We're back for today's BradCast after some much-needed down time last week over the holiday when we tried to look the other way for a few minutes. We've got a lot of catching up to do.
Among the stories we try to catch up with today...
The independent Special Counsel appears to be wasting no time. Even on a holiday. Prosecutor Jack Smith, recently tapped by Attorney General Merrick Garland to oversee two Trump-related criminal probes by the Dept. of Justice --- on the January 6th insurrection and the classified documents stolen by the former President upon leaving office --- jumped into the documents case on Thanksgiving Day. While we were eating turkey, Smith was filing a one paragraph argument with the 11th Circuit Court of Appeals calling out Trump's attorneys for lying during a hearing earlier in the week. That hearing didn't go well for Team Trump, despite being heard by two Trump-appointed federal judges and one appointed by George W. Bush. Smith did not make things any better for them. We explain.
Two Trump-backed candidates in Alaska were each declared losers in the U.S. House [PDF] and U.S. Senate [PDF] races last week after weeks of counting in the state's Ranked Choice Voting midterm elections. Democrat Mary Peltolawill fill the seat in the U.S. House previously held by the late Rep. Don Young, a Republican who occupied the state's only House seat for nearly 50 years. She defeated the failed former President's choice, the state's failed former Governor and Vice Presidential candidate Sarah Palin, as well as two other candidates. And, moderate Republican Sen. Lisa Murkowski, who voted to remove Trump from office during his second impeachment trial last year, was declared to have defeated Trump-endorsed GOP challenger Kelly Tshibaka. Dems will hold a narrow majority in the Senate next year no matter how the U.S. Senate runoff in Georgia between Sen. Raphael Warnock (D) and Trump-endorsed Herschel Walker (R) works out next Tuesday. But, if yet another candidate supported by the disgraced former President crashes and burns next week too, the extra seat in the upper chamber could make a huge difference for Democrats.
Meanwhile, in Arizona, former TV news anchor and Trumpette, Kari Lake, is still pretending that she must have won the Governor's election. All of the available evidence suggests Democratic Sec. of State Katie Hobbs was the winner, albeit by less than one percent. The narrow margin, however, is just a bit higher than the trigger for a statewide recount. So, Lake is now suing the Republicans who run Maricopa County (Phoenix), on the basis that the County's print-on-demand ballot system prevented voters from voting. It didn't. Though some GOP voters reportedly chose not to cast their ballots after being told the precinct-based scanners couldn't read the hand-marked paper ballots printed at a number of the County's voting centers. Those ballots were placed into a locked box and scanned back at County HQ. On Monday, the County certified their results, and the usual parade of deplorables issued threats to the officials for doing so. The state is scheduled to certify results next week, which will be followed by a recount in the incredibly tight Attorney General contest. It is currently led by Democratic candidate Kris Mayes over Trump-endorsed Abe Hamadeh who trails by just 510 votes out of more than 2.5 million cast in the state's November midterms.
Meanwhile, the world's largest volcano, Mauna Loa, is erupting again in Hawaii...for the first time in nearly 40 years.

Like it or not, we're back on today's BradCast after a much-needed week off! And, as it turns out, we've got plenty to talk about. [Audio link to full show is posted below this summary.]
Among the huge number of stories covered on today's show, as we try to get caught up with both what we missed and what's still unraveling today...
It's hot here in Los Angeles. Really hot. A record heat wave (in both intensity and duration) now stretches from Southern California all the way up into Canada. And, no, it is not normal. (Or at least it didn't used to be.)
It's also not normal for Mississippi's capital city of Jackson to have no water for drinking, bathing, flushing or even fighting fires. But it was predictable. That's what happens when you lower taxes and defer maintenance on critical infrastructure for decades before a warming climate dumps tons of rain to knock your water systems offline entirely. Now the state's Republican Governor (who has been instrumental in deferring that maintenance), is discussing privatizing the water system. As of Sunday, in any event, water pressure is finally returning to residents after a full week without, and about a month of boil water notices prior to the outage.
Some good news following Labor Day: Public approval of labor unions, at 71% of the American people, is now the highest it has been since 1965, according to Gallup. That's a 7-point spike in their pre-Labor Day survey since the pandemic began and a more than 21-point jump since 2009. And, as we discuss, that's all good news for both union workers and non-union workers alike!
A judge in New Mexico has ordered Cuoy Griffin, co-founder of Cowboys for Trump and an elected Otero County Commissioner, immediately removed from his post for violation of the U.S. Constitution's "Insurrectionist Disqualification Clause". Griffin, who was convicted of participating in Trump's January 6, 2021 insurrection at the U.S. Capitol, is the first public official to be removed from office since 1869 under Section 3 of the 14th Amendment.
There is new evidence out of Coffee County, Georgia today --- including security camera surveillance video gathered via a federal lawsuit against Sec. of State Brad Raffensperger to block use of his unverifiable touchscreen voting systems --- revealing that rightwing MAGA Trump supporters lied about unlawfully breaching and making copies of the County's voting system software after the 2020 election. The long-running lawsuit was filed by Coalition for Good Governance founder Marilyn Marks, a regular guest on this program. She originally broke the Coffee County voting system software breach story on this show some months ago, along with detailing Raffensperger's clumsy, months-long efforts to cover-up of the entire boondoggle. More details on that story coming soon!
In the second-to-last primary day of the midterm election season, voters in Massachusetts are selecting party nominees for the contest to succeed the state's popular, outgoing Republican Governor in the otherwise liberal-leaning state. As in Maryland in July, the choice on the GOP side in MA is between a Trump-backed election denier and an otherwise normal-ish Republican candidate. In MD, the Trump-backed loon won, likely handing Governor's mansion to the Democrats this fall. Will the same thing happen in MA? Tune in tomorrow!
While we were out, Alaska's embarrassing former Republican Governor Sarah Palin, did not win the Special Election for the state's only U.S. House seat. After a Ranked Choice Voting election featuring two Republicans and one Democrat, the Democrat, Mary Peltola was elected to fill the seat occupied for nearly 50 years by the late Republican Rep. Don Young. She'll serve the rest of Young's term through the end of the year and becomes the first Alaska Native elected to Congress. The same three candidates, and one other, will square off in another RCV election in November for a full term beginning in January. Hopefully Palin will continue her losing streak.
