A. STATEMENT

Auckland University of Technology (AUT) encourages public access to AUT information and supports the legal use of copyright material in accordance with the Copyright Act 1994 (the Act) and the Privacy Act 1993. Unless otherwise stated, copyright material contained on this site may be in the intellectual property of AUT, a member of staff or third parties. Any commercial exploitation of this material is expressly prohibited without the written permission of the owner.

TERMS OF USE OF THE AUT WEBSITE

The use of the AUT website is conditional on and subject to the Terms of Use (Terms). Please read these Terms carefully before accessing or participating in any chatroom, newsgroup, bulletin board, mailing list, website or other online forum available at aut.ac.nz or aut.ac.nz subdomain (Site(s)). You are deemed to have accepted and agree to be bound by the Terms by accessing and participating in these Site(s). AUT reserves the right to modify these Terms at any time and will publish notice of any modifications online. Continued use of the Sites is deemed acceptance of the Terms as modified from time to time.

1. The University grants users of this website a licence (within the meaning of the Act) to:

  • retrieve AUT Material for information only;
  • save or download a local copy for personal use;
  • send it to your printer for personal use to communicate the information to authorised and potential users, but you may not charge for such use;

provided that:

  • materials are not used for commercial purposes;
  • the source in any copy you make is clearly acknowledged;
  • no modification to the material is made without the express permission of the copyright owner.

2. Limitation of Use

You may use AUT Sites for legal purposes only. If a third party claims any material you have contributed to a forum or linked Site is unlawful, you will bear the burden of establishing that the material complies with all applicable laws. By adding content to a forum or linked Site, you agree that such content is in the public domain and you will not claim ownership of, or exclusive copyrights or trademark rights in, such content. AUT computing resources or Sites must not be used to disseminate unsolicited advertising or promotional material of any kind.

3. Disclaimer

Some AUT sites are un-moderated forums containing personal opinions and other expressions of the persons who post entries. Neither the content of these forum Sites, nor the links to other websites are screened, approved, reviewed or endorsed by AUT or any AUT affiliated entity. AUT is not a publisher of any content that may be available via links to and from the AUT website. The material on these forum and linked Sites are the opinion of the specific author, not statements of advice, opinion, or information of AUT. If you feel you might be offended by the content of the Sites, you should discontinue use.

4. Choice of Law / Forum Selection

AUT Sites are hosted on AUT servers located on the AUT campus in New Zealand. You agree that any dispute arising out of or relating to these Terms or any content posted to a Site (including copies and republication thereof) whether based in contract, tort, statutory or other law, will be governed by the laws of New Zealand. Further, you consent to the personal jurisdiction of and exclusive venue in the courts located in and serving New Zealand as the legal forum for any such dispute.

5. Warranty / Limitation of Liability

Forum and linked Sites are provided “As Is”. Use of information obtained from or via these Sites is at your own risk. AUT does not warrant, and hereby disclaims any warranties, either express or implied, with respect to any Site, including (without limitation) warranties of accuracy, completeness, non – infringement, merchantability or fitness for a particular purpose in relation to any information obtained from a Site or a link to it. AUT does not warrant that Sites will operate in an uninterrupted or error – free manner or that Sites are free of viruses or to other harmful components.

6. Indemnification

You agree to indemnify and hold AUT harmless from any claims, losses, or damages (including legal fees) resulting from your violation of these Terms, your use of the Sites, or your placement of any content onto a Site. You also agree to fully cooperate in AUT’s defence against any such claims.

THE USE OF COPYRIGHT MATERIAL

AUT is a party to several copyright licence agreements. These agreements give staff, in the course of exercising their duties, extended rights within the permitted rights as determined by the Act.

1. Copyright Licensing Limited (CLL)

AUT is contracted to CLL who provide a centralised copyright clearance service to educational institutions. CLL’s contract with AUT only applies to AUT employees. All other clients, including students, are restricted to the provisions of the Act. For guidance, consult the documents listed below:

2. Screenrights

AUT has a copyright licence from Screenrights to copy radio and television broadcasts and cable programmes for educational purposes. Copies qualify as made for “educational purpose” if they are made for the purposes of teaching and / or research at AUT.

3. New Zealand Newspapers

AUT has a licence agreement with PMCA. For information on what is permitted click here.

4. Music licence

AUT has a copyright licence with APRA/AMCOS & PPNZ  to perform, communicate and copy music for Educational Purposes under certain conditions. Download the brochure for more information by clicking here.
