With two major stories in the last several days regarding Alabama and the U.S. Supreme Court, it seemed like another good opportunity to bring their former Governor onto The BradCast to discuss both matters. [Audio link to full show follows this summary.]

First up, a bit more from where we left off last week in my rant about the 2024 election coming down to the ongoing existential battle between democracy and autocracy as, sadly, represented largely now by the two major political parties. Democrats largely represent the pro-democracy forces, while the Republican party now, by and large, firmly on the side of the autocrats from Donald Trump on down to the state and local level.

Just one example this week comes out of my old home state of Missouri, where the state Supreme Court unanimously ordered its state Attorney General Andrew Bailey last week to approve the certification for a Constitutional ballot measure that would enshrine the right to make personal decisions about abortion, birth control, childbirth and other issues related to pregnancy directly into the state constitution. That, in a state with one of the most draconian bans on reproductive rights in the nation.

Bailey had been holding up the measure for 135 days for a process that usually takes his office just over 50 days. He had been claiming that the State Auditors assessments that the measure might cost the state about $50,000 a year was "drastically" wrong, and that it would actually cost the Show-Me State some $12 billion instead! Either way, the state Supremes held that the A.G.'s office has no statutory right to hold up signature gathering for a ballot initiative based on his own personal disagreement with a State Auditor's cost assessment.

The MO A.G. is hardly the only GOP state official of late to simply defy the law, the courts and the Constitution. Republican lawmakers in Ohio recently engineered a special election for August 8 --- in defiance of their own law passed just months ago that largely bans August elections --- in order to feature a Constitutional measure to raise the approval percentage needed to enact a ballot initiative from 50% to 60%. That, just in time to interfere with an abortion rights ballot measure in November. The state GOP's measure on the ballot next month to make future initiatives more difficult for voters to adopt, of course, will require only 50% for passage.

Ohio's Republican lawmakers also spent the last year simply ignoring orders from the state's Supreme Court to redraw partisan gerrymandered U.S. House districts. And, last week, the GOP legislature in Alabama simply chose to defy the U.S. Supreme Court which, in June, ordered the state to redraw their House maps to include two Black-majority voting districts. Currently, the state has just one such district out of seven U.S. House seats, despite Black voters comprising more than a quarter of the state's voting age population.

While shamefully approving a new map drawn in a special session last week with just one Black majority district again --- it was signed by Republican Gov. Kay Ivey just hours later --- the state had no problem following a separate SCOTUS ruling last week that allowed them to kill a prisoner, even though three prior attempted executions were a disaster in the state. Two were called off indefinitely as officials couldn't figure out how to find a vein to insert an IV, and the other one took three hours to complete. The three liberals Justices dissented from the Court's six, corrupted, blood-thirsty rightwingers.

We're joined once again today by Alabama's former Gov. DON SIEGELMAN, the last Democrat to serve in that role, after being the only one in state history to serve in all four statewide positions, SoS, A.G., Lt. Gov. and Gov.

Early last month, Siegelman joined us to discuss an op-ed he'd written for WaPo with Alabama's former Republican Gov. Robert Bentley on the death penalty, with the two men conceding that they had come to regret presiding over the barbaric punishment, largely thanks to so many instances of prosecutorial misconduct --- particularly in cases where Black men are convicted and executed.

We picked up on some similar themes today in the wake of last week's SCOTUS ruling and the state killing of James Barber. "It's tragic," Siegelman tells me today. "But the worst part is that we have 167 on Alabama's death row. 115 of those people are sentenced to death growing out of an 1870 Jim Crow law that took Alabama from a state that required a unanimous jury to execute people to one now that allows someone to be sentenced to death on a jury recommendation that is non-unanimous. To my knowledge, Alabama is the only state in the country that is continuing this practice."

"We also have the distinction of having 31 people on Alabama's death row who were not sentenced to death by a jury, but sentenced to death by a judge who overrode the jury," he explains. "The jury recommended life in prison without parole, and the judge said, 'No, I think I'm going to go ahead and kill you anyway.'"

Siegelman also emphasizes that, "If we want to end wrongful prosecutions, if we want to end mass incarcerations, if we want to end the abuse of power by police, prosecutors --- and, I would say, by Presidents --- we've got to repeal the immunity that's been given to prosecutors," when they purposely mishandle a case.

As to Alabama Republicans stunning defiance of last month's Supreme Court order to add a second Black majority U.S. House district in the state under the Voting Rights Act, Siegelman argues: "I would hope the federal court would take action if their order is disobeyed. Including sending U.S. Marshals to pick up the state Attorney General and put him jail for a little while until he comes to his senses."

