When I was practicing transactional law, the litigators would always make fun of us saying all we did was change the names in old forms. That just showed how ignorant they were of actual practice; we also changed the dates and sometimes other stuff too.

In other words, the use of “viability” under Roe as the point where abortion can be outlawed is consistent with over a thousand years of English/American legal tradition.

It’s not a matter of “ancient law” under traditional notions of anglo saxon common law; it’s only murder if a miscarriage happens after quickening. The “let’s stick to tradition” folks sure love to pervert tradition when it suits their means.
