The man arrested, Shaquille Parker, 22, of Forest Road, has not filed a formal complaint regarding the incident.
He was charged with felony second-degree assault, misdemeanor resisting arrest, and violation-level disorderly conduct and marijuana possession.
“We’re doing an internal investigation,” Kilcullen said. “We require a use-of-force form to be completed with any officer who uses force. Mr. Parker has not made a complaint to us, though. In terms of his activity for which he was charged, that will be taken care of in court.”
Kilcullen said Sgt. Dean DeMartino suffered minor injuries from the struggle with Parker, including a knee injury and a broken finger, resulting in Parker’s felony second-degree assault charge.
Police have had an increased presence in the area of Main Avenue and Crane Street, where the incident occurred, after complaints of drug deals, Kilcullen said.
“We have had, over time, many, many complaints of drug dealing and illicit activity going on there, where people there for legitimate purposes were being approached by drug dealers,” he said. “We increased our presence to deal with those constant complaints.”
Kilcullen said the officer was walking his beat when he saw Parker jaywalking, disrupting traffic.
The officer requested to search him, Parker said, but Parker refused. Parker said he then started to walk away and the officer followed. He said he was pepper-sprayed a short time later. Other officers converged and he was sprayed again and Tasered. Later portions of the incident were caught on video.
“The actual charge was disorderly conduct where the individual disrupts traffic. That’s the underlying charge,” Kilcullen said. “Everything else came from that, like the resisting arrest.”
After Parker was in custody, police searched him and discovered he was in possession of marijuana. Parker works at The Daily Gazette as a mailroom inserter.
As part of the department’s internal investigation, Kilcullen said provided video along with surveillance cameras and police cars’ cameras would be reviewed.
“The investigation is just beginning into the entire matter,” he said. “We have camera footage, much more camera footage than what’s on [The Daily Gazette’s] website that captures the incident.”
“I have been pushing to enforce jaywalking but nothing has been done, and then one time they stop someone for jaywalking,” Clark said. “He had the right to say he didn’t want to be searched. The police stepped it up and took it to another level.”
City Councilman Vince Riggi said the underlying issue is noncompliance, and that the incident sends a message that all laws, including jaywalking, are strictly enforced.
“I was taught to comply with police and then let the courts determine if it was legal or not legal,” he said. “I think the key is compliance and that jaywalking is illegal, and probable cause for someone to be stopped. It’s not serious with all other crimes going on, but an officer has the right to approach you for that.”
Kilcullen said the department’s community police officers have dual roles as zone officers responding to calls in their neighborhood and also getting involved in neighborhood activities.
“They attend neighborhood association meetings and are involved in activities like cleanups,” he said. “The city has eight zones and we have one assigned officer to each zone.”
McCarthy said the goal of community policing is to deter crime in neighborhoods and develop a rapport with residents and businesses. The city is set to receive $165,000 in federal funding on July 1 for community policing.
Patricia Ann Smith, president of the Mont Pleasant Neighborhood Association, said she appreciates the police presence in Mont Pleasant and believes they are doing a good job.
“They have been very accommodating and they still are,” she said. “There is a lot to deal with here. We’re trying to accentuate the positives in Mont Pleasant. Every neighborhood has their share of issues, but we appreciate their help to try and make it a safer place for residents to live.”

Schenectady, New York
Schenectady /skᵻˈnɛktədi/ (skə-NEK-tə-dee) is a city in Schenectady County, New York, United States, of which it is the county seat. As of the 2010 census, the city had a population of 66,135. The name "Schenectady" is derived from a Mohawk word skahnéhtati meaning "beyond the pines". The city was founded on the south side of the Mohawk River by Dutch colonists in the 17th century, many from the Albany area. They were prohibited from the fur trade by the Albany monopoly, which kept its control after the English takeover in 1664. Residents of the new village developed farms on strip plots along the river.
Connected to the west via the Mohawk River and Erie Canal, the city developed rapidly in the 19th century as part of the Mohawk Valley trade, manufacturing and transportation corridor. By 1824 more people worked in manufacturing than agriculture or trade, and the city had a cotton mill, processing cotton from the Deep South. Numerous mills in New York had such ties with the South. Through the 19th century, nationally influential companies and industries developed in Schenectady, including General Electric and American Locomotive Company (ALCO), which were powers into the mid-20th century. The city was part of emerging technologies, with GE collaborating in the production of nuclear-powered submarines and, in the 21st century, working on other forms of renewable energy.

