It's still kind of hilarious that the Republican Speaker of the House this week, in announcing an impeachment inquiry of Joe Biden for...(fill in actual crime here when available)...described the Democratic President as "the picture of a culture of corruption". It's particularly amusing given the bulk of today's news on The BradCast. [Audio link to full show follow below this summary.]

Among our stories today...

  • The unspeakable death toll from flooding in Libya is now expected to be in the tens of thousands as bodies line the streets in the eastern coastal town of Derna, where 16 inches of rain fell in one day over the weekend resulting in the collapse of two dams. Given some of the horrifying new numbers from Berkeley Earth this week, however, suggesting that the planet has a good chance of exceeding the 1.5 degree Celsius increase of warming since pre-industrial times which the Paris Climate Agreement seeks to avoid, we could be in for many more such horrific disasters in the years ahead.
  • Following a nearly 5-year probe by a Trump appointed U.S. Attorney and a recently failed plea agreement, Hunter Biden was charged today with 3 felony counts related to using illegal narcotics while buying a gun. These are crimes which almost nobody is ever charged with, especially when they have never fired or even loaded the gun, which Hunter reportedly had for only 11 days. But that must be a part of the "special preferential treatment" the President's son has received, if you hear Republicans tell it. Try not to laugh.
  • The state judge overseeing the sprawling, 41-count racketeering conspiracy indictment [PDF] against the former President of the United States, Donald Trump and his 18 co-conspirators for their attempts to steal the 2020 election in Georgia, has determined that all 19 defendants will not be tried in a single group beginning in October, as Fulton County D.A. Fani Willis had sought. So far, former Trump attorneys Ken Chesebro and Sidney Powell will stand trial next month, but a trial date for all of the others will be set later, likely for some time next year --- if a slot when Trump isn't standing trial on felony charges in three other jurisdictions can be found.
  • The civil trial Trump faces --- along with his two eldest sons, his company and two top executives --- via New York state Attorney General Letitia James, for falsely and unlawfully inflating his company's net worth by billions of dollars in order to fraudulently receive bank loans and other benefits, begins on October 2. Just mentioning that since it seems few others are doing so these days for some reason.
  • The Fox Corporation was sued yet again this week, related to the knowing lies Fox "News" told about the 2020 election being "rigged". The latest suit comes courtesy of New York City's huge pension funds. They charge neglect of corporate duty to protect shareholders by opening themselves up to defamation suits like the one from Dominion Voting Systems. That one cost the pretend news outlet $787.5 million to settle earlier this year. The state of Oregon, on behalf of their public employee retirement fund, has joined the suit. All of which begs the question as to why anybody's money is actually invested in a company known, for years. to be as corrupt as Fox. I might suggest that those whose retirement funds are being handled by NYC and Oregon (and elsewhere) demand the funds pull their money from similarly irresponsible and corrupt corporations --- such as the major fossil fuel companies --- before they too face the huge financial liabilities that await them.
  • Are Wisconsin state Assembly Speaker Robin Vos and his fellow corrupt Republicans in the state's obscenely gerrymandered Legislature blinking in their recent threats to impeach newly-seated state Supreme Court Justice Janet Protasiewicz before she has even heard a case? The High Court's new liberal majority will soon be hearing two citizen petitions challenging the GOP's corrupt state district maps, which have ensured Republican majorities in both the Assembly and Senate for most of the past decade. But this week, just after state Dems announced a $4 million ad buy to let voters in the Badger State known what Republicans are up to in advance of 2024, Vos floated a new legislative "deal" to create new maps. Democratic Gov. Tony Evers immediately rejected the proposal as "bogus". We explain.
  • Remember that Kentucky County Clerk who refused to grant marriage licenses to same-sex couples back in 2015? Kim Davis will now have to pay one of those couples $100,000 for having refused to do so, according to a decision this week by a federal jury.
  • Ken Paxton, the unspeakably corrupt Texas state Attorney General and close Trump ally who is facing trial in the Republican-dominated state Senate on 20 articles of impeachment brought by the state's Republican-dominated House this week, may have dodged at least one bullet. A last-minute deal was struck between the opposing attorneys to skip testimony from Paxton's mistress on Wednesday. She's the one who was given a job by a Paxton donor to make it easier for them to continue their secret affair. The impeachment trial of the state's top law enforcement officer continues in the Senate, which will soon decide if the Republican should be removed from office based on charges of bribery, unfitness for office and abuse of power. Paxton's wife is a state Senator and has been present all week at the trial. She will, however, be barred from voting on his fate.
  • Washington Post reports today that Florida's corrupt Republican Governor Ron DeSantis enjoyed a whole bunch of unreported and undisclosed private plane flights, luxury resort accommodations and meals with wealthy donors after being first elected in 2018. With his Presidential aspirations now failing, he must be angling for a Supreme Court nomination.
  • Finally, Desi Doyen joins us for our latest 'Green News Report' with more on the horrific news out of Libya; the record costs of U.S. weather-related disasters so far this year; more bad news for Texas water drinkers; and a bit of encouraging news courtesy of Biden and the Democrats' Inflation Reduction Act. Oh, we're also still keeping an eye on the powerful, slow-moving Hurricane Lee, a monster storm in the Atlantic which is currently brushing by Bermuda and threatening New England, Canada and Newfoundland over the next several days...

