We dumped a big planned portion of today's BradCast to open phone lines to listeners, in hopes of taking their end of year temperature before next year's Presidential election year begins in earnest. [Audio link to full show follows below this summary.]

Specifically, I wanted to hear from voters who claim to have supported Joe Biden in 2020, but are now planning to...do something else in 2024. Why would they want to do that with so much --- including American democracy itself --- on the line next year? They call in to explain. Lively conversations ensue.

Also today, before we took our right turn toward callers: Donald Trump is getting more and more dictator-y with each new rally and social media post of late. Over the weekend, in Nevada and New Hampshire, it was in regard to immigration (and his increasing love for fellow dictator, Vladimir Putin).

On Friday, a D.C federal jury awarded Georgia election workers Ruby Freeman and her daughter Shaye Moss $148 million dollars in their civil defamation lawsuit against the racist Rudy Giuliani, who lied about the women falsifying 2020 election results in Atlanta and turning their lives upside down ever since in the bargain. The judgment was $100 million more than they'd even asked for. And, on Monday, the pair filed yet another suit against Giuliani following new defamatory remarks he made outside the federal courthouse after the first day of his trial last week.

But ya know who was arguably the most terrified by the verdict in Rudy's case? One Donald J. Trump, who is both facing a huge multi-million dollar judgement in his own civil trial in New York State for years of fraud, even as he is facing a federal criminal trial, scheduled to begin in just over two months time, for crimes related to his attempt to steal the 2020 election. That trial will have a jury pulled from the very same D.C. federal jury pool that just awarded Freeman and Moss $100 million more than they even asked for.

COP28 in 'overtime'; Democracy rises in Poland; New U.S. House maps for NY; More good economic news; Trump at SCOTUS; Rudy defames amid defamation trial; Johnson lies about WI's fake electors...

If, like me, you're old enough to get the joke in today's headline, congratulations on still being alive! (If you don't remember it, here's a reminder.) But, no, we didn't forget Poland on today's chocked-with-a-surprising-amount-of-not-awful-news BradCast!

Among our stories covered today....

  • Who knew that holding a U.N. conference (COP28) on our climate catastrophe in a petrostate like the United Arab Emirates might end without an agreement --- or with a bad one --- from all 200 participating nations for the first time in the annual summit's 28 year history? Well, it ain't over until it's over, with nations now officially in "overtime" at the Conference, which was otherwise set to end last night. Will they dare mention the phrase "fossil fuels" in whatever final statement they finally unanimously agree to make? Stay tuned!
  • In what is being described as a "political earthquake", after eight years under the heavy hand of a far-right anti-immigrant, anti-media, anti-woman authoritarian party's Prime Minister and President, Poland --- with a front-row seat over the past two years to Russia's autocratic invasion of Ukraine --- elected a centrist, pro-EU Prime Minister on Monday! That is good news on a whole bunch of fronts. It became official today when Donald Tusk received a vote of confidence from parliament after a brief delay when a right-wing lawmaker used a fire-extinguisher to douse candles in a Hanukkah menorah in parliament. "This is a wonderful day," said Tusk to the Polish people on Monday night. "Not for me, but for all those who have deeply believed over these years that things will get even better, that we will chase away the darkness, that we will chase away evil. From tomorrow, we will be able to right the wrongs so that everyone, without exception, can feel at home." The news is a welcome counter-point to the recent rise of right-wing authoritarianism in nations from Argentina to The Netherlands. And, hopefully, its a good omen for 2024 in the U.S.
  • On the other hand, Ukrainian President Volodymyr Zelenskyy had to fly all the way to the U.S. on Tuesday to, essentially, beg far-right Congressional Republicans --- who have apparently lost the plot of democracy --- to continue supporting Ukraine's efforts to hold off the imperialist invasion of his country by fascist Russian dictator Vladimir Putin.
  • Speaking of Congress and democracy, very good news out of New York's high court today, which ordered a new U.S. House map for next year's 2024 Congressional elections, after the map used in 2022 resulted in a bunch of seats flipping from D to R in newly drawn districts after state Dems kinda screwed up the whole process. We explain.
  • And in more potentially good news for 2024, inflation continues to fall faster than expected, as the U.S. economy continues to show surprising resilience and little sign of the recession that many had feared when Donald Trump's Federal Reserve Chairman, Jerome Powell, began raising interest rates last year to combat inflation. Inflation is almost back to normal at 3.1% over last year; gasoline is down 11% over the past two months; employers are still hiring and unemployment remains at a near record-low rate of 3.7%. But, some prices are still high at grocery stores, as is rent and the cost of a home mortgage. Economists are watching Powell closely for a read as to when the Fed may deign to finally lower interest rates next year.
  • No sooner had we gotten off air yesterday, than the U.S. Supreme Court announced it would consider an expedited petition filed on Monday by Special Counsel Jack Smith to hear Donald Trump's appeal on Presidential Immunity in his January 6 federal indictment. It doesn't necessarily mean SCOTUS will hear the full case. But it means they will consider doing so. Smith had filed the petition for cert just hours earlier, leapfrogging the D.C. Circuit Court of Appeals in hopes of keeping next year's scheduled March 4th trial date for Trump on track. All of which, at least for now, is encouraging news to suggest that SCOTUS may both do the right thing and do so with the alacrity that would allow the American people a verdict in the case against Trump in advance of next year's Presidential election.
  • The defamation damages trial against dirtbag former NYC Mayor and Trump attorney Rudy Giuliani --- in which he's already been found guilty of defamation --- continued into its second day on Tuesday. But not before his attorney admitted in Court on Monday (as the federal judge has already found), that Rudy's horrendous claims about two Georgia election workers in 2020 committing fraud for Joe Biden were false. And not before Giuliani then stepped out of the courtroom on Monday and repeated the same baseless claims yet again on the courthouse stairs. Today, U.S. District Court Judge Beryl Howell scolded both Rudy and his attorney, noting that Giuliani's remarks on Monday night "could support another defamation claim" by mother and daughter plaintiffs Ruby Freeman and Shaye Moss. The pair are currently seeking damages in the amount of $15.5 to $43 million in their civil lawsuit. And they will deserve every penny they receive.
  • Speaking of dirtbags, following the news last week that Wisconsin's 10 fake Trump electors had settled a civil lawsuit against them, the state's U.S. Senator Ron Johnson --- already on record as having encouraged state lawmakers to steal the Badger State's 2020 election for Trump --- described the settlement as a "travesty of justice." He insisted that Democrats had done the very same thing "repeatedly" and "in multiple states" in the past. Nonetheless, he couldn't name any state where Democrats had secretly created false slates of electors in hopes of stealing an election when pressed by CNN's Kaitlan Collins. (If Johnson was referring to what happened in Hawaii in 1960, he is wrong about that as well.)
  • Finally, Desi Doyen joins us for our latest Green News Report, with both the good and bad, so far, out of the COP28 Climate Conference in Dubai, and some very good news indeed from President Biden regarding the nation's largest ever investment in high speed rail and U.S. passenger rail service.

