Workers compensation = this week 52 weeks since accident; work for not for profit organization; presently on AL return to work on 27/4/20. IME Report has arrived - 3-6 months recovery still expected. I work permanent part=time 24 hours pw ( 3 days per week) contract pre-injury on 9/4/19. I am presently working (Mon 5 hrs Wed 4 hrs, Fri 5 hrs per week as my RTW plan& certificate of capacity through my GP. On return to work there will need to be a decision about my contract. I have always been focused on returning to pre-in jury hours of 24 hrs pw; but have managed only 14 hrs to date. Organization has said they can't afford to continue to pay a casual to cover my other 10 hours. One option is to reduce my contact to 6 hours per day x3 days + 18hrs. I understand they no longer have an obligation to keep me on, if I can have not returned to pre=injury hours of 24hrs per week. I haven't been able to reach 6 hours per day as yet. My Rights? Have I the right to request time to build up my hours to 6 hours before taking/signing the contract? IME told me I should have a pattern of increasing one hour for a month....before adding more. In this case, It would be 5 hours x3 days RTW plan. If this approach is not successful? Have I forfeited all else? Or do I still have the right to request another position, aspect of work in the interim until I increase my hours to 6hour x3 day contract? Any other avenues I can consider? Forgot to tell you I am a 66 yr old female with university qualifications - not that either helps this situation. I have been working for this Organization for 10 years in this permantent part=time contract. Anticipating your expertise. Thank you ELizabeth Skehan
