The guy in the hat waited at a phone booth for the rapist to pass. When he did, the guy pulled out a gun and shot him in the head.
Free roam is unlocked very early on in the game. Even though there is a lengthy main storyline you can ignore it and do whatever for as long as you like.
A linear game has no free roam. You can’t expect a story game to let you abandon a quest once you start it.
