How do you defend a client who you know is guilty? What’s it like to sit opposite a murderer? In answering these questions and more, criminal defence lawyer Kathleen Heath challenges some of the misconceptions that we hold about our criminal justice system, and challenges us to respond with greater compassion to those who have, or are alleged to have, committed crimes. Kathleen is a criminal defence lawyer at the Aboriginal Legal Service of Western Australia (ALSWA), and aspires to help her clients’ stories be told in the courtroom and beyond. She often appears in the Children’s Court, representing children accused of a crime, many of whom have been removed from their families and are in the care of the State. Kathleen received her Bachelor of Laws from the University of Sydney, where she graduated with the University Medal in Law. With the help of a Fulbright Scholarship, she completed her Master of Laws at Harvard University, focusing on criminal justice policy. A video for UK law students studying theft.
Theft is defined under s. 1(1) of the Theft Act 1968 as "dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it" and contains five key elements: dishonesty, appropriation, property, belonging to another and intention to permanently deprive.
This lecture looks at all five elements by splitting them up into the actus reus and the mens rea of the crime.
Appropriation means taking and this only needs to be a right; not all of the rights associated with property (Morris [1984]). Appropriation can even take place with consent or with title to the property since Gomez [1993] supported in Hinks [2000]. This is controversial and arguably diminishes the importance of the actus reus in theft.
Theft is also a finite act per Atakpu [1994] so a person can only be convicted on appropriation. However it will not be theft when the defendant is a bona fide purchaser.
Property is defined broadly and can include things in action (Kohn [1979]) and other intangible property (A-G of Hong Kong v Chan Nai-Keung [1987])
Belonging to another is normally obvious to see in a theft case but there are some unusual cases (Marshall [1998] and Turner (No. 2) [1971]) including where property is received for a particular purpose and where property is received by mistake (A-G’s Reference (No. 1 of 1983) [1985]).
Dishonesty is defined in s. 2 but the main test comes from Ivey v Genting Casinos [2017] UKSC 67 and students should see the podcast episode on that subject.
Finally intention to permanently deprive also has been given a broad interpretation by the courts to include a range of scenarios including ransom (Hall [1849]), property in a different form, (Richards [1844]) and pawning (Phetheon [1840]). Section 6(1) also deals with situations where property is taken “for a period…making it equivalent to outright taking”.

From elaborating upon the kind of academic subject criminal law is to highlighting actual, fascinating case law including famous cases such as R v Miller (1983), R v White (1910) and R v R (1992), we try our best to shed the best light possible upon the nature of the criminal justice system. Throughout this course, you will learn the difference between a conviction of murder and one of manslaughter, moving on to other important distinctions that are a part of criminal law and ones that criminal law helps to make. Furthermore, we describe the approach that students must take when it comes to exam questions and what they can expect from this module, integrating within that, the knowledge pertaining to criminal law. We also go ahead and describe the kind of role criminal law can play in individual lives and society at large by playing a little game. Moving on, the nature of criminal law, due to its close relationship with the state is connected to public law, while we explore the very being of criminal law: by dissecting what crime is in itself, its evolution, the need for a system to punish it and the defenses available in accordance to it.

Criminal law
Criminal law or penal law is the body of law that relates to crime. It regulates social conduct and proscribes whatever is threatening, harmful, or otherwise endangering to the property, health, safety, and moral welfare of people. It includes the punishment of people who violate these laws. Criminal law varies according to jurisdiction, and differs from civil law, where emphasis is more on dispute resolution and victim compensation than on punishment.
History
The first civilizations generally did not distinguish between civil law and criminal law. The first written codes of law were designed by the Sumerians. Around 2100-2050 BC Ur-Nammu, the Neo-Sumerian king of Ur, enacted the oldest written legal code whose text has been discovered: the Code of Ur-Nammu although an earlier code of Urukagina of Lagash ( 2380-2360 BC ) is also known to have existed. Another important early code was the Code Hammurabi, which formed the core of Babylonian law. Only fragments of the early criminal laws of Ancient Greece have survived, e.g. those of Solon and Draco.

Scottish criminal law
Scots criminal law governs the rules of criminal law in Scotland. Scottish criminal law relies far more heavily on common law than in England and Wales. Scottish criminal law includes offences against the person of murder, culpable homicide, rape and assault, offences against property such as theft and malicious mischief, and public order offences including mobbing and breach of the peace. Scottish criminal law can also be found in the statute books of the UK Parliament with some areas of criminal law, such as misuse of drugs and traffic offences appearing identical on both sides of the Border. Scottish criminal law can also be found in the statute books of the Scottish Parliament such as the Sexual Offences (Scotland) Act 2009 asp 9 and Prostitution (Public Places) (Scotland) Act 2007 asp 11 which only apply to Scotland. In fact, the Scots requirement of corroboration in criminal matters changes the practical prosecution of crimes derived from the same enactment. Corroboration is not required in England or in civil cases in Scotland. Scotland is one of the few jurisdictions who require corroboration.

Criminal Law is a 1989 thriller film directed by Martin Campbell and starring Gary Oldman and Kevin Bacon. It received overwhelmingly negative reviews.
Plot
Attorney Ben Chase successfully defends Martin Thiel, a wealthy, young playboy, getting him acquitted of a series of brutal murders — only to find out later that Thiel is indeed a serial killer. Since Thiel cannot be tried again for his crimes, Chase tries to get him to incriminate himself before he can kill again.