The landmark federal climate bill called the Inflation Reduction Act, adopted last year without a single Republican vote when Democrats held majorities in both chambers of Congress, has a long way to go before we can determine its full success or failure.

On the other hand, as discussed on today's BradCast, if it is going well, but few Americans know it's going well --- as corporate broadcast media spend nearly 24 hours a day on various crises both manufactured and real (ironically, many caused by climate change!) --- can it or will it make a difference in next year's elections? [Audio link to full show is posted below this summary.]

But, FIRST UP today, one (or more) of those manufactured crises. House Speaker Kevin McCarthy's desperate attempt on Tuesday to win over his own far-right caucus in the House by unilaterally declaring an impeachment inquiry of President Joe Biden doesn't seem to be going over very well. He had to break his own vow, made just 11 days ago, to do it only after a full vote of the House. It doesn't seem to be winning over enough colleagues to help him avoid a federal Government shutdown at the beginning of the new fiscal year on October 1. And even fellow Republicans in the U.S. Senate apparently see no evidence of High Crimes or Misdemeanors by the President to warrant impeachment.

On the other hand, he hasn't been pushed out of Speaker job by his own party this week...yet. So there's that!

NEXT: Biden and the Democrats' landmark Inflation Reduction Act --- featuring the largest single investment in history in climate change mitigation and clean energy manufacturing and jobs --- is now one year old. It has already begun to "turbocharging" a massive investment in new manufacturing plants and jobs in the U.S. to help reduce fossil fuel carbon emissions causing our climate crisis. It will soon be funding billions of dollars in home improvement projects to allow low and middle-income homeowners to electrify, solarize, upgrade and simply increase energy efficiency to save money. (NOTE: Not currently applicable in states like Florida, Kentucky, Iowa or South Dakota, apparently, which have failed to join the federal program to help their own residents save money and improve their home values while fighting climate change.)

Our guest today to discuss all of this is the great DAVID ROBERTS, longtime climate, energy and politics journalist and podcaster at Volts.WTF. We last spoke to him a year ago, just after passage of the critical legislation.

He explains today that it is still "too early to tell" whether the legislation is a success or not given all of its many practical objectives, which include vastly lowering emissions, creating millions of good paying jobs, sparking a manufacturing renaissance in the U.S. to bring supply chains home for renewable energy technology and overtaking China's dominance in the sector.

"Because the IRA's goals are so vast," Roberts explains, "it will only be over the course of five to ten years that we really have any understanding of whether it pulled it off. It's trying to do enormous things."

"What we definitely can say," however, is "that one of the goals --- which was to spur private investment into these products and supply chains in the U.S. --- is absolutely working. Last I looked, it's like $270 billion-worth of private investment flooding into the U.S."

But the yardstick for success here may be even longer than you think, according to Roberts. He tells me there is yet another goal for the legislation that is "not as public, but, if you talk to some Biden people behind the scenes, they will tell you that this apocalyptic terror you have about the future of democracy is not crazy."

"We are in a perilous, perilous moment. And part of the thinking behind IRA was that it is these parts of the country that were hollowed out by globalization, hollowed out by decades of reflexive 'free trade' dogma --- it's these parts of the county that have experienced this reactionary backlash that we've all been living through over the past little while. And if that goes on, U.S. democracy is in serious, existential trouble. People are freaked out about that all the way to the top. So, part of the goal of IRA was to channel investment into those areas. And that is happening."

Roberts says that much of the new investment "is coming into Southern and Midwestern states," including by companies like First Solar, which is "investing $1.2 billion into a facility in Louisiana. That is the single largest private investment in that state's history." Similar projects are happening in states like Georgia, West Virginia and elsewhere.

So, all we need to assess success of this enormous new law is whether it helps solves both of the nation's most existential crises: Democracy and Climate Change.

"Spurring investment, yes, it is succeeding. Is it succeeding in muting that reactionary backlash? Is it succeeding in muting these horrendous politics we've dealt with? Is it succeeding in turning a few swing voters in those swing states to help Joe Biden get back into office? That we don't know yet. And part of the problem is that our media ecosystem is broken and dysfunctional, and people just don't know about [the law]."

How to solve that? Well, as you can tell, we've got much to discuss today with Roberts along those lines as well, as he characterizes that part of issue as "the six million question" given "how broken the media is, and how difficult it is to get it to focus on these things."

He's got a few ideas, however, some involve "a huge role for NGOs, for the green movement" and even for you, as the climate, economic and political effects of the IRA one year on are still "TBD"...

As the headline suggests, we've got a bunch of different odds and ends and follow-ups and codas to share with you on today's BradCast, along with, several new stories and even a musical ending to it all. [Audio link to full show follows this summary.]

Among today's stories...