Also, while we were out, the President of the United States found it necessary to offer a prime-time address to warn of the rising menace posed to democracy itself by Donald Trump and his supporters. Joe Biden was, of course, both correct and accurate in his remarks outside of Independence Hall in Philadelphia, highlighting the fact that democracy itself will be on the ballot this fall and the threat that demagogues from the right now pose to our nation. "What’s happening in our country today is not normal," he said, though corporate media outlets seemed to have a tremendously difficult time simply pointing out how Biden's assertions were demonstrably true. By way of just one example, after a Trump rally in Pennsylvania over the weekend, in which an invited speaker discussed support for January 6 insurrectionists, including her nephew, who is literally a Hitler fan, USA Today's Francesca Chambersactually said: "President Biden and former President Trump are having some difficulties when it comes to optical issues both could have avoided." (!!!)
Finally today, some thoughts on the Trump-appointed federal judge in Florida who, on Monday, issued an absurd ruling ordering a Special Master to review thousands of pages of highly classified and other stolen government documents obtained by the FBI during its federal court-ordered search of Donald Trump's home at Mar-a-Lago last month. The ruling by Judge Aileen Cannon --- to appoint a Special Master to examine the documents for both executive privilege (which hasn't been claimed by Trump, and can only be asserted by Biden) and for attorney-client privilege --- was ridiculous and absurd on several counts and yet still somewhat less of an outrage than many have characterized it to be over the past 24 hours. We explain why.

On today's BradCast: What you need to know about the stolen national security documents retrieved by the FBI at Mar-a-Lago and the trouble Trump is in. And, about the known results of the strange-world-we-now-live-in primaries and special elections yesterday. [Audio link to full show is posted below this summary.]
First up, those elections, as based on incomplete and/or unverified results in both states.
The biggest story of last night, of course, was conservative Republican Rep. Liz Cheney's loss to a Trump-backed GOP primary challenger in Wyoming for the state's single, at-large House seat. As expected, Cheney lost bigly to former Never Trumper turned MAGA 2020 election denier Harriet Hageman. What does it all mean going forward for Republicans who wrongly hate Cheney and Democrats who wrongly love her and for the Republican Party itself? Cheney offered some hints, as we discuss, in her graceful concession speech on Tuesday night, promising once again that she "will do whatever it takes to ensure that Donald Trump is never again anywhere near the Oval Office."
Then, incomplete results from Alaska, where it has always taken a long time to tally them and will take even longer following election reform adopted by state voters in 2020. They now have an open primary system, where the top four vote-getters go on to general elections which become Ranked Choice Voting (RCV) contests among those candidates.
Like Wyoming, Alaska has just one at-large U.S. House district. But there were two elections for it on Tuesday following the death, earlier this year, of Republican Rep. Don Young. He held the seat for 49 years. One was a Special Election to fill the remainder of Young's term through the end of the year, the other was an open primary for a full term beginning in January.
On the Special, Democratic candidate Mary Peltola currently leads Republicans Sarah Palin (yes, that Sarah Palin) and Nick Begich with about 70% of votes tallied as of airtime. However, because it's an RCV election --- in which none of the candidates received more than 50% of first choice votes --- once the first round of counting is complete, the candidate in last place will be removed and their voters' second place choices will be redistributed to the other two candidates. The entire race is then tallied again. We are unlikely to know the final winner until the end of August, but if Peltola wins, she'd be the first Alaskan native to be elected to Congress.
In the open primary for the full House term beginning next year --- featuring nearly 30 candidates --- it appears that all three of the candidates in the Special will also advance to November's general election. The fourth candidate in that contest has yet to be determined as counting continues. In the state's U.S. Senate race, Republican Lisa Murkowski --- who, like Liz Cheney, voted against Trump in his second impeachment --- will advance to the November general, where she will face Trump-backed Kelly Tshibaka and two other candidates still to be determined, with just over 70% tallied.
Then, longtime, really smart, independent national security journalist MARCY WHEELER of Emptywheel returns to the show for the first time since the FBI's seizure of highly sensitive and classified national security documents at Mar-a-Lago last week, as stolen from the White House by Donald Trump upon leaving office last year.
As usual, we have a lot to cover with Wheeler, who was busy explaining on Twitter last week before anyone else that we know of --- before the unsealing of the FBI's search warrant detailing "probable cause" of three federal statutes violated by Trump --- that the Dept. of Justice was almost certainly investigating the former President for violations of the Espionage Act. As usual, after the warrant was unsealed, she was proven correct.
Also as usual when Marcy's on, you'll need to tune in for the full story. There is simply no way I can detail all of the critical insight and helpful information she has to offer here. But, among the points she helps clarify and explain along with key context from her years of covering similar cases dealing with the Espionage Act, obstruction of justice and the theft of government documents...
What each of the three U.S. Criminal Code statutes cited in the warrant means, and the evidence that Trump appears to have blatantly violated each of them.
Were there, or were there not, documents including nuclear records found and/or sought in the search, as reported by Washington Post before the warrant and inventory list of retrieved items was unsealed.
Are documents sought by the National Archives and DoJ still missing after the search? And/or have they been mutilated or destroyed in violation of federal statutes?
Despite a signed declaration by one of Trump's attorneys that all of the highly classified documents and other material stolen from the White House had been returned to the government as of June, in fact, that was proven untrue. Who is the insider that tipped off the DoJ?
Wheeler argues that Trump is likely far more concerned about obstruction charges than even violations of the Espionage Act. Why? "We know that some of the documents that were responsive to subpoenas regarded January 6," she tells me, before suggesting reason to believe that some of the documents Trump was trying to withhold might be related to other crimes of his from farther in the past, such as: obstruction of justice in the Robert Mueller/Russia investigation; his attempt to bribe the Ukrainian President ("We know that the White House counsel didn't provide Congress the fullest version of the 'Perfect Transcript' of the Trump call with Volodymyr Zelenskyy. So that's an example of concealing a document that should have been released."); or the transcript regarding the classified Israeli intelligence that Trump gave to the Russian ambassador during an Oval Office meeting ("the documents got altered and disappeared.")
She has much more, including this fresh tidbit regarding obstruction: "There was a leak by one of the rightwing journalists [covering this story] that said, 'People close to Donald say he doesn't have to give [certain documents] over because the Archives will just give it to the January 6 Committee.' I'm like, 'That's a confession of obstruction! He just literally confessed to the elements of the offense for obstruction!' And honestly, Brad, this is something that virtually everyone is missing --- this is the one that Trump is terrified of."
