cantwell asks devin if he's familiar with the phrase "diversity of tactics," which he is. cantwell's argument is that the phrase is a euphemism for political violence. devin doesn't recall the phrase being used in the planning meetings he participated in.

devin says the letter is focused on the nature of this specific counterprotest, not the nature of any other action. the organizers of that specific event wanted their intentions to be clear & their intentions were peaceful.

cantwell asks if protest is peaceful by default. devin says he isn't familiar with the history of protest. cantwell offers devin his own qualification as someone with a degree in political & social thought, and asks him how he couldn't know that. objection, question withdrawn.

cantwell, like spencer, is reading aloud from the document put out by PARJ - a document this witness did not author. "if someone doesn't say that it's a peaceful protest, what is it?" cantwell asks.

cantwell is trying to use exhibits from the plaintiffs' exhibit list but is having some trouble matching up the bates numbers. maybe he should've put on his own evidence instead of relying on theirs.

cantwell basically got up there and said 'i don't believe your sworn testimony, does that surprise you?' i know pro se defendants get a long leash but it's time to reel this guy in a little.

cantwell asks devin if he would be surprised that cantwell found it "conspicuous" that devin said he participated only in peaceful protest. "i know he is pro se, but this is not a podcast," plaintiffs say in their objection.

cantwell asks him for clarification about his relationship with BLM cville - devin was never a member of BLM cville, but he attended meetings with them as a liaison for the black student alliance. cantwell asks about SURJ. devin says he also liaised with them, yes, but not DSA

cantwell asks devin about the BSA, the black student alliance, then asks if he knows what the DSA is. he is aware of the DSA, yes. cantwell asks if any of his friends are members of DSA. plaintiffs objection is sustained.

cantwell tells devin he told the reporter in august 2017 that he was not injured, but after he joined the lawsuit in october, "then you're injured?" devin says he didn't want to center himself while his close friend natalie was still so terribly injured.

as to the klan rally earlier in the summer 2017, devin earlier testified that the event itself was not violent. cantwell asks him if he knows the police tear gassed the counterdemonstration & arrested people protesting the klan. devin says he did not know those people.

i'm getting mad again!

"i can't help but notice that you say 'i don't remember' a lot. is everything ok?" cantwell asks derisively. "no, everything is not ok," devin says, on the stand under questioning about a traumatic event by the man who did it to him.

"i don't remember when i first became aware of you," devin tells cantwell. he says he really tries to avoid looking at photos & video of the events of the torch march, so he wasn't seeking that information out.

it wasn't until after his deposition that devin saw photos from that night that led him to believe it may have been cantwell whose pepper spray affected him that night. cantwell is really hung up on not being as famous as he thought.

devin says his only knowledge of any court proceedings related to cantwell's conduct that night were what he shared here in court during his opening arguments last week. cantwell is incredulous that this man hasn't heard about his notorious existence.

"i have reason to believe that the pepper spray i choked on," devin tells cantwell, "came from you among others." cantwell asks if he spoke to county prosecutor robert tracci, devin doesn't even know who that is. he did not speak to anyone about charges related to the spray.

"if there's a group of people who might shoot me for no reason, this is it," devin says, remembering his thoughts upon seeing some of the torch marchers carrying guns on their hips. cantwell asks if there are photos of these guns, devin isn't sure.

cantwell says devin testified he saw torch marchers carrying firearms & asks him if that's legal. devin says he isn't aware of what the regulations are, but he remembers seeing the holstered weapons clearly because he was afraid they might use them.

devin says he can't recall whether he had his phone that night, but he must have because he took at least one photo.
