It was another grim weekend of news. Though there was a bright spot or two. On today's BradCast, we talk about as much of it as we have time for. Including with callers. [Audio link to full show follows this summary.]

Among our coverage today...

  • We begin on a personal note of sorts. I received both my COVID and Flu shots over the weekend. So, as usual, I was pretty laid out for the 24 hours following. That said, I feel great today, happy to feel somewhat protected heading into the holiday season, and ask you to consider doing the same if you haven't already. I would also ask you, once again, not to fall for the deadly lies and disinformation that persists around the very safe and wildly effective COVID vaccines which continue to save billions of lives worldwide, despite the dupes and cretins who would use false "evidence" to hoax you to the contrary. Your life and those of your family are worth protecting. Please do. We're gonna need all hands on deck during next year's critical Presidential election. You will need to be alive to vote. Get your newly formulated COVID shots, now covering additional strains of the deadly virus, ASAP!
  • Next up, the death toll from last week's stunning Category 5 Hurricane Otis in Acapulco continues to rise. At least 45 are now confirmed dead as of airtime today, with several dozen still missing. All of that after the resort city of more than a million had little or no time to prepare for a storm of this magnitude which spun up last week from Tropical Storm to deadly Cat 5 in less than 12 hours, thanks to the rapid intensification of such storms in our climate changed era.
  • Speaking of disinformation, there is a lot of it out there right now, circulating on social media in particular, regarding the Israel-Hamas conflict. And its coming, frankly, from all sides of the conflict. We run through a few of some of the most viral lies that have been moving quickly across Elon Musk's Twitter/X and TikTok. A falsely misrepresented video purporting to show U.S. Marines arriving at an airport in Israel (it's actually a Defense Dept. video from 2022, showing U.S. troops arriving for NATO drills in Romania); Videos of Russian and North Korean dictators Vladimir Putin and Kim Jong Un with false English captions, and much more. Moral: Be careful what you "like" and share on social media. If something is too amazing to believe, there's probably a reason for that. Check with the many various fact-check sites and services out there before making things worse by spreading such disinformation. The real news is bad enough.
  • Speaking of just some of that horrible real news, both the death toll and the humanitarian crisis in Gaza is worsening by the hour, though Sunday saw nearly three dozen truckloads of desperately needed food, water and medicine make its way into southern Gaza. It's not nearly enough, but it's something. That, after a weekend of communications --- both phone and Internet --- being cut off across the entire enclave during Israel's most intense bombing to date as it began to move ground troops into Gaza. The Biden Administration reportedly pressed Israeli Prime Minister Benjamin Netanyahu's far-right government to restore communications in Gaza, has been urging them to allow more humanitarian aid in, and to be "surgical" in its response to the horrific Hamas attacks of October 7. They are having some success. But, from virtually all legitimate reporting, not nearly enough. More than 1.4 million Gazans have fled their homes, and the death toll of Palestinians, as reported by the Hamas-run health ministry, is now said to be more than 8,000. Many of the dead are women and children. Roughly 250,000 Israelis have also been evacuated from homes along both the border of Gaza and the northern border with Lebanon amid persistent rocket attacks following Hamas' attack on Southern Israel earlier in the month that left some 1,400 dead.
  • In brighter news back home, the United Auto Workers union, over the weekend, sealed deals with both Stellantis and General Motors akin to the one struck days earlier with Ford, to end their six-week walkout. The union was able to achieve substantial pay raises for long-time, new and previously temporary workers, along with other long-sought benefits. UAW President Shawn Fain, over the weekend, called the development "a turning point in the class war that has been raging in this country for the past 40 years." At the White House on Monday, President Biden lauded the "historic" deals, "due to the commitment and solidarity of the UAW workers who exercised their right to collectively bargain. They won a record contract with over a 30% increase in wages, greater retirement security and more paid leave." The union also won victories toward hiring thousands of new workers and unionizing newer Electric Vehicle shops.

Today on The BradCast: It was a good day for democracy in the U.S. yesterday, in our continuing battle against the rise of autocracy here at home. The news overseas on that same score, however, thanks to Russia's criminal, autocratic leader, remains significantly dicier. [Audio link to full show is posted below this summary.]

FIRST UP TODAY: It was the first big Special Election night of 2023 in the U.S. on Tuesday. As we saw in advance of last year's 2022 midterms --- when Republicans ignored the evidence before their eyes to hoax themselves into believing a "red wave" was coming (which never did) --- Democrats are once again outperforming expectations in Special Elections around the nation.

We've got results, some of them quite stunning, out of marquee races yesterday in New Hampshire for state House, Virginia for the U.S. House, and in Kentucky for State Senate. In each, Democrats radically outperformed both expectations and history, often by 10 or more points.

But, the most critical race of the night may have been the primary election in Wisconsin, where a vacant swing-seat on the state Supreme Court may finally flip the majority to progressives in the upcoming April 4 general election after years of control by rightwingers. Tuesday's open primary featured two progressives and two so-called conservatives, with the top two vote-getters advancing to the general. Progressive Milwaukee County Judge Janet Protasiewicz easily bested the competition with some 46% of the vote. The two rightwingers, former Supreme Court Justice Dan Kelly and Waukesha County Judge Jennifer Dorow, came in a tight second and third place, with 24% and 22% each, respectively, followed by progressive Dane County Judge Everett Mitchell with 7%.

