1. Introduction

Careesma (JS Media Inc., “we,” “us,” “our”) values the trust you place in us when you give us access to your Personal Data. This Privacy Policy describes how we work to maintain that trust and details our collection, use and disclosure of the information you give to us when you access or use our online and/or mobile services and websites, and software or mobile applications we may provide on or in connection with such services or websites (collectively, our “Site” or “Sites”).

This Privacy Policy incorporates by reference the Terms of Use that apply to your use of our Site. When you visit our Site or provide us with information, you consent to our use and disclosure of the information we collect, as described in this Privacy Policy, unless separate terms are offered by you in writing and accepted in writing by Careesma.

1.1. Our Privacy Center

Careesma is the Controller in respect of all processing of Personal Data that we collect in accordance with this Privacy Policy unless otherwise provided in a separate written agreement. Please feel free to contact us at the information provided below in Section 12 if you have any questions or concerns related to our handling of your Personal Data.

Our core mission is to help job seekers find great jobs, and employers find great candidates. Since each of our affiliates shares this core mission, we developed the Privacy Center as a way of educating our users about our affiliates and how we share data with them to provide the strongest product and service offerings to our users. We encourage you to visit the Privacy Center to learn more.

1.2. Personal Data and Personal Information

Personal data (“Personal Data”) refers to any information that relates to an identified or identifiable individual, and non-personal data (“Non-Personal Data”) refers to any information that does not identify you as a specific individual. Please note that at all times Careesma will adhere to the applicable statutory definition in determining what is and is not Personal Data for the purposes of this Privacy Policy. Where this Privacy Policy refers to “information” or “your information” this may include both Personal and Non-Personal Data.

1.3. The Scope of Our Privacy Policy

This Privacy Policy covers only data that we collect through our Site and from third-party sources in connection with your use of our Site. This Privacy Policy does not apply to any other data collection or processing, including, without limitation, the data collection practices of our affiliates (please visit the Privacy Center to learn more about our affiliates’ privacy practices) or other third-parties, including any third-party operators of webpages to which our Site links, and any information that we collect offline or through any websites, products, or services that do not display a direct link to this Privacy Policy.

1.4. Changes to Our Privacy Policy

We reserve the right to amend this Privacy Policy at any time. We encourage you to visit this section of our Site periodically to keep abreast of any changes. Each time we update this Privacy Policy, we will add a new effective date at the top of the page in the “Last Updated” legend. Any changes and additions to this Privacy Policy will become effective on the “Last Updated” date indicated above and by continuing to use our Site or provide us information after that date, you agree to all changes, additions, and other amendments to this Privacy Policy. In some cases, we may notify you of changes to this Privacy Policy if we feel that we are using your Personal Data collected through our Site in a manner materially different from that stated at the time of collection. We will provide this notice in accordance with applicable law; however, typically, it will be in the form of an email to you or a notice posted to our Site for 30 days prior to the materially different use.

1.5. Our Approach to Privacy

We take privacy seriously and recognize our users do too. We crafted this Privacy Policy with the intention of keeping our users informed about how we process their data in accordance with their expectations and applicable law.

2. Information We Collect

We collect information from and about you when you use our Site. We may also obtain information about you from our affiliates and business partners, other third-parties and publicly available sources.

2.1. Contact and Other Information You Provide to Careesma

We collect information, including Personal Data, from you when you request information, subscribe for a service or otherwise actively send us your data on or through our Site including by accessing our Site. This may include your email address and any other data that you choose to upload to our Site.

2.2. Through Your Activity on Careesma

In addition, as part of the standard operation of the Site, we may collect and analyze information from your computer or mobile device and about actions taken on our Site, including but not limited to your searches on Careesma (such as the titles, location, salary and other information about any of your job searches and results we provide), your activity on our Site (such as page views, clicks, taps, session activity and time), and information about your browser and the device you use to access our Site (such as browser, operating system and device type, MAC address, IP address, and the name of the originating domain from which you accessed our Site).