In 2013, Rochester had more murders per person than anywhere else in our top 10, with a total of 42 for the year. This, plus the 92 rapes, 918 robberies, and 1,055 assaults gave Rochester a total of 2,107 violent crimes for the year—that’s the fourth most per person. Additionally, Rochester had the sixth highest number of property crimes per person, with 10,051 for the year, giving it the fourth highest number of crimes per person overall.
3. Syracuse
Syracuse may be a hub for culture and education, but according to the FBI’s latest numbers, it’s also a hub for crime. In fact, residents in Syracuse have just a 1 in 19 chance of being the victim of a crime (as compared to, say, a 1 in 417 chance in Glen Cove, NY). The reason for this high chance of being the victim of a crime is the high number of total crimes per person—the sixth highest in the state. These crimes were made up of 6,473 property crimes and 1,192 violent crimes, 21 of which were murders.
4. Niagara Falls
The good news is, Niagara Falls didn’t rank quite as badly in the category of murders as some of the others in our top 10—it had just three in 2013, giving it the 19th most per person. The bad news is, it ranked worse than most in all other categories. For its 584 violent crimes and population just shy of 50,000, Niagara Falls had the third most violent crimes per person. And for its 2,807 property crimes, it had the second most per person in this category.
5. Schenectady
This city in Eastern New York comes in among our top 10 mostly due to its high number of violent crimes per person. In 2013, it had a reported total of 607 violent crimes—eight murders, 31 rapes, 203 robberies, and 365 aggravated assaults. With its population of just over 66,000 people, this gave Schenectady the sixth most violent crimes per person. This, plus its 11th most property crimes per person (a total of 2,800 in 2013), gave Schenectady the eighth most crimes per person overall and residents just a 1 in 19 chance of being the victim of a crime.
6. New burgh
Just a moment ago we told you that Schenectady had a high number of violent crimes per person—but that was nothing compared to New burgh. This city had the highest number of violent crimes per person out of anywhere in our analysis, with a total of 435 for its population of just 28,571. These violent crimes included five murders (the fifth most per person), 21 rapes, 150 robberies, and 259 assaults.
7. Johnson City
The Village of Johnson City had 69 violent crimes for its population of 14,866. This gave it the 19th most violent crimes per person. But with 949 property crimes (828 thefts, 111 burglaries, and 10 vehicle thefts), Johnson City had the highest number of property crimes, and, therefore, the highest number of total crimes per person in our analysis.
8. Birmingham
This Broom County city ranked among our top 10 mostly due to its third highest number of property crimes per person. To be a bit more specific, Birmingham had a total of 2,349 property crimes for its population of 46,304. These included 1,767 thefts, 525 burglaries, and 57 vehicle thefts. Additionally, the city had a total of 284 violent crimes, including three murders, 19 rapes, 101 robberies, and 161 assaults, giving it the 13th most per person in this category, and the fifth most total crimes per person in our analysis.
9. Albany
In 2013, Albany had a total of 4,881 crimes, which, with its population of just under 98,000, gave it the 10th highest number of crimes per person in our analysis. These crimes included 4,090 property crimes and 791 violent crimes, eight of which were murders.
10. Utica
Bringing our list to a close is the City of Utica. It had a high number of crimes, pretty much across the board, with a 2013 total of 2,889. With its population of 61,686, this gave it the 14th most per person. this was made up of 2,528 property crimes (the 15th most per person) and 361 violent crimes (the 14th most). To be more specific, these property crimes included 1,997 thefts, 449 burglaries, and 82 vehicle thefts, while the violent crimes included seven murders, 27 rapes, 102 robberies, and 225 aggravated assaults.

SCHENECTADY -- Around the Capital District, there were a number of debate viewing parties Monday night. One was held at Proctor's GE Theatre where about 75 people gathered to watch it on the giant screen rather than from their couch. It was a crowd that seemed to back the former U.S. Senator from New York over the developer from New York City.
"This is the first presidential debate that I have been eligible to vote during and it was a lot, it was a lot,” said Jane Murphy, who plans to vote for Hillary Clinton. "I think Trump was a little sloppy and like petty and I think Hillary was better."
"This is a very dangerous time and either candidate wins, we have a lot of fixing to do,” said Aaron Gruenberg, who moved upstate from New York City. “I think that Donald Trump supporters have a lot to be fearful of and he's playing on their fears."
Hillary Clinton and Donald Trump were shown side-by-side on the giant screen for the entire 90-minutes. She wore red and he wore a blue tie, colors opposite what their parties are typically associated with. Proctors offered drinks for the Left – colored blue - and Right – colored red. The “Left” outsold the “Right” by more than 3-to-1.
"The debate was very entertaining but Secretary Clinton held her own,” said Ang Morris, a well-known activist in the city. “She spoke in an articulate and professional and presidential manner."
"When are we going to cooperate, when are we going to communicate?" voter Shawn Panella asked rhetorically after the debate concluded. “So my vote counts, everyone's vote counts so when you look you've got to do more than just depend on one source, you've got to check everywhere so you can get the correct, right answer."
Some viewers tracked it on social media, some sat quietly. However, in one case, a Bernie Sanders backer was heckling the screen. He was given a couple of chances to pipe down but when he couldn’t contain himself, he was physically-removed. A theatre spokesman said they'd had trouble with him before and even if it was a public event, he was disturbing it.
This showing was a promotion for what Proctor’s will showcase at the end of October, a tongue-in-cheek comedy show about the election titled “Unelectable You.” Proctor’s also plans to show the third Clinton-Trump debate on October 19.
