"Abortion is an essential component of women's health care" --- American College of Obstetrics and Gynecology

The remarkable, temporarily-stayed nationwide ban issued last Friday by a far-right, Trump-appointed federal judge on the use of a drug approved by the FDA for medication abortions more than twenty-three years ago, is hardly the only jaw-dropping, radical right-wing assault on medical and reproductive freedoms over the past week. (See our now-updated, detailed coverage from February on that and related cases.)

Threatened with a suspension of their licenses to practice medicine in Idaho if they so much as inform their patients of the availability of lawful abortions in other States, a group of OB/GYNs has now filed a federal lawsuit [PDF] charging a new, near-total state abortion ban, as interpreted by its Republican Attorney General, Raúl Labrador, violates the U.S. Constitution.

The medical professionals, who do not perform in-state abortions, are joined by Planned Parenthood in their suit, filed last week in U.S. District Court.

The suit was triggered by the Gem State AG's recent letter/analysis [PDF] in which Labrador wrote that state law now "prohibits an Idaho medical provider from...referring a woman across state lines to access abortion services." He concluded that informing a patient about the availability of lawful abortions in other States amounts to "assisting" an abortion in violation of Idaho statute. That violation, the AG added, would trigger a suspension of a medical provider's license to practice medicine in the state.

Plaintiffs in Planned Parenthood v Labrador allege Labrador's interpretation of one of the most extreme anti-abortion laws in the nation runs afoul of several Constitutional rights, including their right to free speech. The suit also reveals how Idaho's new application of a "Fugitive Slave Act" mentality appears to violate other provisions of the U.S. Constitution, including the Commerce Clause and the 14th Amendment's Due Process clause...

As a chaotic vote to condemn Donald Trump's racist comments against four Democratic freshmen Congresswomen of color moved successfully through the House during today's BradCast, we tried --- even if we didn't always succeed --- to focus as much or more on the effects of his Administration's dangerous policies, more than his obnoxious, hateful words as our eternally embarrassing President of the United States. On Monday morning, as we discussed on yesterday's program, Trump's Attorney General Bill Barr, with a stroke of his pen, took Administrative action to effectively rewrite decades of immigration law and case precedent to bar virtually all asylum claims made on the U.S. southern border. The radical action is now being challenged by the ACLU and, according to many immigration experts, is likely to be found unlawful by the federal courts.

Then, on Monday night, after we got off air yesterday, the Administration enacted another radical measure without notice. Trump's Department of Health and Human Services declared a new regulation would immediately take effect to ban medical services providers who receive Title X funding from referring patients to other doctors for abortions. Federal funds are already banned for use in most actual abortions themselves, but now what critics describe as a "gag rule" will be in place to keep medical professionals from even referring their patients.

Title X, signed in 1970 by President Richard Nixon after bipartisan support in Congress, allocates some $260 million each year to family planning services for four million low income women. The funds are granted to states across the country and to organizations such as Planned Parenthood.

Under the new regulations, as our guest today, Politico healthcare reporter ALICE OLLSTEIN detailed after the rule was first proposed earlier this year, "clinics offering abortions would need to construct physically separate entrances, hire separate staff and maintain separate medical records for its abortion and non-abortion providers --- a requirement reproductive care groups argue is so costly that some, or even perhaps many, sites would be forced to close."

At the top of today's show, news broke that, in the wake of the Administration's new regulations and other rightwing assaults on the Constitutionally-protect right to abortion, Planned Parenthood's recently appointed new President, Leana Wen, has been forced out of her post. The group had previously suggested they would need to forgo federal Title X funding if the rule was formally enacted, as have several states across the country who, like Planned Parenthood are suing to block the regulation.

Nonetheless, even before any of those lawsuits have been tried, the new rule has been placed into immediate effect by HHS, resulting in "mass confusion and chaos" for states and medical care providers alike today, according to Ollstein. "Now, any clinic that makes abortion referrals for patients who request one will have their funding cut," she tells me. "Lots of clinics across the country, including all Planned Parenthood clinics, which serve a large portion of the Title X population, said that they can't comply with that. It's against their ethics as doctors to not be able to make a referral that a patient requests. So they said 'We're going to exit this program. We're going to try to rely on our own funding as long as we can. We're going to hope the courts stop this rule, and we're going to try to keep our doors open and serve this low-income population.'" But, as Ollstein notes, "that could be a struggle."