Our Site may also track information about our users in the aggregate for various purposes, including to analyze trends and statistics about the use of our Site, including our services, products, and features. This includes the total number of visitors to our Site, the number of visitors to each page of our Site, IP addresses, the URLs of external websites linked to our Site, search terms, the domain names of our users’ Internet Service Providers, and operating system and browser types. We may use such aggregate information to analyze trends, administer our Site, and track users’ movements for aggregate use. Such aggregate information is not unique to you nor is it linked to any Personal Data that can be used to identify a natural person. We may share this aggregate information with third-parties, including our affiliated and parent companies, for various reasons related to our business, including, without limitation, to assist them in targeting advertisements to appropriate audiences.

2.3. Other Personal Data that Careesma may Receive from Third-Parties

Our Site may offer links to third-party websites that allow you to share information with a third-party website, including one operated by a Careesma affiliate, and from a third-party website to our Site. When you click a link to a third-party website, you are no longer on our Site and your use of the third-party website is subject to the terms and conditions (including any privacy and cookie policies) of that website. For more information on your interaction with third-party websites, please see Section 11 of this Privacy Policy.

Any Personal Data that Careesma may receive from third-party websites through your use of our Site will be processed by Careesma in accordance with this Privacy Policy.

2.4. Your Personal Data may be Required

Typically, we will prompt you at the point when you provide your Personal Data to us whether or not it is necessary that you provide this information in order for Careesma to provide particular services, products or features to you on our Site. If you choose not to provide your Personal Data in such instances when it is necessary, some or all of our services, products or features may not be available to you.

2.5. The Legal Basis on Which Careesma Collects Your Personal Data

If you are visiting this Site from the EU or where similar laws apply, Careesma collects and processes your Personal Data on the basis of different legal grounds, depending on the nature of the Personal Data being provided and the type of processing involved:

Performance of a Contract. Careesma processes certain Personal Data on the basis that such processing is necessary for the performance of our agreement with you, or in order to take steps at the request of the user prior to entering such an agreement. An example of this would be where Careesma shares your Personal Data with an employer or affiliate (such as Indeed, Inc. (“Indeed”)) to facilitate, at your request, a connection between you and such third party through the use of our Site.

Legitimate Interest. Careesma also processes your Personal Data when such processing is necessary for the purposes of legitimate interests pursued by Careesma. This includes where Careesma sends you certain forms of marketing about our products and services, where we believe you have a reasonable expectation that we will perform a particular type of processing on your behalf, or where such processing is strictly necessary for fraud detection and prevention. A further example would be where we share your Personal Data with our affiliates as detailed 4.6 below. Careesma relies on this basis only where an assessment has been performed balancing the interests and rights involved and the necessity of the processing in order to provide our services, products and features to you.

Compliance with a Legal Obligation. We may also process your Personal Data when such processing is necessary for Careesma to comply with a legal obligation. An example of this would be where Careesma is required to retain business records for fixed periods of time in order to comply with local legal requirements.

Consent. Finally, in certain limited situations, Careesma relies on your consent in order to process your Personal Data. Where Careesma requires your consent in order to collect and process certain Personal Data, we seek your consent when you provide your Personal Data or before undertaking such processing, and such processing will only be performed where consent is secured. You can withdraw your consent by following the steps listed in section 10 of this Privacy Policy or by sending an email to careesma-privacy@rgf-ohr.com.

2.6. Storage of Your Personal Data

We retain our users’ Personal Data to the extent it is adequate, relevant and limited to what is necessary for the purposes for which it is processed. In particular, we do not retain your Personal Data for any longer than necessary to perform the services, products and features outlined in this Privacy Policy that you request from us when you use or access our Site.

We may also create and store a unique device identifier (a numeric or alphanumeric string of characters) that is associated with the device you use to access Careesma, which we may also associate with information we collect about your device and any other information you choose to provide, such as your email address. Such data is processed solely in accordance with the purposes outlined in this Privacy Policy, to the extent applicable.

Careesma may also store the information detailed in section 2 of the Privacy Policy on its equipment or the equipment of third-parties with which Careesma has a relationship. Such storage services will be governed by appropriate protections, as required by applicable rules. More information on the security measures applied to your Personal Data is available in Section 6, below.

3. Limitation of Use or Disclosure of Personal Data

3.1. Where You Want to Delete a Job Application

To delete a job application submitted to an Employer from Careesma’s Site, you must contact the prospective Employer directly.

