भ्रष्टाचारका मुद्धालाई पहिलो प्राथमिकता दिँदै आउनुभएकी प्रधानन्यायाधीश कार्कीको कार्यकालको अन्त्यतिर कार्यपालिका र व्यवस्थापिकासंग चर्को अन्तरद्धन्द देखियो । र उहाँ माथि महाअभियोग सम्म लगाउन खोजियो ।
व्यवस्थापिका संसदमा महाअभियोग दर्ता हुँदै गर्दा कार्की भ्रष्टाचारसँग जोडिएको एउटा चर्चित मुद्धाको फैसलामा हुनुहुन्थ्यो । महाअभियोग प्रस्ताव दर्ता भएपछि स्वतः निलम्बनमा पर्नुभएकी कार्कीलाई त्यही अदालतले महाअभियोगसँग सम्बन्धित कामकारवाही तत्काल अगाडी नबढाउन र कार्कीलाई तुरुन्तै अदालतमा हाजिर हुन अन्तरिम आदेश जारी भयो । र कार्यकाल सकिन एक महिना बा“की रहेकाले त्यसदिनदेखि कार्कीले कुनै पनि मुद्धाको सुनुवाई नगरेर सामान्य प्रशासनिक काम मात्रै गरेर विदा हुनुभएको छ ।
कार्कीलाई अदालतमा गुटबन्दी गरेको, न्यायसम्पादन स्वतन्त्ररुपमा नगरेको, कार्यपालिकाको अधिकारमाथि हस्तक्षेप गरेको आरोपसहित महाअभियोग प्रस्ताब दर्ता गरेका राजनीतिक दलहरुले नै अवकास पाउने अन्तिम दिन उहा“माथी लगाएको महाअभियोग प्रस्ताब फिर्तँ लिए ।
त्यसो भए कार्कीमाथि किन लगाईएको थियो महाअभियोग ? संविधान अनुसार महाअभियोग लगाउँदा स्वतन्त्र न्यायपालिकाको हस्तक्षेप कसरी भयो ? के सत्तारुढ दलहरुले भनेजस्तै उहाँले अदालतमा गुटबन्दी नै चलाउनुभएको हो ? या कार्यकारीले भनेजस्तै प्रधानन्यायाधीशले अधिकार क्षेत्रमाथी हमला गर्नुभएको हो ? स्वतन्त्र न्यायालयको कुरा संविधानमा मात्र सीमित गरेर पुग्छ ? किन राजनीतिक दलहरु अदालतलाई आफ्नो गोटी बनाउन चाहन्छन् ? कार्कीले महाअभियोग प्रस्तावपछि किन सुनुवाई गर्नुभएन ? के स्वतन्त्र अदालत बाहिर देखाउने दाँत मात्र हो ? यिनै प्रश्नको जवाफ खोज्न आजैदेखि अवकास प्राप्त प्रधानन्यायाधीश सुशीला कार्की टफ टकमा हुनुहुन्छ ।

Chief judge
Chief judge is a title that can refer to the highest-ranking judge of a court that has more than one judge. The meaning and usage of the term vary from one court system to another. While the term "chief judge" is used in some courts, other courts use terms such as "chief justice," "presiding judge," "president judge," or "administrative judge."
United States courts of appeals
In the United States courts of appeals, the chief judge has certain administrative responsibilities and presides over en banc sessions of the court and meetings of the Judicial Council. The chief judge remains an active judge of the court hearing and deciding cases, but at his or her option may elect to take on a reduced caseload to provide time to perform administrative responsibilities.
In order to qualify for the office of chief judge, a judge must have been in active service on the court for at least one year, be under the age of 65, and have not previously served as chief judge. A vacancy in the office of chief judge is filled by the judge highest in seniority among the group of qualified judges. The chief judge serves for a term of seven years or until age 70, whichever occurs first. The age restrictions are waived if no members of the court would otherwise be qualified for the position. Unlike the Chief Justice of the United States, a chief judge returns to active service after the expiration of his or her term and does not create a vacancy on the bench by the fact of his or her promotion. See 28 U.S.C. § 45.

Chief Justice
The Chief Justice is the presiding member of a supreme court in any of many countries with a justice system based on English common law, such as the Supreme Court of Canada, the Supreme Court of Singapore, the Court of Final Appeal of Hong Kong, the Supreme Court of Japan, the Supreme Court of India, the Supreme Court of Pakistan, the Supreme Court of Nepal, the Constitutional Court of South Africa, the Supreme Court of Ireland, the Supreme Court of New Zealand, the High Court of Australia, the Supreme Court of the United States, and provincial or state supreme courts.
The situation is slightly different in the three legal jurisdictions within the United Kingdom. The courts of England and Wales are headed by the Lord Chief Justice of England and Wales; in Northern Ireland's courts, the equivalent position is the Lord Chief Justice of Northern Ireland and in Scottish courts, the equivalent is the Lord President of the Court of Session. These three judges are not, though, part of the Supreme Court of the United Kingdom, which operates across all three jurisdictions and is headed by the President of the Supreme Court of the United Kingdom.

