The Inn (Romansh: En) is a river in Switzerland, Austria and Germany. It is a right tributary of the Danube and is 517 kilometres (321 mi) long. The highest point of its drainage basin is the summit of Piz Bernina, at 4,049 metres (13,284 ft).

Geography[link]

The source is located in the Swiss Alps, west of St. Moritz in the Engadin region, which is named after the river (Romansh Engiadina: "garden of the Inn"). Shortly after it leaves its source, the Inn flows through the largest lakes on its course, Lake Sils and Lake Silvaplana. It runs north-eastwards, entering Austria, and from Landeck eastwards through the Austrian state of Tyrol and its capital, Innsbruck (bridge over the Inn), and crosses the border into Bavaria near Kufstein.

On Bavarian territory the river runs northwards and passes the cities of Rosenheim, Wasserburg am Inn, and Waldkraiburg; then it turns east, runs through Mühldorf and Neuötting and is enlarged by two major tributaries, the Alz and the Salzach.

From here to the Danube, it forms the border between Germany (Bavaria) and Austria (Upper Austria). Cities on this last section of the river are Simbach on Inn, Braunau am Inn and Schärding.

In the city of Passau the Inn finally enters the Danube (as does the Ilz river there). Although the Inn has a greater average flow than the Danube when they converge in Passau, and its watershed contains the Piz Bernina also the highest point in the Danube watershed, the Inn is considered a tributary of the Danube, which has a greater length, drains a larger surface area, and has a more consistent flow.

Among the many small towns on the river are Braunau am Inn in Austria, birthplace of Adolf Hitler; and Marktl am Inn in Bavaria, Germany, birthplace of Pope Benedict XVI. The Inn is also the only river originating in Switzerland that ends in the Black Sea (via the Danube).

A river is a natural watercourse,^[1] usually freshwater, flowing towards an ocean, a lake, a sea, or another river. In a few cases, a river simply flows into the ground or dries up completely before reaching another body of water. Small rivers may also be called by several other names, including stream, creek, brook, rivulet, tributary and rill. There are no official definitions for generic terms, such as river, as applied to geographic features,^[2] although in some countries or communities a stream may be defined by its size. Many names for small rivers are specific to geographic location; one example is "burn" in Scotland and northeast England. Sometimes a river is said to be larger than a creek,^[3] but this is not always the case, because of vagueness in the language.^[4]

Rivers are part of the hydrological cycle. Water within a river is generally collected from precipitation through a drainage basin from surface runoff and other sources such as groundwater recharge, springs, and the release of stored water in natural ice and snowpacks (e.g., from glaciers). Potamology is the scientific study of rivers.

The water in a river is usually confined to a channel, made up of a stream bed between banks. In larger rivers there is also a wider floodplain shaped by flood-waters over-topping the channel. Flood plains may be very wide in relation to the size of the river channel. This distinction between river channel and floodplain can be blurred especially in urban areas where the floodplain of a river channel can become greatly developed by housing and industry.

The term upriver refers to the direction leading to the source of the river, which is against the direction of flow. Likewise, the term downriver describes the direction towards the mouth of the river, in which the current flows

The river channel typically contains a single stream of water, but some rivers flow as several interconnecting streams of water, producing a braided river. Extensive braided rivers are now found in only a few regions worldwide, such as the South Island of New Zealand. They also occur on peneplains and some of the larger river deltas. Anastamosing rivers are similar to braided rivers and are also quite rare. They have multiple sinuous channels carrying large volumes of sediment.

A river flowing in its channel is a source of energy which acts on the river channel to change its shape and form. In 1757, the German hydrologist Albert Brahms empirically observed that the submerged weight of objects that may be carried away by a river is proportional to the sixth power of the river flow speed.^[5] (This formulation is also sometimes called Airy's law.^[6]) Thus, if the speed of flow were doubled, the flow would dislodge objects with 64 times as much submerged weight. In mountainous torrential zones this can be seen as erosion channels through hard rocks and the creation of sands and gravels from the destruction of larger rocks. In U-shaped glaciated valleys, the subsequent river valley can often easily be identified by the V-shaped channel that it has carved. In the middle reaches where the river may flow over flatter land, meanders may form through erosion of the river banks and deposition on the inside of bends. Sometimes the river will cut off a loop, shortening the channel and forming an oxbow lake or billabong. Rivers that carry large amounts of sediment may develop conspicuous deltas at their mouths, if conditions permit. Rivers whose mouths are in saline tidal waters may form estuaries.