3.2. Children’s Privacy

Careesma does not knowingly collect Personal Data from children under the age of sixteen (16), nor is this Site designed to collect information from or directed at children under the age of sixteen (16). If you are under the age of sixteen (16), you are not authorized to use this Site and should not send us any Personal Data through this Site or by other means. We may advertise jobs directed toward Users between the ages of sixteen (16) and eighteen (18) years of age. If you are between the ages of sixteen (16) and eighteen (18), you are not authorized to use our Site unless you are under the supervision of your parent, legal guardian, or other responsible adult over the age of eighteen (18). If you have reason to believe that a child under the age of sixteen (16), or between the ages of sixteen (16) and eighteen (18) if unaccompanied by a responsible adult, may have used our Site and shared his or her Personal Data with us, please contact us by sending an email to careesma-privacy@rgf-ohr.com or at the information provided below in section 10 of this Privacy Policy and we will delete the Personal Data in accordance with applicable laws.

4. Purposes, Uses, and Disclosures of Your Personal Data

We may process your Personal Data for any of the purposes set forth in sections 4, 5 and 9 of this Privacy Policy, to the extent applicable, including to:

  1. provide and tailor our services, products and features to you,
  2. connect you with our affiliates and unaffiliated third-parties to help you find jobs,
  3. measure and improve our Site, including the services, products and features we make available to you on our Site, and
  4. protect our users and provide them with customer support.

More detail on these purposes, uses and disclosures of your Personal Data is set out below.

4.1. Providing to You the Products, Services and Features We Offer on Our Site

We may use your Personal Data for purposes of providing and personally tailoring the services, products and features available on our Site that you request and to communicate with you about our Site and improvements to it. We may also use your Personal Data to provide administrative notices or communications applicable to your use of our Site, to respond to your questions and comments and provide customer support, to enable you to communicate with us through our blogs, social networks and other interactive media, to solicit your feedback and input, to operate our Site, and to evaluate and improve our business and the services, products and features we offer. In particular, you agree that we may, as part of our services to you, communicate with you, or initiate communication with you on behalf of a third party, through the use of any contact information (including your email) that you may provide to Careesma or that we may otherwise obtain from third-party resources.

4.2. Giving You Relevant Search Results and Recommended Jobs

In order to optimize our services, products and features for you, Careesma may use your previous search and browsing history (e.g. the jobs you click on) to identify you and determine relevant search results and provide you with recommended jobs or reach out to you about jobs you may be interested in. We may also use this data to tailor your experience on the Site, to show you content that Careesma thinks you may be interested in, and display content according to your preferences. Careesma may return different results for the same search query and has full discretion with respect to the job listings it presents in response to any particular search.

4.3. Transfers of Your Personal Data to Employers

Careesma shares your Personal Data with third-parties, including employers and our affiliates, at your request, when you use the Apply Now feature that connects you with third party websites, including those operated by employers and our affiliates, to apply for a job. Any information you send to a third party via a job application on the third party’s website may be kept by the third party, and you should check such third party’s privacy policy to understand how they keep your Personal Data. Other than instances in which users opt to provide their Personal Data via the Apply Now feature or otherwise provide permission to share it, we do not sell our users’ Personal Data to anyone for any reason.

Where you use a third-party integration to apply to a job from Careesma, your application will be processed in accordance with that third party’s terms.

4.4. Sending You Promotional Materials

We collect and process your Personal Data to maintain a record of the jobs you view or apply to on our Site or those of our affiliated and parent companies, inform you of relevant job postings and send you other similar types of marketing communications that may be of interest to you through our Site or affiliated websites, and deliver information to you that we believe is targeted to your interests (such as relevant services, educational or other career development opportunities).

If and to the extent permitted by applicable law, Careesma may use your Personal Data to send you information about Careesma, including promotional materials about this Site and the products and services Careesma offers on it. Careesma may use third-party partners to perform these activities on its behalf. Careesma may also share your information with third-parties (including operators of third-party websites and/or social networking sites) in order to show you personally tailored and targeted advertisements. Such advertisements will only relate to Careesma’s services, products, and features, all of which focus on helping our users find jobs and connect with candidates. If you wish to opt out of receiving any marketing messages from Careesma, please see section 10.3 of this Privacy Policy.

