The Espionage Act of 1917 is a United States federal law passed on June 15, 1917, shortly after the U.S. entry into World War I. It has been amended numerous times over the years. It was originally found in Title 50 of the U.S. Code (War) but is now found under Title 18, Crime. Specifically, it is 18 U.S.C. ch. 37 (18 U.S.C. § 792 et seq.)
It was intended to prohibit interference with military operations or recruitment, to prevent insubordination in the military, and to prevent the support of U.S. enemies during wartime. In 1919, the U.S. Supreme Court unanimously ruled through Schenck v. United States that the act did not violate the freedom of speech of those convicted under its provisions. The constitutionality of the law, its relationship to free speech, and the meaning of its language have been contested in court ever since.
Among those charged with offenses under the Act are German-American socialist congressman and newspaper editor Victor Berger, Four time Socialist Party of America candidate, Eugene V. Debs, who languished almost three years in penitentiary after his conviction, anarchists Emma Goldman and Alexander Berkman, former Watch Tower Bible & Tract Society president Joseph Franklin Rutherford, communists Julius and Ethel Rosenberg, Pentagon Papers whistleblower Daniel Ellsberg, Cablegate whistleblower Chelsea Manning, and NSA contractor and whistleblower Edward Snowden. Rutherford's conviction was overturned on appeal. Although the most controversial sections of the Act—a set of amendments commonly called the Sedition Act of 1918—were repealed on March 3, 1921, the original Espionage Act was left intact.
Espionage or, casually, spying involves a spy ring, government and company/firm or individual obtaining information considered secret or confidential without the permission of the holder of the information. Espionage is inherently clandestine, as it is by definition unwelcome and in many cases illegal and punishable by law. Espionage is a subset of "intelligence" gathering, which includes espionage as well as information gathering from public sources.
Espionage is often part of an institutional effort by a government or commercial concern. However, the term is generally associated with state spying on potential or actual enemies primarily for military purposes. Spying involving corporations is known as industrial espionage.
One of the most effective ways to gather data and information about the enemy (or potential enemy) is by infiltrating the enemy's ranks. This is the job of the spy (espionage agent). Spies can bring back all sorts of information concerning the size and strength of enemy forces. They can also find dissidents within the enemy's forces and influence them to defect. In times of crisis, spies can also be used to steal technology and to sabotage the enemy in various ways. Counterintelligence operatives can feed false information to enemy spies, protecting important domestic secrets, and preventing attempts at subversion. Nearly every country has very strict laws concerning espionage, and the penalty for being caught is often severe. However, the benefits that can be gained through espionage are generally great enough that most governments and many large corporations make use of it to varying degrees.
Hillary Diane Rodham Clinton (born October 26, 1947) is an American politician and former United States Senator from New York from 2001 to 2009. She is the wife of the 42nd President of the United States William "Bill" Jefferson Clinton, and was First Lady of the United States during his tenure from 1993 to 2001. She served under current President Barack Obama as the 67th United States Secretary of State from 2009 to 2013. She is a candidate for the Democratic nomination for President of the United States in the 2016 presidential election.
A native of the Chicago area, Hillary Rodham graduated from Wellesley College in 1969, where she became the first student commencement speaker. She went on to earn her J.D. from Yale Law School in 1973. After a stint as a congressional legal counsel, she moved to Arkansas, marrying Bill Clinton in 1975. She co-founded Arkansas Advocates for Children and Families in 1977, became the first female chair of the Legal Services Corporation in 1978, and was named the first female partner at Rose Law Firm in 1979. While First Lady of Arkansas from 1979 to 1981, and 1983 to 1992, she led a task force that reformed Arkansas' public school system, and served on the board of directors of Wal-Mart among other corporations.
Bernard "Bernie" Sanders (born September 8, 1941) is an American politician and the junior United States Senator from Vermont. He is a candidate for the Democratic nomination for President of the United States in the 2016 U.S. presidential election. A Democrat as of 2015, Sanders had been the longest-serving independent in U.S. congressional history, though his caucusing with the Democrats entitled him to committee assignments and at times gave Democrats a majority. Sanders has been the ranking minority member on the Senate Budget Committee since January 2015, and previously served for two years as chair of the Senate Veterans' Affairs Committee.
Sanders was born and raised in the New York City borough of Brooklyn and graduated from the University of Chicago in 1964. While a student, he was an active civil rights protest organizer for the Congress of Racial Equality and the Student Nonviolent Coordinating Committee. After settling in Vermont in 1968, Sanders ran unsuccessful third-party campaigns for governor and U.S. senator in the early to mid-1970s. As an independent, he was elected mayor of Burlington, Vermont's most populous city, in 1981, and was reelected three times. In 1990, he was elected to represent Vermont's at-large congressional district in the U.S. House of Representatives. In 1991, Sanders co-founded the Congressional Progressive Caucus. He served as a congressman for 16 years before being elected to the U.S. Senate in 2006. In 2012, he was reelected with 71% of the popular vote. During the 2016 presidential primaries, Sanders became the first self-described democratic socialist and first Jewish American to win a presidential primary of a major party, namely the New Hampshire primary.

http://democracynow.org - In Part 2 of our debate about whether National Security Agency whistleblower Edward Snowden should be pardoned, we examine whether he could get a fair trial if he returns to the United States to be tried for violating the Espionage Act. Snowden has said the Espionage Act does not allow a whistleblower or public interest defense, which means his motivations would not be considered in court. Under the act, "it would literally be inadmissible for [Snowden] to tell the jury his motivations," argues Trevor Timm, executive director of the Freedom of the Press Foundation. Meanwhile, Bradley Moss, a national security attorney who has represented whistleblowers, says Snowden "could have gone to the intelligence committees" with his revelations and stayed within legal guid...

In June 2017, the Trump Administration launched its first prosecution under the Espionage Act of an individual accused of leaking classified information to journalists. But the Espionage Act, which was enacted in 1917 as the United States prepared to enter World War I, was never intended to apply to leakers and the press, and was only used to prosecute leakers for the first time during the presidency of Richard Nixon in 1971. 100 years after it became law, the Espionage Act's continued misuse could have a devastating effect on investigative journalism, whistleblowers, and freedom of the press in the United States. Economic espionage is a problem that costs the American economy billions of dollars annually and puts our national security at risk. While it is not a new threat, it is a growing one, and the theft attempts by our foreign competitors and adversaries are becoming more brazen and varied in approach. To raise awareness of the issue, the FBI, in collaboration with the National Counterintelligence and Security Center, has launched a nationwide campaign and released a short film aimed at educating businesses, industry leaders, and anyone with a trade secret about the threat and how they can help mitigate it. Based on an actual case, "The Company Man: Protecting America’s Secrets" illustrates how one U.S. company was targeted by foreign actors and how that company worked with the FBI to resolv...