  • Trump advisor Peter Navarro was found guilty by a jury in D.C. on Wednesday on two counts of Contempt of Congress for refusing to answer his House January 6 Committee subpoenas for testimony and documents. It's the second such conviction for a scofflaw Trump apparatchik. Last year, Steve Bannon was found guilty of the same crimes and sentenced to 4 months in prison. He remains out on appeal. Navarro is expected to appeal as well. We wish them both nothing but luck in their continuing efforts to evade the Rule of Law on behalf of the disgraced former President and continuing con-man.
  • Just a friendly reminder, because I haven't seen it covered much in the wake of the recent small plane death of former Vladimir Putin-ally turned short-lived Russian mutineer Yevgeny Prigozhin. I just wanted to make sure this factoid doesn't fall down the Memory Hole of History: On the day before last year's mid-term elections in the U.S., Prigozhin admitted, for the first time publicly, that Russia had, in fact, "interfered, are interfering and will interfere" in U.S. elections. Yes, in addition to heading up the brutal Wagner mercenary group in Ukraine and elsewhere, being known as "Putin's Chef" and eventually failed mutineer, he was also the guy who finally admitted to having interfered in U.S. elections. He was charged by Special Counsel Robert Mueller in 2018, for having done so in 2016.
  • Following Hurricane Idalia's landfall in Northern Florida last week, it's become clear that a radical new anti-immigrant law signed by the state's Republican Governor Ron DeSantis earlier this year will hamper rebuilding and recovery efforts in the Sunshine State. While damage from Idalia was intense, it made landfall on a sparsely populate part of the state. Next time, Florida may not be so "lucky". In not-unrelated news for the U.S. East Coast, the huge Hurricane Lee has now intensified to a Category 4 today as it nears the Caribbean.
  • A couple of weeks ago, we covered yet another case of voter fraud by a White Republican Trump donor after James Saunders, a 56-year old Ohio attorney, was convicted of unlawfully voting in both Florida and the Buckeye State in the 2020 and 2022 general elections. Last week, he received Ohio's maximum sentence of three years in prison. The judge sent him immediately to jail following his conviction without allowing him to remain free pending appeal.
  • In yet another new case of GOP election fraud last week, Alabama state Rep. David Cole was arrested and charged with voting in "multiple or unauthorized locations" after law enforcement officials determined the District 10 lawmaker actually resided in District 4 in violation of state law. He faces up to 10 years in prison for his crimes, though --- in a turnabout for GOPers these days --- Cole who was elected to public office last year, had the decency to resign following his arrest and says he plans to plead guilty.
  • We've been spent quite a bit of time over the past year and a half on both The BradCast and at The BRAD BLOG covering the alarming, unlawful breach, copying and distribution of Georgia's statewide voting system software by a bunch of MAGA folks on January 7th, 2021 in rural Coffee County. The scheme was allegedly organized by Trump attorney Sidney Powell after being hatched in the Oval Office in December of 2020. Powell and three others were finally charged by Atlanta-area D.A. Fani Willis for their parts in the plot, in Donald Trump's sprawling, 41-count RICO indictment [PDF]. We helped break some of the story last year and have been covering in detail it ever since, including yesterday with guest Marilyn Marks, the woman who first revealed the breach after learning about it via a bizarre phone call she received from one of the participants (who has also since been charged.)

    But there is another, less reported aspect to all of this, with no small amount of irony. Two of those charged for key roles in the plot, the County's then GOP Chair Cathy Latham and then Election Supervisor Misty Hampton, were also part of a voter suppression cabal in the heavily Republican County where about a quarter of the population is Black. In fact, for years, the pair had helped to bring false voter fraud charges against County Commissioner Olivia Coley Pearson, a Black Democrat, for her terrible habit of helping folks get to the polls when they need assistance. As CNN's Elle Reeve details in an excellent report this week from on the ground in Coffee County, there is good reason that some refer to it as "Crooked Coffee"...even before the massive Republican election fraud breach carried out by Hampton, Latham and many others.

  • Next up, Desi Doyen joins us for our latest Green News Report following a record brutal summer across the globe. But she also has some good news, such as the Biden Administration's effort to reverse Trump's oil drilling up in the previously pristine Alaska National Wildlife Refuge (ANWR).
  • Finally, we close out Labor Day week with a new tune from musician and longtime labor advocate Billy Bragg, who says he was inspired by "the ghost of Woody Guthrie" to respond to a song named Rich Men North of Richmond by Virginia-based singer Oliver Anthony after it recently went viral in GOP circles. Bragg's new tune in response is called Rich Men Earning North of a Million and it has a very clear message and solution for Anthony "and people like you."

Election officials grapple with Trump's Constitutional ballot disqualification; Also: Proud Boy boss gets 22 years for 1/6; Courts order lawless AL, FL to restore Black-majority U.S. House Districts...

We're back! Both on today's BradCast and even in L.A., after fleeing the state last month to avoid weeks of construction on the roof of the apartment housing our home studio. To no one's surprise, the work is taking longer than we were told, so please pardon our efforts this week to work around it as best as possible after taking last week off to both avoid it and to enjoy the last days of Summer 2023 before the 2024 fight for Democracy (represented this year by Democrats) and Autocracy (represented by a lawless Republican party) begins in earnest.

Among our stories today...