That's no small assertion from a former state Attorney General himself. Siegelman's got a lot more to say about the matter today, but hopefully that comment will entice you to tune in for our full conversation...

On today's BradCast: Amidst all the madness, we take a moment to revisit a continuing stain on the nation and what can be done about it, with a longtime friend of this program. [Audio link to full show is posted below this summary.]

FIRST UP, however, a few news headlines...

• The cost of our climate crisis strikes home for a huge swath of the nation, as smoke from hundreds of Canadian wildfires chokes American states from Minnesota to New York to the Ohio Valley to the Carolinas.
• Joe Biden's EPA announces it is sending $115 million to Jackson, Mississippi to begin repairing the city's long deteriorating water system. It's the first of some $600 million Congress has allocated to support long-overdue water infrastructure upgrades in the state's capital city, where more than 80% of the population is Black and drinking water supplies have repeatedly failed in recent years.
• The corrupt U.S. Supreme Court Justice Clarence Thomas has asked for another 90 days before filing his annual financial disclosures, following months of brutal investigative reporting revealing hundreds of thousands of dollars worth of his undisclosed luxury vacations, real estate deals and more with billionaire GOP megadonor Harlan Crow.

THEN, we're joined by Alabama's former Democratic Governor DON SIEGELMAN, who recently penned an op-ed at Washington Post with the state's former Republican Governor Robert Bentley. As explained in their piece, both men have come to "regret" overseeing executions during their time as the state's chief executive after witnessing, first hand, "the flaws in our nation's justice system" during their own prosecutions.

Siegelman discusses one death penalty case in particular, the 2000 execution of Freddie Lee Wright, which he says he is now "personally haunted by", telling me today that Wright "should never have been charged with capital murder in the first place. He was exonerated by a jury, 11-1 voted to acquit him of this crime. Then the D.A. came back and struck Blacks from the jury and got a conviction."

There are many other such cases, and he details a few of them. In fact, while AL currently has 167 people on death row, both Bentley and Siegelman write that "at least" 146 of them should have their death sentences commuted. Siegelman tells me he believes all of them should be spared from the barbaric practice of state execution.

He and Bentley are calling for several reforms of the criminal justice system, particularly as it applies to the death penalty. Siegelman details reforms he seeks for the secret Grand Jury system and the outrage of "judicial overrides" that allowed judges to overrule juries to issue death sentences and the lack of unanimous verdicts required for sentencing a convicted criminal to death.

Siegelman also discusses the politics of the death penalty, including during the time that he held the power to block executions as Governor. We discuss that awesome and horrible power as it is wielded by government officials today, even after all that we now know about the racial injustices of a Jim Crow era system that disproportionately targets people of color and has been found to have been exercised against innocent people in the cases of at least 12% of those who have been put to death.

"Here we are in 2023, still using a method that was devised after the Civil War as a way of thwarting a Black juror. The white power structure at the time had a unanimous verdict. But they said, 'No, you know, with Blacks being able to be on a jury, we can't risk not being able to put somebody to death when we want to, so let's go with a non-unanimous jury.' So that's where this relic of the Jim Crow era came from. It was purely a racist process."

"It is just wrong, certainly morally wrong, for Alabama or for any other state. Now Florida has even lowered the bar," notes Siegelman, citing a bill recently signed by Gov. Ron DeSantis. "Alabama has a 10-2 verdict. Florida has an 8-4 verdict, to make it even easier to put people to death by this relic of the 1870s."

"Until I was actually convicted of something that didn't exist except in the minds of the prosecutors, I thought that our system would somehow or another work itself out and be fair," he tells me. "But at the moment that I heard the word 'guilty' from the foreman of my jury, I said a prayer. It was instantaneous, more like a flash, asking God to forgive me because I remembered setting execution dates as Attorney General. And I remembered those that came before me while I was Governor asking that their sentences be commuted."

"But it wasn't even then that I realized how perverted our system of justice is. If in everything there is a purpose, or in every situation one should find a purpose, it was as if God was telling me, 'Okay, Governor, you see what's wrong. Now go fix it.'"

We've got yet another jam-packed BradCast for ya today, with results of note --- as we have them so far --- from the 7 states which held primaries on Tuesday. Then, we're joined by our guest with some helpful insight on what Democrats and progressives should learn from this year's elections to date and some of his critical concerns about the upcoming hearings by the bipartisan U.S. House Select Committee investigating January 6, 2021 insurrection. First, we fly through an extremely curated selection of results from several key races on Tuesday. Among them...