Throughout the course of the river, the total volume of water transported downstream will often be a combination of the free water flow together with a substantial contribution flowing through sub-surface rocks and gravels that underlie the river and its floodplain (called the hyporheic zone). For many rivers in large valleys, this unseen component of flow may greatly exceed the visible flow.

Subsurface streams[link]

Most but not all rivers flow on the surface. Subterranean rivers flow underground in caves or caverns. Such rivers are frequently found in regions with limestone geologic formations. Subglacial streams are the braided rivers that flow at the beds of glaciers and ice sheets, permitting meltwater to be discharged at the front of the glacier. Because of the gradient in pressure due to the overlying weight of the glacier, such streams can even flow uphill.

Permanence of flow[link]

An intermittent river (or ephemeral river) only flows occasionally and can be dry for several years at a time. These rivers are found in regions with limited or highly variable rainfall, or can occur because of geologic conditions such as having a highly permeable river bed. Some ephemeral rivers flow during the summer months but not in the winter. Such rivers are typically fed from chalk aquifers which recharge from winter rainfall. In the UK these rivers are called Bournes and give their name to place such as Bournemouth and Eastbourne.

Classification[link]

Rivers have been classified by many criteria including their topography, their biotic status, their relevance to white water rafting or canoeing activities.

Topographical classification[link]

Rivers can generally be classified as either alluvial, bedrock, or some mix of the two. Alluvial rivers have channels and floodplains that are self-formed in unconsolidated or weakly consolidated sediments. They erode their banks and deposit material on bars and their floodplains. Bedrock rivers form when the river downcuts through the modern sediments and into the underlying bedrock. This occurs in regions that have experienced some kind of uplift (thereby steepening river gradients) or in which a particular hard lithology causes a river to have a steepened reach that has not been covered in modern alluvium. Bedrock rivers very often contain alluvium on their beds; this material is important in eroding and sculpting the channel. Rivers that go through patches of bedrock and patches of deep alluvial cover are classified as mixed bedrock-alluvial.

Alluvial rivers can be further classified by their channel pattern as meandering, braided, wandering, anastomose, or straight. The morphology of an alluvial river reach is controlled by a combination of sediment supply, substrate composition, discharge, vegetation, and bed aggradation.

At the turn of the 20th century William Morris Davis devised the "cycle of erosion" method of classifying rivers based on their "age". Although Davis's system is still found in many books today, after the 1950s and 1960s it became increasingly criticized and rejected by geomorphologists. His scheme did not produce testable hypotheses and was therefore deemed non-scientific.^[7] Examples of Davis's river "ages" include:

• Youthful river: A river with a steep gradient that has very few tributaries and flows quickly. Its channels erode deeper rather than wider. Examples include the Brazos, Trinity and Ebro rivers.

• Mature river: A river with a gradient that is less steep than those of youthful rivers and flows more slowly. A mature river is fed by many tributaries and has more discharge than a youthful river. Its channels erode wider rather than deeper. Examples include the Mississippi, Saint Lawrence, Danube, Ohio, Thames and Paraná rivers.

• Old river: A river with a low gradient and low erosive energy. Old rivers are characterized by flood plains. Examples include the Yellow, Ganges, Tigris, Euphrates, Indus and Nile rivers.

• Rejuvenated river: A river with a gradient that is raised by tectonic uplift.

The way in which a river's characteristics vary between the upper course and lower course of a river are summarized by the Bradshaw model. Power-law relationships between channel slope, depth, and width are given as a function of discharge by "river regime".

