The Italian Olympic Committee (CONI) and the Spanish Olympic Committee (COE) had filed applications against two decisions of the International Jury dismissing protests relating to the 49er Medal Race held on Sunday 17 August at the Qingdao Olympic Sailing Center.

The hearing took place in Beijing today in front of a panel of arbitrators from the Court of Arbitration for Sport (CAS). Charley COOK, chair of the ISAF Race Management Team for the Olympic Sailing Competition, David TILLET, chair of the International Jury and John DOERR, chair of the Jury Panel which heard the Protests, were all present at the hearing.

ISAF Secretary General Jerome Pels said, "ISAF is very pleased with the outcome of today's hearing, with CAS confirming the view of the International Jury. It's the nature of sport to throw up exceptional circumstances like this one, but the members of the International Jury at the Olympic Games are extremely experienced and do a fantastic job for the sport. I'm glad we can now draw a line under this matter and look back on the race and appreciate it for the amazing sporting spectacle it was."

The applications to CAS related to 49er Medal Race at the 2008 Olympic Sailing Competition held on Sunday 17 August. The Danish crew of Jonas WARRER and Martin IBSEN broke their mast shortly before the start of the race, but returned to the marina, borrowed a boat from the Croatian team (who had not qualified for the Medal Race) and went on to finish seventh in the race to win the gold medal.

Two protests followed the race, but both were dismissed by the International Jury. If the Danish team had been disqualified from the race they would have dropped from first to fourth overall. The full decisions from the Jury can be read in our Protests & Communications section.
