Completely aside from the merits, I found the majority opinion in Navajo Nation to be possibly the worst written Supreme Court. opinion in recent memory.

I read every opinion of the Court and have for many terms, and I had not flagged Justice Kavanaugh as a particularly bad writer, or even a mediocre writer, but holy smokes, Navajo Nation is horribly written. It reads like a first draft from an underachieving student. Even comparing it to Pugin v Garland - released the same day - it’s bad.

It’s also very short, so I encourage anyone to skim through it to see what I’m talking about. Entire sentences are repeated wholesale within half a page.

It makes me wonder, was this the result of extremely careful drafting to maintain a majority, or was this opinion shunted to a clerk while Kavanaugh focused on bigger fish? There has to be something.
