The State Department "suggestion" is a conclusory assertion difficult to square with the terrorism statute which specifically removes this activity from the ambit of customarily protected state activity. The trial court still has to decide whether it is reconcilable with the law.

One of the consequences of the Biden administration's decision to suggest MBS get sovereign immunity is that he will now feel much more comfortable traveling to the US, to Europe, to any place where he may have felt the sting of legal accountability for his role in the killing.