There are many details we still don't not know and more disturbing revelations to come. As Wheeler notes several times, this all likely to get much much worse for Trump. But, she emphasizes, just based on what we already know it's already really really bad for him.
"Every half hour or so," she says, "this flash goes through my brain, and I go, 'Oh my God, Donnie has really, really screwed himself .' There are ways that I can imagine this snowballing that people aren't even grasping at this point. And that is all separate from the question of whether he's taken the nuclear codes and given it to [Saudi Crown Prince] Mohammed bin Salman. You don't really need to get ahead of the game here to figure out things are pretty bad."

On Day 2 of public hearings in the U.S. House, Donald Trump's greatest con continues to unravel. On today's BradCast, we get you all caught up on today's public hearings by the bipartisan U.S. House Select Committee investigating the January 6, 2021 attack on the U.S. Capitol and the attempt by the former President to steal the 2020 election by defrauding the nation. [Audio link to full show follows this summary.]
The witnesses who testified live today, as our guest HEATHER DIGBY PARTON of Salon and Hullabaloo pointed out, were all Republicans. And they all made clear that Trump not only lost the 2020 election, but he lied over and again about fraud, even though he was told...over and again, by his closest campaign advisers, top government officials and even his own family, that he lost fair and square. He knew his claims were, as his own Attorney General Bill Barr described it, "bullshit". Nonetheless, he kept barraging his supporters via email for more and more money for his "Official Election Defense Fund". But, as the Committee's Rep. Zoe Lofgren (D-CA) pointed out: There was no "Official Election Defense Fund" and the $250 million in small dollar donations Trump raked in all went to him, not to legal challenges of the 2020 election.
Once again, a mix of live and videotaped witness testimony put the lie to Trump's Big Lie fraud claims and the false notion that he believed them to be true. He didn't. He knew better. He just didn't care. Live witnesses today who underscored those points: Chris Stirewalt, the former Fox "News" political director who made the correct Election Night call that Trump had lost Arizona; BJay Pak, Trump's own U.S. Attorney in Georgia who investigated all of the many claims by Trump supporters of fraud in Atlanta, finding none of them to be true. He was forced to resign thereafter; Trump's own 2020 Campaign Manager, Bill Stepien, was scheduled to testify, but his wife suddenly went into labor on Monday morning, so the Committee relied on his video taped testimony in which he explained that he repeatedly told Trump that his claims of fraud were bogus; Philadelphia's Republican City Commissioner Al Schmidt who debunked Rudy Giuliani's false testimony to the PA legislature that more than 8,000 "dead people" voted in the state in 2020. "Not only was there not evidence of 8,000 dead voters voting in Pennsylvania," Schmidt testified, "there wasn't evidence of 8."
The most damning testimony may have come from Trump's former Attorney General Bill Barr, who said on tape that he and the DoJ tracked down every claim made by Trump and his supporters and found none of them to be true. "Boy, if he really believes this stuff," Barr testified thinking, "he's become detached from reality." No matter how "crazy" he told Trump the allegations were, it made no difference. Barr debunked the notion that the Dominion Voting systems company stole the election for Joe Biden, and even went on to dismantle the easily-debunked 2000 Mules movie which pretends to document tens of thousands of fraudulent ballots cast unlawfully by thousands of people in swing-states. Barr's debunking of that film, which he laughs out loud about, was suspiciously similar to our own debunking on this program several weeks ago.
Even longtime, top GOP election attorney Ben Ginsberg --- who successfully lead the RNC's fight to convince the U.S. Supreme Court to steal the 2000 election for George W. Bush --- testified live on Monday that there was "no credible evidence of fraud produced by the Trump campaign or his supporters." He also made clear that dozens of lawsuits rejected by the courts (including by many Trump-appointed judges) did, in fact, examine the merits of the challenges and found no basis for them.
"I think what is important, and I was really glad to see, that they decided to take one of these hearings and really attack the Big Lie itself," Parton tells us today. "Because I don't think you can really prove the case about Trump's coup plot without attacking that as well. They went from the very beginning. Trump was undermining the election 18 months before the election took place."
Parton also praised the panel's highlighting of Trump's "'willful blindness,' in which he is shown to have been told by everyone that the election was not stolen. We're talking about his own campaign team, people in his family, the Dept. of Justice, various officials around the country. They all said the same thing. Ginsberg pointed out the courts also said the same thing. [Trump] refused to see it, and in fact continuously got more and more angry, apparently, continually ignored what they said, and went toward the people who told him what he wanted to hear."
"That's actually a legal concept, where someone does have an obligation --- they have a responsibility to at least have some recognition of the facts of a case. You're not allowed to go into a court and say, 'I didn't know,' when you've had dozens of people telling you something. So that's leads to maybe a potential criminal referral."
She also explained how she was "shocked" by the Big Lie fund-raising scam. "We all sort of knew this but it hadn't really been a focus until now," she observed. "But I think this is super-important, because this could go toward a real fraud investigation, a real case of wire fraud, where they defrauded millions of devoted followers with a Big Lie. And, in fact, a lot of the people who were involved in that fundraising, they also knew it was a Big Lie because they just testified to it. This is kind of a big deal."

Before we get there today, however, a bit more on the grim news coming out of Ukraine this week, as independently documented evidence of horrific war crimes by Russia continues to mount. On Tuesday, President Volodymyr Zelenskyyaddressed the U.N. Security Council from Ukraine and charged that if the U.N. is unable to remove Russia's veto, as a permanent member of the Council, then they might as well dissolve it entirely. He has a point.
Then, before we get to Sarah and Santa...The news that shouldn't be news at all. Three Republican Senators have now announced they intend to vote in favor of Joe Biden's nominee, Judge Ketanji Brown Jackson, perhaps the most qualified jurist every nominated to the U.S. Supreme Court. On Monday night, Utah's Mitt Romney and Alaska's Lisa Murkowski declared they will support Brown's confirmation, joining Maine's Susan Collins who did so last week. None of that should be news at all, but in the Republicans' twisted, hyper-partisanized world, voting for a SCOTUS nominee tapped by a Democratic President apparently it is. During Monday's Senate Judiciary Committee hearing, South Carolina's Lindsey Graham (who voted for Jackson's appointment to a federal Appeals Court seat just last year, but refuses to vote for her this year) said the quiet part out loud when he declared that if Republicans win back the Senate in November, none of Biden's nominees are likely to be seated to the federal bench.
