Your order
Verso Books must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Once payment has been authorized Verso Books will confirm your order by sending an email to you at the email address you provide. The order confirmation email will include your name, the order number and the total price. Verso Books will make every effort to ensure that payment for your order is only taken once your goods are available for download or have shipped. Acceptance of the payment by Verso Books will bring into existence a legally binding contract between us on these terms.
Verso ebook license
Verso ebooks are free of Digital Rights Management (DRM-free), but are subject to the terms of this license. You own the file once you've downloaded it, and you can use it on any of your devices in perpetuity. It has visible and invisible watermarks, applied by Booxtream, which contain your name and email address. You are prohibited from uploading Verso ebooks to any website or file-sharing network, or in any other way making them available for distribution, sharing, copying, downloading, or reselling. Royalties from every sale will be paid to the author: if you're reading someone else's copy, then please buy your own license from Verso Books.
Availability of goods
Verso Books will make every effort to ensure that books are in stock and being shipped before taking payment. (Pre-orders will only be billed when the books ship to you.) However, if Verso Books has insufficient stock to deliver the goods ordered by you, then we will notify you as soon as possible and any sum debited by Verso Books from your card will be re-credited to your account, and Verso Books will notify you by email at the address given by you when you submitted your order. The refund will be made as soon as possible and in any event within 30 days of your order. Verso Books will not be obliged to offer any additional compensation for disappointment suffered.
Shipping cost
Verso Books offers free shipping worldwide, if your order is over a threshold. US shipping by UPS Ground or USPS Media Mail is free for orders over $20. Shipping to Canada by Ground is free for orders over $25CAD. UK shipping by Second Class is free for orders over £10. Shipping to Rest of World by Priority Air is free for orders over £15. Below the threshold, US shipping will cost $3, Canada $5CAD, UK £3, and Rest of World £6.
Delivery of goods to you
Verso Books will mail, or arrange a courier on your behalf, for the goods ordered by you to the name and address you give Verso Books at the time you make your order. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of dispatch of the order. All delivery times quoted on the web site are estimates only, based on availability, normal processing and delivery companies. You will become the owner of the goods you have ordered when the goods are dispatched to you from our distribution center.
Sales Tax
USA. All US dollar prices displayed on the Verso Books website are exclusive of sales tax. Any applicable sales taxes will be calculated during checkout, and clearly displayed before you submit your final order.
UK and Europe. All sterling prices displayed on the Verso Books website are inclusive of UK VAT. If you are outside the UK, your final price may be different depending upon the VAT rate that applies to your location, in which case this will be displayed before you submit your final order. Under EU VAT legislation certain book items (such as audio books and ebooks) are not eligible for reduced-rate VAT and in those cases the standard VAT rate will apply.
Rest of World. Goods sold by Verso Books that are dispatched to addresses in the rest of the world are not subject to US sales tax or EU VAT, but may be subject to import duties and taxes that are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Verso Books, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.
Liability
If the goods Verso Books delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Verso Books shall have no liability to you unless you notify Verso Books in writing at the Verso Books contact address of the problem within 30 days of the delivery of goods in question. If you do not receive goods ordered by you within 30 days of the date on which they were dispatched to you, Verso Books shall have no liability to you unless you notify Verso Books in writing at Verso Books contact address of the problem within 60 days of the date on which the goods were dispatched to you.
If you notify a problem to Verso Books under this condition, Verso Books' only obligation will be, at its option, to make good any shortage or non-delivery; to replace any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment.
Verso Books will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Verso Books under this condition and Verso Books shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under the paragraph above.
Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit Verso Books liability to you for any death or personal injury resulting from its negligence.
Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.
Force Majeure
Verso Books shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
Invalidity
If any part of these conditions is unenforceable (including any provision in which Verso Books excludes its liability to you) the enforceability of any other part of these conditions will not be affected.
Complaints
Verso Books operates a complaints handling procedure which is used to try to resolve disputes when they first arise. If you have a complaint, please contact Verso, Inc. or New Left Books Ltd at the addresses above, addressing your complaint to the Customer Service Department.
Governing Law
The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.
Entire Agreement
These terms and conditions, together with the current Verso Books website prices, delivery details and Verso Books contact details, set out the whole of our agreement relating to the supply of the goods to you by Verso Books. These terms and conditions cannot be varied except in writing signed by a director of Verso Books. In particular nothing said by any sales person on behalf of Verso Books should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by Verso Books. Verso Books shall have no liability for any such representation being untrue or misleading.
