Clusters 2 to 10 of the #UNCybercrime Treaty include offenses that are not core cybercrimes, are drafted with vague language, or are offenses that interfere with protected speech. These cluster of offenses should be excluded from the proposed Convention.

By including offenses based on harmful speech in the upcoming UN Cybercrime Treaty, governments will be provided a framework to exploit and abuse laws to stifle lawful speech and free expression. Speech related offenses should be excluded from the Treaty.

Speech harms that are otherwise recognized as legally actionable do not need to be specially addressed as cybercrimes in the proposed #UNCybercrimeTreaty. Including content-related crimes in the treaty would pose serious threats to free expression.

EFF is in Vienna this week to stand up for users at talks between Member States over the proposed #UNCybercrimeTreaty. A long list of vaguely worded offenses in a negotiating document for the treaty threatens to criminalize protected speech.

This is a big step in the right direction: voluntary opt-in consent should be the baseline requirement for any data collection, retention, or use. And we should take a step further: online behavioral advertising should be banned.