That means Protasiewicz and Kelly, state Democrats' preferred competition, will square off on April 4. Kelly is a radical, rightwing extremist, election denier, marriage equality opponent, and paid RNC consultant who helped organize Donald Trump's fake 2020 electors scheme in the state. He also lost a previous Supreme Court race in the closely divided swing-state by a whopping 10 points in 2020. In a state where Dems now hold almost every statewide executive position, Republicans are forced to cling to majorities in the state legislature thanks to wildly gerrymandered districts. A progressive majority on the bench, therefore, is expected to be critical over the next few years regarding abortion rights, gun safety, gerrymandering and much more, including voting rights in advance of the 2024 Presidential election.

If voters turnout and vote in April as they did last night, Protasiewicz would defeat Kelly by about 7 points. Of course, its Wisconsin, so I'd be careful about counting chickens before counting ballots just over one month from now.

NEXT UP: Russian President Vladimir Putin's nuclear saber rattling continued on Tuesday during his state of the nation speech. The autocrat announced a unilateral suspension of participation in New START, the last remaining arms control treaty between the U.S. and Russia.

There is a great deal to unpack in all of this, including what Obama-era New START was supposed to do; how the U.S., under Donald Trump, also pulled out unilaterally from a different pact (the Reagan/Gorbachev-era Intermediate-Range Nuclear Forces or INF Treaty); what "suspension" of New START actually means; and how the announcement appears to be yet another desperate attempt by Putin to coerce his way into somehow winning a war of aggression that he appears to be losing in Ukraine, as Russia's unlawful invasion sees its one-year anniversary this week.

To help with all of that today, we're joined by longtime nuclear weapons policy analyst STEPHEN SCHWARTZ who formerly served as Executive Director and Publisher of the Bulletin of the Atomic Scientists. They are the groups who control the notorious "Doomsday Clock". Schwartz, who tweets as @AtomicAnalyst, is also the author of Atomic Audit: The Costs and Consequences of U.S. Nuclear Weapons Since 1940.

"There is no provision in the [New START] treaty for 'suspending' the treaty. You're either in it or not," explains Schwartz. "The suspension is, I guess, a wily way for Putin to get what he wants. Which is, I think, frankly, just an extension of what he's been doing over the last year. This is a nuclear threat by another name."

"It's an effort to frighten the public in the United States, NATO, and Ukraine, into letting let him basically blackmail those countries into letting him do whatever he wants with Ukraine. So he's got this bludgeon --- and it's really the only tool that he has right now --- and he's waving it around until his demands are satisfied."

It doesn't appear to be working. President Joe Biden spoke in Poland yesterday, following a surprise appearance with Ukrainian President Volodymyr Zelenskyy in Kyiv on Monday. "We’re seeing again today what the people of Poland and the people all across Europe saw for decades: Appetites of the autocrat cannot be appeased," declared Biden to cheers in Warsaw. "They must be opposed."

While taking Putin seriously, Schwartz also sees a larger principle at stake. "The way I see it, and I'm no big fan of war at all, is if we just listen to Putin and say 'You're right, we can't risk nuclear war so we're going to stand back and let you carve up Ukraine however you want. And, hey, if you want to take Belarus and Moldova, who are we to stop you?,' I think that would be a terrible precedent for the rest of the world. Not only with regard to what Russia might do in the future, but other countries that have nuclear weapons or might want them."

"The Biden Administration and NATO have been very careful. If you look at every time Putin has done one of these things, the United States doesn't dismiss it and doesn't panic. They walk down the middle and I think that is the right approach here. We need to show that nuclear weapons are fundamentally useless, not just for prosecuting a war, but also for blackmail."

"We need to isolate Putin in this regard," argues Schwartz. "Otherwise, the future world that we're going to live in, brought to you by nuclear coercion, is going to be far worse than anything we dealt with during the Cold War."

Among the many related matters Schwartz speaks to today: Russia's violation of the 1994 Budapest Memorandum, in which Ukraine was guaranteed security and sovereignty after the fall of the Soviet Union in exchange for turning over all nuclear weapons to Russia; The Bulletin of the Atomic Scientists' recent move of the Doomsday Clock to "90 Seconds to Midnight," the closest it has ever been to proverbial "Midnight". Is the world really closer to "Doomsday" now than it was at the height of the Cold War? We discuss all of that and much more on today's very informative program...

Yes, it's possible that two seemingly conflicting things can be true at once. On today's BradCast we report on two different cases where that is true, regarding Russia's war on Ukraine and Dominion Voting Systems' defamation case against Fox "News". [Audio link to full show is posted below this summary.]

