Brandon O. Moulard

Brandon draws on his broad experience in education law to represent K-12 school districts, colleges and universities, private schools, charter schools, and education vendors. He focuses his practice on protecting educational institutions in federal and state litigation involving constitutional claims, employment disputes, state torts, student matters, and contract suits. Beyond his litigation experience, Brandon has counseled education clients on civil rights, employment issues, disability rights, and compliance with state and federal law.

Experience

  • Has defended public and private educational entities in state and federal court against claims under 42 U.S.C. § 1983, Title IX, Title VII, the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, the Fair Labor Standards Act, the Individuals with Disabilities Education Act, the Family and Medical Leave Act, and the Georgia Whistleblower Act

  • Has led litigation teams in appeals before the United States Supreme Court, federal courts of appeal, the Georgia Supreme Court, and the Georgia Court of Appeals

  • Has handled numerous administrative matters, including charges of discrimination with the U.S. Equal Employment Opportunity Commission, employee due process hearings, special education complaints before the Georgia Office of State Administrative Hearings, and unemployment appeals before the Georgia Department of Labor

  • Has represented clients in governmental investigations and worked directly with clients to assist with internal investigations into personnel issues and student matters

  • Has assisted K-12 school systems with developing and implementing risk management policies and procedures

  • Has provided extensive training on civil rights and employment law
