Using ABC iview

The ABC iview service (ABC iview) is provided to you on the following terms (Terms of Use), along with the  ABC-TV iview Access Guidelines and the ABC Online Conditions of Use. The ABC Online Conditions of Use prevail to the extent of any inconsistency. By continuing to access ABC iview, you agree to be bound by these Terms of Use and the ABC Online Conditions of Use. Please check this page regularly so you are aware of any updates to the terms. If you do not agree with any of the terms, as updated or amended, please do not use ABC iview. These Terms of Use govern use of the ABC iview website as well as any related ABC iview application made available on any authorised third party platform or device.

Use of ABC content

All intellectual property rights in the content, software and systems owned by or licensed to the ABC in respect of ABC iview, including video, audio, images, text, logos, names, designs, trademarks and copyright (ABC Content) are reserved to the ABC and any of its third party licensors permitting the ABC to make ABC Content accessible via ABC iview or any other ABC Online Service.

ABC iview is a streaming video content service which does not allow permanent download of ABC Content. ABC iview and all ABC Content is provided for your personal, non-commercial use only. You must not download (other than for temporary caching purposes as part of the video streaming process), retain, store, reproduce, republish, modify, adapt, translate, prepare derivative works from, reverse engineer or disassemble ABC Content, or authorise, allow or provide the means for others to do any of these things, without obtaining the ABC's prior written permission.

Unless otherwise expressly permitted by the ABC, you must not access, view or listen to certain parts of ABC Content using ABC iview if you are located outside of Australia.

You acknowledge that the ABC has absolute editorial control over all ABC Content at all times. The ABC reserves its right to modify, suspend or discontinue all or any part of ABC iview or ABC Content without giving you any notice.

Due to agreements which the ABC has with third party content owners:

  1. not all content broadcast on the ABC's television channels will be available for you to access or view on ABC iview; and
  2. the period of time during which you may access, view and/or listen to certain ABC Content using ABC iview may vary.

ABC Content as made available on ABC iview must always be displayed using ABC iview. You do not have the right to use any ABC Content or ABC mark/logo on your device or elsewhere except as provided on ABC iview and in accordance with these Terms of Use. You agree not to remove, obscure, or alter any ABC copyright notice or trademark on any ABC Content you may have otherwise been permitted by the ABC to access and use.

You must not directly or indirectly charge others for accessing, viewing or listening to any ABC Content, or attempt to commercialise or exploit the ABC Content in any way, which includes advertising or selling any goods and services which offer ABC Content, including any third party software applications.

You must not use ABC Content in any way that directly or indirectly implies any endorsement or approval by the ABC or any person appearing in ABC Content of any non-ABC product, service or content or of any belief, view or opinion expressed within or in respect of any such product, service or content.

You must not disrupt or try to disrupt ABC iview or use ABC iview to distribute software viruses or other harmful programs.

You must not infringe any applicable laws when using ABC iview to access, view or listen to ABC Content.

Entitlements under Parts VA, VB and section 183 of the Copyright Act 1968 (Cth) are reserved to the ABC. For educational institutions: Visit  Screenrights for information about Part VA (download of audio-visual content) and the Copyright Agency for information about Part VB (copying text/images).

Children

The online protection of children and young people under the age of 18 is a shared responsibility between the ABC, the parent or guardian, and the child. The ABC aims to ensure that children and young people who engage with our online spaces understand the possible risks they face and how to minimise them.

ABC Content may contain material or present concepts considered to be indecent, objectionable, offensive or otherwise unsuitable for children. If you permit a child to use your device to access, view or listen to ABC Content on ABC iview, then you are solely responsible for deciding whether or not that ABC Content is appropriate for that child to view.

Privacy

The ABC collects certain information about your usage of ABC iview on an anonymous basis. This information is used to analyse viewer behaviour and consumption of all ABC Content accessible on ABC iview.

Neither the ABC nor any of its agents or suppliers will associate your usage information with any personal information about you or any other information relating to you, such as mobile device IDs or unique IP addresses, unless compelled to do so by law or regulatory or judicial order.

Any personal details and data acquired by the ABC from your participation in this and any other ABC Online Service will be used only in accordance with the  ABC's Privacy Policy.

You agree that you must not infringe or try to infringe the privacy or other rights of any other users of ABC Online Services or any other person, including by storing or trying to store personal data or usage details about any such user or other person.

Digital Rights Management

The ABC and its suppliers, authorised platform providers and content partners may embed digital rights management security in ABC iview or certain ABC Content and/or use other technical content protection measures as required to protect ABC Content from unauthorised access, and in order to meet obligations to third parties who own rights in ABC Content. You must not, and must not authorise, allow or provide the means for others to, adjust or circumvent or try to adjust or circumvent these technical measures.

Expenses and Equipment

You are solely responsible for paying all expenses you may incur when you access or use ABC iview or access ABC Content including your internet or data service provider charges and any excess charges to that provider if you have a limit on the amount of data you can download together with all costs of the equipment and software you need to connect to and use ABC iview and any other ABC Online Service. The ABC is not responsible if your equipment or software is not compatible with ABC iview.

ABC Content may be streamed or downloaded from servers owned and operated by the ABC or from third-party content distribution networks operated on behalf of the ABC to enhance the efficiency of delivery and the quality of viewer experience of ABC Content.

Disclaimers

ABC iview and ABC Content are provided on an "as is" and "as available" basis. You understand and agree that you use ABC iview at your own discretion and risk and that you will be solely responsible for any damage or loss whatsoever that results from such use.

Neither the ABC nor any of its suppliers, authorised platform providers or content partners guarantee that ABC iview and all ABC Content will always be available or be uninterrupted, timely, secure or free from errors and omissions or computer viruses.

The ABC and its suppliers, authorised platform providers and content partners disclaim to the fullest extent permitted by law all guarantees, warranties or representations of merchantability, acceptable quality and fitness for any purpose, security, reliability, accuracy, timeliness, and performance of ABC iview and any ABC Content.

The ABC assists ISPs that opt to offer ABC iview unmetered, and is working to make iview unmetered for users with other ISPs. You should check our FAQs for further details and updates. However, the ABC does not warrant or guarantee that iview will at all times or will always continue to be available unmetered.

The ABC is not responsible for the content, availability or performance of external sites linked to or hosting ABC iview or any ABC Content.

General

If for any reason a court of competent jurisdiction finds any provision or portion of these Terms of Use to be unenforceable, the remainder of these Terms of Use will continue in full force and effect.

If the ABC elects not to exercise or enforce any right that it has against you at a particular time, this does not prevent the ABC from later seeking to exercise or enforce that right.

You must not assign, sub-license or otherwise transfer any of your rights and obligations in these Terms of Use to any other person.

These Terms of Use will be governed by and construed in accordance with the laws of the State of New South Wales which shall have exclusive jurisdiction over any disputes.