  • Enrique Tarrio, former head of the far-right Proud Boys gang was sentenced to 22 year in federal prison on Tuesday following his conviction for Seditious Conspiracy for his role in the January 6th, 2021 U.S. Capitol insurrection. It's the longest sentence for any of the MAGA insurrectionists to date. Also, of note, Tarrio wasn't even in Washington D.C. that day. Point taken: One didn't need to be personally smashing windows and storming the Capitol to be held to serious account for what happened that day. Got it. Hopefully other jurors in other upcoming related cases will get it as well.
  • The federal Courts are still holding. Mostly. For now. On Tuesday, a three-judge panel found that Alabama Republicans blatantly defied an order from the U.S. Supreme Court to add another Black-majority district to their U.S. House map. The SCOTUS order to do so --- after finding the state violated both the U.S. Constitution and Voting Rights Act with their racially gerrymandered districts --- came in Allen v. Milligan [PDF] in early June. Alabama didn't care. In an unprecedented move, they gave the finger to the Court and drew up a new map with the very same deficiencies featuring just one Black-majority district out of seven, in a state where some 27% of residents are Black. The federal court panel has now assigned a Special Master to draw U.S. House districts for the state, after a lawless Gov. Kay Ivey joined with lawless legislators in the gerrymandered statehouse to defy SCOTUS, the Rule of Law and the U.S. Constitution. Alabama is now appealing the ruling to the same U.S. Supreme Court Justices who rejected their arguments barely three months ago.
  • The story is similar in authoritarian Governor and Presidential candidate Ron DeSantis' lawless state of Florida this weekend. In this case, a state court judge on Saturday ordered the state legislature to draw a new U.S. House map restoring a Black-majority district in Northern Florida that DeSantis had personally ordered state lawmakers to break into pieces and divvy up its Black voters into White Republican districts. The weekend's court order would seem to be good news. However, the State will now appeal the ruling directly to its Supreme Court where DeSantis has hand-picked a majority of the Justices. As we have long been warning, the fight between Democracy and Autocracy (or Fascism, as one of our longtime listeners insists), continues into 2024.
  • Next, I finally catch up with a bunch of news on a growing story --- some of which we've been discussing over the past two years --- that I've otherwise been trying to get to for weeks, but for all of the various indictments, hurricanes, wildfires, debates, etc. continually sidetracking me. The news has to do with the continuing feeling I have that Donald Trump will ultimately not be on the ballot come next November. As noted, that's not a prediction or an inside scoop. It's simply a feeling for now, but one that I can't shake as an increasingly swelling body of evidence seems to support its possibility.

    Today, that evidence includes polling last month finding nearly two-thirds of Americans say they will either "definitely" (53%) or "probably" (11%) not support Trump in 2024. Might such numbers begin to grab the notice of Republican Primary voters? (So far, the answer is largely no. But we've got a long way to go --- and a lot of criminal trials --- before the GOP's nominating convention next July.) There are already a number of high profile Republicans calling on Trump to drop out of the race or noting that he very well may be Constitutionally disqualified entirely from the ballot.

    It is that part of this story today --- disqualification from the ballot via Section 3 of the 14th Amendment of the U.S. Constitution for his role in the January 6 Insurrection --- that we focus on today. Namely, the far-right, Federalist Society legal scholars who recently issued a 126-page law review paper [PDF] finding Trump to be Constitutionally ineligible for the ballot --- "cannot be president --- cannot run for president, cannot become president, cannot hold office" --- due to his roll in the January 6 insurrection.

    And now, there is a host of state Secretaries of State --- both Republican and Democratic --- around the country who are currently or soon to be grappling with the decision as to whether Trump is even eligible to be on their state ballots in 2024.

    Among those Secretary of State's discussed today, after they recently offered various opinions on the matter: New Hampshire's David Scanlan (R); Ohio's Frank LaRose (R); Arizona's Adrian Fontes (D), New Mexico's Maggie Toulouse Oliver (D); Maine's Shenna Bellows (D) and Michigan's Jocelyn Benson (D). (Benson gets credit for the first part of today's headline. REO Speedwagon gets credit for the alternate hed.)

On today's BradCast, it's special coverage of the first GOP Presidential Primary debate of the 2024 campaign. It featured eight candidates, none of which were named Trump, But he was there anyway. [Audio link to full show follows below this summary.]

The raucus two-hour debate in Milwaukee, Wisconsin was sponsored by Fox "News" and held before a rowdy audience of booing and cheering Republicans who, at times, resembled a pro wrestling crowd --- or a lynch mob --- more than supporters of an American political party.

The actual participants on the stage were (in order of polling popularity before the debate): Florida Gov. Ron DeSantis; 38-year old entrepreneur Vivek Ramaswamy (who, if you hadn't heard of him before last night, you probably have now); Former Vice President Mike Pence; Former South Carolina Gov. and U.N. Ambassador Nikki Haley; Former New Jersey Gov. Chris Christie; South Carolina U.S. Senator Tim Scott; Former Arkansas Gov. Asa Hutchinson; North Dakota Gov. Doug Burgum (who, if you hadn't heard of him before last night, you may still have no idea who he is today.)

We're joined today by some favorite BradCast special coverage guests to try and make sense of it all. (Which was no easy feat, frankly!) HEATHER DIGBY PARTON is a longtime, award-winning columnist at Salon and founder of Digby's Hullabaloo blog; "DRIFTGLASS" is otherwise known as both @Mr_Electrico on the site formerly known as Twitter and occasional as just "Bill" back at home in "Flyover Country, Illinois" where he produces the weekly Professional Left Podcast.