Given all the legal delay tactics available to him, Is it even possible at this point for there to be a verdict in any of Donald Trump's criminal trials before November 5th, Election Day, in 2024? A former federal prosecutor joins us to discuss that very thing on today's BradCast. [Audio link to full show follows below this summary.]

BUT FIRST, there was quite a bit of other news today, some of which is somewhat related...

  • Short-lived former Republican U.S. House Speaker Kevin McCarthy announced he is quitting Congress at the end of this month. The GOP's thinnest of House majorities will become even thinner until California holds a Special Election next year to fill the seat, likely not before next June. That means Republicans will have just two votes to spare on any legislation, including on whether to prevent the Government from shutting down in mid-January. (Happy New Year!)
  • The U.S. Dept. of Justice unsealed war crimes charges against four Russian soldiers accused of torturing an American in 2022 following their ongoing invasion of Ukraine. It is the first time such charges have been filed under a 30-year-old statute. Nonetheless, Congressional Republicans --- even after the news of atrocities committed against Americans and Ukrainians alike --- continue to oppose additional military aid to help our sovereign ally defend democracy itself in Europe against the imperialistic assault of its fascist Russian neighbor.
  • The ten fake 2020 Trump electors in Wisconsin have settled a lawsuit filed against them by two official Biden electors. All ten Republicans, some of them top state GOP officials, have agreed to withdraw their false election filings, acknowledge Joe Biden won the 2020 election, share all related communications, and never serve as a Presidential Elector again in any election where Trump is on the ballot. Exchanges disclosed between several of them reveal that they knew what they were doing was wrong and an attempt to "possibly steal" the election. The exchanges also reveal that WI's U.S. Senator Ron Johnson advocated for the state Legislator to to steal the election for Trump.
  • The six fake 2020 Trump electors in Nevada were criminally indicted today by the state's new Democratic Attorney General Aaron Ford. They all face penalties ranging from one to five years in prison for each of the various charges. This crew of miscreants also includes top Republican state officials, such as state GOP Chair Michael McDonald, Clark County GOP Jesse Law, and Jim Hindle, the man who runs elections in Storey County! Those degenerates join others in both Michigan and Georgia who have already been charged for their parts in attempting to steal the 2020 election for Trump. That, in a state where a new law adopted by the Democratic-run legislature to specifically criminalize future fake electors was vetoed by the state's new Republican Governor Joe Lombardo earlier this year.

THEN, we're joined by RANDALL D. ELIASON, the former chief of the fraud and public corruption section at the U.S. Attorney’s Office for the District of Columbia. He now teaches criminal law at George Washington University Law School, contributes to the New York Times and elsewhere, and blogs at his own site, Sidebarsblog.com.

Last week, Eliason penned an op-ed for the Times, calling for a "Rocket Docket" for Donald Trump's criminal charges, particularly related to his federal indictment in D.C. related to his attempt to steal the 2020 election. Eliason argues that the American people, to paraphrase Nixon, "have got to know whether or not their (former) President is a crook" before they may have to decide whether to vote for him next year. In fact, he argues, they have a right to know that.

But with all of the pre-trial motions available to the former President, in all four of the criminal trials he is currently scheduled to face next year, is it even be possible for there to be a verdict at the trial level in any of those cases before Election Day, after which, if Trump wins, he'll be able to make most, if not all of the charges disappear?

Eliason argues yes, particularly in the federal trial in D.C., currently overseen by U.S. District Court Judge Tanya Chutkan, as scheduled to begin on March 4 (the day before Super Tuesday). But, he notes at the Times, "whether it happens will be decided by a relative handful of federal jurists --- including a number appointed by Mr. Trump himself."

Nonetheless, Eliason maintains today that a court schedule to keep that trial on track for a verdict before Election Day next year --- and even before Republicans must finalize their 2024 Presidential nomination at their convention next Summer --- is still totally possible. What the courts need to do, he tells me, "is pretty simple. They need to put these [pre-trial] motions on a fast track...They can do that when they want to. They have done it in the past. They just have to have the will to do it. Same with the Supreme Court."