First up today, on Presidents' Day, Joe Biden made a surprise visit to Ukraine to meet with its President Volodymyr Zelenskyy just days before the first anniversary of Russia's horrific invasion of its sovereign neighbor. It was also just days after Vice President Kamala Harris declared at the Munich Security Conference over the weekend that the U.S. believes Russia has committed "crimes against humanity" in their unlawful invasion.

In his remarks, President Biden described "a brutal and unjust war," as air raid sirens were heard during his visit to the Ukrainian capital. "One year later, Kyiv stands," said Biden after meeting with Zelenskyy at Mariinsky Palace. "And Ukraine stands. Democracy stands. The Americans stand with you, and the world stands with you." As we discuss, yes, it's possible to understand various diplomatic missteps taken by the U.S. and NATO in Eastern Europe following the fall of the Soviet Union, while still being able to hold the correct party accountable --- in this case, Russia --- for unjustifiable and continuing atrocities.

As yet another war in defense of democracy rages in Europe against a tyrannical autocracy, a decades-long champion of democracy in the U.S. and across the world is now in his final hours. On Saturday, the Carter Center in Atlanta announced that "After a series of short hospital stays," 98-year old former President Jimmy Carter has "decided to spend his remaining time at home with his family and receive hospice care instead of additional medical intervention."

We share some thoughts today on the legacy of our 39th President, including some of his comments last year on the first anniversary of the Donald Trump-incited Republican attempt to overthrow the U.S. Government on January 6, 2021. "One year on, promoters of the lie that the election was stolen have taken over one political party and stoked distrust in our electoral systems," Carter wrote at New York Times. "These forces exert power and influence through relentless disinformation, which continues to turn Americans against Americans."

The "relentless disinformation" of Fox "News" has been on full display for the past several days, following last week's redacted unsealing of Dominion Voting Systems' 192-page motion [PDF] seeking summary judgment in its $1.6 billion defamation suit against the right-wing fake news outlet. As the striking filing reveals in detail, Fox hosts and executives alike knew they were broadcasting fake, evidence-free claims of election fraud by Trump and his supporters following the 2020 election. They didn't much care. Instead, they feared losing viewers and chose to put company profits above both truth and the health of American democracy.

Dominion may prevail in this case. We hope they do. Even as we have been no friend to the company or any of the other oft-failed, private computer voting and tabulation firms over the past 20 years. In fact, some of the news misreported by Fox and Trump's supporters like Sidney Powell and Rudy Giuliani was taken directly from some of our accurate, exclusive reporting from years ago. But, again, two seemingly conflicting things can be true at once. Fox lied about election fraud and should be held accountable for that, and Dominion and other voting system vendors have repeatedly failed in American elections.

By way of fresh evidence to support that charge, we close with details on voting system failures in both New Jersey and California in November of 2022. In both cases, the systems ended up naming candidates who actually lost to be the winners and vice versa. In Monmouth County, NJ, the ES&S voting tabulators allowed duplicate votes to be uploaded to it twice. It wasn't discovered until last month. In Alameda County, CA, the tabulators were programmed incorrectly to do the impossible math of Ranked Choice Voting (RCV) elections in the Bay area. It was discovered in late December last year by a pro-RCV organization who happened to run the math on their own computers and discovered the error.

In both cases, the errors were discovered after losing candidates were certified as winners. How many places did that happen but wasn't ever discovered, because human beings rarely bother to count ballots to make sure the computers did so accurately. This is what comes of outsourcing public elections to private companies and running elections on computer systems that are virtually impossible to oversee by the American public.

On today's BradCast: When the hot debates die down, the liars, of late, having been trying to claim (false) victory. Let's not let them, shall we? [Audio link to full show is posted below this summary.]

We're seeing a lot of that in recent days when it comes to, for example, Russia's help for Donald Trump election in 2016 (yes, it actually happened, despite the disinformed denialists now opportunistically claiming otherwise) and, as we focus on today's program, on those pretending that the CDC and other public health officials had it all wrong about COVID. They didn't. And just because we're all really sick and tired of the continuing pandemic and discussion of COVID in the news has largely been overtaken by other pressing matters, the deadly virus is still killing hundreds of Americans each day. That, after nearly 1,000,000 Americans were killed over the past two and half years. Please don't let the anti-mask and anti-vaccine bullies mislead or cow you.

We never enjoy being the bearer of bad news (it just seems to be our lot in life of late), but a new COVID sub-variant of Omicron, known as BA.2.12.1, is apparently the most transmissible yet, and it is quickly rising across the nation (and world). Some facts you may want to know about that today, why you should get your shots if you haven't already, and why you shouldn't bow to pressure from anyone to not wear a mask indoors if you damned well feel like it.

Also, the Vice President tested positive today. Thankfully, because she is double-vaccinated and boosted, she is, so far at least, said to be asymptomatic. Many others are not quite as lucky, particularly the unvaccinated, many children, and, in particular, those who live in states run by Republicans like Florida Governor and Presidential hopeful Ron DeSantis. He is still turning up the heat on his lies that critics of his failed COVID policies --- the state banned mask mandates and forced schools to remain open when they shouldn't have --- were wrong, and that he was right.