She also explains how the Right is able to justify this blatant intrusion of the federal government between a patient and her doctor, given their years of decrying the Affordable Care Act (Obamacare) under the premise that the landmark healthcare law would do just that. Ollstein also goes on to warn that the federal case currently moving through the U.S. 5th Circuit Court of Appeals that could strike down Obamacare entirely as unconstitutional, is now a very real threat to the law's future --- which even Republicans in Congress are now beginning to panic about.

Also on today's program, we follow the House Democrats move today to pass a non-binding resolution condemning Trump for his racist "go back" to your countries tweets over the weekend, directed towards Reps. Alexandria Ocasio-Cortez, Rashida Tlaib, Ayanna Pressley and Ilhan Omar, all of whom are American citizens. Three were born in the U.S. and one, Omar, came here as a child refugee to escape civil war in Somalia. Also today, Texas Democratic Rep. Al Green announced his intention to introduce Articles of Impeachment against Trump once again tonight after the vote on resolution to condemn Trump. He vows to force a floor vote on the Articles within two legislative days.

By show's end, the racism resolution had been passed by Congress with the votes of all Democrats, four Republicans and newly independent former Republican Justin Amash, after what is being reported as a "bitterly partisan brawl" and "one of the most polarizing exchanges" ever on the House floor. The measure comes after both Trump's racist tweets telling the women to "go back and help fix the totally broken and crime infested places from which they came" on Sunday, and his doubled-down assertion on Monday that their criticism of his Presidency and policies demonstrates they "hate America".

In fact, as Philip Bump cleverly highlights in a "Who said it?" test at Washington Post, Trump's own comments about the U.S. during the Obama Administration are far more demonstrative of hating America than anything ever known to have been publicly uttered by the four women he continued to attack on Twitter today. We're happy to associate ourselves with Stephen Colbert's response to all of this from Monday night.

Finally, as if all of that isn't chaotic and ugly enough, Desi Doyen joins us for our latest Green News Report, after New Orleans dodged catastrophe (for now) from Hurricane Barry over the weekend; the U.S. sees its wettest 12-month period on record (again); and the weekend blackout in NYC reveals (also, again) the fragility of this nation's vulnerable infrastructure...

On today's BradCast: Some encouraging election news. More disturbing news about the Republican's "sham" rush rob to ram through another GOP activist onto the U.S. Supreme Court before they could lose their slim majority in the U.S. Senate. And the re-emergence of Barack Obama before the November midterms. [Audio link to show follows below.]

First up today, noteworthy reported results from Thursday's midterm primary elections in Delaware and some largely good election news elsewhere.

In Florida on Friday, a federal judge ordered 32 counties sued by a number of voting rights and Latino advocacy groups to immediately publish election materials in Spanish, in addition to English, in compliance with the Voting Rights Act. As we discussed with Demos' Senior Counsel Stuart Naifeh on a program last week, the groups had sued after the counties failed to comply with the VRA, despite some 50,000 U.S. citizens who were dislocated from Puerto Rico after Hurricane Maria having trouble re-registering and voting in the Sunshine State's "English only" counties. The judge's ruling, suffice to say, suggests he was VERY unhappy with the defendants in the case.

In Kansas, a Republican candidate for the state's House of Representatives has been arrested on election fraud charges. Notably, the Sec. of State Kris Kobach, a longtime GOP "voter fraud" fraudster and now the state's Republican nominee for Governor, had no comment on the arrest after having failed to bring the charges himself, despite convincing the state legislature to give him prosecutorial powers (the only SoS in the nation with such powers) and despite having made claims of a massive "voter fraud" epidemic central to his role as the state's chief election official.

Then, the week-long circus at the U.S. Senate Judiciary Committee's confirmation hearings for Donald Trump's U.S. Supreme Court nominee, former Republican activist turned D.C. Court of Appeals Judge Brett Kavanaugh, wrapped up on Friday, with still more late disclosure's about Kavanaugh's record while serving as an operative in the George W. Bush Whitehouse. The disclosures come from documents from during that period which Republicans had attempted to keep "confidential" from the American public.