• IOWA: Retired Navy Admiral Mike Franken upset former U.S. Rep. Abby Finkenauer in the state's Democratic U.S. Senate primary. He will face off against 88-year old, six-term U.S. Senator Chuck Grassley. Also noteworthy in the Hawkeye State: progressive Democratic criminal justice reformer Kimberly Graham won the Democratic primary for prosecutor in Polk County (Des Moines), where she is likely to win this November.
• MISSISSIPPI: Two-term Republican Rep. Michael Guest was forced into a runoff by GOP voters as punishment for having voted in favor of a bipartisan, outside Commission to investigative the January 6th insurrection.
• MONTANA: Donald Trump's disgraced, scandal-plagued, forced-to-resign Interior Secretary Ryan Zinke is locked in a tight race to win his old job back as a U.S. Congressman. The final results of the close race with state Sen. Al Olszewski, which Zinke leads by about 1,000 votes as of airtime, will be held up by a day or two due to a ballot printing error that will require, under state law, that all ballots now be hand-counted.
• NEW JERSEY: While there may have been races of note there, we didn't have time for ANY of them today! Sorry about that, NJ! (I know. Always the bridesmaid...)
• NEW MEXICO: Seasoned TV weather guy Mark Ronchetti won the GOP primary for Governor after promising to increase the state's already record oil production, deriding new standards in state schools for increased instruction on race (in a state that is half Hispanic and has 23 federally recognized Native American tribes and nations), and by slamming his November opponent, Democratic Gov. Michelle Luhan Grisham, for closing in-person schooling during the worst pandemic in 100 years. Also: Progressive Democrat Gabriel Vasquez was victorious in the 2nd Congressional District race to take on GOP Rep. Yvette Herrell in what is seen by Dems as a possible House pickup this November.
• SOUTH DAKOTA: The state's only House Member, Republican Dusty Johnson, easily won his primary despite voting to certify the 2020 election results and in favor of the January 6 Commission. Shamefully, there is no Democrat running for the state's single At Large Congressional seat. Of greater note, a ballot proposition that would have raised the threshold for passage of certain future ballot propositions to 60% was soundly rejected by voters. That proposition was meant to make it harder to pass a ballot proposition this November that would expand Medicaid under ObamaCare to state residents. Similar expansions measures have been adopted by voter initiatives in about 7 other states. GOP lawmakers in SD must really hate their own constituents.
• CALIFORNIA: All statewide office holders are Dems, so there isn't much drama there. But two local contests have received quite a bit of national notice. The Los Angeles Mayoral race will go to a runoff, after Trumpy Republican real estate billionaire turned "Democrat" Rick Caruso failed to clear the 50% bar, despite dropping some $40 million of his own money into the race. He'll face progressive Rep. Karen Bass, previously seen as the favorite to win until Caruso and his money showed up, in the November runoff. But, interestingly, receiving as much or more notice from national corporate news outlets than almost any other race on Tuesday, voters recalled progressive criminal justice reformer, Chesa Boudin, after two and half years as San Francisco's District Attorney. Predictably, national media is (mis)reporting this as a story of "failed progressive policies" that resulted in rampant crime in the city, despite the fact that overall crime decreased during Boudin's tenure.

We're then joined by longtime progressive champion, journalist, and author JOHN NICHOLS of The Nation for analysis of Tuesday's contests --- and those from week's past --- along with his concerns and warnings about the upcoming January 6 hearings in the House.

As to the primaries so far this season, Nichols observes, among other things that while "Republican turnout is very spiked" and Dems "not so spiked", that is "not necessarily a complete disaster" for Democrats. He also notes that "progressives are winning a lot of Democratic primaries" and "in some unexpected and really interesting places".

"Despite what a lot of the pundits will tell you," he argues, means that "the grassroots Democratic voters seem to be sending a very clear signal that they want to go up against these Trump Republicans in this very tough year with clearly defined progressive candidates."

While he offers thoughts on the recall defeat of progressive District Attorney Boudin in San Francisco, Nichols also observes that criminal justice reformers are actually still winning elections in many other places around California and elsewhere. (See, for example, a progressive criminal justice reformer victories in neighboring counties to San Francisco and Kim Reynolds in Des Moines, IA, as mentioned above, as just two such examples.)

Then, it's on to the upcoming January 6 hearings, where Nichols has both advice and concerns, particularly about what the Committee will ultimately offer in their critical recommendations. His greatest concerns seem to center on what Democrats are willing to compromise on in order to find unanimity with the Committee's anti-Trump, but still hard-right Republican Vice Chair Liz Cheney.