Biotic classification[link]

There are very many systems of classification based on biotic conditions typically assigning classes from the most oligotrophic or unpolluted through to the most eutrophic or polluted.^[8] Other systems are based on a whole eco-system approach such as developed by the New Zealand Ministry for the Environment.^[9] In Europe, the requirements of the Water Framework Directive has led to the development of a wide range of classification methods including classifications based on fishery status^[10] A system of river zonation used in francophone communities^[11][12] divides rivers into three primary zones:

• The crenon is the uppermost zone at the source of the river. It is further divided into the eucrenon (spring or boil zone) and the hypocrenon (brook or headstream zone). These areas are characterized by low temperatures, reduced oxygen content and slow moving water.
• The rhithron is the upstream portion of the river that follows the crenon. It is characterized by relatively cool temperatures, high oxygen levels, and fast, turbulent flow.
• The potamon is the remaining downstream stretch of river. It is characterized by warmer temperatures, lower oxygen levels, slow flow and sandier bottoms.

Whitewater classification[link]

The International Scale of River Difficulty is used to rate the challenges of navigation—particularly those with rapids. Class I is the easiest and Class VI is the hardest.

Stream order classification[link]

The Strahler Stream Order ranks rivers based on the connectivity and hierarchy of contributing tributaries. Headwaters are first order while the Amazon River is twelfth order. Approximately 80% of the rivers and streams in the world are of the first and second order.

Rivers have been used as a source of water, for obtaining food, for transport, as a defensive measure, as a source of hydropower to drive machinery, for bathing, and as a means of disposing of waste.

Rivers have been used for navigation for thousands of years. The earliest evidence of navigation is found in the Indus Valley Civilization, which existed in northwestern Pakistan around 3300 BC.^[13] Riverine navigation provides a cheap means of transport, and is still used extensively on most major rivers of the world like the Amazon, the Ganges, the Nile, the Mississippi, and the Indus. Since river boats are often not regulated, they contribute a large amount to global greenhouse gas emissions, and to local cancer due to inhaling of particulates emitted by the transports.^[14][15]

In some heavily forested regions such as Scandinavia and Canada, lumberjacks use the river to float felled trees downstream to lumber camps for further processing, saving much effort and cost by transporting the huge heavy logs by natural means.

Rivers have been a source of food since pre-history.^[16] They can provide a rich source of fish and other edible aquatic life, and are a major source of fresh water, which can be used for drinking and irrigation. It is therefore no surprise to find most of the major cities of the world situated on the banks of rivers. Rivers help to determine the urban form of cities and neighbourhoods and their corridors often present opportunities for urban renewal through the development of foreshoreways such as riverwalks. Rivers also provide an easy means of disposing of waste-water and, in much of the less developed world, other wastes.

Fast flowing rivers and waterfalls are widely used as sources of energy, via watermills and hydroelectric plants. Evidence of watermills shows them in use for many hundreds of years such as in Orkney at Dounby Click Mill. Prior to the invention of steam power, water-mills for grinding cereals and for processing wool and other textiles were common across Europe. In the 1890s the first machines to generate power from river water were established at places such as Cragside in Northumberland and in recent decades there has been a significant increase in the development of large scale power generation from water, especially in wet mountainous regions such as Norway.

The coarse sediments, gravel, and sand, generated and moved by rivers are extensively used in construction. In parts of the world this can generate extensive new lake habitats as gravel pits re-fill with water. In other circumstances it can destabilise the river bed and the course of the river and cause severe damage to spawning fish populations which rely on stable gravel formations for egg laying.

In upland rivers, rapids with whitewater or even waterfalls occur. Rapids are often used for recreation, such as whitewater kayaking.

Rivers have been important in determining political boundaries and defending countries. For example, the Danube was a long-standing border of the Roman Empire, and today it forms most of the border between Bulgaria and Romania. The Mississippi in North America and the Rhine in Europe are major east-west boundaries in those continents. The Orange and Limpopo Rivers in southern Africa form the boundaries between provinces and countries along their routes.