Salon's political reporter AMANDA MARCOTTE, who's been reporting on the proceedings, joins us to discuss what we've learned --- and haven't --- about Kavanaugh and the Democrats' surprisingly united and aggressive attempt to block his confirmation. "The Senate Democrats came at this in a way that I don't think I've ever seen them do anything of this sort before. They had an organized strategy, and they executed it pretty well," she explains.

We focus specifically today on Kavanaugh's "threat to women's health and safety" with his disingenuous and misleading statements to the Committee (and to potential swing voting Republican Sens. Susan Collins and Lisa Murkowski) about Roe v. Wade's Constitutional right to an abortion as "settled law". Several lines of questioning from Sen. Kamala Harris (D-CA) this week, as well as so-called "committee confidential" documents released by Sen. Cory Booker (D-NJ) --- at threat of Senate expulsion --- underscore the con that both Republicans and the activist Judge Kavanaugh are attempting to pull off on the American public.

"If you were a space alien and you just dropped in to watch these hearings, you would get the impression that the Republicans think of Brett Kavanaugh as a liberal lion. All they do is talk about how anti-racist he is, how pro-equality. The cases that he's ruled on that they've highlighted were the three or four extremely rare ones where he sided with working people or oppressed people or people trying to get healthcare. The tiny minority of his cases. They barely go a minute without talking about how much he loves women, and he's practically a feminist," Marcotte says. "It's been kind of surreal, because obviously they don't believe a word of it, because if they actually thought he was any of the things they were presenting him as, they wouldn't have nominated him."

She charges Kavanaugh has been trying to "imply that he's going to uphold Roe", though "he clearly has no intention of doing it. That's why the leaked emails were such a big deal...These hearings should be understood as an elaborate theater to give Susan Collins and Lisa Murkowski cover while they vote, to claim that they're pro-choice while voting to overturn to Roe v. Wade."

We also take a few minutes to discuss Marcotte's recently published book, Troll Nation: How the Right Became Trump-Worshiping Monsters Set on Rat-F*cking Liberals, America, and Truth Itself --- not that she has particularly strong opinions on such things. :-)

Finally, after another tough week --- almost a year and a half of them, in fact --- former President Barack Obama reemerged on Friday with a speech at the University of Illinois that unloaded on Trump as, among other things, "a symptom, not the cause" of our current woes. More importantly, he offered some advice and inspiration regarding the necessity of voting in this November's midterms and elections beyond them. We close out the week with some excerpts from his address...

On today's BradCast, the GOP health care plan to "repeal and replace" Obamacare has landed with a thud among Democrats and, only somewhat more suprisingly, among so-called conservatives. And, as our guest argues today, that may have been the plan all along. [Audio link to show posted below.]

House Republicans leadership introduced their long awaited health care plan on Capitol Hill late yesterday and we break down the details of it today. But, other than Donald Trump who described it, via Twitter, as "our wonderful new healthcare bill", the plan does not seem to be going over well in a number of key quarters. Of course, Democrats oppose the new scheme to "repeal and replace" the Affordable Care Act (or, "ObamaCare") and Republicans have yet to have their new plan, dubbed the American Health Care Act, scored by the non-partisan Congressional Budget Office (CBO). So we don't know how much it will cost or how many people will actually be covered under it (or lose their coverage, thanks to it.)

But, the more important push-back against the new plan appears to be coming from Republican members of Congress and the rightwing policy groups like the Heritage Foundation and the Koch Brothers-funded Americans for Prosperity. They are calling it "ObamaCare-lite" and vowing to block it, as our guest Ryan Grim, Washington Bureau Chief for Huffington Post reports today.

Grim tells me why, based on his reporting, the roll-out --- and the plan itself --- appears to be such a disaster, and suggests that Republicans, including Speaker Ryan and Republican Senate Majority Leader Mitch McConnell, have no actual intention of repealing and replacing the Affordable Care Act at all. "They're pretending," he says. "Also they didn't think they were going to win the election. They didn't think they were going to catch this car that they've been chasing down the road. The problem for them is that Obamacare itself was basically designed by the Heritage Foundation years ago. So it's almost unfair for them to try to come up with an alternative to the thing that they developed themselves. But they're the ones who disavowed their original plan, so it's not that unfair."