You may opt-out of receiving promotional and marketing communications from Careesma by contacting us at the information provided below in section 11 of this Privacy Policy.

4.5. Preventing Fraud and Spam, and Complying with Legal Obligations

We may disclose your Personal Data to law enforcement or other public authorities (including courts and tribunals) where we are legally required or compelled to do so (such as in response to a subpoena, search warrant, court order or other legal process) or we otherwise determine, in good faith, that such disclosure is necessary to defend our interests in legal, administrative or other proceedings, to comply with the law, to cooperate with or seek assistance from law enforcement, to prevent a crime (such as to prevent fraud or spam) or protect national security, or to protect your interests or safety or that of other users of our Site. This means, for example, that we may honor subpoenas, search warrants, law enforcement requests, and court-mandated directions to reveal your Personal Data, including your identity and email address.

4.6. Sharing Your Information with Our Affiliates

Our core mission, shared by each of our affiliates, is to help job seekers find great jobs, and employers find great candidates. In support of this mission, we share certain information with our affiliates. Such information sharing is governed by this Privacy Policy. We also developed the Privacy Center as a way of educating our users about our affiliates and how we share data with them to provide the strongest product and service offerings to our users. We encourage you to visit the Privacy Center to learn more.

Information shared by you with Careesma may be shared with any Indeed affiliated entity, no matter where located, to provide you with services, to improve the Site and optimize functionality on the Site, and other purposes as described in this Policy. In particular, such sharing strengthens Indeed’s ability to help people find jobs and employers find good candidates. The services provided to you and the functionality of the Site could not be provided without such transfers. If you do not wish your information to be transferred in this way you should not use this Site.

For the purposes of this Policy, “affiliates” means any entity that directly or indirectly, controls, is controlled by, or is under common control of or with an Indeed entity, now or in the future. “Control” for these purposes means having a majority of shares or the right and ability to direct management. And this includes Indeed affiliated entities located outside the European Economic Area (“EEA”) or Switzerland.

Examples of our affiliates and affiliated websites include: Indeed, Glassdoor, Simply Hired, Syft/Indeed Flex, Resume.com, Wowjobs.com, Engineerjobs.com, RescueMyResumes.com and Resumeperfector.com.

Such data sharing with our affiliates will be performed for a number of specific reasons.

– Improved Services

It provides job seekers with more personalized and improved content, performance, features and services on Careesma’s and its affiliates’ websites. For example, Careesma and its affiliates use your previous search and browsing history (e.g. the jobs you click on), IP address, or email address to determine relevant search results, display and moderate career insights, such as company reviews, job listing salary data, and interview tips, and more. Such sharing is also performed to facilitate improved data analysis, testing, research, and service improvement.

It also allows employers to have better insight into the performance of their job postings. For example, we may share data related to user clicks on their job postings which in turn allows them to understand how their job posting may or may not be achieving their goal of attracting candidates. By providing employers with the information they need to better utilize our platform, they can provide stronger job postings.

– More Employers, More Job Listings and More Job Seekers

Such data sharing allows job seekers to access an even broader database of job listings and Employers, and for Employers to access more Job Seekers. For example, this allows Careesma to recommend jobs or Employers on Careesma or on websites of Careesma affiliates. It also facilitates the display of job listings from the websites of Careesma’s affiliates’ to Careesma and applications to them.

We and our affiliates are able to recommend job seekers (and their resumes or resume extracts) to an employer hosted by us or an affiliate. Equally, we and our affiliates are able to recommend job listings hosted by us or by an affiliate to job seekers visiting Careesman.in and websites of our affiliates. We and our affiliates can also share employer data (such as account information and behavioral data) to provide a better experience to those employers.

– Better Security for Users

Such data sharing allows Careesma and its affiliates to process your Personal Data for the purpose of improving user security and internal operations, troubleshooting, and detecting and preventing fraud and spam.

4.7. Automated Processing of Your Personal Data

In order to optimize the performance of our Site and services for users, we perform automated processing of Personal Data evaluating certain specific aspects relating to a user, in particular to analyze or predict aspects concerning a user’s personal preferences or interests in terms of our Site and services. Where it occurs, such processing is carried out if it is necessary for the performance of our agreement with our users, to allow us to provide our services to our users, or in other cases on the basis of a user’s consent.