Reception
Criminal Law received a decidedly unfavorable reaction from critics, with a 33% "rotten" rating on review aggregator Rotten Tomatoes. Roger Ebert called the film "a textbook example of a movie going wrong before our very eyes."
Oldman's performance is generally regarded as one of the worst of his career. The film marks his first use of an American accent, which was derided by many critics for rendering his dialogue "forced and stilted".Peter Travers of Rolling Stone gave a scathing appraisal of the performance, writing: "Oldman is a powerhouse...But what's a British actor doing playing a Harvard attorney in a Boston-based movie shot in Montreal? Flailing about like a drowning man, that's what. Oldman's [accent is] laughably in-and-out". He added that "Bacon delivers the film's one modulated performance", while "Oldman rants hysterically".

In answering these questions and more, criminal defence lawyer Kathleen Heath challenges some of the misconceptions that we hold about our criminal justice system, and challenges us to respond with greater compassion to those who have, or are alleged to have, committed crimes. Kathleen is a criminal defence lawyer at the Aboriginal Legal Service of Western Australia (ALSWA), and aspires to help her clients’ stories be told in the courtroom and beyond. She often appears in the Children’s Court, representing children accused of a crime, many of whom have been removed from their families and are in the care of the State. Kathleen received her Bachelor of Laws from the University of Sydney, where she graduated with the University Medal in Law. With the help of a Fulbright Scholarship, she completed her Master of Laws at Harvard University, focusing on criminal justice policy. Theft is defined under s. 1(1) of the Theft Act 1968 as "dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it" and contains five key elements: dishonesty, appropriation, property, belonging to another and intention to permanently deprive.
This lecture looks at all five elements by splitting them up into the actus reus and the mens rea of the crime.
Appropriation means taking and this only needs to be a right; not all of the rights associated with property (Morris [1984]). Appropriation can even take place with consent or with title to the property since Gomez [1993] supported in Hinks [2000]. This is controversial and arguably diminishes the importance of the actus reus in theft.
Theft is also a finite act per Atakpu [1994] so a person can only be convicted on appropriation. However it will not be theft when the defendant is a bona fide purchaser.
Property is defined broadly and can include things in action (Kohn [1979]) and other intangible property (A-G of Hong Kong v Chan Nai-Keung [1987])
Belonging to another is normally obvious to see in a theft case but there are some unusual cases (Marshall [1998] and Turner (No. 2) [1971]) including where property is received for a particular purpose and where property is received by mistake (A-G’s Reference (No. 1 of 1983) [1985]).
Dishonesty is defined in s. 2 but the main test comes from Ivey v Genting Casinos [2017] UKSC 67 and students should see the podcast episode on that subject.
Finally intention to permanently deprive also has been given a broad interpretation by the courts to include a range of scenarios including ransom (Hall [1849]), property in a different form, (Richards [1844]) and pawning (Phetheon [1840]). Section 6(1) also deals with situations where property is taken “for a period…making it equivalent to outright taking”.

Finally intention to permanently deprive also has been given a broad interpretation by the courts to include a range of scenarios including ransom (Hall [1849]), property in a different form, (Richards [1844]) and pawning (Phetheon [1840]). Section 6(1) also deals with situations where property is taken “for a period…making it equivalent to outright taking”.

Furthermore, we describe the approach that students must take when it comes to exam questions and what they can expect from this module, integrating within that, the knowledge pertaining to criminal law. Moving on, the nature of criminal law, due to its close relationship with the state is connected to public law, while we explore the very being of criminal law: by dissecting what crime is in itself, its evolution, the need for a system to punish it and the defenses available in accordance to it.

How do you defend a client who you know is guilty? What’s it like to sit opposite a murderer? In answering these questions and more, criminal defence lawyer Kathleen Heath challenges some of the misconceptions that we hold about our criminal justice system, and challenges us to respond with greater compassion to those who have, or are alleged to have, committed crimes. Kathleen is a criminal defence lawyer at the Aboriginal Legal Service of Western Australia (ALSWA), and aspires to help her clients’ stories be told in the courtroom and beyond. She often appears in the Children’s Court, representing children accused of a crime, many of whom have been removed from their families and are in the care of the State. Kathleen received her Bachelor of Laws from the University of Sydney, where she graduated with the University Medal in Law. With the help of a Fulbright Scholarship, she completed her Master of Laws at Harvard University, focusing on criminal justice policy. Theft is defined under s. 1(1) of the Theft Act 1968 as "dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it" and contains five key elements: dishonesty, appropriation, property, belonging to another and intention to permanently deprive.
This lecture looks at all five elements by splitting them up into the actus reus and the mens rea of the crime.
Appropriation means taking and this only needs to be a right; not all of the rights associated with property (Morris [1984]). Appropriation can even take place with consent or with title to the property since Gomez [1993] supported in Hinks [2000]. This is controversial and arguably diminishes the importance of the actus reus in theft.
Theft is also a finite act per Atakpu [1994] so a person can only be convicted on appropriation. However it will not be theft when the defendant is a bona fide purchaser.

Criminal law
Criminal law or penal law is the body of law that relates to crime. It regulates social conduct and proscribes whatever is threatening, harmful, or otherwise endangering to the property, health, safety, and moral welfare of people. It includes the punishment of people who violate these laws. Criminal law varies according to jurisdiction, and differs from civil law, where emphasis is more on dispute resolution and victim compensation than on punishment.
History
The first civilizations generally did not distinguish between civil law and criminal law. The first written codes of law were designed by the Sumerians. Around 2100-2050 BC Ur-Nammu, the Neo-Sumerian king of Ur, enacted the oldest written legal code whose text has been discovered: the Code of Ur-Nammu although an earlier code of Urukagina of Lagash ( 2380-2360 BC ) is also known to have existed. Another important early code was the Code Hammurabi, which formed the core of Babylonian law. Only fragments of the early criminal laws of Ancient Greece have survived, e.g. those of Solon and Draco.