We discuss a number of historic cases --- Watergate, the 2000 election, even cases from 2020 and several of Trump's current cases --- where even the Supremes were able to act with alacrity. "Bush v. Gore they decided in one day," notes Eliason, "so they can move quickly when they want to. But that's really what it all comes down to now."

So, will they? And, if they do, will Trump be able to argue that he did not receive a fair trial in the bargain because they were rushed? And, is there any indication to date that the appellate courts, including SCOTUS, also appreciate the importance of ensuring a conviction or an acquittal before Election Day next year?

We were otherwise looking forward to a fun BradCast today. Then Hamas launched a surprise attack on a number of Israeli towns and a music festival on a kibbutz on Saturday, in a horrific assault by land, air and sea. Hundreds were killed, injured or taken hostage. Now, Israel is brutally retaliating in Gaza. [Audio link to full show is posted below this summary.]

More than a thousand are reportedly dead on both sides, with attacks and atrocities against civilian populations that amount to nothing less than war crimes. At least 11 Americans have also been confirmed by the White House as killed, with an unknown number still missing.

Of course, none of this began over this weekend. So, today, we tried to offer some quick history of how we got here and how war crimes are "never okay" before opening up our phone lines to listeners --- both pro/anti-Palestine and pro/anti-Israel and pretty much everything in between --- with thoughts from callers on the weekend's tragedy and where it all goes from here.

Thanks to the billionaire-funded rightwing media machine (and much of the corporate media that is a part of it), it remains all too easy to muddy enough waters to fool a huge chunk of the American people these days with evil, lies and bad faith. On today's program...

  • President Biden made an impassioned case to world leaders for continuing support for Ukraine's existential battle against Russia's evil and lies --- and in defense of democracy --- at the U.N. General Assembly on Tuesday. He also called for uniting the world against our ever-worsening climate crisis.
  • Ukrainian President Volodymyr Zelenskyy also addressed the same body to make his own impassioned case that his nation's battle against the barbaric, 19-month invasion by autocratic neighboring Russia is, in fact, a warning for other democracies around the world.
  • Here at home, U.S. House Republicans --- who have become alarmingly pro-Putin, pro-Russia and pro-autocracy --- are now eating themselves alive. It seems increasingly unlikely that they can even come to an agreement among their own warring factions to adopt a measure to simply keep the government open and funded after the federal fiscal year ends next week. It is unclear that many of them even want to. As Democratic House Leader Hakeem Jeffries aptly observed over the weekend, the House GOP is now "in the middle of a civil war."
  • So, what is Speaker Kevin McCarthy's plan to get out of this mess by October 1, when his extremist GOP caucus threatens to shut down the government without, at the very least, adopting a Continuing Resolution to stay open for another 30 days so Republicans can negotiate with themselves? Impeachment of Joe Biden, of course! (Spoiler alert: There is still no evidence of either high crimes or misdemeanors, but that may not matter. As we discuss, this is the very same playbook that did in Hillary Clinton with "but her emails!" and, back in 2004, John Kerry with that swiftboat nonsense. Apparently, the American people are very easy to fool. Do Democrats have a plan in response?)
  • Finally, speaking of being fooled again, Desi Doyen joins us for our latest Green News Report, as California pushes back, in court, against Big Oil's decades of deadly climate lies. As Gov. Gavin Newsom explained when announcing the state's lawsuit against five of the largest fossil fuel companies: "These guys have been playing us for fools. They've been playing all of us for fools."

We wrap up our last BradCast before standing down next week with a bunch of disparate stuff, both good and bad, and even a song to help you whistle as you leave the theater before next week's holiday. [Audio link to full show follows below this summary.]

WE DID START THE FIRE: And we're also responsible for the smoke from hundreds of them in Canada, now threatening the health of more than 100 million Americans. We're also responsible for the record, weeks-long deadly, triple-digit heat wave in Texas now spreading north and east and touching off deadly severe storms along with it. Of course, those who watch Fox "News" and the read their deceptive Fox Weather website will never know who's to blame for it all and who is endangering their lives and those of their great grand-kids. But keeping their viewers and readers dumb and disinformed is the whole purpose of the Fox fake news project. Sadly, we all pay the price.

'CEASEFIRE AND NEGOTIATE!': Happily, it seems the 24-hour mutiny in Russia last weekend --- wherein longtime Vladimir Putin-ally, Yevgeny Prigozhin, gave the game away by declaring that their imperialist invasion of Ukraine was built on lies and was never about either "demilitarizing" or "de-Nazifying" Ukraine --- has helped the scales fall from a bunch of Americans' eyes. New polling from Reuters/Ipsos since the Prigozhin's short-lived insurrection finds a nearly 20-point bump since last month in American support for Joe Biden's policy of helping Ukraine defend themselves. That includes majorities in both major parties as well as independents. That's very good news. And, while I'm unlikely to reach many of the duped rightwingers who have fallen hook, line and sinker for Putin (and Trump) propaganda about the conflict, I am hoping that I might still be able to help some of those on the supposed anti-war Left who have fallen for the same propaganda. I'm talking largely about the "ceasefire and negotiate!" crowd. A few words for them today in hopes of helping a least a few of them understand how they have also been played by the same, authoritarian sources as the rightwingers.

