Someone needs to let the President of the United States know that Memorial Day is, at least in theory, a somber remembrance for the nation's war dead. It might have been nice if that someone had done so before Trump showed up in Japan over the weekend --- for talks with that nation's Prime Minister --- and wished U.S. troops stationed with our ally and former WWII foe a "Happy Memorial Day!" It certainly wasn't a happy one around many parts of the U.S. for a number of reasons. But, once again, we try to find the bright spots where we can.

Among the swarm of stories covered on today's BradCast [Audio link posted below summary]...

  • The record swarm of tornado swarms continued on Memorial Day, with some 53 twisters touching down in eight different states on the same day. A man in Ohio was killed when a car flew into his living room and at least 130 were reportedly injured in the Buckeye State, where power was knocked out to more than 5 million residents as of Tuesday morning. "Catastrophic" destruction was seen across many states after Monday marked a record-tying 11th straight day with at least eight tornadoes in the U.S. according to NOAA. Whether media outlets connected the virtually unprecedented storms (and month of flooding in the Midwest and Central U.S. that preceded it) to our worsening climate crisis is another matter entirely;
  • Speaking of Ohio, at least before the storms, a KKK rally on Saturday brought out 9 Klansmen and between 500 and 600 counter-protesters. At least the folks in Dayton got that one right, if not some of their responses to emergency interruptions during their favorite TV programs as tornadoes swept through the state on Monday;
  • And, speaking of getting it wrong, there is the far-right evangelist Franklin Graham, son of the late, respected minister Billy Graham. Franklin, a Trump supporter who has attacked Indiana Mayor and 2020 hopeful Pete Buttigieg for being both gay and a practicing Christian at the same time, used his tax-exempt religious pulpit to call for "Christian leaders" to declare a "day of prayer" next Sunday for Donald Trump, who, Franklin says, has been "attacked" by his "enemies" more than "any President in the history of this nation". President Abraham Lincoln dissents;
  • As the loony right rises, or tries to, we move out west to Fresno, California, which, as we reportedly exclusively back in 2013, single-handedly blocked an attempted statewide "recount" of Prop 37, a state ballot initiative that would have required the labeling of GMO foods. The wingnuttery in Fresno continued over the weekend, as its minor league baseball franchise, the Fresno Grizzlies, "celebrated" Memorial Day with a video tribute that featured a speech by Ronald Reagan and a montage of Americas "enemies" that included Kim Jong Un, Fidel Castro and....wait for it....New York's Democratic freshman Rep. Alexandria Ocasio-Cortez. The team eventually apologized to AOC --- hours after their initial apology for the video itself --- though they never bothered to mention that, among other "enemies" shown in the 3 and a half minute video played at the ballpark, anti-fascism and anti-KKK marchers were also singled out. 'Happy' Memorial Day!;
  • In voting news over the long weekend....the U.S. Supreme Court on Friday put on hold two different earlier rulings from lower federal appeals courts finding that Republicans in both Ohio and Michigan had unconstitutionally gerrymandered their Congressional maps for the past decade. The high court's action was issued without comment as we await their pending decisions on two similar cases the Justices heard earlier this year regarding unlawful partisan gerrymanders in North Carolina and Maryland. That may be a bad omen for those two cases. But, for now, the SCOTUS order blocks the lower court orders to draw new, fair Congressional maps for 2020 in Ohio by June 14 and in Michigan (where new state legislative districts were also ordered) by August 1;
  • There was better news, for a change, in the state of Texas of all places. The state's legislative session ended on Monday without confirmation of the nomination of Gov. Greg Abbott's Secretary of State David Whitley, thanks to all Senate Democrats refusing to support him. Whitley was forced to resign without the confirmation, which was withheld after the unqualified former travel aid to Abbott had falsely announced in January that 100,000 non-citizens were registered to vote in Texas, with 58,000 of them having illegally cast votes since 1996. As it turns out, most of those voters had become naturalized citizens over that period. But that didn't prevent Whitley from instructing the state's County Clerks to purge voters in 30 days unless they could prove their citizenship or from referring the case to the TX Attorney General who promptly ordered criminal investigations for his own part in the attempted purge. The state was sued by three different voting rights groups and a number of naturalized citizens. They were forced to settle by changing voter roll purge rules for the future and paying some $450,000 to plaintiffs for their legal costs and fees;
  • Finally today, with at least 24 candidates vying for the 2020 Democratic presidential nomination and debates set to begin next month, voters have been sizing up how the hopefuls might take on Donald Trump next year (presuming he's the GOP nominee) if they win the nod. Last week, during a Washington Post forum, South Bend, IN Mayor Buttigieg, who was deployed to Afghanistan in the Naval Reserves, cited Trump's draft dodging due to a claimed "disability" during the Vietnam War. When asked about his comments over the weekend on ABC's This Week, rather than backing off of them, Buttigieg doubled-down, revealing a) Trump was, indeed, a draft dodger who now pretends to revere the military, but who was willing to let someone else take his place in Vietnam and b) Mayor Pete is not afraid to stand up, at least rhetorically, to the bully who has become the President of the United States, even after some in the media attempted (as they do) to try and call him out for it...