Well, if death rates in states like Florida and Georgia last year, which were two to three times those in blue states per capita, are considered to be "right", then I guess I'm glad I don't live in such states. But I'd still like to help those who do. Yes, as Axios reported late last month, based on then-new CDC numbers, "America's political divisions are now on display in mortality rates."

Sadly, Florida, with its more than 73,000 COVID deaths, is a perfect example. As Axios Tampa Bay reported, "Death rates in Florida and Georgia (more than 200 deaths per 100,000) were much higher than in states with largely vaccinated populations such as New York (112 per 100,000), New Jersey (73 deaths per 100,000), and Massachusetts (50 per 100,000)." And, based on data comparing deaths that would normally be expected, "Between August and December 2021, Florida experienced more than triple the number of excess deaths (29,252) as New York (8,786), despite both states having similar population counts."

That didn't stop DeSantis, during his State of the State address earlier this year, from lying to his constituents: "We would not allow fear or politics to harm our kids. We were right and they wrong and millions of families in Florida are better for it." Sure. Unless you count the tens of thousands of Florida families mourning the unnecessary loss of their loved ones thanks to DeSantis' deadly lies and horrific COVID policies.

In other news of note late last week, on Earth Day, Twitter announced a long overdue policy banning advertisements purchased to push climate change denialism. We'll see if they actually carry it out. But, perhaps more of note, since Elon Musk's $44 billion purchase of the social media company was announced on Monday, it will be interesting to see if the self-proclaimed "free speech absolutest" and CEO of Tesla, the company almost single-handedly responsible for kicking off the planet's electric vehicle revolution, will keep the ban in place as he takes the company private to use as his own personal plaything. (P.S. The entire story of Musk's purchase of Twitter serves as still more evidence that taxes are way way too low for rich people and corporations!)

As it turns out, it wasn't an attack from highly skilled opposition mercenary warriors trained in the art of espionage, deception and surprise attacks that took down the Cyber Ninjas. It was their own incompetence, dishonesty and hopes of escaping huge court fines for failing to follow the rule of law that appears to have done them in. Or, perhaps they're just in hiding, ready to pounce again when they are least expected! [Audio link to full show is posted at bottom of this summary.]

First up on today's BradCast, however, before we get to the "death" of the Ninjas and their ongoing clown show, President Biden and Vice President Harris traveled to Atlanta on Tuesday to call for U.S. Senate filibuster reform in order to pass voting rights and election protection legislation with a simple majority. That, in hopes of countering voter suppression and election subversion measures being adopted by GOP controlled states across the nation.

All 50 Senators who caucus with the Democrats (plus Vice President Harris) are on record in support of the critical Freedom to Vote Act and John Lewis Voting Rights Advancement Act. But in the U.S. Senate, while that simple majority vote may be enough to cut taxes or allow drilling and mining on previously protected federal lands or seat Supreme Court Justices for life, it's currently not enough votes to protect American democracy. Not with the Republican Party now fully in opposition to both voting rights and democracy while Senate rules require a 60-vote super-majority to pass both pieces of legislation.

As Biden pointed out in his remarks today --- for the first time, offering a full-throated call to reform the Senate rules --- the united GOP opposition to voting rights is fairly new. Until recently, even Republicans voted in support of expanding and protecting voting rights at the federal level --- at least enough of them to overcome a Senate filibuster. But not anymore. At the same time, obstructionist Democrats Joe Manchin (WV) and Kyrsten Sinema (AZ) have refused to allow the majority to create a carve-out to the filibuster --- akin to hundreds of others in the Senate --- to adopt the legislation that both of them claim to support.

This week, Manchin even went so far as to describe the filibuster to reporters as a critical Senate tradition that has been in place "for 232 years." In fact, the filibuster as we now know it has been in place since 1975, as historian Max Kennerly explained on a Twitter thread in response to Manchin. "232 years ago, in 1790, a simple majority could end any debate," he notes. And Adam Jentleson, Harry Reid's former Chief of Staff who wrote a book on the filibuster, went so far as to alert Manchin to how much the Constitution's framers virulently opposed a super-majority requirement for anything at all, quoting both "father of the Constitution" James Madison and Alexander Hamilton from The Federalist Papers. (Which is why there is no such requirement in the Constitution.)

"Sadly, the United States Senate — designed to be the world's greatest deliberative body — has been rendered a shell of its former self," Biden, a former six-term Senator, declared in his impassioned remarks on Tuesday, describing the filibuster as having been "weaponized and abused."

Whether the Biden/Harris calls in Atlanta for reform will have any effect on the clueless Manchin and the similarly disinformed or dishonest Sinema remains to be seen. Senate Majority Leader Chuck Schumer continues to insist that "failure is not an option", vowing a series of votes on the matter between now and Monday's Martin Luther King Day holiday.

Meanwhile, the GOP fight against election integrity may have hit a few embarrassing snags after their infamously failed "post-election forensic audit" in Maricopa County (Phoenix), Arizona last year. As you already know, the state GOP Senate's taxpayer funded audit theater found no Chinese bamboo in the County's 2.1 million hand-marked paper ballots, but it did declare that Joe Biden defeated Donald Trump by even more votes than originally certified. And if you follow The BradCast, you also may know that real election audit experts discovered that even those numbers were apparently "made up out of whole cloth" by the Ninjas, whose actual count of the ballots (never mind the results on them) was off by tens of thousands.

