERC), represented by various government agencies, to plan and implement Guam’s response concerning hazardous materials. The Superfund Amendment and Reauthorization Act (SARA) of 1986 and Hazardous Materials Transportation Act (HMTA) of 1990 requires each state and territory to have a State Emergency Response Commission, and a Local Emergency Planning Committee (LEPC).

Compliance concerns include those related to the timeliness of required sump testing, spill prevention equipment testing, and overfill inspections. Notice of Public Hearing

In accordance with Title 5 of the Guam Code Annotated, Chapter 9, §9301(a), the Guam Environmental Protection Agency (Guam EPA) would like to notify the general public and owners/operators of Underground Storage Tanks (USTs) containing Regulated Substances of a Public Hearing to discuss Title 22 Guam Administrative Rule, Chapter 50, Guam EPA Underground Storage Tank Regulations that became effective on September 30, 2013. Guam’s UST regulations models the federal regulations and therefore, owners/operators of USTs on Guam must comply with the Implementation Time Frames for 2015 Underground Storage Tank Requirements to include, but not limited to the following: Emergency Generators, Field Constructed Tanks, Airport Hydrant System, Compatibility, etc.

Reminder Notice

The Guam Environmental Protection Agency (Guam EPA) reminds owners of Aboveground Storage Tanks (AST) containing Regulated Substances that they are required to apply for an AST Permit with the Agency by February 10, 2019, in accordance with Guam Public Law 34-140 – the Aboveground Storage of Regulated Substances Act, and codified in Title 10 Guam Code Annotated Chapter 76A, Division 3. Guam EPA is currently extending the permitting period to June 30, 2019 in an effort to have all owners of ASTs to come into compliance with Guam Public Law 34-140. The AST Permit Application Form and the Aboveground Storage of Regulated Substances Act are available online at www.epa.guam.gov.


FAILURE TO OBTAIN A PERMIT FOR YOUR FACILITY OR BUILDING MAY RESULT IN A FINE OF UP TO TWENTY-FIVE THOUSAND DOLLARS ($25,000.00), OR A DAILY FINE OF ONE HUNDRED DOLLARS ($100.00) PER 500 GALLONS OR GREATER, FOR ASTs OR CONTAINERS WITH AN AGGREGATE EQUAL TO, OR GREATER THAN 500 GALLONS CONTAINING REGULATED SUBSTANCES.

TRIENNIAL REVIEW: Guam Water Quality Standards

The Guam Environmental Protection Agency (Guam EPA) is requesting public involvement from the local community and other interested parties during the upcoming triennial review of Guam’s Water Quality Standards (WQS) regulation in accordance with Clean Water Act (CWA) Section 303(c).

Section 303(c)(1) of the CWA and the EPA’s implementing regulations at 40CFR 131.20 require that Guam, from time to time, but at least once every three years, hold public hearings to review applicable WQS and, as appropriate, modify and adopt WQS. In each WQS triennial review cycle, states and tribes, with input from the public, review their existing WQS to identify additions and/or revisions that are necessary or appropriate to ensure that their WQS meet the requirements of the CWA and the needs of the state or tribe.

Guam EPA intends to revise the island’s WQS in a variety of ways including additions of and revisions to water quality criteria, adopted implementation procedures, or other general policies. The public is highly encouraged to read the Water Quality Standards Regulatory Revisions Final Rule published in 2015 which addresses 6 key program areas.