A bit more of the news roundup, then MARK KASTEL of Cornucopia explains a terrible trend --- why America's organic farmers are not only fleeing the business, but in some cases taking their own lives (more on that latter herefrom the Guardian).

Our conversation grew out of this column by his friend and colleague Jim Goodman, who's owned a family dairy farm for forty years. He knew the name of every one of his 45 cows. The reason he quit --- the reason so many are throwing in the towel --- is a complex tale of inadequate labeling, Big Ag masquerading as small producers of genuinely organic products, and the resulting glut of milk and produce that strangles the little guy.

On today's BradCast...the Republican Party may appear to be falling apart on one level --- because it is (and we cover quite a bit of their various disasters in advance of tonight's Republican Presidential debate in Boulder, CO today) --- but on another level, the GOP still controls not just both chambers of the U.S. Congress, but also the vast majority of statehouses and Governor's mansions across the country.

So, while the Democrats' Presidential prospects may be encouraging for them, are they actually in denial about their real problems? And/or is there another way out of their current morass?

Ian Millhiser, journalist, Constitutional law expert and author of the new book, Injustices: The Supreme Court's History of Comforting the Comfortable and Afflicting the Afflicted, joins us to discuss what may be the Democrats' best way out of the mess: The U.S. Supreme Court and as many as four vacancies that may occur on the bench during the next Presidency. "The Future Of The Democratic Party," he wrote recently, "Will Be Decided By The Supreme Court."

"A big reason why Democrats are so far underwater when it comes to state legislative races, when it comes to House races, is because of the Supreme Court," Millhiser tells me on today's show. "The Supreme Court has ordered the lower federal courts not to even look at partisan gerrymandering cases. They're not allowed to even consider them under existing Supreme Court doctrine."

Millhiser goes on to explain how the Court's recent rulings on voting rights have also made things far more difficult for Democrats. SCOTUS, he argues, "isn't enforcing the Constitution and at other times its mangling the Constitution."

"The situation Democrats find themselves in is due to a number of problems layered on top of each other, many of which are at the fault of the Supreme Court. Many of these problems could be solved if we had a Supreme Court that was prepared to give us fairer elections," he notes. With as many as four --- four --- seats potentially becoming vacant on the Court during the next Presidency, the party that controls the White House as of 2017 will have an enormous opportunity to affect what happens in this country for generations.

While both major parties often use the potential for Supreme Court vacancies to underscore the importance of controlling the White House, Millhiser explains the reasons --- and there are many --- why the 2016 election really is different from recent elections where that argument has been offered. "If the Supreme Court gets even more conservative," he warns, "then you're looking at an apocalypse for the Democratic Party."

Before we get to Hillary Clinton and the awful truth about her climate plan and climate change itself on today's BradCast, Bernie Sanders is now leading all the major Republicans in national polling now.

That's right, in head-to-head national match-ups between the independent U.S. Senator from Vermont and Jeb Bush, Scott Walker or even Donald Trump, Sanders wins the Presidency --- if the election was held today, and those who wanted to vote got to vote (and got to have their votes counted as intended) --- according to a new CNN/USAToday/Gallup poll.

Nonetheless, the corporate media still loves to ignore Sanders. Though, thanks in part to the #BlackLivesMatter protesters that interrupted him during a progressive forum last week (the intra-progressive controversy we've been covering over the past week), he was finally allowed to appear on Meet the Press over the weekend.

Also, over the weekend, Trump continued to widen his lead against the rest of the Republican field and Hillary Clinton offered a tepid plan on how she would begin to deal with climate change.

We speak on today's show to David Roberts, the great environmental journalist from Vox.com (formerly of Grist.org), about Clinton's plan and the awful truth about both her plan and everyone else's.

