Update August 2016 I have decided to upload this video again because I keep getting messages about what eventually happened 6 months after the date of the alleged incident. Well - "big pause" - NOTHING HAPPENED! Stand up for your rights folks. ********************************************************************************************** This incident happened in Cambuslang on 4th September 2015. I was stopped by a lone police constable who accused me of using my mobile phone whilst driving. I was NOT using my phone whilst driving and had a witness (my passenger) to corroborate this. The police guy, however, was having none of it. He insisted that he had seen me on my phone and demanded that I hand it over. He wanted to seize the phone and take it away for it to be analysed and used as evidence against me. I am self-employed - the phone in question is the phone I use for work. I have known people that have had phones or computers seized by the police and because they seize so many it can take more than a year to get your property back. I told the guy repeatedly that I wasn't using my phone, adding that I didn't appreciate a lone police constable (with no witness) pulling me over and falsely accusing me of using the phone. There was no reasoning with this guy - he was a condescending cretin on a complete power trip. Anyway. because I wouldn't hand over the phone he started accusing me of being aggressive and that's when I decided to start videoing the incident. To cut a long story short... the guy called for backup and I eventually got arrested, cuffed and slung in the back of a police car. After sitting in the back of the car for about 5 minutes at the scene of the alleged crime, the backup guys then took over from the first guy. I got the impression from the backup that they knew the guy had made a complete blunder but because he was a fellow police constable they reluctantly went along with his version of events. Rather than get arrested for obstructing the police from doing their 'so-called' duty and allow them to seize my phone, I suggested that they remove the cuffs, give me my phone back, and issue me with a fixed penalty (that I assured them I would not be paying). Eventually, they agreed and I was allowed to go on my way - phone in pocket and ticket in hand (a potential £100 fixed penalty and 3 points on my licence). I had 28 days to pay the fine. I didn't pay it and have heard nothing as of 8th of January 2016. I assume the procurator fiscal has slung the charge and I don't expect anything to come of this incident now - if, however, I find myself in court over this matter then I am confident that the charge will be dropped then, as phone records show no incoming/outgoing calls, no incoming/outgoing messages, and no internet activity at time of alleged incident. Anyway... enough waffle... the reason I am posting this is to show people that -- if you are accused of a crime such as this and are innocent, then don't be intimidated and bullied into handing over your property to obstinate, unreasonable figures of authority who - in reality - are public servants employed to safe-guard the public rather than terrorise us. Power to the People! Vive la Revolution... Update 28th August 2016 More than 10 months after the date of the alleged incident, and me not paying the fine NOTHING has happened.