For example, in certain cases such processing allows Careesma to display search results, or to perform certain spam and fraud detection activities to protect our users. Such processing is subject to the safeguards detailed in this Privacy Policy to protect the privacy of our users, and you may contact careesma-privacy@rgf-ohr.com to contest any decision generated by said automated processing.

4.8. Transfers of Information to Service Providers

We may use third parties to perform services in connection with our operations, to improve the Site and our services, products, and features, to protect our users and better understand their needs, and to optimize the services and the users’ experiences. These service providers may have access to Personal Data in the course of providing these services, which may involve transfers of such Personal Data to other countries. Such transfers are only made for the purposes set forth in sections 4, 5 and 9 of this Privacy Policy, to the extent applicable and necessary. Our sharing of your Personal Data with service providers is performed in full compliance with applicable data protection rules and subject to appropriate safeguards, primarily through the use of agreements between Careesma and the recipients that ensure adequate protection of our user’s Personal Data.

4.9. Third-Party Sites Linked-to from Careesma

You may also use certain third-party websites or services, including those of our affiliates, that you link to from our Site. In such cases, the information you provide to the third-party is subject to the third-party’s terms and conditions, and privacy practices (including any privacy and cookie policies). Please see section 8 of this Privacy Policy for more information regarding links to third-party sites on Careesma.

Apply Now is a service we make available on our Site that allows you to connect with the Employer directly or through job listings hosted by our affiliates, such as Indeed, that we display on our Site. When you click on the Apply Now link, you will be directed to the Employer’s or our affiliate’s website to apply for the job and may be prompted to create or sign in to an existing account with that website. Your interaction with the Employer and our affiliates is subject to their terms and privacy practices (including any privacy and cookie policies), and Careesma is not responsible for and this Privacy Policy does not apply to your interactions with those websites. Should you take advantage of this feature on our Site, we suggest that you read the applicable terms (including privacy and cookie policies) of the website with which you interact.

5. Additional Uses and Disclosures of Non-Personal Data

In addition to the other uses and disclosures of information set forth in this Privacy Policy, and notwithstanding anything in this Privacy Policy to the contrary, we may use and disclose, for any purpose, any non-personal data, except where we are required to do otherwise under applicable law. If we combine any non-personal data with Personal Data, then we will only use and disclose such combined information for the purposes described in sections 4 and 9 of this Privacy Policy while it is so combined.

6. Security

Careesma seeks to use reasonable security measures to help protect against the loss, misuse and alteration of the Personal Data under Careesma’s control. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. In addition, please note that emails, messages sent via your web browser, and other similar means of communication with other users, are not encrypted. Therefore, while we strive to protect your information, we cannot guarantee its security.

Please also be aware that we may use third-party cloud service providers that provide hosting, data storage and other services pursuant to standard terms and conditions that may be nonnegotiable; these service providers have informed us or the general public that they apply security measures they consider adequate for the protection of information within their system, or they have a general reputation for applying such measures. However, we will not be liable (to the fullest extent permitted by law) for any damages that may result from the misuse of any information, including Personal Data, by these companies.

7. Cookies

“Cookies” are small pieces of information that are stored by your browser on your computer’s hard drive. Please see our Cookie Policy for further information regarding Careesma’s use of Cookies.

– Do Not Track Requests

Your browser automatically shares certain information about you, such as your IP address and other information about your device and browser, with the websites you visit that may be considered Personal Data under applicable laws. Some browsers allow you to send websites you visit a Do Not Track signal. As there is not yet an agreement on how to respond to such signals, Careesma does not respond to them or alter its privacy practices in any way.

8. Links to Third-Party Sites

Our Site may contain links to other websites that we do not operate, including those of our affiliates listed in the Privacy Center. When you click on a link to another website, including a website operated by one of our affiliates, you may leave our Site and your browser may also disclose information, such as the URL of the page on which you clicked the link, to the operator of the other website. This Privacy Policy does not apply to, and Careesma is not responsible for the content or privacy practices of any such linked websites. We encourage you to review the privacy practices of any linked website before interacting with it, as the operator’s privacy practices may differ from ours. You should direct any questions about the privacy practices of linked websites to their respective operators.