"Paul Ryan is not an idiot. He has the phone numbers for the Koch Brothers, Club for Growth, Freedom Works, Heritage, all these different outfits that piled on it today. So how was this not worked out [in the last 8 years]? It suggests to me that it's not actually a serious attempt," Grim explains before detailing why it is not even a safe bet, at this point, to assume that Ryan and McConnell "actually want to pass something" at all.

Also on today's show: Trump lied about requiring U.S.-made steel in pipelines like KeystoneXL, and France, fearing the possibility of hacking, cancels on-line voting in advance of their upcoming elections...

On today's BradCast, as dark as yesterday's show was, today is somewhat the opposite, with a whole bunch of encouraging news from the courts and the people across these United States. [Audio link to show follows below.]

Attorney and legal journalist Mark Joseph Stern of Slate joins us to break down the full 4th Circuit Court of Appeals' potentially landmark decision upholding the state of Maryland's ban on semi-automatic "weapons of war" and the U.S. Supreme Court's ruling today on a race-based death penalty case out of Texas.

On MD's ban on military-style assault weapons, enacted by the legislature following the 2012 Sandyhook Elementary school massacre, the full court's majority ruling, including a number of Republican-appointed judges, soundly rejected the opponents argument that, as Stern says, "once enough people own a certain type of gun, the 2nd Amendment magically begins to protect it." He explains what may happen next with this case as it moves toward the Supreme Court and offers his thoughts on why GOPers and the NRA are suddenly unconcerned with their "states rights" arguments when it comes to guns.

On the SCOTUS death penalty case, granting a repreive, for now, to a Texas man on death row since 1997, Stern explains how the case underscores that "people who are sentenced to death in this country get the worst lawyers sometimes...It's really quite shocking." Incredibly enough, Chief Justice John Roberts eloquently agreed --- at least in this case.

And more encouraging news also covered today...

  • A federal court in Texas blocks the state's attempt to defund Planned Parenthood;
  • North Carolina's Democratic governor moves to withdraw the state's appeal to SCOTUS, filed by his Republican predecessor seeking to overturn a federal appeals court finding that the state's election reform law unconstitutionally discriminated against African-Americans "with surgical precision";
  • An FEC commissioner refuses to back down in the face of legal threats from Koch Brothers'' funded group after her demand to see Trump's alleged evidence of thousands of illegal votes cast in New Hampshire's 2016 Presidential election;
  • Another new poll finds Trump's approval ratings "sinking like a rock";
  • A Muslim group raises $90 thousand (so far) to help repair the desecrated Jewish cemetery in St. Louis, MO;
  • A people continue to exercise democracy, whether Republicans and Donald Trump like it or not, by showing up in huge numbers at Congress member town halls across the country...

Guest: Alternet's Steve Rosenfeld on a report from legal experts finding more than 50 Trump electors were unlawfully seated...

On today's BradCast, it's another busy day of warmongering on Capitol Hill, attempts to gut American's health care systems, and one last-ditch effort to keep Trump from becoming the President-Elect. [Audio link to the show follows below.]

The cyberwar-mongering against Russia continued today in both the U.S. media and U.S. Congress, despite wildly erroneous reporting by mainstream media outlets and the disturbing lack of public evidence to support both the claims and calls from Democrats and some Republicans alike, to go on the offensive against the former Soviet nation. Those calls increased today during a U.S. Senate hearing with outgoing Dir. of National Intelligence James Clapper (who previously lied to Congress about the NSA's bulk collection on American email and phone call information), and despite new revelations that the FBI never examined the computer servers of the DNC, which they allege to have been hacked by Russia in hopes of supporting Donald Trump over Hillary Clinton.

Then, a new report documents an attempt from a bi-partisan legal team hoping to block the ratification of Trump's Electoral College victory in Congress on Friday. The effort is based on the group's 1,000-page documented legal finding that more than 50 of Trump's electors were unlawfully and/or unconstitutionally seated.

