Internet filter blacklist leaked on web
The communication regulator’s blacklist of banned internet sites has apparently been leaked, prompting an internet advocacy group to accuse the Government of making it easy to access child pornography.
The Government is planning to introduce a mandatory internet filter that will block access to a list of dangerous websites.
The list of sites – managed by the Australian Communications and Media Authority (ACMA) – is designed to catalogue sites containing child pornography or other criminal content.
Wikileaks, an organisation that aims to reveal secret information, today published what it claims to be the ACMA blacklist.
As well as child pornography, the list of 2,395 pages also includes online gambling sites, YouTube links, regular porn and fetish sites, and websites of a tour operator, Queensland boarding kennel and a Queensland dentist. It also includes the Wikileaks website.
“We now find Australia acting like a democratic backwater,” the Wikileaks site says.
“Apparently without irony, ACMA threatens fines of up to $11,000 a day for linking to sites on its secret, unreviewable, censorship blacklist – a list the Government hopes to expand into a giant national censorship machine.”
ACMA says it is likely to make a comment on the matter later today.
Wikileaks has previously published similar lists from Thailand, Denmark and Norway. The blacklist includes the Wikileaks website itself.

Anyway, this is a very unpopular move by the Government, and many experts have deemed it unworkable. Most Australian ISPs have refused to participate in the trial process of the Government’s mandatory filtering scheme.
Though the Federal communications Minister is a conservative Christian, the centre-left government is largely pushing ahead with the scheme in order to win the support of two independent Upper House MPs. One is a rightwing fundie Xian who wants to get rid of teh porn, and the other is an anti-poker machine politician who wants to get rid of online gambling sites.
Australia has ridiculously sluggish internet, and this harebrained scheme—should the unthinkable happen and it goes ahead—will only make it worse.
It looks like the (conservative) Coalition would block the internet filtering plan:

Wikileaks seems to be having some trouble atm. I just posted on the same story and I’ve (shock! horror!) linked the specific wikileaks page in question … so I guess I’ll be hauled off to jail soon.
Then again, wordpress blogs are not hosted in Australia so I guess there’s not much the Aussie government can do about it anyhow.
Probably the worst they can do is make a complaint to WordPress, which can put your post into private until the complaint is addressed. Then again, Senator Conroy is a conservative Christian, and who knows how malicious those fuckers can be?
I wonder how long it will be before someone comes up with a “Banned in Australia” banner for our blogs, along the lines of the “Banned in Red China” banner you could get a couple of years ago.

Did you see the article in which Conroy said the wikileaks list is not the proper ACMA blacklist, but you could still face criminal charges for linking to it or posting it. WTF?
regardless of it not necessarily being the black list, however EFA reckons at least 95% of the blacklist is on it, it contains links to illegal material
what is of concern is not only providing the list, but providing access to it also just by linking to where it can be found.

particularly section (iv) below (bolded) is the point being discussed atm, also regarding whether claims of defence regarding the intent of providing people with access to the list. (there is a remote chance that a court will accept the argument that providing access to the blacklist in order to critique the operation of a legislative scheme is ‘necessary for or of assistance in the administration of justice’, but I wouldn’t count on it)
474.22 Using a carriage service for child abuse material
(1) A person is guilty of an offence if:
(a) the person:
(i) uses a carriage service to access material; or
(ii) uses a carriage service to cause material to be transmitted to the person; or
(iii) uses a carriage service to transmit material; or
(iv) uses a carriage service to make material available; or
(v) uses a carriage service to publish or otherwise distribute material; and
(b) the material is child abuse material.
Penalty: Imprisonment for 10 years.
(2) To avoid doubt, the following are the fault elements for the physical elements of an offence against subsection (1):
(a) intention is the fault element for the conduct referred to in paragraph (1)(a);
(b) recklessness is the fault element for the circumstances referred to in paragraph (1)(b).