Chief Justice of India
The Chief Justice of India (CJI) is the highest-ranking judge in the Supreme Court of India, and thus holds the highest judicial position in India. As well as presiding in the Supreme Court, the Chief Justice also heads its administrative functions.
As the chief judge, the Chief Justice is responsible for the allocation of cases and appointment of constitutional benches which deal with important matters of law. In accordance with Article 145 of the Constitution of India and the Supreme Court Rules of Procedure of 1966, the Chief Justice allocates all work to the other judges who are bound to refer the matter back to him or her (for re-allocation) in any case where they require it to be looked into by a larger bench of more judges.
The present Chief justice of India is T.S.Thakur. He has started acting from 3 December 2015. Before him H.L.Dattu was the Chief Justice of India. He was last acting on 2/12/2015.

Supreme court
A supreme court is the highest court within the hierarchy of many legal jurisdictions. Other descriptions for such courts include court of last resort, instance court, judgment court, apex court, and highest court of appeal. Broadly speaking, the decisions of a supreme court are not subject to further review by any other court. Supreme courts typically function primarily as appellate courts, hearing appeals from decisions of lower trial courts, or from intermediate-level appellate courts.
However, not all highest courts are named as such. Civil law states do not tend to have singular highest courts. Additionally, the highest court in some jurisdictions is not named the "Supreme Court", for example, the High Court of Australia; this is because decisions by the High Court could formerly be appealed to the Privy Council. On the other hand, in some places the court named the "Supreme Court" is not in fact the highest court; examples include the New York Supreme Court, the Supreme Courts of several Canadian provinces/territories and the former Supreme Court of Judicature of England and Wales, which are all superseded by higher Courts of Appeal.

Dipak Misra
Justice Dipak Misra (born 3 October 1953) is a judge of the Supreme Court of India. A former Chief Justice of the Patna and Delhi High Courts, he is in line to become the Chief Justice of India in 2017, succeeding Justice J. S. Khehar.
Yakub Memon Issue
The Supreme Court judge, who led the bench that rejected 1993 Mumbai serial blasts convict Yakub Memon's last-ditch appeal to stop his execution, received a death threat in writing, reports said on Friday. Justice Dipak Misra received an anonymous letter which says "irrespective of the protection you may avail, we will eliminate you", NDTV new channels reported.
Career
Justice Misra enrolled at the Bar on 14 February 1977 and practised at the Orissa High Court and the Service Tribunal. He was appointed as an Additional Judge of the Orissa High Court in 1996 and was later transferred to the Madhya Pradesh High Court in 1997 where he was made a Permanent Judge on 19 December 1997. He served as Chief Justice of the Patna High Court from December 2009 to May 2010 and thereafter he was appointed Chief Justice of the Delhi High Court where he served till October 2011. As Chief Justice of the Delhi High Court, he helped decide over 5000 cases and helped clear the backlog of cases by making the Mediation Centre and Lok Adalats more effective.

A Supreme Court judge has written to the president for impeaching Chief Justice Surendra Kumar Sinha over the judge's removal from a bench of the apex court. In a letter to President Abdul Hamid yesterday, Justice AHM Shamsuddin Choudhury alleged that the chief justice “out of his personal grudge” had removed him (Shamsuddin) from a bench of the SC. The Daily Star has obtained a copy of the letter. The SC judge said the chief justice didn't allow him to take part in the bench's activities since September 9. “I wrote to the chief justice on September 8 after I got a letter with his [the CJ] instructions on September 2. A cause list of the benches related to the Appellate Division was published on September 8, and I found that I had been removed from the bench,” Justice Shamsuddin, who retires on October 1, mentioned in the letter to the president. -

