Situación de derechos humanos de las personas LGBTI en Venezuela Audiencia Pública del 154 Período de Sesiones de la Comisión Interamericana de Derechos Humanos (CIDH) Martes 17 de marzo de 2015 → Extracto del informe sobre el 153 Período de Sesiones de la CIDH http://www.oas.org/es/cidh/prensa/comunicados/2015/037A.asp En relación con la situación de los derechos humanos de las personas lesbianas, gay, bisexuales y trans (LGBT) en Venezuela, las organizaciones solicitantes de la audiencia señalaron que altos funcionarios se han pronunciado públicamente de manera discriminatoria respecto de dichas personas. Según informaron las organizaciones, en Venezuela no hay reconocimiento de las familias diversas; existe discriminación en el ámbito de la salud; y no se llevan adelante investigaciones en los casos de crímenes de odio de personas LGBT, aún cuando incluyen ataques y detenciones ilegales por parte de agentes estatales. En tal sentido, destacaron que la situación de impunidad se agrava considerablemente en el caso de personas trans que ejercen trabajo sexual. En relación con la actividad de defensores, alegaron haber recibido amenazas relacionadas con el ejercicio de su defensa de personas trans, e indicaron que el Estado cierra espacios de participación a organizaciones que critican la situación de derechos de personas LGBT. Por su parte, los representantes del Estado indicaron que la discriminación contra personas LGBT es un tema cultural, y se refirieron antecedentes jurisprudenciales y medidas legislativas en garantía de los derechos de personas LGBT. Adicionalmente, indicaron que la Defensoría del Pueblo ha adoptado varias medidas en materia de capacitación de agentes estatales, aunque reconocieron que existen retos para la inclusión plena de personas LGBT. As the organizations reported, in Venezuela there is no recognition of diverse families; discrimination exists in the health arena; and investigations are not conducted into cases involving hate crimes against LGBT persons, even when these include attacks and illegal detentions by agents of the State. Along those lines, the petitioners pointed out that impunity is becoming much worse in cases involving trans sex workers. In terms of activities by rights defenders, they alleged having received threats because of their defense of trans persons’ rights and said the State shuts down access to participation by organizations that criticize the situation concerning the rights of LGBT persons. For their part, the State representatives indicated that discrimination against LGBT persons is a cultural issue, and they referred to legal precedents and legislative measures to guarantee the rights of LGBT persons. In addition, they indicated that the Ombudsman’s Office has adopted a number of measures related to the training of State agents, although they recognized that challenges remain for the full inclusion of LGBT persons. The IACHR urges the State to adopt a non-pathologizing gender identity law; investigate with due diligence crimes committed against LGBT persons; and take further measures, including public policies for the benefit of LGBT persons and those who defend their rights.