Alternet journalist Steve Rosenfeld, who broke the story late last night, joins us to explain the basis for the last-ditch effort to stop Trump, its chances for success, and some Congressional Democrats' surprising response to it.

"Everywhere you look under the rug, there's something else that is either broken or not followed when it comes to the partisan tinkering of elections," Rosenfeld tells me, arguing that Dems should use the information from the legal experts to both challenge Trump's (lack of) mandate and, at the very least, "as a moment to lecture the Republicans on voter suppression." He adds that despite the seeming Hail Mary nature of the effort, "today people are frantically searching for a Senator" to support a challenge to the Electoral College results during the Joint Session of Congress scheduled for Friday. Good luck with that.

Also today: U.S. House Speaker Paul Ryan announces that the GOP plans to end federal funding for Planned Parenthood, despite the organization's popularity and Desi Doyen joins us for the first Green News Report of the new year, with a whole bunch of environmental-related news that you may have missed over our holiday break, including the blatantly false story late last week by the Washington Post charging that "Russian hackers penetrated [the] U.S. electricity grid"...

On today's BradCast, Desi Doyen and I are finally back from a week of maddening illness over the holiday! My enormous thanks to Nicole Sander of RadioOrNot.com for her generously quick-footed and quick-witted guest-hosting in our absence!

First up today is a quick review of what we can (or can't) look forward to over the next two weeks in Paris, where the largest gathering of world leaders in history is now underway in hopes of carving out a "final" agreement to curb the global emissions that cause deadly climate change. We will have much more on the COP21 conference as it unfolds over the next two weeks.

Then it's onto the rightwing extremism --- from the Black Lives Matter protesters shot in Minneapolis to the attack at Planned Parenthood in Colorado Springs --- that took place over the past week. As we note, it wasn't ISIS or Syrian refugees threatening our nation last week. Rather, as made clear once again, "the call is coming from inside the house."

Finally, we are joined for the interview by independent journalist Brandon Smith of the blog Muckrakery. It was Smith's persistent work and FOIA requests and lawsuit (along with the efforts of independent activists and attorneys) that eventually led to the release last week of the Chicago PD dash-cam video showing the outrageous killing of 17-year old Laquan McDonald by Officer Jason Van Dyke who has now been charged with first-degree murder.

"The Freedom of Information Act," Smith explains, "can be used by anyone. So, if you're reading a news story and something sounds fishy to you, you can ask for any document or piece of information. It's your government. It's your responsibility, and mine too, to hold them accountable for what they do with their positions of power."

We discuss why it took more than a year for the Chicago Police to release the tape during its cover up of an apparent murder, whether Mayor Rahm Emanuel has responded sufficiently, and what we still do not know about the killing. (For example: What happened to the audio on that video tape?; What about the surveillance video allegedly deleted by cops at the Burger King?; Why didn't the corporate media file suit to get at the video themselves?; And what of all of those other officers at the scene who failed to take action, or lied about it, after witnessing Van Dyke pump 16 bullets into McDonald --- the first two while he was walking away from them, the other 14 while he was shot, on the ground, and a threat to nobody?)

"I'm just trying to report the story of police brutality in Chicago," Smith tells me while describing how much remains unknown and what he plans to FOIA next. "We want to know who knew what about the case, and how long they kept it hidden, and kept that story out there that Laquan was acting erratically and threatening officers. Not only that, but keeping the video secret and fighting the release of the video which would tell people this was a murder, according to the prosecutors."

All of that and more today on what is clearly just the tip of the very bad and racially-based policing in the Windy City and beyond...

Buckle up! On today's BradCast, we jump on board the crazy train to dissect last night's GOP/Fox 'News' Presidential Debate(s)!

My guests today are award-winning blogger/journalists Heather Digby Parton of Digby's Hullabaloo and Paul Rosenberg of Random Lengths News --- both also contributors for Salon.

Can Trump ever be derailed? Fox 'News' and Roger Ailes sure seems to be trying. And does any of it actually matter a year and a half out from the general election and more than six months before any votes are ever cast? We discuss all of the above (after "Digby" and I take short victory lap concerning Donald Trump!) and much more in today's post-debate roundtable!