Wide of defendants STORYLINE: The chief judge in Saddam Hussein's genocide trial threw the ex-president out of the courtroom on Monday after the defendant complained about the proceedings. (These shots are not seen in the pool pictures). "I don't want to come to this court" Saddam said as he waved a yellow paper at the chief judge Mohammed Oreibi al-Khalifa. Al-Khalifa snapped back "when I decide to get you out I get you out. Get him out." pointing to guards to take Saddam out. The incident began when co-defendant Sabri al-Douri, director of military intelligence under Saddam, referred to another co-defendant, Sultan Hashim Ahmad al-Tai, by his rank of lieutenant general. The judge then said that the defendants could not be referred to by their former rank. An angry Saddam then raised the request not to attend the session, when the judge threw him out of the courtroom. The trial had resumed on Monday without lawyers representing the ex-president or any of the other six defendants. Saddam's lawyers announced on Sunday that they would boycott the proceedings "indefinitely", citing the replacement of the chief judge. They also alleged other violations of legal procedure, such as the court's refusal to hear non-Iraqi lawyers and its demand that foreign attorneys seek permission to enter the courtroom. Among Saddam's nine lawyers are a Jordanian, a Spaniard, a Frenchman and two Americans, including former US Attorney General Ramsey Clark. Plot: On October 6, 1970 while boarding an international flight out of Istanbul Airport, American 'Billy Hayes (I)' (qv) is caught attempting to smuggle 2 kilos of hashish out of the country, the drugs strapped to his body. He is told that he will be released if he cooperates with the authorities in identifying the person who actually sold him the hash. Billy's troubles really begin when after that assistance, he makes a run for it and is recaptured. He is initially sentenced to just over four years for possession, with no time for the more harsh crime of smuggling. The prison environment is inhospitable in every sense, with a sadistic prison guard named Hamidou ruling the prison, he who relishes the mental and physical torture he inflicts on the prisoners for whatever reason. Told to trust no one, Billy does befriend a few of the other inmates, namely fellow American Jimmy Booth (in for stealing two candlesticks from a mosque), a Swede named Erich, and one of the senior prisoners having already served seven years, an Englishman named Max, the latter two also in for hash related charges. One prisoner not befriended is Rifki, who wields power in the prison as the unofficial eyes and ears for the guards. As Billy, his family and his girlfriend Susan attempt through legal and diplomatic channels for Billy's release, Max tells him that the only way out is to "catch the midnight express" aka escape, which is what Jimmy is continually trying to do. When Billy's situation changes, he becomes more desperate in every sense of the word. It seems as if Billy has only two options: to let the prison ultimately figuratively then literally kill him, or to somehow regain control of his life through whatever means available.

Humorous Judge Dismisses 'Ridiculous' Ticket When Woman Parks 2 Seconds Early
Sarah brought a parking ticket to Chief Judge Frank Caprio but the judge thought the ticket was ridiculous. Sarah explained the clock in her car said it was 10:00 a.m. when she tried to park in the spot that was a no parking zone from 8:00 to 10:00 a.m. She was fined for stopping her car two seconds before parking there became legal. According to footage from the show, the judge gave her a hard time anyway, joking to the court inspector: "What does justice demand in this case, is it jail?"

Supreme Court judge seeks Chief Justice Surendra Kumar Sinha's impeachment
A Supreme Court judge has written to the president for impeaching Chief Justice Surendra Kumar Sinha over the judge's removal from a bench of the apex court. In a letter to President Abdul Hamid yesterday, Justice AHM Shamsuddin Choudhury alleged that the chief justice “out of his personal grudge” had removed him (Shamsuddin) from a bench of the SC. The Daily Star has obtained a copy of the letter. A Supreme Court judge has written to the president for impeaching Chief Justice Surendra Kumar Sinha over the judge's removal from a bench of the apex court.
In a letter to President Abdul Hamid yesterday, Justice AHM Shamsuddin Choudhury alleged that the chief justice “out of his personal grudge” had removed him (Shamsuddin) from a bench of the SC.
The Daily Star has obtained a copy of the letter.
The SC judge said the chief justice didn't allow him to take part in the bench's activities since September 9.
“I wrote to the chief justice on September 8 after I got a letter with his [the CJ] instructions on September 2. A cause list of the benches related to the Appellate Division was published on September 8, and I found that I had been removed from the bench,” Justice Shamsuddin, who retires on October 1, mentioned in the letter to the president.

The chief judge in Saddam Hussein's genocide trial threw the ex-president out of the courtroom on Monday after the defendant complained about the proceedings. (These shots are not seen in the pool pictures).
"I don't want to come to this court" Saddam said as he waved a yellow paper at the chief judge Mohammed Oreibi al-Khalifa.
Al-Khalifa snapped back "when I decide to get you out I get you out. Get him out." pointing to guards to take Saddam out.
The incident began when co-defendant Sabri al-Douri, director of military intelligence under Saddam, referred to another co-defendant, Sultan Hashim Ahmad al-Tai, by his rank of lieutenant general.
The judge then said that the defendants could not be referred to by their former rank.
An angry Saddam then raised the request not to attend the session, when the judge threw him out of the courtroom.
The trial had resumed on Monday without lawyers representing the ex-president or any of the other six defendants.
Saddam's lawyers announced on Sunday that they would boycott the proceedings "indefinitely", citing the replacement of the chief judge.
They also alleged other violations of legal procedure, such as the court's refusal to hear non-Iraqi lawyers and its demand that foreign attorneys seek permission to enter the courtroom.
Among Saddam's nine lawyers are a Jordanian, a Spaniard, a Frenchman and two Americans, including former US Attorney General Ramsey Clark.