All of that and many more questions asked, answered, discussed or dodged on today's special edition of The BradCast, as Trump heads to a jail in Atlanta to be booked on his fourth criminal indictment of the year and Fulton County District Attorney Fani Willis asks the Court [PDF] to begin his racketeering trial just two months from now in October(!) and as the once Grand Ole Party continues its long, dangerous descent into madness.

POST-SHOW UPDATE: The judge quickly approved Willis' request for an October 23 trial, but only for Trump attorney Ken Chesebro (alleged architect of the fake electors scheme), who invoked Georgia's speedy trial law. The other defendants do not yet have a trial date. So The Cheese stands alone...

Today's BradCast might be best summarized by matching up the mugshots and court appearances this week (most of them just today!) of Republican attorneys who are being held accountable for felony crimes, most related to election fraud. [Audio link to full show follows below this summary.]

From left to right of the rogues gallery pictured above...

  • Ohio attorney and Trump donor James Saunders was found guilty on Tuesday of two counts of election fraud for having voted twice, once in Ohio and once in Florida, in both the 2020 and 2022 general elections. The judge immediately sent him to jail after the verdict, even before his sentencing next week. Saunders apparently committed the same crimes in 2014 and 2016, but the statute of limitations had already run before Cuyahoga County prosecutors nabbed him.
  • Republican Texas Attorney General Ken Paxton's trial on 20 impeachment charges in the state Senate is scheduled to begin on September 5. The photo above (second from left) is his mugshot from 2015 when he was charged with state felony Securities Fraud which he has yet to be tried for. TX voters elected him twice since then, nonetheless. As to the charges for which he has now been impeached, Texas House impeachment managers this week released new details about Paxton's abuse of office as the state's top law enforcement official, which include abuse of office to help his friend and donor Nate Paul, his use of a fake Uber account, burner phones and secret personal emails accounts used, in part, to facilitate his secret visits with his mistress who Paul's firm hired in order to make it easier for Paxton to visit her in Austin. All of that, even as Paul was secretly paying to renovate Paxton's home in McKinney. Paxton, who led the failed U.S. Supreme Court lawsuit attempting to toss out every vote cast in Georgia, Michigan, Wisconsin, and Pennsylvania, in the 2020 Presidential election, is also under federal investigation for many of the crimes he has been impeached for in the Lone Star State where he is now serving his third term as A.G.
  • A whole passel of Donald Trump co-defendants --- many of them also Republican attorneys --- were in the news today, as many surrendered to felony charges in Fulton County, Georgia, after being charged in the state racketeering conspiracy indictment along with Trump for their efforts to steal the 2020 election in the Peach State. Seen in mugshots above (slots 3 through 6) are Trump attorneys Rudy Giuliani, John Eastman (booked yesterday), Ken Chesebro, and Sidney Powell. Also surrendering today in Atlanta was Misty Hampton, the Republican Election Director of Coffee County, GA who invited Powell, and a bunch of other MAGA folks in to the Elections Office in the rural, Republican-leaning GA county to make unlawful copies of the state's sensitive voting system software. Also in related news today were Trump's former Chief of Staff Mark Meadows and former Trump DoJ attorney Jeffrey Clark. Both are co-defendants in the RICO case, currently seeking to move their trials to federal court. Both had moved in federal court to postpone or cancel their surrenders in Fulton County. Both motions were rejected by the federal court today just before airtime after Fulton County District Attorney Fani Willis made clear that they had both been given more than enough time before this Friday's deadline to turn themselves in.

In other, occasionally related news on today's program...

  • Yevgeny Prigozhin, founder of the Russian mercenary Wagner military battalion and leader of a short-lived coup against his former close ally, Vladimir Putin, earlier this year, reportedly died along with 9 others in a private jet that crashed shortly after takeoff approximately 60 miles north of Moscow on Wednesday. The plane was video-taped falling out of the sky after something appears to have caused an explosion after the jet had reached cruising altitude.
  • Milwaukee Public Schools were closed today in Wisconsin due to a dangerous heat wave. The closure comes on the same day that eight GOP candidates --- none named Trump --- are to appear in Milwaukee this evening for the party's first Presidential Primary debate of the 2024 season. Pretty much all of these candidates, many of whom pretended to be furious about school closures due to COVID, are also climate crisis deniers. Nonetheless, they are unlikely to raise the issue of our climate emergency at tonight's debate, despite the school closures today due to climate change in the very city in which they will be debating tonight.
  • The newly all-male state Supreme Court in South Carolina reversed the Court's own ruling from earlier this year today, regarding the state Legislature's near total abortion ban, even though the majority opinion concedes the new law infringes "a woman’s right of privacy and bodily autonomy." The 5 men now serving as Justices --- following the lone female Justice's mandatory retirement earlier this year --- just don't care, apparently. Unlike the now-retired female Justice who wrote the majority opinion blocking the new law earlier this year, the dudes now sitting on the state's High Court believe those state Constitutional interests of women do not outweigh "the interest of the unborn child to live."