Ecosystem[link]

The organisms in the riparian zone respond to changes in river channel location and patterns of flow. The ecosystem of rivers is generally described by the River continuum concept, which has some additions and refinements to allow for spatial (dams, waterfalls) and temporal (extensive flooding). The basic idea is that the river can be described as a system that is continuously changing along its length in the physical parameters, the availability of food particles and the composition of the ecosystem. The food (energy) that is the leftover of the upstream part is being utilized downstream.

The general pattern is that the first order streams contain particulate matter (decaying leaves from the surrounding forests), which is processed there by shredders like Plecoptera larvae. The leftovers of the shredders are utilized by collectors, such as Hydropsychidae, and further downstream algae that create the primary production become the main foodsource of the organisms. All changes are gradual and the distribution of each species can be described as a normal curve with the highest density where the conditions are optimal. In rivers succession is virtually absent and the composition of the ecosystem stays fixed in time.

Chemistry[link]

The chemistry of rivers is complex and depends on inputs from the atmosphere, the geology through which it travels and the inputs from man's activities. The chemistry of the water has a large impact on the ecology of that water for both plants and animals and it also affects the uses that may be made of the river water. Understanding and characterising river water chemistry requires a well designed and managed sampling and analysis.

Like many other Aquatic ecosystems, rivers too are under increasing threat of pollution. According to a study of the WWF's Global Freshwater Programme, the 10 most polluted rivers are: Ganges, Indus, Yangtze, Salween-Nu, Mekong-Lancang, Rio Grande/Rio Bravo, Río de la Plata, Danube, Nile-Lake Victoria, and the Murray-Darling.^[17]

Some rivers generate brackish water by having their river mouth in the ocean. This, in effect creates a unique environment in which certain species are found.

Flooding[link]

Flooding is a natural part of a river's cycle. The majority of the erosion of river channels and the erosion and deposition on the associated floodplains occur during flood stage. In many developed areas, human activity has changed river channel form, altering different magnitudes and frequencies of flooding. Some examples of this are the building of levees, the straightening of channels, and the draining of natural wetlands. In many cases human activities in rivers and floodplains have dramatically increased the risk of flooding. Straightening rivers allows water to flow more rapidly downstream increasing the risk of flooding places further downstream. Building on flood plains removes flood storage which again exacerbates downstream flooding. The building of levees may only protect the area behind the levees and not those further downstream. Levees and flood-banks can also increase flooding upstream because of back-water pressure as the upstream water has to squeeze between the levees.

Studying the flows of rivers is one aspect of hydrology.^[18]

Direction[link]

A common misconception is that most, or even all, rivers flow from north to south.^[19][20][21] Rivers in fact flow downhill regardless of compass direction. Sometimes downhill is from north to south, but equally it can be from south to north, and usually is a complex meandering path involving all directions of the compass.^[22][23][24] Three of the ten longest rivers in the world—the Nile, Yenisei, and Ob—flow north, as do other major rivers such as the Rhine, Mackenzie, and Nelson.

Rivers flowing downhill, from river source to river mouth, do not necessarily take the shortest path. For alluvial streams, straight and braided rivers have very low sinuosity and flow directly down hill, while meandering rivers flow from side to side across a valley. Bedrock rivers typically flow in either a fractal pattern, or a pattern that is determined by weaknesses in the bedrock, such as faults, fractures, or more erodible layers.

Rate[link]

Volumetric flow rate, also called discharge, volume flow rate, and rate of water flow, is the volume of water which passes through a given cross-section of the river channel per unit time. It is typically measured in cubic meters per second (cumec) or cubic feet per second (cfs), where 1 m³/s = 35.51 ft³/s; it is sometimes also measured in litres or gallons per second.

Volumetric flow rate can be thought of as the mean velocity of the flow through a given cross-section, times that cross-sectional area. Mean velocity can be approximated through the use of the Law of the Wall. In general, velocity increases with the depth (or hydraulic radius) and slope of the river channel, while the cross-sectional area scales with the depth and the width: the double-counting of depth shows the importance of this variable in determining the discharge through the channel.

