Citing COVID-19 concerns, a federal judge has ordered ICE to release all immigrant children, detained inside its three family detention centers for more than 20 days, by July 17. However, ICE can still detain children beyond the 20 days if a suitable sponsor isn't found, a parent/guardian declines the minor's rights to be released, or if they previously failed to appear at a court hearing.
Judge Gee oversees a 1997 court settlement known as the Flores agreement that says the government can't detain children for more than 20 days. In April, Gee found that ICE and ORR had violated the settlement and ordered the prompt release of children to sponsors.
As of June 8 there were 124 children detained by ICE at one of its family detention centers, according to the order. The Flores settlement agreement, which the Trump admin has been trying to get rid of, applies to unaccompanied and accompanied children, but not their parents.
