    AFSPA gives no immunity unlike what people try to make of it. But only the Central Govt can order prosecution. There is simply no immunity from investigation. This aspect was overlooked in 1990 when the experience of hindsight of proxy war conditions was not there

    Sir just curious to know...how is it possible to file an FIR against army there..as they are protected by AFSPA..then how can FIR be lodged??

    Disagree. The law of averages worked then as it works now. There were brilliant, mediocre and not so competent Generals then as there are now. Perception of the past being better than the present will always exist.

    Incorrect. We are a nation under multiple threats. Our security and intelligence agencies have kept the nation secure. There is no absolutism in security. Can a hundred percent be ever guaranteed. Its always work in progress. We can improve a lot no doubt.

    But like in all cases of unnatural death an investigation would be carried out. AFSPA does not provide anything against that

    Sir, If stone pelters come in middle of an army operation and attack army personnel, then the latter has all the right to defend themselves

    Pardon my ignorance general saab, but in any case of civilian death at the hands of any law enforcement agency, isn't there an automatic investigation? This law exists in the US. Personnel involved in such an incident are placed on paid admin leave and weapon turned in.

    Good question. However, AFSPA does not provide immunity from investigation or prosecution. However, for the latter specific approval of the Central Govt is necessary. It means even holding a person in judicial custody is valid. All this was drafted in a hurry in 1990.

    Learnt that a counter FIR also lodged by the Army.

    An army convoy was attacked by over 200-500 stone pelters. 1 JCO & other Jawans got badly injured & crowd tried to snatch weapon frm JCO. In defense Army Jawans fired in self defence which killed 2 stonepelters fr which Mehbooba mufti blames army for disturbing peace in valley

    Bhullas are some ofvthe most patient yroops and very righteous. After all even in 1930 in Peshawar they refused to embus for an operation to target the Khudai Khidmatdars. The Regt lost the chance to enhance its tally of VCs earned in WW1
