The club, who are represented on the water by Larry ELLISON's BMW ORACLE Racing team, released the following statement on Tuesday 7 April:

"The Golden Gate Yacht Club and its team, BMW ORACLE Racing, remain committed to negotiate with the Defender, Société Nautique de Genève/Alinghi, a conventional mutual consent protocol for the next America's Cup that would involve all teams.

"This follows the April 2 decision of the New York State Court of Appeals confirming the Golden Gate Yacht Club as the Challenger of Record for the 33rd America's Cup.

"BMW ORACLE Racing's owner, Larry Ellison, and the President of Alinghi, Ernesto Bertarelli, have communicated with each other since the court ruling.

"At this stage the club believes it is best to keep communications between the parties private in the interests of reaching a successful conclusion as quickly as possible."

Last Thursday the New York State Court of Appeals ruled unanimously in the favour of the Golden Gate Yacht Club (GGYC), reserving the previous decision of the Appelate Division and reinstating the original ruling of Justice Cahn in the Supreme Court. This declared the Club Nautico Espanol De Vela's (CNEV) challenge for the 33rd America's Cup accepted by the Société Nautique de Genève (SNG) as invalid, and instated the GGYC as Challenger of Record.

The SNG, who are represented on the water by Ernesto BERTARELLI's Alinghi team, issued the following statement in response to the ruling: "It has consistently been our view that the America's Cup should be fought on the water. Today through the American courts the Golden Gate Yacht Club has won the right to challenge the Société Nautique de Genève. We will now discuss the terms for the regatta with them and will prepare our defence of the 33rd America's Cup."

The Court ruling encouraged both the GGYC and SNG to work together to agree a protocol to govern the competition for the 33rd America's Cup. If this can not be agreed, a best-of-three match in giant multihulls will take place under the conditions drawn up in the Deed of Gift, the document which governs the America's Cup.