'THIS IS NOT A NORMAL COURT': President Biden was right about that today, at least. We knew after all of the surprisingly good rulings of late from our otherwise corrupted, stolen and packed U.S. Supreme Court majority --- on issues of democracy and voting, in particular --- that it was almost certainly too good to last. As the high court's 2022 term comes to a close, they returned to their corrupted form on Thursday by overturning more than 40 years of precedent to bar Affirmative Action policies in college admissions for all private and public colleges and universities (while exempting military academies for some odd reason). Though it's not easy, we try to make sense of the Court's dizzying 237-page ruling [PDF], including multiple concurrences and dissents, as the far-right activists on the bench --- and those that put them there --- get to cross another long-term project off their list today.

SMOKE GETS IN YOUR EYES: And lungs, from the record shattering Canadian wildfires. At least if you live in any of a whole bunch of states in the mid-west or east this week. That, and more climate news, both good and bad, as Desi Doyen joins us for our latest Green News Report.

THEY DEFINITELY DIDN'T START THE FIRE: But they did, after 34 years, put all news words to it! And not a moment too soon, in my opinion! Yours may vary. Welp, it was another slow news weekend [insert eyes-rolling emoji here]. But we try to come up with something to cover on today's BradCast nonetheless. [Audio link to full show is posted below this summary.]

Among the many stories covered on today's program...

  • Extreme weather and warnings of same walloping much of the nation today, as two weeks of historic triple digit temperatures in Texas spread to other states, resulting in major storms, deadly tornadoes, widespread power outages and cancelled flights from Arizona through the mid-west up into New England and down to the Carolinas and Florida. But if you hear about these seemingly ever-worsening nightmares from some major U.S. outlets --- like Fox "News" (and even ABC, etc.) --- you may hear absolutely nothing about the man-made climate change that is fueling our intensifying global crisis.
  • On Friday, Politico finally covered the story that we broke on this show six weeks ago about how Georgia Sec. of State Brad Raffensperger says he will not be installing urgently recommended security upgrades to its horribly vulnerable Dominion voting systems until after the 2024 Presidential election in the critical battleground state. We covered that news exclusively here in mid-May. Politico covered it here on Friday. And my tweet pointing both out was throttled by Twitter over the weekend so that it's nearly impossible to find without a direct link. That is here. (More, hopefully, on this issue tomorrow!)
  • Speaking of Georgia, a federal judge has ordered Rudy Giuliani to pay the legal fees for the two Atlanta election workers --- Shaye Moss and her elderly mother Ruby Freeman --- who are suing him for defamation after he (and Trump, and the rest of the MAGA crew) falsely accused them of committing fraud in the ballot tabulation room during the 2020 Presidential election.
  • Curiously enough, the far-right, wildly corrupted U.S. Supreme Court keeps making not terrible rulings at the end of this year's term. Today, a challenge to a ruling on a case out of Louisiana, where a federal court mandated an additional black majority U.S. House district, was rejected. The case will be sent back to a lower court. If the lower court rules as SCOTUS did a few weeks ago --- when they stunned the world by upholding the Voting Rights Act and requiring another black majority House district in Alabama --- today's decision could be very good news for those that care about voting rights, the Constitution, and equal representation for all.
  • Also today, SCOTUS allowed several lawsuits against Ohio State University to proceed, after it was discovered the school had, for years, protected a serial sexual abuser who served as a team doctor for years. This is probably not good news for OSU's former wrestling coach and serial denier Rep. Jim Jordan (R-OH).
  • The lower courts are holding as well, for now. Last week, a federal judge permanently overturned Arkansas' unspeakably cruel ban on gender-affirming medical care for transgender kids, and a federal judge in Florida temporarily blocked Gov. Ron DeSantis' anti-freedom crusade to ban minors from attending drag shows. Amusingly, one of the reasons the judge blocked the new law was because it was in conflict with DeSantis' so-called "Parents Bill of Rights" legislation adopted in 2021.
  • Finally today, before opening the phones to listeners, we discuss the bizarre story of whatever the hell happened over the weekend in Russia where, for about 24 hours or so, civil war nearly broke out. That, as Yevgeny Prigozhin, formerly a close ally of Vladimir Putin and commander of the mercenary Wagner Group (arguably Russia's best fighting force in Ukraine), declared Russia's justification for attacking Ukraine --- to demilitarize and de-Nazify the sovereign nation --- to be a lie. Wagner's march toward Moscow, however, ended as quickly as it began, with Putin theoretically granting Prigozhin safe harbor in Belarus, even if both his future and those of the troops in the Wagner brigade remain uncertain at this hour. We open the phones with what is left of today's show to discuss what the hell is going on and where both Russia and Putin's fortunes may be heading from here...

On today's BradCast: Yes, some actual, unqualified good and, frankly, surprisingly good news from our otherwise wildly corrupted U.S. Supreme Court on voting rights and racial gerrymandering! [Audio link to full show is posted below this summary.]

Last year, following oral argument at the High Court in Allen v. Milligan, a Voting Rights Act challenge in Alabama, pretty much all Court watchers and voting rights advocates thought that Section 2 of the VRA was in big, big trouble. That, after the Supremes had already gutted Section 5 of the Act in the Shelby County case back in 2013 and have been nibbling away at the rest of the landmark 1965 law ever since.

But on Thursday, Chief Justice John Roberts and Justice Brett Kavanaugh actually joined with the Court's three liberals in a 5 to 4 majority opinion [PDF], upholding a lower court ruling by a three-judge panel --- including two Trump appointees --- which had determined that Alabama must rewrite its redistricted Congressional maps after the 2020 Census to include a second majority Black U.S. House District.