Sediment yield[link]

Sediment yield is the total quantity of particulate matter (suspended or bedload) reaching the outlet of a drainage basin over a fixed time frame. Yield is usually expressed as kilograms per square kilometre per year. Sediment delivery processes are affected by a myriad of factors such as drainage area size, basin slope, climate, sediment type (lithology), vegetation cover, and human land use / management practices. The theoretical concept of the 'sediment delivery ratio' (ratio between yield and total amount of sediment eroded) captures the fact that not all of the sediment eroded within a catchment reaches the outlet (due to, for example, deposition on floodplains). Such storage opportunities are typically increased in catchments of larger size, thus leading to a lower yield and sediment delivery ratio.

Management[link]

Rivers are often managed or controlled to make them more useful, or less disruptive, to human activity.

• Dams or weirs may be built to control the flow, store water, or extract energy.
• Levees, known as dikes in Europe, may be built to prevent river water from flowing on floodplains or floodways.
• Canals connect rivers to one another for water transfer or navigation.
• River courses may be modified to improve navigation, or straightened to increase the flow rate.

River management is a continuous activity as rivers tend to 'undo' the modifications made by people. Dredged channels silt up, sluice mechanisms deteriorate with age, levees and dams may suffer seepage or catastrophic failure. The benefits sought through managing rivers may often be offset by the social and economic costs of mitigating the bad effects of such management. As an example, in parts of the developed world, rivers have been confined within channels to free up flat flood-plain land for development. Floods can inundate such development at high financial cost and often with loss of life.

Rivers are increasingly managed for habitat conservation, as they are critical for many aquatic and riparian plants, resident and migratory fishes, waterfowl, birds of prey, migrating birds, and many mammals.

The Station nightclub fire was the fourth deadliest nightclub fire in American history, killing 100 people. The fire began at 11:07 PM EST, on Thursday, February 20, 2003, at The Station, a glam metal and rock n roll themed nightclub located at 211 Cowesett Avenue in West Warwick, Rhode Island.

The fire was caused by pyrotechnics set off by the tour manager of the evening's headlining band, Great White, which ignited flammable sound insulation foam in the walls and ceilings surrounding the stage. A fast-moving fire engulfed the club in 5½ minutes. Some 230 people were injured and another 132 escaped uninjured. Video footage of the fire shows its initial growth, billowing smoke that quickly made escape impossible, and the exit blockage that further hindered evacuation.

The fire started just seconds into headlining band Great White's opening song, "Desert Moon," when pyrotechnics set off by the band's tour manager, Daniel Biechele, ignited flammable acoustic foam on both sides of the drummer's alcove at the back of the stage. The pyrotechnics were gerbs, cylindrical devices that produce a controlled spray of sparks. Biechele used three gerbs set to spray sparks 15 feet (4.6 m) for 15 seconds. Two gerbs were at 45-degree angles, with the middle one pointing straight up. The flanking gerbs became the principal cause of the fire.

The flames were at first thought to be part of the act; only as the fire reached the ceiling and smoke began to billow did people realize it was uncontrolled. Twenty seconds after the pyrotechnics ended, the band stopped playing and lead singer Jack Russell calmly remarked into the microphone, "Wow...that's not good." In less than a minute, the entire stage was engulfed in flames, with most of the band members and entourage fleeing for the west exit by the stage.

By this time, the nightclub's Wheelock AS fire alarm system had made everyone acutely aware of the impending danger, and, although there were four possible exits, most people naturally headed for the front door through which they had entered. The ensuing stampede led to a crush in the narrow hallway leading to that exit, quickly blocking the exit completely and resulting in numerous deaths and injuries among the patrons and staff. Of the 462^[1] in attendance, 100 lost their lives, and about half were injured, either from burns, smoke inhalation, or trampling. Among those who perished in the fire were Great White's lead guitarist, Ty Longley, and the show's emcee, WHJY DJ Mike "The Doctor" Gonsalves.