And finally...

  • Trump says he will go in for booking at the Fulton County jail on Thursday evening, during TV's prime-time, of course. As he is set to be arraigned for his fourth criminal indictment of the year (his second one for attempting to steal the 2020 election), musical satirist Randy Rainbow returns with an all new, hilarious tune to mark the occasion and close today's program...

Also: Hurricane Hillary eyes Southern CA and/or AZ...

Details on that on today's BradCast, along with a whole bunch of other stuff we've had to set aside of late, thanks to the now 91 criminal felony charges being faced by our corrupt and disgraced former President. [Audio link to full show follows this summary.]

Among the stories covered today that (largely) have nothing to do with felony indictments...

  • Hurricane Hilary spins up suddenly off the coast of Mexico and is now gaining strength amid an El Nino. The storm is said to be heading north to make what could be an "exceedingly rare" landfall over the next few days somewhere here in Southern California or along the Baja Peninsula before moving up and into Arizona --- if you believe scientists who are experts in this sort of thing.
  • The gerrymandered Republican state legislature in North Carolina on Wednesday overrode vetoes by Democratic Gov. Roy Cooper to enact new laws that are unspeakable cruel to, among others, transgender children. If you are unaware, we explain exactly why these types of laws --- now adopted by 22 GOP-controlled states (though being challenged in court in most of them) --- are so awful and cruel. That is, unless you are a Republican, like those who stole control of the NC legislature, who believe Big Government should intercede between doctors and patients and that so-called "parental rights" should also be overruled by Big Government autocratic fiat.
  • Speaking of autocracy, gerrymanders and Big Government Republicans now dictating to small, local government and voters...the morally and ethically broken GOP-controlled state legislature in Texas has recently passed a law to oust the chief election official in Harris County (Houston) --- and only in Harris County --- just months before upcoming municipal elections in the state's largest and most Democratic-leaning County. A state judge this week found the new law in violation of the Lone Star State's constitution. But, just hours later, the state put that ruling on hold by appealing it to the TX Supreme Court (all Republican). The November elections are now just weeks away and, unless something changes quickly, will apparently be run by the Harris County Tax Assessor-Collector who has zero experience running elections and had nothing to do with the months-long planning for the one where early voting is set to begin next month.
  • In far more encouraging news about autocracy, gerrymandering and, in this case, democracy, we head to the great state of Wisconsin. On August 1, Justice Janet Protasiewicz became the state Supreme Court's newest member after being elected earlier this year. Her landslide (for Wisconsin) 11-point victory in April means that liberals now hold a majority on the state's High Court for the first time in about 15 years. On August 2, a group of petitioners filed with the state Supremes to not only force new, fair legislative maps for the state's House and Senate for the first time in more than a decade, but also for emergency elections next year for all members of the state Senate, many of whom will not otherwise face reelection until 2026 despite occupying seats that petitioners argue are held only thanks to the GOP's unconstitutional partisan gerrymanders. BRAD BLOG legal analyst Ernie Canning wrote about this challenge to the state's illicit, entrenched legislative majorities this week and the potentially very good news it represents for Badger State voters. Just after airtime today, however, he updated his article with...well, some more good news but also...some troubling news about the gerrymandered GOP's new scheme to undermine democracy, the rule of law, the state constitution and state voters with impeachment proceedings against Protasiewicz in hopes of stealing back the Court to hold onto their entrenched, corrupt state legislative majorities. (See Ernie's UPDATE today on that story for more details.)
  • Then, a bit of listener mail in response to my apparently controversial suggestions of late that Donald Trump may very well not be on the general election ballot by November of next year.
  • And, finally, Desi Doyen has our latest Green News Report with updates on the horrific fires on Maui and in Canada, but some very encouraging news about President Biden and the Democrats' landmark climate law, signed one year ago this week, which is already resulting in a clean energy manufacturing, construction and jobs boom in the U.S. --- and even overseas!...

We've got more Special Coverage on today's BradCast of the fourth --- and, theoretically, last, but who knows? --- criminal indictment of our disgraced former President for the Summer season. [Audio link to full show follows below this summary.]

On Monday's show this week, just hours in advance of the massive new criminal charges out of Georgia, we detailed the dangers to next year's elections of the illicit Coffee County, Georgia voting system software breach carried out by Trump supporters beginning on January 7, 2021 (and covered up in the many months that followed by Sec. of State Brad Raffensperger). The scheme --- which we helped break last year and have been covering ever since --- is now known to have been just one part of a multi-state conspiracy organized by Trump attorney Sidney Powell and hatched inside Trump's Oval Office in December of 2020. It remains a huge threat to the security of next year's Presidential elections across the entire state of Georgia and in more than a dozen states with jurisdictions using the same breached, proprietry hardware and software that was stolen from Coffee County.

On Tuesday's show, we detailed the sprawling 97-page RICO indictment [PDF] of Donald John Trump and 18 co-conspirators charged with 41 felony counts by a grand jury in Fulton County, Georgia late on Monday. The charges are related to Trump's alleged (and failed) criminal enterprise to steal the 2020 Presidential election in the Peach State (and elsewhere) and comes out of the two-year probe by Fulton County, D.A. Fani Willis. We broke down all of the charges, detailed those who were indicted, along with a focus on the specific charges brought against Powell and the three others facing several counts related specifically to conspiracies to commit Computer Theft, Computer Trespass, Computer Invasion of Privacy ("with the intention of examining personal voter data") and Conspiracy to Commit Election Fraud as part of the Coffee County scheme.