The final report that the Ninjas and its CEO Doug Logan produced last year on behalf of the GOP State Senate, also included 77 claims of "possible" fraud in the County's reported tallies and other questions to raise alarms about the legitimacy of tens of thousands of "maybe" illegal votes.

As it turns out, however, according to a 93-page, point-by-point rebuttal [PDF] of each of those claims, released last week by the Republican-majority Maricopa County Board of Supervisors after months of investigation, 76 of the Ninjas' 77 claims were completely wrong.

For example, according to the Ninjas' final audit report, 5,295 voters "potentially voted in multiple counties" in Arizona. The county found, however, that, in reality, just 5 voters may have done so. (They've forwarded their findings to the state AG). The Arizona Republic's Jen Fifield offers a helpful, detailed summary of most of the key rebuttals from the County, explaining how the Ninjas got it so embarrassingly wrong on virtually every "misleading, inaccurate and false" score.

The County's response to the Ninjas' pathetic report was mostly lost, however, amid the news the next day that the Cyber Ninjas were claiming to be no more. A spokesperson announced that they had shut their doors and all employees, including founder and CEO Logan, had been let go, following a contempt ruling from an Arizona Superior Court Judge. He found that failure by the Ninjas to turn over thousands of pages of public records documenting their "audit", its financing, and their communications with officials about it in two separate lawsuits violated the law. The plaintiffs sought a $1,000/day penalty until the documents were turned over. The judge informed the Ninjas they would be fined $50,000/day instead! They then declared they no longer existed, like a ninja disappearing into the night! Except they are really shitty ninjas.

The judge has stated that their claims at insolvency in an attempt to shut down to avoid the court fines was not going to work, threatening to apply the $50,000 daily fine to individuals with the company, like "former" CEO Logan. As it turns out, Logan formed a second company last year named Akolytos, using the same business and mailing addresses as the Cyber Ninjas. But his hopes of escaping the court fines through that second company may not work either, as journalist Kim Zetter details in her latest, excellent Zero Day newsletter. SAD!

Republicans remain shamefully disinformed one year later; Biden calls out predecessor's 'web of lies conceived and spread for profit and power'; American democracy remains in peril...

While we've been citing the New York Times Editorial Board's headline from New Years Day of late on The BradCast, declaring that "Every Day is Jan. 6 Now", today it quite literally was, as the nation marked the grim first anniversary of Donald Trump's final, deadly and failed attempt to steal the 2020 election. [Audio link to full show is posted below this summary.]

We'll let you tune in for details of our special coverage today, in which we discuss some difficult realities in the ongoing fight to save American democracy. Trump's attempted coup might have failed on January 6, but his evidence-free lies about the election have succeeded in duping nearly 80% of Republicans into believing that Joe Biden's victory was not legitimate. That, despite the lack of any evidence, more than one year later, that the election results were fraudulent in any state.

As noted on today's program, authoritarianism and fascism, it seems, have had far greater success over the centuries for a reason. They are much easier than democracy, which requires truth, facts, transparency, public oversight and public participation in its defense. But, if you are lied to, if you don't know what is actually going on in our country, in your government, if you don't know the facts, it is difficult to defend them or democracy itself.

But we will keep striving to do so, by bringing you independently verifiable facts every day for as long as we can --- in a way that doesn't require you to simply trust us --- in hopes of somehow, someday, someway, restoring a sense of a shared reality from which we can all take action.

Toward that end, both Vice President Kamala Harris and President Biden offered remarks today from inside the U.S. Capitol Rotunda, one year after it was attacked by a duped MAGA Mob ginned up by Donald Trump to believe that his lies about the election had any relation to reality. On that day, and those that followed, some his supporters, as well as several U.S. Capitol and D.C. law enforcement officers, paid the price with their lives, along with nearly 150 officers who were injured in the unprecedented assault.

We share both Harris' and Biden's words today, each of whom underscored yet again the necessity of federal legislation to shore up voting rights to counter the GOP's newly enacted schemes to subvert elections and overthrow democracy itself.

For his part, Biden forcefully called out the failed former President in blistering remarks in which he accused Trump and his supporters of holding a "dagger at the throat of democracy" in an "armed insurrection" one year ago.

"We must be absolutely clear about what is true and what is a lie," Biden urged. "The former President of the United States of America has created and spread a web of lies about the 2020 election. He’s done so because he values power over principle, because he sees his own interests as more important than his country’s interests and America’s interests, and because his bruised ego matters more to him than our democracy or our Constitution. He can’t accept he lost."

"Right now, in state after state, new laws are being written --- not to protect the vote, but to deny it; not only to suppress the vote, but to subvert it; not to strengthen or protect our democracy, but because the former president lost," he continued. "It's wrong. It’s undemocratic. And frankly, it's un-American."