In other insane GOP Congressional news, Michigan Rep. Fred Uptonannounced today that he will not seek re-election. He is the fourth of 10 Republican House members who voted in favor of Donald Trump's second impeachment (for inciting the January 6th insurrection) to retire instead of run for re-election.
Meanwhile, way up north in Alaska, more than 40 candidates are now running in the upcoming June Special Election to fill the state's one U.S. House seat, which had been held for 49(!) years by Don Young, the 88-year old Republican Congressman who died suddenly last month.
Donald Trump has chosen his favorite candidate in the race, the one my guest today describes alternately as "The Quitter" and the "former half-term Governor", Sarah Palin. The failed 2008 Vice Presidential candidate is emerging from Alaskan and rightwing media obscurity in hopes of finding relevance again in the far-right wingnut world she helped create during her 2008 run, just before quitting politics halfway through her first term as Alaska's Governor. Palin signed up to run for the Special Election and regular general election primaries --- both to be held on June 11th --- on the final day to qualify, last Friday on April Fools Day. (Seriously.)
We're joined today by one of the nation's foremost Palinologists, JEANNE DEVON, who made a name for herself as "AK Muckraker", helping to introduce Palin to the world in 2008 at her award-winning The Mudflats blog. She has since gone on to co-write a NYTimes best seller, Blind Allegiance to Sarah Palin - A Memoir of Our Tumultuous Years, and served as Press Secretary for Alaska's state Senate Democrats and as Communications Director for the state's Democratic Party. (She is currently working with FX to develop a television series based on her book, The Blood of Patriots, which she co-wrote will Bill Fulton about the Alaska militia movement.)
Before we get to Palin and the potentially insane way that Alaska is about to run its Special Election, Devon offers some thoughts on the decades long legacy of the late Don Young who, though "he didn't have that much power anymore" after being stripped of Congressional committee assignments due to "blatant corruption," was still "an institution, and Alaskans like their institutions."
While some in the media have been regarding Palin as the front-runner to fill Young's seat, Devon seems less convinced. "Palin's approval rating and likeability has been underwater since she quit [in 2009.] She is not a popular figure in the state anymore." Devon cites a comment she saw at today one of the "hardcore fringey rightwing" Facebook groups she sometimes drops in on, suggesting those folks do not appear to be fans. "Very hard pass," she reports one commenter as writing, adding "she quit once when the going got tough. And in my mind that defines her entire political career."
A lack of popularity is not all Palin will have to contend with. There are more than 40 candidates running in both the Special and regular primaries, which will be held on the same day. Palin has signed up for both. But in addition to several progressive candidates Devon cites, with impressive resumes and following, she seems most excited about one candidate on the ballot with at least as much "name recognition" as Palin: Santa Claus!
Yes, Claus is "actually a member of the North Pole City Council" and "literally on the ballot". He represents what Devon describes as "one of the most conservative towns in Alaska" and "he is a democratic socialist --- of course --- because he's Santa!"
Devon notes, however, that "Santa Claus has also said he will not run for the next full term. He will just run to finish the end of Don Young's term. Because we are now faced with two elections."
As to those two elections, they will be run under a new scheme in the state. For the first time, anybody who wants to run for office can simply sign up to run, no petition gathering necessary. (Thus, the 40+ candidates!) The top four vote-getters in the primary will then go on to the general election, which will use Ranked Choice Voting (RCV) --- a confusing and difficult to both count and oversee method of voting, allowing voters to rank their choices for the office. (As I explain to Devon, when and if Alaska tires of RCV, as many jurisdictions do after using it, when they discover that neither voters nor candidates understand it, they may wish to look into the simpler Approval Voting method, allowing voters to choose Yes or No for all candidates on the ballot. Easier to understand, to count and to oversee, since computers and centralized counting aren't needed for the complicated math and many rounds of tallying necessary under RCV.)
Of course, Devon has much more insight on what is likely to be a fascinating and/or hilarious race, with both Palin and Clause on the ballot. Additionally, there are six Democrats on the Special Election ballot. Among them, she cites "Christopher Constant, who was the first openly gay person to be elected to the Anchorage Assembly --- and remember, Anchorage is half the population of the state. Then there is Mary Peltola, who long ago served 12 years in the legislature. She's an amazing Native leader who is also an expert in fisheries, which is important up here. And there's a sitting legislator from Fairbanks named Adam Wool. So all of these are Democrats who could certainly fill that slot."
She also has some thoughts to share on Sen. Murkowski, who is up for re-election this year as a Republican --- after voting to remove Trump from office in his second impeachment and declaring her support for Ketanji Brown Jackson this week. Will that doom her chances of re-election? Tune in to find out what Devon has to say about that race --- which will also be run as a top-four primary contest with an RCV general, in a state which has a history of plenty of election and tabulation controversy in recent years.

Today on The BradCast, we tackle another small, totally easy to solve issue: Untangling the worldwide supply chain debacle. [Audio link to full show follows this summary.]
But, before that, at least a few stories seem to be resolving themselves today...
Nine families of victims of the 2012 Sandy Hook Elementary School massacresettled their lawsuit with Remington, the manufacturer and marketer of the semi-automatic rifle used to kill their family members, for $73 million. The deal is noteworthy because federal law bans such suits against the gun industry, but Connecticut law does not. In this case, the U.S. Supreme Court rejected Remington's attempt to block the suit based on the protections in federal law.
Prince Andrewsettled a lawsuit filed against him by a woman who says she was 17-years old when she was sexually abused by Andrew, as coerced by the late financier and child sex trafficker Jeffrey Epstein. The settlement includes an undisclosed donation to the charity of the victim, Virginia Giuffre, and an acknowledgement by Andrew that she has suffered abuse as a victim It is unknown if Giuffre will personally receive any money as part of the agreement.