"It's so polarized between the parties that Hillary can say anything she wants," Roberts tells me about her plan to add half a billion solar panels to the nation's grid by 2021. "But, as long as the House is in Republican hands they are foursquare against any of this --- any clean energy, any efficiency, anything that restrains fossil fuel in any way...If we're being honest with ourselves, what she's capable of doing is what the Presidency can do without legislative help."

Roberts is not optimistic about where the planet is headed, and holds scientists partially responsible for not being straight with the public about how bad things really are. He says "it's still physically possible" to save ourselves from where we're headed, "but it would mean the entire world shifting, basically, to a war footing in the next five years, and remaining on war footing for the next century. It's possible, but do you see anything around you that indicates that's going to happen? We're not doing it. So I think that it's worth at least saying, hey guys, we're headed for the shit. At this point, we're probably going to get mired in some really terrible stuff."

Despite those thoughts, it's actually an enlightening and entertaining discussion with Roberts! Finally, to close things out today (and cheer you up even more!), the U.S. House passes a bill to make it illegal for states and local governments to require consumer labeling of GMOs --- because, ya know, Republicans "hate" Big Government and are all for "local control" of issues.

Opponents vow fight against 'Monsanto Protection Act' in Senate...

By a vote of 275-150 (including the support of 45 Democrats), the U.S. House of Representatives passed the "Safe and Accurate Food Act" this past week.

Don't be fooled by the name.

The Act, which would prevent state and local governments from mandating the labeling of genetically engineered foods (GMOs), has alternatively been described by opponents as the "Deny Americans the Right to Know" or "DARK Act", as well as the "Monsanto Protection Act".

Disturbingly, the House vote comes on the heels of a new, peer-reviewed scientific report finding an "accumulation of formaldehyde, a known carcinogen, and a dramatic depletion of glutathione, an anti-oxidant necessary for cellular detoxification, in GMO soy, indicating that formaldehyde and glutathione are likely critical criteria for distinguishing the GMO from its non-GMO counterpart."

The study, published in Agricultural Sciences this month, used "a new biology method to integrate 6,497 in vitro and in vivo laboratory experiments, from 184 scientific institutions, across 23 countries." It is critical of the U.S. government's current standard for GMO assessment which, the report concludes, are "outdated and unscientific for genetically engineered food since it was originally developed for assessing the safety of medical devices in the 1970s."

Peer review of the study cited its new methods and findings to conclude that "until such Standards are developed for testing, we believe it premature to approve GMOs and to consider them safe." The study's lead author, MIT-trained biologist Dr. V.A. Shiva Ayyadurai, Ph.D, adds: "This is not a pro- or anti-GMO question. But, are we following the scientific method to ensure the safety of our food supply? Right now, the answer is 'no'."

The Environmental Working Group (EWG), one of 300 organizations opposing the "DARK Act", has vowed to fight the measure in the U.S. Senate.

Although the legislation would deprive U.S. citizens of a right to know possessed by citizens in 64 other nations including China and most of Europe, there is a silver lining, of sorts. No doubt final passage would furnish comedian Bill Maher with the material needed to repeat the hilarity he offered following California's rejection of a GMO labeling initiative last year.

"If you’re one of the millions of Californians who voted against labeling genetically modified foods," Maher said, "you can’t complain when it turns out there’s horse meat in your hamburger and your sushi is made out of lost cats and condoms. You said you didn’t want to know. Now lap that shit up!"

P.S. Without a proper break over the summer this year, and then continuing non-stop since the elections, I must say I'm not nearly an accomplished enough writer to properly describe how fried I am right about now.

As mentioned, I'm on the road and will continue to be until after the New Year. I need to complete some deadlines for articles elsewhere, knock out a few radio shows, and figure out how The BRAD BLOG can survive as we move forward into our 12th(!) year in January. But between now and then, I'm going to try to force myself to take some down time, at least from blogging, if possible, for a few weeks. We'll see if I'm successful. I'm usually not. (I suspect I may, at the very least, be popping up on Twitter. So be sure to follow both @TheBradBlog and @GreenNewsReport there in the meantime if you're not already.)

4,600 rejected Vote-by-Mail ballots will remain uncounted in contest decided by just 800 votes out of 1.5 million cast...

Proponents of Oregon's Measure 92, a GMO labeling initiative, are conceding defeat in what had become the most expensive ballot campaign in state history. The proponents from RightToKnow.org were unsuccessful in their lawsuit this week arguing that some 4,600 ballots were illegally left uncounted and should be included in the final tally from the razor-thin November 4th contest.