The new indictment brings the number of criminal felony charges that our disgraced former President is now personally facing in four different jurisdictions at both the state and federal level to a gob-smacking 91!

And then on today's program, our hot indictment summer continues, with both legal and political analysis of the new indictment with two old friends.   • How that "REPORT" is likely to be an unlawful continuation of the same criminal enterprise under RICO that he is already charged with.
  • What we should expect from next week's first-of-the-season 2024 GOP Presidential debate in Milwaukee and whether Trump will (or should) show up for it.
  • My continuing --- if, apparently, controversial --- Spidey Sense (not a prediction...just a sense, as explained today) that Trump will, ultimately, not end up being the GOP Presidential candidate on next year's ballot...

Hot enough for ya? Well, you ain't seen nothing yet. More on that on today's BradCast, but we lead off with some slightly better news on accountability for a few Team Trump wingnuts. [Audio link to full show follows this summary.]

Rudy Giuliani admitted in court documents filed on Tuesday night that he made "false" claims about Georgia poll workers Shaye Moss and her mother Ruby Freeman. The filing was part of their defamation suit against the disgraced Trump attorney and former NYC Mayor. They were the two women who risked their lives to valiantly help tally votes during the COVID pandemic in 2020 at the State Farm Arena in Atlanta, only to be falsely targeted by Giuliani and Donald Trump (and then their minions) for mistallying ballots. Trump called Freeman a "vote hustler." Giuliani falsely charged the two African-American women were passing USB drives back and forth in the counting room "like vials of heroin or cocaine". (In fact, it was Freeman passing a ginger mint to her daughter.) Rudy's legal admission, however, appears to be an attempt at avoid turning over critical discovery documents, including emails from during the period when he and Trump were actually attempting to steal the 2020 election. We'll see if his ploy works. More to come in that suit, I suspect.

Another Trump grifter was sentenced to federal prison on Tuesday for stealing money from donors to the private, MAGA "We Build the Wall" project. Colorado "businessman" Timothy Shea was sentenced to five years and three months after two other men who also organized the scheme were previously sentenced to multiple years in prison. All three were charged along with Trump's former top advisor Steve Bannon, who was pardoned by Trump for this crime on his way out of office. Bannon, however, has since been charged for related crimes by New York state.

Then there is the dope Ammon Bundy. Remember him? (Look him up.) He's an old school wingnut who has now been found liable by a jury for more than $50 million as part of a defamation suit filed against him by a hospital in Idaho that he and fellow rightwingers falsely accused, according to the Idaho Statesman, of "working with the government to take children away from Christian families to be sexually abused and given to gay couples."

That, however, is the good news today. As to the rest of it, well...

The ocean water off the tip of Florida now appears to have hit an all-time record for seawater anywhere on Planet Earth since man has been here anyway. Literally hot tub-like temps of 101.1 and 100.2 Fahrenheit were recorded over the past two days. That, as a new study of ocean currents published by the journal Nature on Tuesday finds a key part of the Gulf Stream known as the Atlantic Meridional Overturning Current (or AMOC) could collapse entirely by mid-century or even as early as 2025 as waters continue to warm. The result would be catastrophic and, according to scientists, "affect every person on the planet."

We explain what that means --- and doesn't --- along with a bunch of newly shattered heat, wildfire and flooding records this summer by way of prelude to today's guest, meteorologist GUY WALTON, 30-year Weather Channel veteran, tracker of worldwide climate records, and author of the World of Thermo illustrated children's book series on our quickly worsening climate crisis.

"We are smashing more records than usual," Walton tells me today, "except for the United States. Globally there have been more" broken records than usual this Summer. He does stick his neck out to predict this one: "I have no doubt that July of 2023 will go down, when the figures get computed, as the warmest month in recorded history. Not just the warmest July, but the warmest month ever."

While Walton has been observing and reporting on these new records for years, he concedes there is one that he didn't expect, at least so soon. "That warm water temperature down near Miami of over 100 degrees Fahrenheit. Didn't think I'd live to see something like that."

Other landmarks, such as "the disappearance of Arctic sea ice," he explains, "was not predicted until about the year 2050. Now it's going to be more like 2030 [or] 2040." That is part of our discussion about how climate scientists tend to be quite conservative in their predictions, despite rightwing climate deniers who falsely claim they are just "liberal grifters" trying to make a buck on the extremely lucrative career (insert rolling eyes emoji here) of climate science.

Other topics of note discussed with Walton today: His attempt to "kill two proverbial birds with one stone" by his naming of major heat waves after oil companies. (We are currently suffering through Heat Wave Chevron); The extraordinary number of climate deniers who (incredibly) still exist at this point. ("I find that a large number of climate deniers actually failed their science classes when they were going to high school, because they can't read charts [or] very simple graphics."); And the dark turn taken in the third, recently published book in his World of Thermo climate change series for kids, this one titled World of Thermo: Grim Reaping.