Both a jury and a judge helped settle former Alaska Governor Sarah Palin's defamation lawsuit against the New York Times by rejecting it in no uncertain terms. On Tuesday, the jury in the civil trial brought by Palin found the Times' editorial board not guilty of libeling the former GOP Vice Presidential nominee. The paper had erroneously cited a "clear link" between a map published by a Palin campaign websites featuring a gun site on certain Congressional districts --- including then Democratic Rep. Gabby Giffords' --- and the 2013 mass shooting in Tuscon that killed six people and critically injured the Congresswoman. The jury's rejection of Palin's suit came the day after the judge, as the jury was still deliberating, declared that he planned to dismiss the case anyway after finding that Palin failed to prove the paper acted maliciously against her. For its part, the Times described the verdict as "reaffirmation of a fundamental tenet of American law: public figures should not be permitted to use libel suits to punish or intimidate news organizations that make, acknowledge and swiftly correct unintentional errors."
And, in the weeks-long Russian/Ukraine military stand-off, there was a long-awaited easing of tensions as President Putin announced that Russia was ready for talks with the U.S. and NATO on a number of issues and that some Russian forces on the border with Ukraine would be withdrawing. President Biden, however, in remarks this afternoon at the White House, said the U.S. had "not yet verified" any troop withdraws and that a Russian invasion of Ukraine remained a possibility. The White House noted, however, that the U.S. remains opens to high-level diplomacy in hopes of avoiding military conflict in Europe.
On that news, Wall Street rallied after weeks of saber-rattling had weighed down the market and helped send oil and gas prices through the roof, serving as another reminder today of just one more way that our vulnerable supply chain can wreak havoc on an otherwise booming economy.
We're joined today by The Prospect's Executive Editor and author David Dayen to help us untangle the mess that has been made over the past 40 or 50 years, under both political parties in this rare case, of a supply chain that has exposed its vulnerabilities with the onset of the COVID pandemic two years ago. But since then, it has continued to reveal its ill-designed brittleness and the very serious threat it poses to America's economic security.
Dayen walks us through how his Special Issue delves into the broad failures of the supply chain, largely put in place over the years by the Wall Street "free market" to maximize corporate profit at the expense of American jobs and national security...in exchange for cheap prices on goods! As Dayen details, the problems here are not one single failure across the chain, but as he breaks down, "multiple 'single points of failure'" across industry after industry all along the broken chain.
"We designed a system over the course of decades --- both parties --- that had lean inventories, that relied on offshore production, that relied on this concept of globalization," he explains. "That allowed the production facilities to become very concentrated. That allowed the spokes within the system to become concentrated. That deregulated everything to try to lower prices on shipping and transportation. And that allowed Wall Street to take the primary role in governing these efforts --- in other words, telling corporations 'Yes, you have to move your production offshore for cheap labor', and 'We have to deregulate these industries so that costs stay low,' and 'You have to have just-in-time production so that you don't have any inventory sitting around just wasting money, and we're spending too much money on warehouses.'"
With this precarious, profit-driven system in place, Dayen steps through The Prospect's full team coverage of how a virus breaking out in a manufacturing hub in China can shut down the entire system. Any sudden increase in a demand for goods --- say, during a pandemic --- ends up tying the giant, oligopolized over-seas container shipping system into knots and stranding massive cargo ships at sea while there is no room left for off-loading at U.S. ports. Once finally off-loaded, sometimes after months waiting in line off-shore, a U.S. rail system run by just a couple of companies and a trucking system that doesn't pay workers nearly enough for their efforts further bottlenecks the process. Then there's the vast lack of warehouse space for all those goods if they can ever get to where they need to be. All the while, these disruptions and failures work to the benefit of the largest distributors --- like Amazon and Walmart --- while cutting the knees out from under independent retailers and raising prices for everyone. So much for those low prices that consumers, at least, were supposed to get out of the deal.
But, as Dayen also explains, it doesn't take a pandemic. A cross-border bridge protest in Canada, saber-rattling in Eastern Europe or the Middle East and, perhaps even more crippling to the supply chain over the past year than anything else, climate change related disasters which promise to only get much more frequent and severe in the years ahead.
"The problem is the supply chain is run on these knife-edge principles that make it impossible for it to adjust to a shift up in demand. That is the entire problem," he argues. "So people who go on and say, 'No, this isn't a problem, it's just this shift. Everything will be fine.' They're missing the point. The point is that this lack of adjustment reflects problems with how the system is engineered."
And, yes, Dayen has advice on how to re-engineer the entire system. The good news, he also explains, is that both corporations and members of Congress --- from BOTH parties --- seem to finally be getting it. They are looking at and passing bills that encourage (and spend money on) the regionalization and onshoring of manufacturing back here in the U.S., and the Biden administration is investing heavily --- when Congress allows them --- into a number of long-overdue fixes.
It may all sound dry on paper, but it's actually a fascinating and very lively conversation on today's program that I hope you'll tune in for.

There are two stories, one major, the other one only "major" thanks to rightwing media fueling it, that I've wanted to cover more on The BradCast of late, but haven't. Why? Because, in both cases, both stories make little sense to me and the so-called "experts" or pundits out there seem to be ideological, for or against, in one way or another that fails to offer much clarity or insight to either story. [Audio link to full show is posted below this summary.]
So, I figure, if the so-called pundits and experts don't know much and are doing little more than offering their opinions and best-guesses, our callers couldn't do much worse, right? Fact-check: True! Callers came through today with shining colors!
The first story is the dumb Canadian trucker protests over vaccine mandates. As you know, they are attempting to shut down U.S.-Canadian trade across transcontinental bridges in hopes of forcing the government to meet their demands. They have been succeeding at harming the economy in both countries, at least until this weekend when Canadian police finally cleared the crossing at the Ambassador Bridge between Windsor, Ontario and Detroit. That closure threatened some $360 million a day in two-way cargo across the bridge or about 25% of the U.S.-Canada goods trade, according to Reuters.
The otherwise unpopular demonstrations in Canada are being fueled with money from the U.S. and round-the-clock coverage on wingnut cable TV. And, in addition to shutting off trade (leading some automakers to have to shut down some production), the demonstrations have included Trump, Nazi and Confederate flags, as well as protesters urinating on a Canadian war memorial. At a crossing into Montana from Coutts, Alberta, the Royal Canadian Mounted Police say they arrested 11 people blockading the border after learning of a cache of guns and ammunition, including long guns, handguns, body armor, and a lot of ammo and high-capacity magazines.
Can you imagine Fox "News" supporting an actual civil rights protests in this country that included weapons, Nazi flags and urinating on war memorials? But, of course, the dumb protests in Canada have little to do with actual civil rights --- even as I strongly support the right for anybody to protest whatever they want, even dumb stuff like opposition to life-saving vaccine mandates.