The fire, from its inception, was caught on videotape by cameraman Brian Butler for WPRI-TV of Providence, and the beginning of the tape was released to national news stations. Butler was there for a planned piece on nightclub safety being reported by Jeffrey Derderian, a WPRI news reporter who was also a part-owner of The Station. WPRI-TV would later be cited for conflict of interest in having a reporter do a report concerning his own property.^[2] The report had been inspired by the E2 nightclub stampede in Chicago that had claimed 21 lives only three days earlier. At the scene of the fire, Butler gave this account of the tragedy:^[3]

...It was that fast. As soon as the pyrotechnics stopped, the flame had started on the egg-crate backing behind the stage, and it just went up the ceiling. And people stood and watched it, and some people backed off. When I turned around, some people were already trying to leave, and others were just sitting there going, 'Yeah, that's great!' And I remember that statement, because I was, like, this is not great. This is the time to leave. At first, there was no panic. Everybody just kind of turned. Most people still just stood there. In the other rooms, the smoke hadn't gotten to them, the flame wasn't that bad, they didn't think anything of it. Well, I guess once we all started to turn toward the door, and we got bottle-necked into the front door, people just kept pushing, and eventually everyone popped out of the door, including myself. That's when I turned back. I went around back. There was no one coming out the back door anymore. I kicked out a side window to try to get people out of there. One guy did crawl out. I went back around the front again, and that's when you saw people stacked on top of each other, trying to get out of the front door. And by then, the black smoke was pouring out over their heads. I noticed when the pyro stopped, the flame had kept going on both sides. And then on one side, I noticed it come over the top, and that's when I said, 'I have to leave.' And I turned around, I said, 'Get out, get out, get to the door, get to the door!' And people just stood there. There was a table in the way at the door, and I pulled that out just to get it out of the way so people could get out easier. And I never expected it take off as fast as it did. It just -- it was so fast. It had to be two minutes tops before the whole place was black smoke.

Aftermath[link]

Thousands of mourners attended a memorial service at St. Gregory the Great Church in Warwick on February 24, 2003, to remember those lost in the fire. Following the tragedy, Governor Donald Carcieri declared a moratorium on pyrotechnic displays at venues that hold fewer than 300 people.

Five months after the fire, Great White started a benefit tour, saying a prayer at the beginning of each concert for the friends and families touched by that fateful night and giving a portion of the proceeds to the Station Family Fund. The band said they would never play the song "Desert Moon" again. "I don't think I could ever sing that song again," said lead singer and founder Jack Russell.^[4] Guitarist Mark Kendall stated, "We haven't played that song. Things that bring back memories of that night we try to stay away from. And that song reminds us of that night. We haven't played it since then and probably never will."^[5] The band has since resumed playing the song.^[6]

The fire was the deadliest in the United States since the 1977 Southgate, Kentucky, Beverly Hills Supper Club fire that claimed 165 lives. The worst nightclub fire occurred on November 28, 1942, in Boston at the Cocoanut Grove, where 492 died after paper decorations caught fire. The Rhythm Night Club Fire in Natchez, Mississippi, claimed the lives of approximately 209 persons during a dance on April 23, 1940. The Station fire exceeded the death toll of 87 in the March 25, 1990 Happyland Fire in the Bronx, New York City.

The site of the fire was cleared, and a multitude of crosses were placed as memorials, left by loved ones of the deceased. Surviving family members have announced their intention to acquire the site and erect a permanent memorial.^[7]

On May 20, 2003, nondenominational services began to be held at the site of the fire on a monthly basis. Family members and friends gathered to memorialize their loved ones. In June 2003, the Station Fire Memorial Foundation was formed^[8] with the purpose of purchasing the property, building and maintaining a memorial. The Foundation continues to hold yearly services on the site, near the anniversary of the fire.

In the days after the fire, there were considerable efforts to assign and avoid blame on the part of the band, the nightclub owners, the manufacturers and distributors of the foam material and pyrotechnics, and the concert promoters. Through attorneys, club owners said they did not give permission to the band to use pyrotechnics. Band members claimed they had permission.