Early last year SCOTUS had used the "shadow docket" to temporarily put the lower court's ruling on hold without a hearing, allowing the 2022 elections to move forward with just one out of AL's seven U.S. House Districts having a Black majority, despite African-Americans comprising some 27% of the state's population. That ruling --- along with tea leaves read from oral argument last year and Roberts' history of working to dismantle the VRA --- led many to believe the Court would permanently allow the state's racial gerrymander to remain in place, effectively overturning the ban on election laws and House maps created with a racially discriminatory intent.

Alabama's GOP gerrymander had been challenged as a violation of both the Constitution and Section 2 of the VRA, after the Supremes' previous gutting of Section 5 of the Act removed the mandate for jurisdictions to demonstrate in advance that new election laws did not discriminate on the basis of race. Challenges under the Act may still be filed under Section 2, but only after the discriminatory voting measure has been enacted.

The Court's actions last year also allowed similar racial gerrymanders in several other states, including Louisiana, Georgia, Texas and elsewhere, resulting in the GOP winning a razor-thin 5-seat majority in the U.S. House in November.

Thursday's stunning decision, according to experts, could net Democrats as many as four or more seats in the House in the 2024 elections, and is likely to affect ongoing legal challenges in as many as 10 states.

Our guest on today's program believes that, "Gerrymandering and redistricting was one of the big reasons why Republicans probably had about a net gain of between 12 and 15 seats [last year] when you look at the various partisan gerrymanders and the various racial gerrymanders that the Court allowed."

We're joined today to discuss all of this, the details of how it happened, and what it appears to mean going by forward by a stunned DAVID DALEY of FairVote, where he is an expert on gerrymandering and author of two different books on the topic.

"I don't even know what to say," Daley explains at the top of our conversation. "I'm so used to delivering the bad news, and all of a sudden I'm a doctor telling you you're going to live forever. This is an unusual role for me."

But, don't worry. Daley is still able to share a number of concerns about several other cases with opinions coming soon from SCOTUS, despite today's unreservedly good news for voters, voting rights, and the future of the not-dead-yet Voting Rights Act!

THEN, with today's excellent news that may well result in Democrats regaining the majority arguably stolen from them by unlawful GOP gerrymanders last November, the current GOP majority in the House is busy eating itself alive. The party's far-right flank has mounted a mutiny on the House floor this week, in rebellion against Republican House Speaker Kevin McCarthy's debt ceiling deal last week with President Biden to avoid the first-ever default of the U.S. Government. And it's all quite hilarious.

FINALLY, Desi Doyen joins us for our latest Green News Report, as the worsening affects of our climate crisis are now choking Americans across much of the east coast and midwest with toxic smoke from hundreds of record, out-of-control, Canadian wildfires blanketing much of the nation. We also cover the Biden EPA's long-overdue upgrades of Jackson, Mississippi's water system and the ecological disaster in the wake of the destruction of a critical dam in Russian-occupied Ukraine.

[NOTE: Today's program was completed just prior to the breaking news late today of Donald Trump's reportedly 7-count federal criminal indictment in Special Counsel Jack Smith's probe in the disgraced former President's stolen documents case. On today's BradCast: It was a mixed bag for democracy overseas this weekend, where (as here in the U.S.) a democratic election does not necessarily guarantee the winner will be a small "d" democrat. Meanwhile, the version of democracy we have here at home ain't necessarily doing much better. Arguably worse, in fact. [Audio link to full show is posted at the end of this summary.]

Among the stories covered on today's program...

  • A 49-year old man has been arrested after attacking two staffers of Virginia's Democratic Rep. Gerry Connolly with a metal baseball bat on Monday at his district office in Fairfax. The motive for the attack was unknown as of airtime, but the incident is yet another in a sharp rise of threats and attacks against lawmakers and their families since Donald Trump's January 6, 2021 sore-loser insurrection at the U.S. Capitol.
  • For the first time in his 20 years as Turkey's leader, President Recep Tayyip Erdogan will now face a runoff election to retain power in two weeks. Over the weekend, the increasingly authoritarian Erdogan was able to notch just 49.5% of the large turnout vote, falling just short of the 50% needed to win outright against opposition leader Kemal Kilicdaroglu, who received just shy of 45%. The next two weeks will see a fight for the remaining 5.7% of the vote won in the first round on Sunday by a third party candidate. Erdogan is believed likely to pull off another victory on May 28 --- despite startling inflation and his handling of an earthquake that resulted in more than 50,000 deaths --- after failing to win outright for the first time in his political career. Kilicdaroglu, however, vows he will win control of the key NATO ally, which has drifted toward the conservative right and Russia in recent years.
  • The news was slightly brighter in Thailand over the weekend, where two different opposition parties to the ruling military junta easily bested the competition. It was a "stunning" victory for the liberal Move Forward party who, with the help of young, first-time voters, easily defeated the populist, billionaire-controlled Pheu Thai party that had been favored to win going in to the weekend. Move Forward's agenda includes rolling back the military's political role and reforming laws that stifle dissent. The question now, however, is whether either Move Forward or Pheu Thai will be able to build a governing coalition in parliament and win the coveted Prime Minister's position. All parties, however, including those backed by the military, seemed to recognize the voice of the weekend's democratic vote. For now.
  • Back here in the U.S., the controversy over last week's appalling, 70-minute Donald Trump town hall, gifted to him by CNN, continues. In the second half of today's program we open the phones to listeners on whether CNN should have held the forum at all --- allowing the disgraced, twice-impeached, criminally indicted, sexual abuser former President of the United States to offer lie after lie after lie before a live audience of cheering supporters --- and, if not, how should the frontrunner for the 2024 GOP Presidential nomination be covered? Also, while the performance was clearly a gift to Trump in his run for the GOP nod, will it actually help him in the long-run to win a general election next year? I am not so sure. In fact, I don't think it will help him at all and is as likely to hurt him in a number of ways. We take a lot of thoughts from a lot of callers on those points, several of whom disagree with my own take on the matter, though in several different and interesting ways...