"It's up to all of us --- to 'We the People' --- to stand for the rule of law, to preserve the flame of democracy, to keep the promise of America alive. That promise is at risk, targeted by the forces that value brute strength over the sanctity of democracy, fear over hope, personal gain over public good.

"Make no mistake about it: We’re living at an inflection point in history," Biden said. "As we stand here today --- one year since January 6th, 2021 --- the lies that drove the anger and madness we saw in this place, they have not abated. So, we have to be firm, resolute, and unyielding in our defense of the right to vote and to have that vote counted."

"We are in a battle for the soul of America," he charged, reiterating the argument with which he kicked off his 2020 campaign as he concluded his remarks. "I did not seek this fight brought to this Capitol one year ago today, but I will not shrink from it either. I will stand in this breach. I will defend this nation. And I will allow no one to place a dagger at the throat of our democracy."

He finished by offering a blessing for "those who stand watch over our democracy."

On today's BradCast, we continue to catch up with a few of our favorite progressive journalists as the year grinds down. And, yes, there are still a few things to celebrate before Christmas. [Audio link to full show is posted below this summary.]

This week, unionized Kellogg's workers in four states --- Michigan, Nebraska, Pennsylvania and Tennessee --- approved a new five-year contract after a long, 11-week strike. The corporate cereal behemoth had recently threatened to replace the strikers with new, permanent (scab) workers. But, according to members of the Bakery, Confectionery, Tobacco Workers and Grain Millers (BCTGM) International Union, the loud support of lawmakers, including the President of the United States and members of his Administration, Sen. Bernie Sanders, as well as state and local officials in Michigan and elsewhere, buoyed their resolve to keep going. And it worked! The BCTGM President noted this week that the new contract includes wage increases, cost-of-living adjustments, expanded health and retirement benefits and "does not include any concessions."

The victory for 1,400 workers, at a company which touted its workers just last year, during the darkest days of the pandemic, as "essential workers helping to feed the nation," was one of several for unionized labor this year. Our guest today, author and longtime progressive journalist JOHN NICHOLS of The Nation and Madison, Wisconsin's Capitol Times, joins us to help explain why.

"What's happened again and again" this year at companies like Kellogg's, John Deere and elsewhere, Nichols explains, "is that initially, the company bargains in the old-fashioned way. 'We're going to be tough with you...We'll permanently replace you.' All the old tricks." But, in a labor market with very low unemployment, where it is now difficult to find skilled workers or those willing to work in difficult, often dangerous conditions for low pay and benefits, "it's not going to work in this situation. The end result is the companies blinked."

But we've got much more than just the rise of labor in 2021 to catch up on with Nichols today in a lively, wide-ranging conversation on that...

  • on how the Protecting the Right to Organize (PRO) Act would help a broad swath of workers across the country;
  • on Joe Manchin and the (theoretical) death of Biden's Build Back Better Act and what the West Virginia Democratic Senator's betrayal to his own party and his own constituents may mean for the future of the filibuster and federal voting rights legislation;
  • on Nichols' fascinating new article for The Nation on the FBI's weird scrutiny of It's a Wonderful Life as a Communist tool back in the 1950s (they thought it made Mr. Potter --- and capitalism --- look bad);
  • and on his upcoming new book calling for accountability --- akin to that which came out of FDR's Pecora Commission following the Great Depression --- for Coronavirus Criminals and Pandemic Profiteers. "In every chapter in the book," Nichols explains, "I find individuals who died, and I track through the cabinet members, the judges, the CEOs, whoever, who could have taken actions that would have let that person live."

That's just a taste. Tune in for much more today with the great Mr. Nichols!

Then, yes, in the spirit of the holidays (and, perhaps, in hopes that it may save even one life), we laud two Republicans today for (barely) doing the right thing this week. One is Congressman Tom Rice of South Carolina, who now says he regrets voting against Joe Biden's certification in two states following the Trump-incited attack on the U.S. Capitol on January 6th. ("There was a coward in that equation," Rice told Politico. "But it wasn’t Mike Pence.") And, perhaps most begrudgingly of all, we laud Trump himself for saying out loud during a wingnut interview this week: "The vaccine worked. But some people aren't taking it. The ones that get very sick and go to the hospital are the ones that don't take the vaccine. ... If you take the vaccine, you're protected. Look, the results of the vaccine are very good...People aren't dying when they take the vaccine."

Yes, the bar is admittedly very low at this point, but we've gotta start somewhere if we want to figure out how to repair this broken nation (and planet.)

Speaking of...the fine folks at ExxonMobil were apparently able to fit in one last disaster before year's end, with an explosion in the middle of the night at one of their refineries near Houston that injured four workers, three of whom were airlifted from the scene. The company downplayed the incident, as usual, describing it as "a fire occurred at our facility". The Houston County Sheriff's office described a "major industrial accident". We hope to learn more soon.

No room for that story today, however, in our final Green News Report of the year (we're standing down next week, Nicole Sandler will be filling in for us for most of it), as Desi Doyen joins us for a round-up of the disasters and successes in the environmental world in 2021, and much more...including one more victory for labor and union workers, as the Biden Administration mobilizes to rid the nation of millions of lead pipes...