"Oregonians will never know the true outcome of this election," Paige Richardson, Campaign Director for Yes on 92 said, after a judge rejected the group's attempt to block final certification of the automatic statewide "recount" that followed the extraordinarily close computer-tallied results of the contest.

A hand-count of some 1.5 million hand-marked Vote-by-Mail (VBM) paper ballots cast and previously tallied only by optical-scan computers was triggered after the initially certified margin of defeat for the initiative was just 812 votes, or .02 percent, or just 812 votes. State law requires hand counts for elections with an initial margin of less than .5 percent.

Some 13,000 ballots across Oregon --- which holds its elections only by mail-in ballot --- were rejected and never counted due to signatures on the ballot envelopes judged by election officials to not match those on voter registration cards on file. Voters with signature problems on their ballots are sent a letter to notify them, allowing them two weeks to contact officials to confirm that they were the one to have cast the ballot in question.

Additionally, a new state law requires the Sec. of State to publicly release the names of such voters. That allowed proponents to try and contact those voters to urge them to cure their signature problems with county election officials. 8,600 voters responded and ultimately had their ballots included in the tally, while 4,600 did not. Those 4,600 rejected ballots, more than enough to potentially flip the final results of the election, were left uncounted...

A statewide hand-count of millions of hand-marked paper ballots is currently underway in Oregon, as proponents of a GMO-related ballot initiative hope to overcome the computer-tallied margin of less than one-fifth of one percent, as reported by the state following the November 4th election.

But proponents of the measure are expressing concern about the process of the count, including corporate interference and thousands of votes that have been excluded, due to questions about signatures on mail-in ballots.

We recently detailed how the "Yes on Measure 92" campaign trailed by just over 800 votes (.02%) out of more than 1.5 million cast, in what has become the most expensive ballot measure battle in Oregon state history. $21 million dollars were reportedly spent to defeat the measure by corporate opponents of the "Right to Know" initiative. Monsanto, DuPont, Kraft, Pepsico and other national food companies had worked to block Measure 92's mandate requiring food sold in the state containing genetically modified products be labeled as such. Proponents reportedly spent just $9 million in support of the initiative.

As the statewide "recount" is now underway (we use quotes around the word to denote that, until now, the paper ballots have never actually been counted by human beings, only by oft-failed, easily-manipulated, sometimes wildly-inaccurate computer optical-scanners), proponents are citing a number of concerns about the way the state is carrying out the hand count, including what they describe as attempted illegal interference by Measure 92's corporate opponents, and the exclusion of thousands of ballots which, proponents believe, are being inappropriately left out of the final count.

While the number of ballots excluded from the tally could be more than enough to reverse the results of the contest, according to proponents, the complaints also serve to underscore a number of serious drawbacks to Oregon's all Vote-by-Mail election system, as well as mail-in voting in other states...

The November 4, 2014 elections are not over in several parts of the country. One of those places is Oregon, where progressive candidates and ballot measures were largely successful in bucking the rightward trend of election results produced by much of the rest of the nation. Nonetheless, a GMO-related ballot measure requiring the labeling of genetically modified foods appeared to have failed on Election Night in the wake of a record amount of campaign cash spent by food manufacturers to defeat it.

The measure, however, now appears headed toward a statewide "recount" as the official computer-reported results have greatly narrowed in the weeks following Election Day, with the race now regarded as "too close to call" by some. The "No" margin decreased to less than 1,500 votes as of late last week, after the Yes on 92 campaign was said to have been "reaching out to 13,000 voters whose ballots had signature problems and weren't counted," according to Oregon's KPTV.

[Note: The BRAD BLOG tends to use quotes around the word "recount", since most ballots in the U.S., even hand-marked paper ballots, are never actually counted by human beings in the first place, with most jurisdictions relying only on easily-manipulated and sometimes wildly inaccurate computer tabulators which tally ballots either correctly or incorrectly. Without an actual hand-count by human beings, its impossible to know either way.]

For the first time this year, the state publicly released the names of voters whose ballots had signature problems. That transparency allowed Measure 92's supporters to attempt to notify those voters to request they contact election officials to work out any discrepancies in order to have their ballots tallied.

As of Monday afternoon, numbers posted on the Oregon Sec. of State's results page show the margin having narrowed even further, with just 809 "No" votes outpacing "Yes" votes, out of more than 1.5 million ballots cast across the state. Finalized results are due from all counties by 5pm today...
