Supreme Court appears likely to allow abortion drug to remain available

A majority of the court on Tuesday seemed ready to throw out a dispute over the FDA’s expansion of access to the abortion medication mifepristone in 2016 and 2021 on the ground that the challengers do not have a right to sue. Mifepristone is one of two drugs used in medication abortions, which make up for more than half of the abortions performed in the United States.

Justices seem to favor IRS in dispute over shareholder’s life insurance policy

On Wednesday, the justices seemed to agree with the IRS, in Connelly v. Internal Revenue Service, that proceeds of a life-insurance policy earmarked for the redemption of a shareholder’s stock after the shareholder dies increases the corporation’s value for the purposes of determining federal estate tax.

A fast-moving argument over medication abortion

As crowds of demonstrators gathered outside the Supreme Court on Tuesday, the courtroom itself was full for oral arguments in FDA v. Alliance for Hippocratic Medicine, the dispute over the FDA’s 2016 and 2021 decisions to ease access to the abortion drug mifepristone.

Justices appear sympathetic to insurance company in asbestos bankruptcy

At Tuesday’s argument in Truck Insurance Exchange v. Kaiser Gypsum Co., the justices appeared likely to side with an insurance company over whether it has the right to complain about a plan in an asbestos bankruptcy that, according to the insurance company, facilitates fraudulent claims.