"[Trump] has absorbed all of the rightwing tropes of the past 30 years and made them his own. He's ingested them, digested them, regurgitated them, played with them, shaped them into figurines, and just endlessly fascinated himself with them, and invited people to play along with him," Rosenberg tells me. "And people are happy to do so, because he is their ideal --- he is a super-wealthy person who is 'just one of us'."

For her part, Parton says the debate actually does matter, for one reason, "because what we're seeing are the contours and outlines of the Republican argument. I think it's pretty clear they're going to be running as war-mongering, tax-cutting, slash-and-burn politicians who are going to roll back everything that's happened in the last eight years. And they're going to do it all in the first day, so that's good."

A fascinating and fun discussion! Plus: Desi Doyen joins us for the latest Green News Report' on another new candidate in the GOP race and the pushback against the President's new rules for emissions cuts...

Before things get really dirty today on today's BradCast, breaking news on Planned Parenthood getting hacked and what that should mean for your electoral system; a U.S. Senator reports that Obama plans to reject the Keystone XL pipeline; NSA plans to finally destroy American phone records (thanks to Edward Snowden); and approval ratings fall off a cliff for the Republican Party --- especially by Republicans!

Then, though you may need a shower afterward (I do!), the latest Trump mess on allegations of 'rape' by his former wife Ivana and the amazing response to those claims by Trump's long-time attorney --- who needs to be fired...immediately.

Yes, this is the man who is now the front-runner for the Republican Party nomination for President of the United States in 2016. Moreover, the first official Presidential debate is scheduled on Fox "News" for a week from Thursday. So, I guess it's time to start covering the man as we'd cover any other legitimate candidate, much less the front-runner, right?

Finally, Desi Doyen joins us for the latest Green News Report to make everything better again --- except for that stuff about the imminent destruction of the human race...

Cites O'Keefe's prior alleged criminal violations in phony Planned Parenthood 'sting'...

Appearing on MSNBC's The Ed Show on Friday night, Eugene Iredale, the attorney for former San Diego ACORN worker Juan Carlos Vera, made short work of the chiseling claim made by federal criminal and professional liar James O'Keefe, that he had agreed to pay Vera $100,000 simply to bring to a close a "ridiculous lawsuit."

"If he wants to get out of the settlement and wants to fight us in court," Iredale told host Ed Schultz in response to O'Keefe's fundraising bluster, "we're ready any time. We can go right now!"

O'Keefe agreed last week to settle the lawsuit filed by Vera in July of 2010 against him and his partner Hannah Giles. Vera had been fired by ACORN after deceptively edited video tapes of him, secretly recorded by O'Keefe and his partner Hannah Giles, were published by Andrew Breitbart in 2009. While the edited tapes made it appear as though Vera, whose English is poor, was interested in cooperating in a scheme to smuggle underage prostitutes across the Mexican border, in reality, Vera had played along with the pair in order to gain information, including taking their photos, and then immediately notified law enforcement about the ridiculous scheme O'Keefe and Giles were proposing.

After word of the settlement with Vera leaked to Wonkette's Matthew Phelan and Liz Farkas last week, O'Keefe took to Twitter to play the victim, describing his payout to Vera as the necessary result of a "nuisance lawsuit".

"Sadly, this is the cost of exposing the truth," he explained to his gullible fundraising base in a statement posted to his ironically named Project Veritas website late last week. "That's why so few people do it. There are liability issues inherent in undercover journalism."

Many of those paying attention to this long shameful saga would be right in responding in turn: "Um, what 'journalism'"?!

O'Keefe continued his post-settlement Twitter tantrum to describe media coverage of his settlement agreement as "lies and lies and more lies from journafascists," taunting them to "have the guts" to allow him to respond on TV.

The BRAD BLOG's Brad Friedman responded to O'Keefe in turn with an invitation to appear live with him on his KPFK/Pacfica Radio show this coming Wednesday, at which time he could, among other things, explain how deceptively edited videotapes deserve to be labeled "journalism" or why he describes Vera's complaint as "meritless accusations". O'Keefe has yet to respond to the invitation...