Democracy is not having an easy time of it of late, as both of our main stories on the always pro-democracy BradCast seem to underscore today. [Audio link to full show follows below this summary.]

FIRST UP, after months of wrangling, Ohio's gerrymandered Republican state House on Wednesday decided to put majority rule up for a vote this summer. Specifically, they voted to hold a special election for a state constitutional amendment asking voters if all future amendments placed on the ballot must reach 60% for passage. The GOP amendment in August will require only 50% to be adopted, as has been the case for all such measures in the Buckeye State since 1912.

The August special election will come just in time to preempt a the state's November general election, which is likely to feature a citizen-led ballot amendment to protect abortion in Ohio as a constitutional right. That, of course, is why Republicans are hoping to undermine that measure with their own small turnout election in late Summer. They hypocritically characterized the controversial initiative as a "constitutional protection act", meant to keep "out-of-state special interests" away from Ohio's foundational documents. But the measure's top backer was a PAC named "Save Our Constitution", funded with $1.1 million from one single out-of-state billionaire GOP megadonor.

Every single former state Governor opposed the measure, along with five former Republican and Democratic state Attorneys General and the Ohio Libertarian Party. But it was supported by the state's hypocritical Republican Gov. Mike DeWine and Sec. of State Frank LaRose, both of whom eagerly supported an election reform package adopted just four months ago in January, which did away with August Special Elections after finding them to be low-turnout and expensive. Then these "conservatives" supported this new special election anyway, at a price tag of $20 million to state taxpayers, in exchange for which they will get to vote on taking away their own democratic power.

Similar efforts to undermine abortion rights, however, since the overturning of Roe v. Wade by the corrupt U.S. Supreme Court last year, have failed miserably in both right- and left-leaning states. But those measures won with anywhere from 50 to 60% of the vote. Recent AP polling finds support for reproductive freedoms in Ohio to be at 59%. Thus, the GOP's attempt to undermine majority rule this Summer by requiring 60% for passage of future ballot measures...other than their own.

NEXT: CNN called it a "town hall". In truth, it was a 70-minute Donald Trump infomercial filled with a non-stop litany of his twisted lies from beginning to end. The number of lies he told is entirely too long to detail here, on everything from the 2020 election, to January 6, to his stolen classified documents, to this week's federal court verdict finding him liable for sexual abuse and defamation, to pretty much anything else that you or CNN moderator Kaitlin Collins or the Trump-supporting crowd in attendance at St. Anselm's College in Manchester, New Hampshire could come up with.

He also made clear that he would pardon the January 6th insurrectionists and seditionists, and that he supports the imperialist invasion of authoritarian Vladimir Putin's Russia over defending democracy and humanity in Ukraine.

But, while Wednesday night's shameful spectacle clearly embarrassed even the many CNN commentators serving as post-game analysts, did the live town hall ultimately help or hurt Trump overall?

We're joined today by our old friend HEATHER DIGBY PARTON of Salon and Hullabaloo to discuss exactly that and much more related to what is arguably one of the lowest moments in CNN history.

"It was a clown show," says Parton who did not realize it would include an audience stacked with GOPers, as it was presented as a Republican town hall before next year's New Hampshire primary. "That gave him the ability to go on national TV and essentially hold a rally. A rally in which he had a foil there in Kaitlan Collins, who, I think she did about as good as you could do. I don't have a lot of complaints with her, she was thrown into a situation that was unwinnable."

She discusses why CNN is taking this attempted turn to the right, in order to curry favor with Trump voters at the behest of their new, rightwing owner who sees Fox "News" as fair and balanced. "CNN is in a ratings spiral, doing a lot of retooling. It seems obvious to me that CNN thought they could maybe cop some of those people if they put on the right show. That's what they did. It was horrifying."

While I discuss several points in which Trump did himself no favor with prosecutors preparing indictments against him, Parton cites some of the actually "dangerous" fallout likely to come from Wednesday night. "[Trump] said some things that were literally dangerous. For example, his stuff about Ukraine. I'm sure Vladimir Putin heard him clearly when he said, 'Within 24 hours [after taking office], I will do it'. We know exactly what he meant. Immediately upon becoming President, he would withdraw support and force Ukraine to surrender. That means the war that he was going on and on about, 'People are dying, they're dying'. They're going to be dying at least until November 2024 now, for sure, because he said that. There's no way that Russia will do anything until they know whether or not he's going to be President again. And that is disgusting."

Just to be clear, while we're debating whether California's senior Democratic Senator should step down on today's BradCast, the longest-serving U.S. Supreme Court Justice should not only have stepped down long ago, he should have been removed by the force of impeachment long ago as well. [Audio link to full show is posted below this summary.]

It was a very busy and lively show today, covering a bunch of interesting and occasionally related news. Among today's story's...

