The Worst Proposal He's Seen, AEA's Washington Expert Warns About The Perils Of The Part 145 Re-Write We've devoted a lot of verbiage to the topic... but as more and more of the details of FAA's current Part 145 proposal emerge, we're wondering if we've underplayed it. Short and sweet, the current version of FAA's part 145 Rule-Making is just plain bad news. For instance... The rule proposes a 24-month transition period to reissue new certificates, and there is no implementation period. With the current lack of FAA workforce and sequestration initiatives, how will the agency approve and reissue certifications to 4000 repair stations in a 24-month period? Without the FAA's ability to service an application in a timely manner, businesses will close. Contrary to the FAA's claim, this proposal does not reflect current repair station aircraft maintenance and business practices, or advances in aircraft technology. It simply does not recognize avionics as a profession. These changes would not modernize the regulations to keep pace with current industry standards and practices. Rather, they would roll modern aviation back to the days of round motors and tube radios from the 1930s. The AEA has received second-hand information that various user groups, as well as certain FAA inspectors, have incorrectly assumed and promoted that the Part 145 NPRM proposal only applies to repair stations that cater to Part 121 air carriers. Getting Sick and Elderly Chimpanzees Out of Labs and Into Sanctuaries: A Rulemaking Petition
The United States is the only country in the world that uses chimpanzees for research. Despite scientific evidence demonstrating they are unnecessary, more than 900 languish in US labs today. Visit www.ReleaseChimps.org to learn more. Many of the chimpanzees are elderly and sick, and 80-90% are not even being used in research. A law already exists that would retire these chimpanzees to sanctuary, however it is not being fulfilled. In response, NEAVS, the North American Primate Sanctuary Alliance (NAPSA), Save the Chimps, Fauna Foundation, Animal Protection of New Mexico, the Kerulos Center, Sen. Bob Smith (lead sponsor of the Senate version of the CHIMP Act), and Friends of Washoe -- under the counsel of Katherine Meyer of Glitzenstein & Crystal in Washington, DC, a premier law firm with extensive experience and success in animal protection -- filed a Rulemaking Petition asking the government to define when a chimpanzee is not needed for research and therefore eligible for retirement. The Rulemaking Petition holds them accountable to the law.

Dupre granted TCEQ Rule Making 217.55 by Southern Trenchless
Eric Dupre' petition's the Texas Commission on Environmental Quality to make a rules change to Chapter 217.55 to adopted rules on Rehabilitating existing manholes, lift stations, and Wastewater Treatment Plants. To also cover protective coatings in critical areas that concrete is exposed to extreme H2S and other aggressive corrosive by-products found is sanitary sewer systems. This is very important for Texas tax payers that float the bill to maintain these structures. Until now this has been silent in TCEQ's design criteria and was unregulated State wide. This change will allow for better design to mitigate premature failures and extend the service life of hundreds of thousands of existing structures State wide.

Debrief of the DC Circuit's Oral Arguments on EPA's Greenhouse Gas Rulemakings, Panel 1
The US Court of Appeals for the District of Columbia Circuit heard two days of oral argument to review four of EPA's greenhouse gas emissions rules: the "timing" rule, the "tailoring" rule, the "endangerment" rule, and the "tailpipe" rule. These four rules were EPA's response to Massachusetts v. EPA and represented the bedrock of EPA's regulation of greenhouse gas emissions under the Clean Air Act (CAA). The court's rulings on these four rules had the potential to halt, delay, modify, or greatly increase the scope of greenhouse gas regulation under the CAA. The stakes were among the highest in recent environmental litigation.