The far more dangerous story, obviously, continues in Russia and Ukraine, where the former has now reportedly deployed as many as 130,000 troops on three sides of the latter and where, according to the weeks long insistence from the U.S., an invasion is now as "imminent" as this Wednesday. The U.S. --- and NATO and the EU --- have been warning of an "imminent" attack for weeks now, and one may be. But Russia continues to deny any plans for an attack on the former Soviet state and nobody seems to have any more than best guesses about what the truth is and what will actually happen next.
Perhaps a better question is why is the U.S. so loudly broadcasting what they see as Russia's "imminent" plans to invade --- now said to be as early as this Wednesday. Is it because Russia really is going to invade? Or is there another reason?
We discuss all of that and much more with some terrific callers today --- including one who says he used to work for in Russ for a vodka millionaire, and another who explains that she had been working recently on a construction project at the border crossing into British Columbia from Washington State.
Then, as usual, there are the always-fun callers who completely disagree with me on everything (particularly on life-saving COVID vaccines), and I always enjoy those calls the most! I'll hope you do too!...

The weekend brought us another avalanche of news in the Trump Era. As usual, we try to catch up by focusing on the stories that actually matter. But, even at that, we couldn't get to half of what we'd planned for today BradCast. But we did have time for a bunch of great callers. [Audio link to show is posted below.]
Among the many stories we cover today that they were calling in to comment on...
A federal judge has restored a nationwide injunction to block the Trump Administration's likely-unlawful new policy that bars asylum to migrants who travels to the U.S. through another country before entering the U.S.;
Former GOP Governor and Congressman Mark Sanford of South Carolina becomes the third major Republican candidate to announce his intention of running against Donald Trump for the party's 2020 Presidential nomination, after previously describing Trumpism as "a cancerous growth" and charging the Republican Party has "lost our way". His long-shot bid, joining former MA Gov. Bill Weld and former IL Rep. Joe Walsh, will be made all the more difficult now that the Republican Party in South Carolina, along with those in Nevada, Kansas and Arizona, have cancelled the GOP caucuses and primaries in those states for 2020 at the behest of our thin-skinned, cowardly, unfit President;
Next door in North Carolina, it now appears to be full-speed ahead for Tuesday's two U.S. House Special Elections which were imperiled for a time by Hurricane Dorian. While the storm resulted in some cancelled Early Voting days last week, most of those hours were made up with extended hours over the weekend, leaving Democrats with a larger share of the early vote in the 9th Congressional District than they even had during early voting in last November's "Blue Wave" election. The Republican candidate reportedly "won" that race by about 900 votes in a district held by Republicans since the 1960s. But the election was never certified after revelations of a massive GOP Absentee Ballot Election Fraud scheme. Both Donald Trump and Vice President Mike Pence are in the 9th district on Monday night, with two separate rallies, for far-right GOP State Senator Dan Bishop in the do-over race against centrist Democrat Dan McCready. The contest is currently being characterized as a toss-up and is being regarded as a bellwether for the 2020 elections. The other race, in NC's 3rd Congressional District is to fill the seat of the late Republican Rep. Walter Jones in an even more "red", if Hurricane Dorian-battered, district on the state's coast;
And in D.C. today, Trump declared that year-long peace talks with Taliban officials and the Afghan government are now "dead". That, after Trump revealed his cancellation of a secret meeting that had been set with Taliban officials this week at Camp David --- on the week when the nation commemorates the 18th anniversary of 9/11 while the nation's longest war (in response to it) continues on with no end in sight despite campaign promises from Trump to end it;
We also briefly reference the plan announced today by Democrats on the U.S. House Judiciary Committee to hold a formal vote this week to officially begin their impeachment inquiry of Donald J. Trump before opening up our lines to callers on all of the above and more.
Among the additional topics on listeners minds today: The Democratic Presidential primary and the likely-disastrous move by Los Angeles County to replace its hand-marked paper ballot voting system with an ill-considered and 100% unverifiable touchscreen voting system (pictured above) before the 2020 Presidential elections. The new system (pictured above) was developed by its brainchild, L.A. County Registrar-Recorder/County Clerk Dean Logan, who now refuses to appear on the show or answer our questions about the new, still uncertified system, as he used to. He calls it Voting Solutions for All People or VSAP. As one caller notes, the new system is shamefully being supported by the L.A. County Board of Supervisors. One of them, longtime Democratic Supervisor Janice Hahn, has been (mis)representing the new system as an "exciting" "upgrade" from the previous system, despite the fact that the computer-marked "paper ballot" summaries the new system produces can never be known to reflect any voter's intent after an election in the nation's most populous voting jurisdiction. Similarly unverifiable touchscreen systems are being implemented in Pennsylvania, Georgia, Texas and other key states before the 2020 election, despite warnings against electronic Ballot Marking Devices from world-class cybersecurity and voting systems experts...

On today's BradCast: A new petition effort to rename the block of Fifth Avenue in New York City where the Trump Tower is located after President Barack Obama has now gained nearly half a million signatures. It began as a joke, according to its author, but quickly caught on. While it's a brilliant, if unlikely idea, other, somewhat more important petition efforts --- with actual legal standing --- have recently caught fire over the past week or so as well. And the consequences of those efforts could be far reaching. [Audio link to today's show is posted below.]
First, in the battleground state of Georgia, where the Secretary of State has just selected an all new 100% unverifiable touchscreen ballot marking device (BMD) voting system for the state, which voters will be forced to use at polling places in 2020, was certified just a week or so ago in violation of the state's elections code, according to election integrity experts and opponents of Republican SoS Brad Raffensberger's $150 million new system made by Dominion Voting Systems of Canada.
Raffensberger's decision comes as a federal judge in Atlanta, just last week, found [PDF] the state's current 100% unverifiable touchscreen voting system to be "unsecure, unreliable, grossly outdated....seriously flawed and vulnerable to failure, breach, contamination and attack". So much so, that the judge also declared the old system be in violation of voters' right to have their votes counted as cast. As we discussed with one of the plaintiffs in detail last week, U.S. District Judge Amy Totenberg ordered the state to use a new, hopefully verifiable system in 2020. But the new system selected by Raffensberger may face a similar fate in federal court, as opponents vow to challenge it as well, while calling for hand-marked paper ballots instead.