On Monday night, the bipartisan House Select Committee on the January 6th attack on the U.S. Capitol voted unanimously to refer criminal contempt charges to the Dept. of Justice for Donald Trump's former Chief of Staff Mark Meadows. During their hearing, Committee Vice Chair Liz Cheney (R-WY) read a number of texts from Fox "News" personalities and from Don Jr., sent to Meadows during the hours the Capitol was under attack after Trump incited the riot in his last gasp effort to steal the 2020 election. The messages were pleas to get Meadows to convince Trump to call it off. Those same Fox personalities would soon go on the air and pretend that "antifa" was behind the deadly assault. The texts prove they knew otherwise and, according to Cheney, serve as more "evidence of President Trump's supreme dereliction of duty during those 187 minutes" when he failed to act while the U.S. Capitol was under assault by domestic terrorists.

Committee member Adam Schiff (D-CA) shared several damning text messages from unidentified members of Congress that were sent to Meadows as well, noting that, due to the ongoing investigation, the lawmakers were not being named "at this time." Separately, Committee Chair Bennie Thompson (D-MS) said those names would eventually be made public, as the Contempt referral for Meadows also referenced several "members of Congress" who participated in phone calls and White House meetings to help strategize before the eventual bloody insurrection.

Meanwhile, another House Select Committee investigating the coronavirus crisis may be heading toward separate contempt charges against former Trump official and prominent COVID denier, Peter Navarro. He says he cannot cooperate with that Committee's probe because Trump gave him a "direct order" not to, claiming Executive Privilege (which former Presidents do not have), and that because of it, "this matter is out of my hands."

"Trump's supreme dereliction of duty" in 2020 is unspeakable in many cases, but it's only part of his unspeakable legacy and a seemingly unending list of criminal culpability.

But never mind 2020. Some good government groups are still seeking accountability for the 2016 campaign that put the disgraced former President into the White House in the first place. Last week, Free Speech for People (FSFP) and the Campaign for Accountability filed suit [PDF] in D.C. federal court against the Federal Election Commission (FEC) for failing to take action on a complaint they filed in December of 2016. That complaint alleged unlawful "coordination" between the Trump Campaign and the Russian Federation.

"Even today, despite multiple investigations, critical information about the money spent in the 2016 election is still unknown," said RON FEIN, Legal Director of FSFP, in a statement announcing the new lawsuit. "How much did the Russian Federation spend? When and for which efforts did it make the payments? How much (and which) of that spending was ‘coordinated’ with the Trump campaign? Answering these questions is the FEC’s job, and they’ve sat on it for almost five years."

Now, says Fein, who joins us on today's program, the groups have no choice but to take the FEC to court to force the government's long-dysfunctional federal campaign regulator to investigate the complaint. Fein explains how "coordination" has a very different meaning in campaign finance law than it does in the matters that Special Counsel Robert Mueller looked at in his two-year probe. "Congress passed a law specifying that coordination 'shall not require agreement or formal collaboration,'" he says. "It could be a wink and a nod. Put that into the context of things like Trump saying, 'Russia, if you're listening, I hope you find those emails'," after which Russia attempted to hack the Clinton campaign, and the question of unlawful coordination under campaign finance law becomes plain to see.

"I don't mean this as a personal attack on Mueller or anyone who worked on that team," Fein clarifies, "because they're not campaign finance experts, but they missed an important area of the law that the Federal Election Commission has the authority to investigate, and the obligation to at least make a decision on our administrative complaint that alleged this."

FSFP's "2016 administrative complaint alleged that the Russian government paid for computer hacks, social media posts, and paid political advertisements to influence the 2016 election, and that the Trump campaign engaged in 'coordination' with the Russian government," the group notes in their statement announcing the new suit.

"There were many aspects of what happened in the 2016 election that were extremely troubling, from a legal as well as from a broader, democracy-preservation standpoint," Fein tells me today. "For example, even illegal political spending is required to be disclosed. That's what both the Russian government and the Trump Campaign failed to do. And that's the information that we would have if they disclosed it."

The six member FEC, with three Commissioners appointed by each major party, is notorious for tie votes that end up killing action against campaign finance violations that even the FEC's own staff argues should be pursued. In this case, Fein says, the FEC didn't even hold a vote on their complaint over the past five years. Their lawsuit is meant to force the Commission to hold that vote. If the court orders them to do so and the complaint then fails to receive the necessary four votes to proceed with a full investigation, FSFP can sue the Commission again. It's potentially a long road, but one that could actually be short-cutted.

"Because it takes four votes to do anything in the FEC, if there is not a four-vote majority to appear in court --- this has happened several times recently --- the FEC has simply defaulted," explains Fein. "And then the statute provides --- and this was rarely, if ever, used until just the past year or so --- the statute provides that if there's a default judgement, then the plaintiff can just go ahead and sue the parties that they filed the administrative complaint against directly. In other words, if that plays out that way, then we'd be in a position to sue the Trump Campaign and the Russian government and cut the FEC out of the picture entirely."