Finally today, some listener comments in response to my conversation last week with E&E News climate impacts journalist Thomas Frank on the "canary in the coal mine" climate change-fueled home insurance crisis now roiling the state of Florida. As listener Wendy noted, what is happening there now has been predicted for years, as the insurance crisis threatens to become a home mortgage crisis, as also discussed with Frank. She notes that climate and investment researcher Spencer Glendon offered brief, yet remarkably prescient remarks on these points during a Sohn Institute conference back in 2019. We shared a few on-point minutes today from Glendon's 2019 remarks at that conference. His full 15 minutes, however, are well-worth listening to and can be viewed right here...

Today on The BradCast: Why I'm quickly becoming a single-issue voter and you should too. [Audio link to full show follows this summary.]

It's getting easier and easier by the day --- as Trump's Republican Party completes its transition to full-on autocracy --- to make my choices for next year's general election before I even know who will be running. If a candidate is pro-democracy and running against a pro-autocracy candidate, I'll choose the one who supports democracy every time. It's simple.

It's not a partisan issue either. If there is anyone left within the Republican Party willing to support democracy and oppose authoritarianism, I'm happy to examine the rest of their record and consider voting for them. The way things are shaking out, however, I'm not sure where I would find such a Republican candidate, all of which is discussed in varying degrees of detail on today's program.

Among the many stories today that help illustrate what I believe will be the single most defining issue in American elections for the foreseeable future...

  • A Township Clerk in Michigan is stripped of his election administration duties after being one of 16 people indicted this week for defrauding the state by pretending to be a "duly elected" elector after the 2020 Presidential election. Each of the 16 Republicans are charged with 8 criminal counts related to conspiracy to commit election forgery. Each charge carries a penalty of anywhere from 4 to 14 years in prison. While they all deserve punishment, I especially hope they throw the book at the longtime, elected Shelby Township Clerk Stan Grot, who violated the trust of the people he serves, who definitely understood what he was doing wrong, and that Donald Trump did not win Michigan's 2020 election.
  • While GOP election officials are violating election laws (Grot is not the only one), the Republican lawmakers are otherwise working hard to prevent (certain) people from voting at all. Happily, a U.S. District Judge in Florida recently blocked a new state law that prevented certain former felons and non-citizens from participating in voter registration drives. The judge found the measure, signed by Gov. Ron DeSantis, to "reduce individual rights to ashes" in violation of the U.S. Constitution.
  • Meanwhile, Republicans in the U.S. House are attempting to force similar measures on all 50 states, reducing states rights to ashes (despite long pretending to care about them, but only in certain, very specific circumstances). Their newly introduced measure is called The American Confidence in Elections Act. It makes it more difficult for many to vote, easier to cheat, and easier for millionaires and billionaires to further purchase American elections. Contrast that with two Democratic voting and election reform measures being reintroduced --- the Freedom to Vote Act and John R. Lewis Voting Rights Advancement Act --- which would, among other things, make it easier for legal voters to cast their votes, provide support for election workers, regulate dark money in elections, ban partisan gerrymandering, revive portions of the Voting Rights Act gutted by SCOTUS, and allow every voter a hand-marked paper ballot. Again, another clear illustration of a pro-democracy party versus an anti-democracy party. Next year's choices should be simple.
  • And, if there are any remaining questions about Democracy v. Autocracy as the stark new stakes our country now faces, there is likely no clearer illustration of it than Monday's explosive New York Times story detailing the Republican's $22 million "Project 2025". The plan, being prepared by former Trump White House officials for Trump or whichever Republican next wins the White House, involves what NYU Historian and fascism expert Ruth Ben-Ghiat described as "autocratic capture". The scheme, which they are not trying to hide, calls for the consolidation of all Executive Branch power into the White House, allowing the President to purge tens of thousands of career public officials deemed as insufficiently loyal, and to allow him or her to take over complete control of all independent Executive Branch agencies, such as the Dept. of Justice, FCC, FTC, Federal Reserve and many others. The President would also grant himself the power to block the allocation of monies appropriated by Congress. As one of the Republicans behind the project explains: "There is no way to make the existing structure function in a conservative manner. ... What’s necessary is a complete system overhaul." Another tells the Times: "What we’re trying to do is identify the pockets of independence and seize them." Are the extraordinary 2024 stakes making sense out there yet?
  • All of that as the planet's climate continues to degenerate thanks to the continuing burning of fossil fuels and those in the industry --- and politicians they've purchased --- who continue to lie to the public about it. In California's "Darth Valley Run" one guy is making the best (or worst?) of it...even as he seems to concede he is certifiably insane. (See the photo above for a hint.)
  • And, in Philadelphia on Thursday, President Biden, speaking at a shipyard, detailed an extraordinary array of remarkable new renewable energy projects now underway --- mostly off-shore wind in this case --- and the thousands of good-paying, union jobs that come with them, created by Biden and Congressional Democrats in all 50 states as part of last year's Inflation Reduction Act.
  • Finally, Desi Doyen further breaks down the stakes for the planet --- as all-time, mind-blowing heat records continue to be shattered across the Northern Hemisphere --- in our latest Green News Report...