In the meantime, however, more than 1,400 state voters, as of air time, have signed a petition demanding a reexamination of the newly selected system, charging that it was improperly certified in violation of the state elections code. Only 10 voters, according to GA state law, are needed to sign the petition to trigger such a second look, far fewer than the number of Georgia residents now demanding it.
And, at the same time, way up north in Alaska, another petition effort is rocking our nation's 49th state. In just two weeks, a multipartisan coalition has gathered more than 29,500 signatures calling for a recall of newly-elected Republican Gov. Mike Dunleavy. That is a thousand more signatures than required by law --- and a lot of signatures in such a short time, in a state with a population of only about three quarters of a million. The petitioners say they will continue to collect signatures through September 2nd. If this first step is successful, as appears likely, a second effort to get about 70,000 signatures will be needed to place the actual recall measure on the ballot.
The unprecedented effort comes as Gov. Dunleavy has attempted to implement radical cuts of some $443 million to the state budget, including $130 million --- or 40% of the state's budget contribution --- to the University of Alaska system. Also slashed was about $30 million for senior benefits, early learning funds and Alaska Legal Services. One of the most objectionable (and likely unlawful) attempted cuts was to the state's court system, a punitive measure in the exact amount of what the state currently spends on abortion services, meant as retaliation by the Republican Governor for the state Supreme Court having upheld a constitutional right in the state to abortion services.
And, all of this comes as Alaska is seeing record high temperatures and wildfires that have ravaged about two and a half million acres in the state this year amid our ongoing climate crisis, and as the President of the United States appears to have made a secret deal with the Governor to okay a controversial mining project on the pristine waters of the Bristol Bay watershed.
We're joined today by our old friend JEANNE DEVON, formerly known as "AKMuckraker" of the great Alaska blog The MudFlats. She now serves as Communications Director for the state Democratic Party and breaks down the details of the political tremors now reverberating in Alaska, including the fact that, while the state Democratic Party supports the petition effort to remove Dunleavy, they are not actually responsible for the effort. It is being brought forward by a coal baron, believe it or not, along with a longtime Republican legislator, the last living signer of Alaska's Constitution (a 95-year old Dem, pictured above), and the state's former independent Governor's Chief of Staff, among others.
The broad coalition, Devon explains, opposes Dunleavy for a host of reasons as the transplant from the "lower 48" does not appear to understand Alaska's values and how Republicans, Democrats and independents don't necessary operate on the same terms they do elsewhere in the country. For example, as we discuss, Alaska --- which has voted for the Republican nominee in every Presidential election since Lyndon Johnson --- is actually a socialist state, in that the fossil fuel companies who operate there are legally obligated by the state to send royalty checks to every man, woman and child each year.
"It's set up that way," Devon explains, because the resources are seen as being "owned communally by everyone in the state. We actually have written in our state constitution that our resources are to be developed 'for the maximum benefit of the people'." The result, she says, is that the people who live in Alaska own their own resources and receive a minimum basic income. Ideas that unleash shouts of "SOCIALISM! COMMUNISM!" by Republicans elsewhere, but not in Alaska for some odd reason, where the state relies, bigly, on those royalties from the fossil fuel industry. Devon notes the payments also serve to "keep 25,000 Alaska families out of poverty every year" and sever as "a huge influx of almost a billion dollars into the local economy."
As to the recall movement, she suggest that not only will petitioners successfully complete the first step, but that they are also likely to gather the 70,000 signatures needed in the second step to see the measure to remove Dunleavy placed on the ballot. "You do have folks that are Republicans, who are industry Republicans, business Republicans, who are conservatives but not ideologues in the way that Gov. Dunleavy is. He is coming from the point of view of really breaking government. And that is where the line is drawn. There is just a sense that he does not love the state, and he doesn't understand the state" as a native of Scranton, Pennsylvania.
In regard Dunleavy's attempt to punish the state Supreme Court, Devon argues "It's unconstitutional on so many levels. It's chilling that you can have a branch of government that not only will do their own calculations about the number of dollars that the state has spent on abortion, but will then line item veto just that amount from the entire court system as punishment. And then announce it, publicly, that this is what they're doing and why." With the help of a cold-hearted GOP operative by the name of Donna Arduin, hired by Dunleavy to slash the budget after similarly devastating cuts she made on behalf of GOP Governors in Kansas, Arizona and Florida, Devon explains that Dunleavy "even cut the money that would have earthquake-proofed children's libraries in schools, so that giant bookshelves won't fall on tiny children" in the earthquake prone state.
In our fascinating discussion today, Devon also explains what is known about the deal recently struck between Dunleavy and Donald Trump --- during a secret meeting at the state's airport in Anchorage --- that resulted in Trump's order to his EPA to reverse an environmental endangerment finding by the Obama Administration's EPA that had finally blocked the long controversial Pebble Mine project. The enormous and controversial planned gold, silver and copper mine, according to scientists, environmentalists and many other opponents in the state, will put the world's largest and most important sockeye salmon habitat in critical danger in and near Bristol Bay, causing what the EPA described previously as "irreversible loss of fish habitat". Devon describes it as"the largest wild sockeye salmon fishery on the planet. It employs almost 20,000 commercial fisherman. It feeds a region of indigenous Alaskans who have been surviving off of these fish for over 10,000 years. It's not only a food staple, but really an entire culture" that will be destroyed if the mine is allowed to be built.

Donald Trump appears to have either never read the U.S. Constitution that he is sworn to protect and defend, or he just doesn't understand it, or he just doesn't care about it, as his new attack on the press being "able to write whatever they want to write" reveals again today. But that may be the least of our problems at the moment --- and on today's BradCast. [Link to full audio posted below.]
After quick updates today on still rising death tolls in the continuing unspeakable disasters following Hurricane Maria in Puerto Rico and the massive, ongoing and deadly wildfires in California, it's back to North Korea, where the U.S. military continues to flex its muscle and threaten the nation in a way that we would neverallow another nation to do off our own shores. With B-1 bombers and F-15 fighters now conducting missile launch drills off both costs of the Korean Peninsula (even North of the Demilitarized zone that divides North and South Korea) and the USS Ronald Reagan steaming its way there, we continue to provide reason and cover for North Korean leader Kim Jong Un to increase his own military arsenal. In the bargain, as a new poll reveals, two-thirds of Americans now feel Trump's rhetoric threatening to "completely destroy" the isolated nation is making the situation worse, not better, between the two countries.