Humorous Judge Dismisses 'Ridiculous' Ticket When Woman Parks 2 Seconds Early
Sarah brought a parking ticket to Chief Judge Frank Caprio but the judge thought the ticket was ridiculous. Sarah explained the clock in her car said it was 10:00 a.m. when she tried to park in the spot that was a no parking zone from 8:00 to 10:00 a.m. She was fined for stopping her car two seconds before parking there became legal. According to footage from the show, the judge gave her a hard time anyway, joking to the court inspector: "What does justice demand in this case, is it jail?"

Supreme Court judge seeks Chief Justice Surendra Kumar Sinha's impeachment
A Supreme Court judge has written to the president for impeaching Chief Justice Surendra Kumar Sinha over the judge's removal from a bench of the apex court. In a letter to President Abdul Hamid yesterday, Justice AHM Shamsuddin Choudhury alleged that the chief justice “out of his personal grudge” had removed him (Shamsuddin) from a bench of the SC. The Daily Star has obtained a copy of the letter. The SC judge said the chief justice didn't allow him to take part in the bench's activities since September 9. “I wrote to the chief justice on September 8 after I got a letter with his [the CJ] instructions on September 2. A Supreme Court judge has written to the president for impeaching Chief Justice Surendra Kumar Sinha over the judge's removal from a bench of the apex court.
In a letter to President Abdul Hamid yesterday, Justice AHM Shamsuddin Choudhury alleged that the chief justice “out of his personal grudge” had removed him (Shamsuddin) from a bench of the SC.
The Daily Star has obtained a copy of the letter.
The SC judge said the chief justice didn't allow him to take part in the bench's activities since September 9.
“I wrote to the chief justice on September 8 after I got a letter with his [the CJ] instructions on September 2. A cause list of the benches related to the Appellate Division was published on September 8, and I found that I had been removed from the bench,” Justice Shamsuddin, who retires on October 1, mentioned in the letter to the president.

The chief judge in Saddam Hussein's genocide trial threw the ex-president out of the courtroom on Monday after the defendant complained about the proceedings. (These shots are not seen in the pool pictures).
"I don't want to come to this court" Saddam said as he waved a yellow paper at the chief judge Mohammed Oreibi al-Khalifa.
Al-Khalifa snapped back "when I decide to get you out I get you out. Get him out." pointing to guards to take Saddam out.
The incident began when co-defendant Sabri al-Douri, director of military intelligence under Saddam, referred to another co-defendant, Sultan Hashim Ahmad al-Tai, by his rank of lieutenant general.
The judge then said that the defendants could not be referred to by their former rank.
An angry Saddam then raised the request not to attend the session, when the judge threw him out of the courtroom.
The trial had resumed on Monday without lawyers representing the ex-president or any of the other six defendants.
Saddam's lawyers announced on Sunday that they would boycott the proceedings "indefinitely", citing the replacement of the chief judge.
They also alleged other violations of legal procedure, such as the court's refusal to hear non-Iraqi lawyers and its demand that foreign attorneys seek permission to enter the courtroom.
Among Saddam's nine lawyers are a Jordanian, a Spaniard, a Frenchman and two Americans, including former US Attorney General Ramsey Clark.

Chief Justice Ma (Chinese: 馬道立) is the incumbent Chief Justice of the Hong Kong Court of Final Appeal. Between 2001 and 2010, he held various positions in the High Court of Hong Kong, as a Judge of the Court of First Instance, a Justice of Appeal and the Chief Judge of the High Court. He was appointed the Chief Justice on 1 September 2010.
Chief Justice Ma graduated with an LL.B from Birmingham University in 1977. He completed his Bar Finals in 1978. He was called to the English Bar (Gray’s Inn) in 1978, the Hong Kong Bar in 1980, the Bar of the State of Victoria in Australia in 1983 and the Bar of Singapore in 1990. He was appointed Queen’s Counsel in 1993 and made an Honorary Bencher of Gray’s Inn in 2004. He was admitted to the degree of Doctor of Laws (honoris causa) by the University of Birmingham in 2011. He was awarded the Grand Bauhinia Medal by the Government in June 2012 and was conferred an Honorary Fellowship by Harris Manchester College of the University of Oxford in November 2012.