Still a long road, but a much shorter one that doesn't rely on the corrupted FEC.

In the meantime, FSFP --- as we discussed with its co-founder and President John Bonifaz early last month --- is continuing its campaign calling for the resignation of Attorney General Merrick Garland for failing to meet the moment in taking action on the endless list of criminal allegations against Trump and his minions before, during and after his Presidency. When I inquire with Fein as to whether the recent criminal Contempt indictments against former Trump lackey Steve Bannon has changed the group's outlook, he notes that, if anything, "the call for Garland to resign is even stronger right now."

You'll need to tune in to find out why.

And then, one more bit of breaking Trump Accountability that came in during today's show, as a Trump appointed federal judge rejected the former President's lawsuit seeking to block House Ways and Means Committee Chair Richie Neal (D-MA) from obtaining Trump's tax records. The ruling is the latest in a roller-coaster legal battle that begin in April of 2019. Trump's Treasury Department refused to turn over the documents to Congress, as required by law. Biden's has agreed to. Trump sued to stop them. Trump now has 14 days to decide if he will appeal.

Finally, we close with Desi Doyen and today's grim Green News Report following the deadly, climate change-fueled tornado swarm that slammed Kentucky and several other states over the weekend. Though she also has some slightly brighter news at the same time, as the Biden Administration reveals its new, electric vehicle charging strategy, made possible by the recent passage of the $1.2 trillion infrastructure bill...

It's a busy BradCast, today! I'm NICOLE SANDLER, guest hosting for Brad and Desi, with a full plate today.

Because this was such a busy news cycle, we begin with the news about the vote that ousted freshman Congresswoman Marjorie Taylor Greene (Q-GA) from the two committees Kevin McCarthy put her on. While that was happening in the House, the Senate began a "vote-a-rama" that went on all night. It finally ended at 5:35am, with VP Kamala Harris in her role as Senate President casting the tie-breaking vote to pass a shell of a bill that will eventually contain the $1.9 trillion COVID relief legislation that will require only 50 (+1) votes to pass using the process known as reconciliation.

Because there was so much news breaking on Thursday, something that should have gotten a lot of attention was overlooked by the media. Following the vote in the House to rid the committee of Marjorie Taylor Greene, there was a "special order" hour on the House floor, organized by Congresswoman Alexandria Ocasio-Cortez. Many of us watched her compelling and frightening account of her experience during the Capitol insurrection on January 6, streamed on Instagram Live. It kept me awake most of the night Monday night, as I couldn't shake the feeling of terror she conveyed over the course of the 90-minute live stream. I'm guessing the response she received was overwhelming, as she put together this "special order" event on the House floor to allow other members to tell their stories of what happened to them that awful day. In the second segment of today's show, I share some of those stories, each of which should be included in next week's Impeachment Trial.

Landmark bill would enact long-overdue voting reforms, but needs at least one key rewrite to close a loophole regarding hand-marked paper ballots...

As their first official bills in each chamber of Congress --- H.R.1 in the House and S.1 in the Senate --- Democrats are proposing a remarkably ambitious election, campaign and ethics reform measure which would go a long way towards enhancing our system of democracy. At least one important rewrite is needed, however, in order to close a loophole in its mandate regarding hand-marked paper ballots.

H.R.1 or the For The People Act of 2021, was introduced by Rep. John Sarbanes (D-MD) with hundreds of Democratic co-sponsors on January 4. It is supported by both Democratic House Speaker Nancy Pelosi and Senate Majority Leader Chuck Schumer.

With the exception of partisan gerrymandering as applied to State legislative offices --- which is out of the hands of federal lawmakers --- the bill would, for all intents and purposes, outlaw a wide array of voter suppression, intimidation and deceptive practices that have, for decades, been used to undermine American democracy.

The massive bill, clocking in at nearly 800 pages, also includes Congressional ethics reforms and other important measures, but we focus here on the statute's provisions to help outlaw suppressive measures and improve election security, transparency and the verifiability of results.

As presently written, the measure appears to mandate the use of "voter verified permanent paper ballots" in all federal elections. That aspect, however, must be improved with minor, but very important revisions to mandate the availability of hand-marked paper ballots --- the only type that can be known to be "voter verifiable" --- for all voters at the polling place for both early and Election Day voting.

H.R.1 also includes provisions for either hand-counting of paper ballots or the use of optical scanning computers accompanied by Risk Limiting Audits. It includes mechanisms to fund those post-election activities.

The bill provides for minimum periods during which States must make early voting available in federal elections and promotes, streamlines and secures mail-in voting. It tightens ethical standards and also takes a stab at reducing the role of dark money in campaigns, while prohibiting the presence of foreign money and interference in our elections. This includes a mandate that TV, radio and online platforms "make reasonable efforts to ensure that [election-related] communications...are not purchased by a foreign national".

The real question isn't whether H.R.1, if appropriately amended, should become law. The question is whether a sufficient number of Senators are willing and able to do what is necessary to ensure it becomes law...