Then, we're joined by progressive Alaska Dispatch News columnistSHANNYN MOORE to explain the gob-smacking scheme --- approved just one hour after Trump's EPA Administrator Scott Pruitt met with a lobbyist from a Canadian mining company, as recently revealed by internal emails --- to re-kindle the possibility of federal approval for Pebble Mine on Alaska's pristine Bristol Bay watershed.
The move toward allowing the mammoth copper and gold mine comes after years of protest by Alaskan natives (like Moore), three years of study by the Obama Administration's EPA (which found the mine could "result in complete loss of fish habitat" in the sensitive spawning ground of more than half of the world's sockeye salmon), risks the loss of some 14,000 jobs, and runs directly counter to last November's statewide ballot initiative in which voters sought overwhelmingly to protect the area from mining interests and irreversible destruction. (You may leave public comment for the EPA here on this, before October 17th.)
We also talk with Moore, who, like many Alaskans, is a hunter and gun-owner, about her most recent column on the terrorist-enabling NRA/GOP's indefensible block of any and all legislative gun safety measures, despite wildly overwhelming support from Americans --- of all parties --- for a wide variety of such reforms in the wake of last week's massacre in Las Vegas...

Today on The BradCast: The national media is still missing the disturbing anti-democratic problem at the center of the Flint, MI lead-poisoning disaster; New, kind of amazing, poll numbers out of Iowa for both Donald Trump and Bernie Sanders; The GOP establishment continues to warm up to Trump...and much more.
First up, we're joined by Connor Coyne, Flint resident, father and novelist, to discuss his detailed article at Vox on "what the national media got wrong" in their coverage of the city's disastrous and continuing water crisis.
Coyne, who is a stay-at-home dad, says that while his two young daughters appear to be fine at the moment, "Nothing is definitive. And, in a way, that is part of what makes this such a scary experience for all of us. We don't know now, and really will not know for quite some time, how extensive the damage is."
"Flint now has hundreds, possibly thousands, of kids who are going to be dealing with the consequences of this crisis for the rest of their lives," he tells me. "They could live to be 90 years old, they could move anywhere in the world, they're going to be dealing with lead poisoning their entire lives." He adds: "If there is one organization I'd like to give a boost to it's FlintKids.org," a local organization collecting funds to help with medical support that the children of Flint are going to need for a very long time.
Coyne then goes on to explain how this disaster came about, thanks directly to Michigan's appalling, undemocratic "Emergency Manager" system that allows Governor Rick Snyder (R), to unilaterally appoint anyone of his choosing to completely replace local democratically-elected officials, including the Mayor and the entire City Council, in any city he likes, for whatever reason he determines.
It was, in fact, one of Snyder's hand-selected Emergency Managers who switched the city's water supply from the clean Lake Huron to the corrosive Flint River without bothering to put the appropriate filtering system first. As he notes at Vox, it's "inconceivable" that this problem would have occurred or, at least, gone this horribly wrong, "had Flint residents been able to threaten incumbents at the ballot box." But with the Emergency Manager system, there is no such accountability.
"Flint may be the most dramatic example of that system having gone wrong," he tells me. "But I think about all of the cities that have been under Emergency Managers --- Pontiac, Detroit [also Highland Park, Benton Harbor and elsewhere] --- it hasn't really gone right anywhere. Emergency Management doesn't work ethically, but it also doesn't work practically. It just flat out does not work."
Coyne explains how voter turnout has been getting "worse and worse and worse since" Flint's Emergency Manager was installed and, of course, why shouldn't it? Elected officials are stripped of all power under Snyder's tyrannical system. We also discuss how voters, state-wide, voted to do away with the Emergency Manager law in a statewide referendum back in 2012, only to see it immediately re-implemented by state Republicans in an almost identical form --- though with an added provision that legally bars the law from repeal by voter referendum.
Where are the "Tea Partiers" and "Patriot Movement" and "Militiamen" now? And how can it be that even the Washington Post, who reported on this story in December after well over a year of poisonous drinking and cooking and bathing water in Flint, didn't even bother to use the words "Emergency Manager" in their coverage? Unfortunately, WaPo wasn't alone either, as we discuss in our enlightening, if disturbing, interview today.

Today's BradCast is packed with news from top to bottom. Please buckle up before listening.
First, Big Oil's deceptive scam in California (as discussed on yesterday's show) has succeeded, for now, as Dems pull landmark legislation that would have called for a 50% cut in petroleum usage in the state.
Then, new polling finds Bernie Sanders overtaking Hillary Clinton now in Iowa, as well as New Hampshire, while the party's internecine battle over more debates continues. On the GOP side, candidates not named Trump are flailing as they desperately try to get attention. It's not working --- neither is their lost hopes of scuttling the Iran peace plan.
Next, author and national security correspondent Shane Harris joins us to discuss his disturbing new exclusive at The Daily Beast on 50 U.S. intelligence analysts now reportedly charging that the U.S. has been "cooking" its intel on ISIS.
The still-unnamed military intelligence analysts working for CENTCOM, as Harris explains, are reportedly seeing some of their own reports manipulated by higher-ups. "Key pieces of [their analyses] that they feel are very important [are being] taken out, not given the proper context, [and] in some cases making it look like ISIS and al Qaeda are weaker than these analysts actually believe they are."
So are these charges akin to the way intel on Iraq and WMD was manipulated by the Bush Administration in the 2002/2003 lead-up to war, as revealed by the notorious Downing Street Memos ("the intelligence and facts were being fixed around the policy")? Or are these claims more akin to the hyperventilation over unsubstantiated allegations from the Right concerning Benghazi?
Harris tells me his reporting suggests it is more likely the former than the latter, though it remains unclear who is behind the alleged manipulation of intel and how high up it might go, even if proven true. "What I think is notable is that these 50 --- actually 52 --- professionals who are doing this every day, to go against their bosses, to take this to the IG is a very bold move. They feel very strongly that they have a case," he explains. "I've never seen anything like this. Usually whistle-blowers are in ones and twos, but for a group of people en masse to complain like this is certainly unique in my experience as a reporter."
We discuss who may be behind the alleged "cooking" of the intel and whether President Obama or the White House is somehow directing all of this as the Bush/Cheney Administration was doing in the case of the manipulated intel on Iraq. Tune in for Harris' response to those questions and many others, in what seems, at least as of now, a startling, if still-developing story.