  • Democracy seems to be out of reach yet again in the Middle Eastern/Sub-Saharan nation of Sudan, as deadly fighting broke out between two military factions in the country's capital and elsewhere over the weekend.
  • A well-known Kremlin opposition figure and critic of Russian President Vladimir Putin's horrific invasion of Ukraine was sentenced to 25-years of hard labor today for daring to speak out against the war last year. 41-year old Vladimir Kara-Murza is just the latest facing a long prison sentence for public opposition to Putin's barbaric, criminal assault on his sovereign neighbor.
  • Last week we explained why Fox "News", if they were smart, would do everything in their power to reach a settlement with Dominion Voting Systems before the trial in the $1.6 billion defamation lawsuit filed by the voting machine vendor against the Republican propaganda outlet began in earnest this week. Jury selection in the trial, in which Dominion has Fox dead to rights for repeatedly, falsely and knowingly lying to viewers that Dominion somehow rigged the 2020 election for Joe Biden, was supposed to begin today. But Delaware Superior Court Judge Eric Davis, without explanation, announced the trial would begin tomorrow instead, leading some to believe Fox may be trying to strike a last minute settlement.
  • On Friday, the U.S. Supreme Court issued a brief, administrative stay on the rulings by far-right, activist U.S. District Judge Mathew Kacsmaryk and the far-right U.S. 5th Circuit Court of Appeals that ban the FDA-approved use of mifepristone, the nation's top abortion medication, in all 50 states. The temporary stay will only remain in place until Wednesday, at which time the full SCOTUS will either keep it in place throughout the appeal to Kacsmaryk's unprecedented, activist ruling --- in which he is attempting to legislate from the bench and overrule the FDA's 23-year old approval of the safe and effective drug --- or they will allow a first-of-its-kind ban to go into effect while the appeal moves forward. Today, we cite a few of the 5th Circuit's huge errors in their recent ruling, as detailed by The BRAD BLOG's Ernie Canning.
  • And, speaking of our corrupted, rightwing federal judiciary, there was yet more jaw-dropping news over the weekend of the unspeakable corruption and seemingly endless lawlessness of Justice Clarence Thomas, the longest-serving current member of the U.S. Supreme Court. We quickly review the full story again today, from Clarence's unlawful failure to disclose his activist wife Ginni's salary from the Heritage Foundation for some 20 years, until called out for it in 2011; to Ginni's apparent "Judicial Insider Trading" on the infamous 2010 Citizens United ruling; to ProPublica's blockbuster exclusive two weeks ago detailing decades of Clarence's unlawfully undisclosed luxury travel courtesy of GOP megadonor Harlan Crow; to last week's second ProPublica jaw-dropper revealing that Crow purchased properties from Thomas, including his mother's house (which she still lives in, rent free!) and which also went unlawfully undisclosed in in his annual disclosure forms; and then this weekend's latest scoop from WaPo finding Clarence hasn't bothered for years to report income from a real estate firm owned by Ginni and her family.
  • Finally, speaking of both the rightwing federal judiciary and people who should arguably resign immediately, California's 89-year old senior Democratic Senator Diane Feinstein has missed about 60 of 80 floor votes in the U.S. Senate this year, as she is sidelined in San Francisco with shingles. There is currently no date for her return to the 51-49 upper chamber. But, even more importantly, her extended absence from the Senate Judiciary Committee has stalled the confirmation process for more than a dozen federal court judges nominated by President Biden. As calls for her resignation began last week, the fading trailblazer has asked to be removed, temporarily, from the powerful Judiciary Committee. Unfortunately, it's not quite as easy as that, as we explain today.

    In the bargain, a debate has surfaced among Congressional Democrats, some of whom are calling for her resignation after decades of service, others describing the push as misogynistic, others defending her during her convalescence, while still others appear to be supporting her at the moment, though their patience is clearly wearing thin.

    We cover all of that today before opening our phones to listeners --- her constituents in Southern California --- for their opinions on whether DiFi should stay or go. We had a lot of really smart and interesting callers today...even if their opinions were ultimately in sync. They believe its time for her to fly...

I have no idea what this week is going to bring. As noted on today's BradCast, nobody, save for (maybe) the Manhattan District Attorney does. And I suspect even he is largely flying blind about what happens once (and if) Trump is ultimately indicted in New York State. [Audio link to full show is posted below this summary.]

Before we get to discussion about that --- and callers on the same topic --- today is the 20th anniversary of the U.S. invasion of Iraq. As we said at the time, and have been saying for the 20 years since, we were lied into war under false premises by the George W. Bush/Dick Cheney regime. In the bargain, hundreds of thousands of Iraqis were killed and about 5,000 Americans. No weapons of mass destruction were ever found. More disturbingly, no one was ever held accountable for that pointless war and the lies that were told to get us there.

Back in 2003, 66% of Americans supported the invasion, in no small part because opposition voices in the U.S. were largely shut out of the mainstream media conversation. Now, 61% of Americans, according to new polling, think that war was a mistake.

And, because there was never any accountability for the war criminals, guys like Florida Gov. Ron DeSantis are considered to be front-runners to become the next Republican nominee for President of the United States. That, despite the fact that, as Washington Post detailed over the weekend, DeSantis played a key role in torturing detainees with forced-feeding at Guantanamo Bay while he served as a 27-year old Navy lawyer there.

Meanwhile, now playing the part of imperialistic invader and war criminal is Russia and its leader Vladimir Putin, who the International Criminal Court on Friday issued an arrest warrant for, accusing him of abductions of thousands of Ukrainian children since his unlawful invasion just over one year ago.

