Youre mistaken. Im in this industry and is why I mentioned it. I have talked to our local DA who handles short term rental cases as ive had two cases in admin court for my short term rental.

Chicago has to meet, but is allowed to exceed state law. Chicago expressly prohibits age discrimination for vacation rentals.

Page 7, paragraph 2 title'd "13".

If you look at other places where they mention age discrimination, such at the Illinois Human Rights act, Chicago Fair Housing, they note that age discrimination banned by THAT law, is for 40+ and pertains to public accommodations. The vacation rental law does not include that exception or caveat.

Chicago is well within its right to have more stringent rules.

Based off replies some people think that the wiretap and secret audio recording laws (all party consent laws) come into play here.

Some folks think its harassment.

Some folks think you need permission to record someone from your front lawn as they drive by your house.

Tortious Interference?

Does not appear to be the case, yet. I didn't downvote you, but here's the general criteria for tortious interference.

  1. Existence of a Contract or Business Relationship Contractual Interference: There must be a valid, enforceable contract between the plaintiff and a third party. Business Relationship Interference: There must be an existing business relationship or expectancy, not necessarily formalized in a contract.

  2. Knowledge of the Relationship or Contract The defendant must have knowledge of the contract or business relationship. This doesn't mean they need to have detailed knowledge, but they must be aware that such a relationship exists.

  3. Intentional Act of Interference The defendant must have intentionally acted to interfere with the contract or business relationship. This act can be through various means such as persuasion, threats, or providing false information.

  4. Improper Motive or Means The interference must be improper, meaning it was done with a wrongful purpose (such as malice) or through improper means (such as fraud or coercion).

  5. Causation There must be a direct causal link between the defendant's interference and the disruption or breach of the contract or business relationship. The plaintiff must show that the interference caused the harm.

  6. Damages

The plaintiff must have suffered actual damages as a result of the interference. This can include financial losses, reputational harm, or other measurable harm.

This is a waste of your time, I would highly recommend you getting a free consult if possible so youre not wasting your $$$ and your time.

If you can get him on record saying he's doing this to try and hurt your business, and you can demonstrate that your business has in fact been harmed (people leaving, reviews mentioning it) then youre moving into territory where you should probably talk to an attorney as there "might" be something there.
Based on what you are saying now, they aren't doing anything wrong. (I'm still very doubtful, but that moves into territory I do not have industry experience in so I'm not willing to make any firm claims)

Try and befriend them. Have a calm conversation and see if you can identify their hangups. I have a neighbor who records my guests. She cries about them all the time even though they never bother her. Some people are just nosy busybodies.

This user in this thread handled a tough neighbor situation in a good way. You should heed her advice.

Sir. If something is completely untrue, and then you have to use an "if" qualifier, then its not completely untrue.

The facts as written state the neighbor is recordi9ng people as they drive past and has a sign that says they are being streamed to youtube.

Let's stay within the bounds of what is actually happening because that is what matters.

One of the best idea's that I have read in this entire post. Infinitely times better than every person suggesting it's illegal for someone to record people driving by from their front lawn and to seek legal action.

You maam(?) are a class act and this is a master class in one way of addressing this issue. No senseless escalation. No ridiculous "seek legal help" claims.

100% on talk to the neighbor. There's a great suggestion from another user that had problems with a neighbor and befriended them.

In regards to Oregon, Read that law carefully again. That is not an example. That pertains to PRIVATE conversations and telephone calls. There isn't even a conversation happening here. The man has a camera recording people who pass his property. They are also not secretly recording. They are telling you flat out, youre being recorded.

Because I'm getting tired of people who dont seem to understand this here's a law office from Oregon.

Below is from that law office.

"Oregon State Law

Oregon is generally a two-party consent state, meaning that all parties to a conversation need to consent to a recording of that conversation. However, there are a few important exceptions to this general rule. First, you do not need to obtain the consent of all parties when recording audio in a public place or gathering where people generally do not have a reasonable expectation of privacy, or where they know they are being recorded. Second, although it is illegal to eavesdrop on a phone call without any party’s consent, state law requires only one party to consent to recordings of phone calls or other electronic communications. Only in-person conversations require all parties’ consent in Oregon, subject to the public recording exception.

It is a misdemeanor under Oregon law to record a conversation without proper consent or to disclose an illegally recorded conversation. Violating this law can also open you to civil liability in the form of an award of damages and attorneys’ fees to injured parties."

In context for this its very black and white. It may not be for YOU but it's black and white for anyone who knows.

I listed those examples because if it were in fact illegal you would be able to find court cases that support that. So go ahead and find any court cases where somebody posted their stuff to social media in the same context and there you go. Don't hide behind just cuz someone does something doesn't mean it's legal. I agree with that overall statement, but this is something that hundred of millions of people have done and do daily. If it were illegal it would stupid easy to find examples of at least some of these people. That was my point.

Feel free to ask that same attorney for this specific example and I'm sure they will tell you.

Your example is also published for commercial use. Commercial use is not what's going on here.

This is someone with a video camera recording from their front lawn in public. There is no expectation of privacy. It is not illegal to record.

Host declined booking because his "calendar cannot accommodate " but listing still up [Toronto]

I mean it's not your place to make medical decisions for someone else which is kinda what you were doing.

Disabled people an old people get declined for reasons like this all the time because people are just doing it for their safety. It's just a veiled form of discrimination.

