Hi - We have a job to remove 4 trees at a clients house in a subdivision. We got weird vibes that the neighbors hated this client as she asked us not to set foot in their property. One tree was already removed prior to our estimate. I just got a call from someone claiming to be from the HOA stating that they have a cease and desist out with Davey Tree and are considering legal action. I told HOA lady that our contracts put all ownership and liability on the customer for any tree that's removed.
I suspect Davey had a contract for the entire jobs (5 total trees) and only got through 1 before they got their cease and desist letter. This would be a good money maker, but I'm feeling like it's not worth the headache. If my suspicions are correct, Davey has lawyers on staff and decided to walk away. Either way, I'm curious on the legality of HOA's vs Contractors. Even though I think we're covered from our contract, we're a new company and don't want to go to court.

Ugly custody trial, other parent has violent history where they attacked school officials, social workers, kids in front of witnesses.
Lawyer literally sat on doing anything for months when I gave him copies of police reports etc, names and addresses of all involved who would testify. Records of convictions that required dispositions, school records. then at last minute day of trial said none of his subpoenas were responded to. I don't think he did them at all. Do I have the right to ask to see them as proof? That none were responded to is sus to me.
One particular file he said "the records were destroyed." Then why do I have them when I called them and they were available? That was what made me think he did nothing.
ETA I feel really dumb. Not because anyone has made me feel that way. That I let all this happen and i'm not experienced with these things. I'm trying to answer as many questions as I can. Not trying to be difficult. The judge kept saying "you both have fine lawyers." and i'm like "actually..." but they don't let you speak in family court. you have to speak through your lawyer. Which I get. But he wasn't saying or presenting anything I said.
At one point they suggested parenting classes for other parent. But because I was yelled at prior for speaking up in family court I said nothing. My lawyer didn't object. and afterwards I said "why didn't you bring up last time other parent had parenting classes in ended with them assaulting the teacher?!?" he said "why didn't you say something." like, listen AH we have talked about this MANY times when meeting. You literally have the documents on it you said you couldn't enter because they aren't "official" but never subpoenaed the official ones or the people who were involved in that failure. I got current contact info for all parties involved in those incidents. To pretend like he didn't know and it was my job to speak up when every time I spoke up I was told not to. So I get why they want lawyers to be the ones talking in family court. But...he just sat there. How could you forget something like that occurring?
I thought...in clear cut cases of child abuse where allegations are founded this would have been easier. I feel like the judge didn't know the truth because no one presented it. The AFC did a great job. Represented the interests of my children well.