9. Acquisitions and Other Reorganizations

Information collected pursuant to this Privacy Policy, including Personal Data, may be disclosed to one or more third-parties (including our affiliates and parent company) in connection with any change of ownership or control in Careesma’s business (whether by merger, sale, or otherwise), or any other reorganization or joint venture, or assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceeding), and any such information may be used by such third-party in accordance with this Privacy Policy.

10. Your Privacy Rights

Careesma users that provide their Personal Data to Careesma may avail of the rights detailed below. We may request additional information for verification purposes and to allow us to respond to your request.

10.1. Your Right to Rectify Your Personal Data

Careesma does not offer users the ability to create an account or related privacy settings. You may make a formal request to edit or update your Personal Data held by us in connection with your use of our Site by sending an email to careesma-privacy@rgf-ohr.com.

10.2. Your Right to Object to or Restrict the Processing of Your Personal Data

If you have any queries or complaints about how we process your Personal Data we encourage you to contact us by sending an email to careesma-privacy@rgf-ohr.com.

Alternatively, if you do not wish to do this you may make a formal request to object to, or restrict, our processing of your Personal Data. For example, you have the right to object to the legitimate interest processing of your Personal Data by Careesma for marketing purposes. In order to do so, please send an email to careesma-privacy@rgf-ohr.com.

10.3. Opting out of Marketing Messages and Withdrawing Consent

If you no longer want to receive marketing materials from us based upon your Personal Data, there are a number of options available to you:

You may opt-out of receiving marketing emails from Careesma by clicking the “unsubscribe” or similarly-designated link provided in any marketing email sent to you. This will remove your email address from our email marketing distribution list. You will no longer receive marketing emails from Careesma at that email address unless you later request to receive such marketing emails again, you sign-up to receive another or different service from Careesma for which you agree to receiving marketing emails from us, or you otherwise indicate your consent to receive marketing emails from us.

In addition, you may opt out of all marketing messages or withdraw your consent from any consent-based processing of your Personal Data by sending an email to careesma-privacy@rgf-ohr.com. In your message, please detail which activities from which you wish to opt out or withdraw your consent. We will comply with your request as soon as reasonably practicable, and in accordance with applicable laws.

Finally, please note that we may still send other messages to you, such as administrative messages.

10.4. Your Right to Access and to Portability of Your Personal Data

Careesma does not offer users the ability to create an account or related privacy settings. You may make a formal request to access your Personal Data held by us in connection with your user of our Site by sending an email to careesma-privacy@rgf-ohr.com. Please include the following sentence in your email: “I am requesting to access my personal data.” We will provide your Personal Data to you in a portable format to allow it to be transmitted to third-parties. Please note, if you have interacted with us using more than one email address, you must send us an additional email from each such email address so that we may locate and provide access to your Personal Data associated with those email addresses as well.

10.5. Your Right to Delete Your Personal Data

Careesma does not offer users the ability to create an account or related privacy settings. You may make a formal request to delete your Personal Data held by us by sending an email to careesma-privacy@rgf-ohr.com. Please include the following sentence in your email: “I am requesting to delete my personal data.” Once your request has been confirmed, we will initiate the necessary steps to execute this exercise. Please note, if you have interacted with Careesma using more than one email address, you must send us an additional email from each such email address to exercise your requests with respect to those email addresses, and any associated Personal Data, as well. Where the deletion request relates to Personal Data that you previously requested be made public on our Site, we will make reasonable efforts to inform any other controllers of this request.

10.6. Some Limitations

Such rights of rectification, objection, restriction, access, portability and deletion are subject to certain limitations, as provided for by applicable laws. Individual requests will be completed within the time allotted by relevant regulations, which starts to run from the point of Careesma confirming your request. Where permitted, please note there may be a charge for subsequent requests from the same individual, which will be determined by Careesma and only imposed to the extent permitted by applicable law.

11. International Data Transfers

When you use our Site, we may process and store your Personal Data outside of the country in which you are located, including in the United States and the European Union. Such transfers are performed in full compliance with applicable data protection rules and subject to appropriate safeguards, primarily through the use of agreements between Careesma and the recipients that ensure adequate protection of our user’s Personal Data. The services provided to you and the functionality of the Site could not be provided without such transfers.