You wouldn't be in any trouble if they had issues as long as you described your place okay. Be careful though any discrimination claims result in a notation to our accounts even if they were inconclusive or not provable. If we get too many bad things happen :(. It's irritating especially when you know it's made up.

Sure but the only thing I commented on was it wasn't illegal to record someone. And publishing it isn't necessarily a problem either.

Honestly I don't know why people fight about this so much.

How many TikTok YouTube Facebook etc videos are posted on a daily basis where there are people in the background or where people are pranking someone like Bushman from Texas where he records people without their permission in public spaces and then publishes all those to his channel....

How many kids at school and at the playground or at the Public pool are recording videos of them and their friends and have other people in the background or just someone panning across some location full of people and then posting those videos to Facebook TikTok other social media?

This is a public recording taken from someone's yard.

Then you have all the first amendment audits that happened in public where they go and record military bases or police stations from the outside and they get all feisty with the recorder and they post that to their channel. There's lots of bystanders not working for the state or the federal government in those videos.

You should read those laws a little bit closer. If you need me to fill you in let me know.

Just to give you a hint you posted the law for telephone conversations.

Not all conversations are protected. These also aren't recordings of conversations. They're recordings of people driving down a road that someone is taking from their front lawn with absolutely no expectation of privacy nor conversation happening.

Feel free to list an example in the US, in any state, where this would be illegal. I am very open to being wrong. I am just relatively confident this is not illegal in any of our states in the context here. I do work in an industry where I take recordings of people, without permission, in 49 states and also Puerto Rico. It's allowed because my recordings are all done in public. That person is recording from their lawn. Their, lawn. Anything they can see from their lawn is fair game.

This would be very useful information for OP to have if there are any examples fitting this context to share with OP. Don't tell me I'm wrong, explain why I'm wrong to help OP.

This is not actually true as written. There are specific states and cities for which lower age discrimination IS protected. Its far less common, but does exist.

For example, Massachusetts have age discrimination protections at all public accommodations.

Chicago I know does for short term rental places, and I "think" (would need to verify) that it applies to all public accommodations too.

Im saying this in a neutral tone and it isn't personal. I gotta be honest, I deplore women who act like this about men. The whole "strange man" argument has been brought up at my place several times by women who didn't bother reading our ad and then were surprised that men are in other bedrooms and wanted a refund contrary to policy. And ya'll never nice about it. One woman went as far as to book a month, found out other men stayed on site(three other women also by the way), and left demanding a refund. When I refused to do more than refund if we rebook (which as it turns out would have been about a 95% refund) she left me a bad review and refused to take it down so I rescinded my offer. I just kept her money for the month long booking for being an asshole about it.

Its very combative and strewn with passive aggressive comments just like the above one I quoted. Your hangups with men, are your problem to deal with. Not ours as as host. I have had SIGNIFICANTLY more women who don't have this problem stay with us than do. Probably because the ones with hang-ups book a place that suits their needs. They dont book a place that is coed and then complain about "strange men" like youre doing here.

If you are that frightful of men existing, then stop booking shared places unless they advertise women only for the entire property. That's the ONLY valid thing for you to do. Expecting that because you are a woman there won't be men around is ridiculous.

All that said, if your host advertised the amenity that says words to the effect of "bedroom door has lock on it" OR if they verbalized it in the ad someplace then you can 100% use that to get out of your reservation if they wont add a lock right away.

If you do not see that in the ad, then there is no reason you should expect it. To look you wanna check out the list of amenities as it should be listed there. I can snap a pic of what it looks like on my ad if you want to know what it looks like.

According to the rules on Airbnb they do. Once a primary person checks out, the reservation is no longer active and everyone else has to go.

I doubt the vast majority of hosts would care but its always been a rule that the primary has to be there for the whole stay. Its to avoid what is in essence, a third party booking.

For example I can't book under my account, show up to check in with my friends, and then leave so they get the space to themselves. This check out situation is identical, except for duration and when it occurs.

Will a host care? id be shocked if even 1% of hosts care. Is it a rule? Yep, and its for liability reasons. Is airbnb gonna say anything? It'll never ever come up unless the host says something to them and there was a problem.

It is in the rules. Once the primary person checks out, the reservation is over and the property can no longer be used by their guests.

Its to avoid primaries from booking for people and then leaving early and letting whoever else stay on site and use the property as that is not allowed.

To be clear, i dont know many hosts who would care about this, and airbnb wont get involved unless there is some sort of issue and the host reports it. But a rule it is, none the less.

Yes its accurate for airbnb rules.

Once the primary checks out the reservation is done, there aren't allowed to be other people on site. Its to prevent faux third party bookings where one person shows up for check in with their friends, and then leaves.

The only difference between that and this is the length of time and what date of the reservation it occurs on.

This is not something that would ever come into play unless there were damages and I'm confident in saying the vast vast majority of hosts would never care or bat an eye at this. It's also a very smart move by your friend.

It is a rule really. Not one that most hosts would care about, but to the letter of Airbnb it is. The primary booker has to present from start to finish. It starts once they arrive, and ends once they depart. If the primary checks out, everyone else is supposed to be gone at that point too.

Just like it's not okay for the primary to show up, check in, and then leave for the entire duration with their guests on site this is the same thing, just a much smaller duration.