Among Nichols' top hopes for the Committee: Recommendations that Congress adopt a resolution that bars insurrectionists like Donald Trump from office, as per Section 3 of the U.S. Constitution's 14th Amendment; and (in what will clearly be a much heavier lift for the Committee's Republicans like Cheney), a call to abolish the Electoral College.

But will the hearings ultimately make any difference to a divided nation, with so many already having hardened their positions on Trump and his attempt to steal the 2020 election? We've got a whole lot to discuss with Nichols today, so I hope you'll tune in!...

Today on The BradCast, a very ominous sign from the U.S. Supreme Court. Very. [Audio link to full show is posted below.]

On Thursday, the Court issued a 6 to 3 opinion in Jones v. Mississippi, which shatters years of established Court precedent that had prevented minors from being charged with life in prison without the possibility of parole in all but the most extraordinary circumstances, and where a judge has specifically made a rare finding that the juvenile's "crimes reflect permanent incorrigibility."

But the ruling by the Court this week --- in a case where a boy, Brett Jones, who had turned 15 days earlier, grew up as "the victim of violence and neglect that he was too young to escape," before snapping and killing one of his abusers just after he had abruptly lost access to the medication he took for mental health issues --- is appalling for a host of reasons.

Not only because, at 31 years old, Jones has since become a reformed, model prisoner in every regard (even the widow of his victim has urged the court for his release); Not only for the 6 to 3 majority decision by all 6 Republicans appointed to the stolen and packed Court; Not only for the opinion itself which will consign more than 1,500 others who committed crimes as children to dying in prison; Not only for the fact that this particular opinion was written for the majority by Justice Brett "What I did when I was young doesn't matter" Kavanaugh (of all people!); Not only for the fact that the decision overturns long-standing, painstaking Court precedents developed over several cases throughout the years; Not only for the fact that the majority simply pretend they did not overturn established legal precedent at all; And not only for the fact that Justice Sotomayor was forced to call the majority out for all of that in the starkest, most savage terms on behalf of the minority (charging the majority "is fooling no one" and "distorts [the precedential cases] beyond recognition", even as she specifically quotes Kavanaugh's very own prior statements on the importance of respecting established legal precedent); But, most troublingly, also for what it may portend in the weeks ahead, much less the years ahead, unless Democrats can quickly, at this point, figure out that they better come to their senses and figure out how to reform the U.S. Supreme Court before we see a boatload of similarly long-held precedents in even more disturbing cases, being completely trashed and overturned by this newly emboldened rightwing Court.

We're joined today by the great MARK JOSEPH STERN, our go-to Supreme Court correspondent from Slate, to discuss not only the Jones v. MS case itself, but what we should glean --- and none of it is good --- from how it has just played out before our eyes, now that the stolen majority on the Court has a full three Donald Trump appointees packed onto it.

As the newly emboldened rightwing activist Justices on the U.S. Supreme Court this week merely pretended precedent didn't exist, by essentially adopting dissenting views from the several cases that created the precedents, a newly emboldened rightwing state Supreme Court majority in Florida did something very similar. Stern also reports on that case, concerning a people's ballot initiative on recreational marijuana in the Sunshine State, which also underscores the long GOP Big Lies that they oppose judicial activism or Big Government tyranny.

With those outrages --- and what they portend for an era of rightwing judicial activism this week --- we also discuss the new proposal by Democrats in the House and Senate to expand SCOTUS from 9 Justices to 13, and the "kick-the-can-down-the-road" bipartisan Presidential Commission empaneled by Joe Biden to "study" the idea of reform for both SCOTUS and the federal judiciary as a whole.

Stern closes with a heads up --- a stark warning, in truth --- as to the big decisions still to come from the Court before the session ends in June, on the Affordable Care Act ("ObamaCare"); foster care by same-sex couples; and a clearly unconstitutional new abortion law (also out of Mississippi) in light of Thursday's appalling decision in Jones v. MS, which Stern categorizes as both "barbaric" and "one of the most dishonest and cynical decisions in recent memory."

Finally, in hopes of leaving you with some slightly brighter news after such a foreboding, grim report from SCOTUS and Stern, we've got some encouraging new polling numbers for Joe Biden. But, much more importantly, from young people who, for the first time in many years, and in rather substantial (even record) numbers across all races, are beginning to feel hopeful about the future again, as they see government as an ally on issues of poverty, combating climate change and on health care.

Hopefully none of them tune in for the earlier part of today's program...
