Supreme Court Rules In Whatcott Case

If you wish to read the entire decision, you can do so here. However, as a bit of a summary, the court upheld the Taylor decision reasserting that laws against hate propaganda in Canada are indeed constitutional. In fact, the decision was unanimous; Bevery McLachlin, who had originally offered one of the four dissenting opinions in the Taylor case, was also in agreement regarding the constitutionality of the law. As such, Taylor remains the governing law as well as the guide for any future case laws dealing with hate speech, be it via telephone hotline or the Internet.

Two additional thoughts come to mind. First, it seems to us that this decision sort of puts the kibosh on Marc Lemire's appeal. Second, with the repeal of sec. 13 currently languishing in the senate, it seems quite possible that the Conservatives might allow the bill to quietly die since the Supreme Court decision was unanimous and included  judges appointed by Mr. Harper.

Suffice it to say, the Speechies are a little unhappy right now.

According to Fromm, Christie's Prognosis is Quite Dire

Fromm posted the following on his Facebook account earlier today:

Lawyers like Gerry Spence, someone this writer admires a great deal, defended individuals he didn't agree with but who he believed deserved a fair trail. Our issue with Christie was never his defence of the likes of Topham, Tremaine, Zundel, Fromm, Droege, and others their ilk, but with his affinity and support of beliefs of his clients. That is his legacy and it can't be whitewashed.

That being said, and while some of our readers may take issue with this writer for what I'm about to say here now, but if Christie has only 6 months I hope the time he has left is spent with his family (he still has young children). I hope that he uses the time to reflect his life and perhaps reconsider his views. And, when the time comes, he passes on with as little suffering as possible.

I don't celebrate death, even for those mentioned on this blog. I hope for redemption and believe people can change. And this applies to Doug Christie as well.

Our Debunking of the Whitaker Matra Used as Source Material

We had completely forgotten about this, but we thought we'd share it now.

Some time ago we were contacted by someone who spent a great deal of time debunking the Bob Whitaker mantra to discuss our article which also took on the cliched claims used in the mantra. Nate then created a video reading portions of our counter and uploaded to YouTube.

Christie Drops Out of Topham Case for Medical Reasons

Found the following posted to Topham's website:

“Dear Arthur:
 
I regret to advise that Mr. Christie has been diagnosed with an advanced form of liver cancer, and has received medical advice that he cannot practice law any further at the present time. In these circumstances, it will be necessary for you to seek other counsel as soon as possible.”

Doug Christie had been rumored to be in poor health for some time now. Specifically, he was believed to have been suffering from prostate cancer. If that's true case, the cancer appears to have spread to his liver. And if he is dropping clients, it leads us to conclude that his long-term prognosis isn't good.

This writer had an uncle who died as a result of liver cancer and, based on that experience, knows that it is a hell of a way to go.

Time will tell how this affects Topham's case moving forward.

Brotherhood of Hate

While the Collective has had the pleasure of knowing Dan for a while now he first came to our attention back in 2004 or 2005 when he did an interview regarding his rejection of racism and the violence associated with the movement. At the time he was still concealing his identity, but not long after he became a very public advocate for non-violence and anti-racism. He has never sugarcoated his past and now uses it to inform people about the dangers of this movement and so that people, especially kids, are not drawn into it.

Interestingly, Dan's article comes at an interesting time given the information we received recently regarding an assault in Ontario this past August:

KITCHENER — A man was assaulted by two or three armed men in Victoria Park on Friday evening.
Police were called about 10:25 p.m. to Park Street.

A man was confronted by men armed with an edged weapon and a hard metal object, Waterloo Regional Police report. He was cut in the abdomen. He was treated and released from hospital.

We suspect we know who the victim is as well as at least one of the alleged attackers.

Topham Continues Posting Antisemitic Screeds

The wheels of justice turn slowly. But they do continue to turn in the case of Arthur Topham. BCL recently noted that the Crown is not going to allow Topham to turn the court into a circus by allowing him to use it as a venue to air his antisemitic conspiracy theories.

Also of interest, it appears that the Crown will be using the Noble case (R. V. Noble) as a model for sentencing (here and here). So if convicted, Topham will be looking at 6 months incarceration followed by three years of close supervision.... though we do have to note that Noble repeatedly violated the terms of his release during his three years of close supervision with seeming impunity.

40+ Years of Paulie

Received this message in response to our previous post:

There's a wonderful picture of baby-faced Paulie, soaking and out cold, after he lunged at William Kunstler and the old man defended himself by dousing him in a pitcher of water. It was carried in papers across North America in May 1970 and was Paulie's first major foray into media stardom. If you could dig that one out of the archives I'm sure Paul would really appreciate it.

Jesus. Paulie was a fashion disaster even in his 20s.

Sadly we can't seem to find our copy of Paulie after the soaking (and after he learned it was a bad idea to attack William Kunstler), but we'll see what we can dig up.

But for this photo, we say to our anonymous reader, we do believe you owe us a beer.

20 Years of Paulie

We're still working our project to document the early history of the modern racist movement in Canada (focusing on the years between 1960 and 1999 primarily and paying special attention to the Heritage Front, Western Guard Party, and Edmund Burke Society, though any photos, newspaper clippings, letters, or documents would be a welcome addition to our collection). We have been thrilled with the wealth of information we have received from our readers and we wish to thank all of you who have contributed to the project.

One of our readers sent us the following editorial cartoon from 1993 that we thought we would share:


The cartoon refers to Paulie's association with far-right hate groups, particularly the Heritage Front. In 1993, it was reported that Fromm had attended a neo-Nazi event celebrating Hitler's birthday two years earlier; the cartoon references this event.

And 20 years later, we see that Paulie still likes to associate with neo-Nazis:


After whining about the "destitute" Tremaine, Paulie makes his usual financial request.

One again has to wonder how much of that money Tremaine will ever see?
