Plus: On the Espionage Act's 100th Anniversary, it's now being used against whistleblowers and journalists rather than spies...
By Brad Friedman on 7/14/2017 6:15pm PT

On today's BradCast, take your pick. Either the Trump Administration (and its cronies in Congress) are liars or completely incompetent. There is plenty of evidence for both. [Audio link for show follows below.]

For a start today, the number of people now reported to have been at that June 2016 Trump Tower meeting with a Russian attorney said to have dirt on Hillary Clinton has now risen to eight. And, not single day has gone by since the revelation of that meeting one week ago, without the Team Trump explanations for it --- including from the President himself --- changing. Why?

But those aren't the stories today to suggest they are either liars or buffoons (and can't do math either.). Among the many additional stories placed into appropriate context today:

  • Trump's own Sec. of State takes a withering shot at Trump's government;
  • A congressional GOPer laments Republicans "simply don't know how to govern";
  • The non-partisan CBO finds Trump's budget doesn't actually balance (it's only off by $3.4 trillion);
  • Senate Republicans newest health care repeal plan doesn't either;
  • Some GOPers are willing to shut down the government if Trump's wall isn't funded (by tax-payers, not by Mexico, as promised);
  • Trump's border "wall" is beginning to sound exactly like Dubya and Obama's border fence (And his plans for immigration reform are beginning to sound a lot like Obama's as well.)

Given a new Pew survey finding a huge majority of Republican voters now believe higher education at universities and colleges has a "negative effect" on the country, perhaps none of today's stories should come as much of a surprise.

Finally, on the 100th Anniversary of the Espionage Act, the Committee to Protect Journalists offers a report on how, since Nixon first did so in the 70's, the Act has been misused to prosecute whistleblowers rather than spies, particularly under Obama, and how Trump may well begin using it against journalists in the bargain...

The Peach State faces yet another contested election following more than a decade of election failures, vulnerabilities and repeated warnings...
By Ernest A. Canning on 7/14/2017 8:38am PT

"I worry that what we have here in Georgia is the Titanic Effect," Georgia Tech Computer Scientist Richard DeMillo observed, regarding the myriad security issues revealed during the course of last month's U.S. House Special Election in Georgia's 6th Congressional District.

"Georgia officials are convinced the state's election system cannot be breached. Shades of the 'unsinkable ship'. They have neglected to give us life boats...a fail-safe system designed so that in case of a catastrophe Georgia voters can easily verify that reported vote totals match voter intent. It is the sort of common-sense approach that first-year engineering students learn. Other states have that capability. Inexplicably, Georgia does not," DeMillo said in a statement quoted in support of a legal challenge filed contesting the 100% unverifiable results of the June 20 contest.

The computer scientist's concerns are hardly the first expressed about Georgia's absurd voting system. In fact, they cap well over a decade of chilling revelations, shocking vulnerabilities and dire warnings issued from the community of experts who have examined the Peach State's voting system, including a number of those who installed it in the first place back in 2002.

For election integrity advocates, the allegations set forth in the July 3 complaint (Curling II) --- filed by the Coalition for Good Governance and a multi-partisan (Republican, Democratic and Constitution Parties) group of electors --- should be enough to make their hair stand on end. That's especially true as it relates to official intransigence and even outright hostility towards computer scientists and researchers who revealed critical vulnerabilities within the state's 100% unverifiable and Orwellian-named Diebold "AccuVote" TS touch-screen voting and tabulation system.

Curling I involved an earlier unsuccessful effort, filed just prior to the election, to secure a temporary restraining order that would have compelled Georgia to use paper ballots during what had become the most expensive U.S. House race in American history.

With the exception of a relatively small number of verifiable paper absentee ballots, Georgia 6th Congressional District electors were forced to cast their votes into electronic black holes. The result: an "election" in which Republican Karen Handel reportedly defeated Democrat Jon Ossoff 51.9% to 48.1%, despite almost all pre-election polls predicting an Ossof win, with some surveys finding the Democrat with a 7 point lead over his Republican opponent. The touch-screen "victory" for Handel, the state's former Secretary of State, is now being contested in Curling II precisely because the reported results were produced by a wildly vulnerable and 100% unverifiable e-vote tabulation system.

As Brad Friedman accurately reported in his first BradCast following Election Day, the results "may be absolutely right or completely wrong...Nobody knows for certain either way...[What we] do know, according to the state's reported results, [is] that Democrat Jon Ossoff defeated Republican Karen Handel in GA-06 by a nearly 2 to 1 margin on the only verifiable ballots used in the race, the paper absentee mail-in ballots"...

Guest: Pastor Malinda Harnish Clatterbuck of Lancaster Against Pipelines | Plus: GOP tries again on health care, and what is Team Trump hiding?...
By Brad Friedman on 7/13/2017 6:38pm PT

On today's BradCast: Republicans in the U.S. Senate gets desperate, Team Trump keeps getting caught in lies, and an order of Catholic nuns in rural Pennsylvania takes action to block a pipeline from being built on their own land. [Audio link to show follows below.]

First up: The Senate GOP today released the newest version of their attempted scheme to repeal and replace ObamaCare, and it's as bad as we'd warned it would be on our previous shows this week. The new version removes some of the tax cuts for the wealthy, but leaves in the massive Medicaid cuts that will remove health care for millions, and adds a new provision by Sen. Ted Cruz (R-TX) that would allow private insurers to sell largely worthless health care plans to suckers in order to claim they have "lowered premiums!"

The newest proposal will also likely continue to have a very difficult time finding the 50 GOP votes needed for passage in the Senate, but it would be a huge mistake to count them out and let your guard down. As that is moving forward, with a vote said to be scheduled for next week, two House Democrats have now officially filed an Article of Impeachment against Donald J. Trump for Obstruction of Justice, and more evidence of Team Trump having lied about contacts with various Russians and other foreign agents continues to emerge. What, if anything, are they trying to hide? And why?