If you're wondering just how terrible Putin actually is, please do yourself a favor soon and watch last week's Academy Award winning Best Documentary, Navalny (currently available via HBO Max and Amazon Prime). As discussed today, it is jaw-dropping. For a whole bunch of reasons. And, don't worry, it's also uplifting and hilarious at times...even as we see, live and as it happens, the attempted assassination of Russia's incredibly likable opposition leader, Alexei Novalny, and the remarkable moment when he actually tricks one of his own would be assassins into confessing to his attempted murder. All caught live on camera!

Then, we get to the story that I have a feeling we'll be covering for some time on this program: the first criminal indictment of a U.S. President in our nation's history. It may finally happen this week in New York (emphasis on "may"), thanks to Manhattan D.A. Alvin Bragg. He is believed likely to bring charges against Donald Trump related to the hush-money payments the disgraced former President made to porn star Stormy Daniels to cover up a sexual affair. That payoff, carried out at his direction by his then-attorney Michael Cohen, helped Trump win the 2016 Presidential election. Cohen went to jail for it. Trump never did. At least not yet.

Trump is almost certainly not going to be "BE ARRESTED ON TUESDAY", as he claimed in a panicked, weekend, ALL-CAPS statement on his social media site. Tuesday is seen as the earliest time he could possibly be indicted by a Grand Jury in New York. But, even if so, he will not be "ARRESTED" by New York law enforcement officials in Florida, where he now lives.

If Trump finally is indicted on criminal state charges, whether it's this week or next, will he actually go back to New York to turn himself in? Seems unlikely. But, if not, then what? Would NY ask Ron DeSantis' Florida law enforcement to arrest and extradite Fugitive Trump from Mar-a-Lago? Also seems unlikely, even with DeSantis believed almost certain to run for the GOP's 2024 Presidential nomination against Trump. Will Trump's supporters actually "PROTEST, PROTEST, PROTEST!!!" as the cowardly ex-President is begging them?

And why are House Republicans, led by House Judiciary Chair Jim Jordan --- who pretends to support law and order --- now actually weaponizing the federal government to try and undermine Bragg's case?

In fact, nobody knows what is coming next. There is no playbook for what is about to happen --- whether it happens this week, or next, or even in a different state, like Georgia. But it does seem to be a good day to open our phones to listeners on the topic, to talk about it all and get their best guess about what where things go from here.

On today's BradCast: If lying to Americans about crime failed to result in a "red wave" for Republicans in 2022, perhaps lying to them about "woke" banks will do the trick in 2024! I'm sure it'll work. [Audio link to full show is posted below this summary.]

Among the many stories and important context offered on today's program...

  • Moody's considers downgrading the U.S. banking sector in the wake of several bank failures in recent days, even while declaring that the industry's outlook remains strong.
  • Inflation has eased slightly over the past month, according to the U.S. Bureau of Labor Statistics. Wall Street rejoices.
  • Elizabeth Warren, as usual, was right when she warned in 2018 that rolling back the Dodd-Frank Act (enacted to prevent bank failures after the 2008 banking crisis) to loosen regulations and oversight of banks like Silicon Valley Bank and Signature Bank would end in disaster. As she noted at the time, before Donald Trump signed the bill to loosen restrictions on financial institutions: "Washington is about to make it easier for the banks to run up risk, make it easier to put our constituents at risk, make it easier to put American families in danger, just so the C.E.O.s of these banks can get a new corporate jet and add another floor to their new corporate headquarters." As usual, we should have heeded her warning.
  • Today we explain exactly happened that resulted in the failure and subsequent federal takeover of SVB and Signature by the FDIC, in case it hasn't yet been made clear. And, while the unnecessary failures stem directly from loosening government oversight and restrictions on banks to gamble with depositer funds, as allowed by Congress and Trump in 2018, what didn't cause it, is "wokeness." That's the explanation from Fox "News" over the past few days for what happened.
  • The cause of the bank failures was also not ESG (Environmental Social Governance) or DEI (Diversity, Equity and Inclusion, as Fox itself boasts about on its own company's website) or CRT or LGBTQ or anything else that Fox and Ron DeSantis are lying about to Americans about.
  • But what does appear to be true, when it comes to the latest Fox/DeSantis boogeyman of "woke", is that Americans have no problem with being "informed, educated on, and aware of social injustice," the definition of "woke" according to most Americans in a new USA Today/Ipsos poll. The same survey also finds Americans overwhelmingly (75% to 21%) in opposition of book banning by state's such as DeSantis' Florida.
  • 81-year old Republican minority Senate Leader Mitch McConnell has now been released from the hospital after suffering a concussion from a fall last week. But he has checked into inpatient rehab for some reason. We truly hope he will be okay, if only because he may now be the only thing still holding together Congressional GOP support for Ukraine in its war against imperialistic invading Russia.
  • As we learned on Monday night via Tucker Carlson on Fox, DeSantis is now against supporting Ukraine in what he now describes as a "territorial dispute" with Russia, the authoritarian-led nation that has invaded it. As it turns out, DeSantis, while a member of Congress, was strongly in favor of the U.S. supporting Ukraine with lethal aide against Putin. That was before he became a contender for the 2024 GOP Presidential nomination and decided to be against it. The survival of democracy in Europe is, apparently, no longer important for either of the GOP's two 2024 front-runners. Donald Trump has said his "peace plan" is to allow Russia to "take over" parts of Ukraine.
  • But some good news for democracy out of New Mexico, where the state legislature finally passed a voting rights bill on Monday that will expand the franchise to all residents who are now out of prison; strengthen access to the ballot for Native Americans; make Election Day a state holiday; and significantly strengthen the state's automatic voter registration program.
  • Finally, Desi Doyen joins us for our latest Green News Report.
