Leasing
We have an experienced, sophisticated and diverse leasing practice representing a broad cross-section of clients in all aspects of lease transactions, which includes attorneys who are active members of the Urban Land Institute (ULI) and the International Council of Shopping Centers (ICSC). Our national leasing practice includes the structuring, negotiating and drafting of ground, hotel/resorts, office, industrial, and retail lease transactions. We take pride in representing our clients in all aspects of the leasing process, including serving our clients’ interests during the letter of intent stages, the leasing and construction stages, and the post-lease execution stages (i.e., amendments and termination agreements).
For tenants on the retail side, we represent national and regional retail tenants on their leasing needs nationwide. We also have experience serving our tenant clients in the negotiation of complex, build-to-suit leases. Our representation of tenants includes every aspect of the leasing transaction important to a tenant, whether negotiating lease provisions related to tenant build-out and allowances, assignment and subletting, common area maintenance pass-through protections, default provisions, co-tenancies, exclusives, and radius restrictions.
Property Management
On behalf of property managers and owners, our team assists in the enforcement of remedies, including eviction, rent collection and general compliance with lease provisions. We also assist property owners with the ongoing operating challenges faced when managing leased property.
On behalf of owners and tenants, we have assisted our clients through the life cycle of development, operation, and management of their facilities. Whether it is a build-out for a prospective facility or current occupancy of an as-built facility, we have coordinated with our clients’ facility management and construction departments to create efficiencies and clarity of tasks as between the client and its service providers. Specifically, we have developed Master Service Agreements and sub-agreements for our clients’ use in interfacing with their service providers, architects, engineers, property managers, and contractors. These documents include, but are not limited to, Property Management, Transactional Management/Brokerage, Portfolio Administration, Project Management and Work Letter agreements. Our assignments have ranged from the handling of a portfolio of facilities across state lines to the development of individual corporate headquarters.