While investigators focused on the foam material that had been installed behind the stage, claiming the foam was intended for use in packaging and product display, testimony available to the public contradicts this. Testimony by Barry Warner, the salesman from American Foam who sold the foam to the Derderians, confirmed that there was a sales order for high-density acoustic soundproofing foam. Chemical analysis of the actual foam that was in the nightclub on the evening of the fire was never released to the public. A roll of foam confiscated from the basement of the nightclub after the fire was removed by the ATF but the testing done on that specific foam was never released to the public. Witnesses to the fire reported that once ignited, flames spread across the foam at approximately one foot per second.

A National Institute of Standards and Technology (NIST) investigation of the fire, using computer simulations with FDS and a mock-up of the stage area and dance floor, concluded that a fire sprinkler system would have contained the fire long enough to give everyone time to get out safely.^[9] However, because of the building's age (built in 1946^[10]) and size (4,484 square feet (404 m²)), many believed the Station to be exempt from sprinkler system requirements. In fact, the building had undergone an occupancy change when it was converted from a restaurant to a nightclub. This change dissolved its exemption from the law, a fact that West Warwick fire inspectors never noticed. On the night in question, the Station was legally required to have a sprinkler system but did not;^[11] outcry over the event has sparked calls for a national Fire Sprinkler Incentive Act but those efforts have so far stalled.^[12]

On December 9, 2003, brothers Jeffrey A. and Michael A. Derderian, the two owners of The Station nightclub, and Daniel M. Biechele, Great White's former road manager, were charged with 200 counts of involuntary manslaughter — two per death, because they were indicted under two separate theories of the crime: criminal-negligence manslaughter (resulting from a legal act in which the accused ignores the risks to others and someone is killed) and misdemeanor manslaughter (resulting from a petty crime that causes a death). Three of the four men pleaded not guilty to the charges. The Derderians also were fined $1.07 million for failing to carry workers' compensation insurance for their employees, four of whom died in the blaze.

Band manager's trial[link]

The first criminal trial was against Great White's tour manager at the time, Daniel Michel Biechele /ˈbiːkliː/ BEE-klee, 29, from Orlando, Florida. This trial was scheduled to start May 1, 2006, but Biechele, against his lawyers' advice,^[13] pled guilty to 100 counts of involuntary manslaughter on February 7, 2006, in what he said was an effort to "bring peace, I want this to be over with."^[13]

Biechele sentencing[link]

On May 10, 2006, State Prosecutor Randall White asked to sentence Biechele to 10 years in prison, the maximum allowed under the plea bargain, citing the massive loss of life in The Station fire and the need to send a message.^[13] Speaking to the public for the first time since the fire, Biechele appeared remorseful during his sentencing. Choking back tears, he made a statement to the court and to the families of the victims.

For three years, I've wanted to be able to speak to the people that were affected by this tragedy, but I know that there's nothing that I can say or do that will undo what happened that night. Since the fire, I have wanted to tell the victims and their families how truly sorry I am for what happened that night and the part that I had in it. I never wanted anyone to be hurt in any way. I never imagined that anyone ever would be. I know how this tragedy has devastated me, but I can only begin to understand what the people who lost loved ones have endured. I don't know that I'll ever forgive myself for what happened that night, so I can't expect anybody else to. I can only pray that they understand that I would do anything to undo what happened that night and give them back their loved ones. I'm so sorry for what I have done, and I don't want to cause anyone any more pain. I will never forget that night, and I will never forget the people that were hurt by it. I am so sorry.

Superior Court Judge Francis J. Darigan sentenced Biechele to 15 years in prison, with four to serve and 11 years suspended, plus three years probation, for his role in the fire.^[14] Darigan remarked, "The greatest sentence that can be imposed on you has been imposed on you by yourself." Under this sentence, with good behavior, Biechele would be eligible for parole in September 2007. Judge Darigan deemed Biechele highly unlikely to re-offend, which was among the mitigating factors that led to his decision to impose this sentence.

The sentence drew mixed reactions in the courtroom. Many of the families believed that the punishment was just; others had hoped for a more severe sentence.^[14]

Biechele's parole supported by families of victims[link]

On September 4, 2007, some families of the fire's victims expressed their support for Biechele's parole.

Leland Hoisington, whose 28-year-old daughter, Abbie, was killed in the fire, told reporters, "I think they should not even bother with a hearing -- just let Biechele out... I just don't find him as guilty of anything." The state parole board received approximately 20 letters, the majority of which expressed their sympathy and support for Biechele, some going as far as to describe him as a "scapegoat" with limited responsibility.

Board chairwoman Lisa Holley told journalists of her surprise at the forgiving attitude of the families, saying, "I think the most overwhelming part of it for me was the depth of forgiveness of many of these families that have sustained such a loss."

Dave Kane and Joanne O'Neill, parents of youngest victim Nicholas O'Neill, released their letter to the board to reporters. "In the period following this tragedy, it was Mr. Biechele, alone, who stood up and admitted responsibility for his part in this horrible event... He apologized to the families of the victims and made no attempt to mitigate his guilt," the letter said.

Others pointed out that Biechele had sent handwritten letters to the families of each of the 100 victims and that he had a work release position in a local charity.

On September 19, 2007, the Rhode Island Parole Board announced that Biechele would be released in March 2008.

Biechele was released from prison on March 19, 2008. As reported by the Associated Press, he did not answer any questions and was quickly whisked away in a waiting car.

Nightclub owners' trial[link]

Following Biechele's trial, the Station's owners, Michael and Jeffrey Derderian, were scheduled to receive separate trials. However, on September 21, 2006, Superior Court Judge Francis J. Darigan announced that the brothers had changed their pleas from "not guilty" to "no contest," thereby avoiding a trial.^[15] Michael Derderian received 15 years in prison, with four to serve and 11 years suspended, plus three years probation—the same sentence as Biechele. Jeffrey Derderian received a 10-year suspended sentence, three years probation, and 500 hours of community service.

In a letter to the victims' families,^[16] Judge Darigan said that a trial "would only serve to further traumatize and victimize not only the loved ones of the deceased and the survivors of this fire, but the general public as well." He added that the difference in the brothers' sentences reflected their respective involvement with the purchase and installation of the flammable foam.

Rhode Island Attorney General Patrick C. Lynch objected strenuously to the plea bargain, saying that both brothers should have received jail time and that Michael Derderian should have received more time than Biechele.^[15]

In January 2008, the Parole Board decided to grant Michael Derderian an early release; he was scheduled to be released from prison in September 2009, but was granted his release in June 2009 for good behavior.^[17]

Civil settlements by other defendants[link]

As of August 2008, nearly $175 million has been offered to the families of the victims of the fire by various defendants in settlement.

In February 2008, Providence television station WPRI-TV made an out-of-court settlement of US $30 million as a result of the claim that their video journalist was said to be obstructing escape and not helping people exit. WPRI-TV (owned by LIN Broadcasting) was filming a story on nightclub tragedies, and was there that night to film as part of their story.^[18]

In late March 2008, JBL Speakers settled out of court for $815,000. JBL was accused of using flammable foam inside their speakers. The company denied any wrongdoing.^[19]

Anheuser-Busch has offered $5 million,^[20] McLaughlin & Moran, Anheuser-Busch's distributor, has offered $16 million,^[20] Clear Channel Broadcasting has offered $22 million.^[21] Home Depot and insulation company Polar Industries has also made a settlement offer of $5 million.^[22]

Sealed Air Corporation agreed to pay $25 million as settlement. Sealed Air made soundproofing foam installed in the club.^[23] The State of Rhode Island and the town of West Warwick agreed to pay $10 million as settlement.^[24]

In September 2008 the band Great White offered $1 million in a settlement to survivors and victim's relatives,^[25] the maximum allowed under the band's insurance plan.^[26] Club owners Jeffrey and Michael Derderian have offered to settle for $813,000,^[27] which is to be covered by their insurance plan due to the pair having bankruptcy protection from lawsuits.^[27]

There are other named defendants who have not yet made a settlement offer including American Foam Corporation who sold the insulation to the Station Nightclub.^[28]