Then, an order of Catholic nuns in central Pennsylvania dedicated a new outdoor chapel last Sunday at the edge of a cornfield and smack-dab in the path of a planned $3 billion natural gas pipeline. PASTOR MALINDA HARNISH CLATTERBUCK of Lancaster Against Pipelines and the Community Mennonite Church of Lancaster joins us to explain the defiant action by the nuns of The Adorers of the Blood of Christ, in the ongoing attempt to block the huge "Atlantic Sunrise" pipeline from being built by a private, Oklahoma-based company. The Williams Partners company has received federal Eminent Domain orders from the Federal Energy Regulatory Commission that would allow them to steal the use of the land from the sisters and other residents along the 300-mile path of the massive pipeline path in rural Lancaster County, PA.

Clatterbuck scoffed at the "irreparable harm" argument being made in U.S. District Court by the company in their emergency motion, to be heard next week, against the sisters' open-air chapel . "It's really ironic that they would use that language when the harm that they are proposing to do, not just to Lancaster County, but to the whole extension of Central Pennsylvania with this pipeline, would be violating the waterways --- 380-some waterways --- this pipeline would be crossing. And it would be going through more than 250 wetlands. And permanently fragmenting over 44 deep forests. I feel like that's irreparable harm that we're really pushing back against," she tells me.

"The audacity of an industry to feel as though they have an entitlement to put a pipeline wherever they want to is unfathomable to me," the pastor and longtime community organizer says, while responding to Williams' statement that they have no problem with peaceful protest by the nuns, as long as they move their chapel to a different location on the land they have owned for almost 100 years. "Isn't that amazing, how arrogant they are? It's not their property. This is the nuns' property. And the nuns have a right to do on their property what they want, right? Isn't this America?"

Paging Sean Hannity! (Who used to pretend to be infuriated by eminent domain...at least when it was done by Democratic Administrations.) And, paging Republicans and Donald Trump! (Who still pretend to be infuriated by encroachments on "religious freedoms," such as when other Catholic nuns, like the Little Sisters of the Poor, challenged the contraceptives mandate of ObamaCare.)

Finally, Desi Doyen joins us for the latest Green News Report on the Delaware-sized iceberg that has just broken off of Antarctica, Tesla's plan to build the world's largest battery in just 100 days (or it's free!), and much more, including a Phoenix weatherman who has been lying to his viewers --- over our public airwaves --- about global warming...in the middle of yet another record heat wave...

Guest: Lisa Gilbert, Public Citizen's VP of Legislative Affairs...
By Brad Friedman on 7/12/2017 6:09pm PT

On today's BradCast, good-ish news on several fronts. But only good-ish. That said, we'll take what we can get these days. [Audio link to complete show is posted below.]

First up: Hackers have been stealing thousands of credit card numbers and social security numbers from Donald Trump's hotels for months. Years, actually. But, other than that, no need to worry about his ability to oversee our nation's cybersecurity. (Or, for that matter, the security of private voter registration data his so-called "Election Integrity Commission" has requested from all 50 states.)

In related-ish news, Trump is reportedly furious in the wake of Donald Trump Jr.'s recently revealed meeting with a Russian attorney who promised dirt on Hillary Clinton during the campaign last year. But, he's not mad at Trump Jr., he's mad at the media for reporting it, apparently, and at dozens and dozens of sources inside his own White House and otherwise close to him, who keep leaking these sorts of things to the press.

In turn, even Congressional Republicans (including folks like Rep. Trey "Benghazi" Gowdy) are growing increasingly furious at the Administration, as their legislative agenda continues to be sidetracked by the ever-growing turmoil of the seemingly hapless Team Trump.

Nonetheless, Senate Republicans say they are planning to unveil the newest version of their health care repeal on Thursday, with a vote planned for early next week. The good-ish news is that they've reportedly removed some of the huge tax cuts to the wealthy from the bill in hopes of winning enough GOPers for approval in the chamber. But the huge cuts to Medicaid are said to still be in the legislation, which means it may still have the same problem finding 50 votes for passage in the Senate.

All of that, even as a new study finds that the Affordable Care Act ("ObamaCare"), which Republicans hope to dismantle, isn't in the "death spiral" Republicans and Trump continue to pretend it is. In fact, the study finds the landmark health care law is having its best year yet, and is actually more healthy and profitable than ever, despite continuing attempts by the GOP and White House attempts to undermine it.

Finally today, some more good-ish news as the federal Consumer Financial Protection Bureau (CFPB), created in response to the 2007 global banking crisis, has finally enacted a new rule to curb fine-print "arbitration clauses" in contracts that prevent customers from being able to sue banks and credit card companies who are ripping them off.

Public Citizen's Vice President of Legislative Affairs, LISA GILBERT, joins us today to explain the good-ish news, and the Republicans' plan to undermine it all together as soon as humanly possible.

"We call them 'rip-off clauses' because that is exactly what they do. Many people sign contracts without reading the tiny fine print --- we would say most --- and in those contracts, whether it's with a financial institution, whether it's a credit card, whether it's a cell phone contract, people are foreclosed on the right to sue a company if it wrongs them," Gilbert explains. "If they can't sue, they are instead forced into arbitration. It's a kangaroo court set up. It's something the corporation itself funds and pays for, so you can imagine, it is biased in their direction. Few people ever go to it at all, but when they do, they tend to lose. So it's a way for corporations to get out of jail free if they rip off their customers."

After a 5-year process, the CFPB has finally enacted the regulation as called for by the Dodd-Frank Act. So, naturally, Republicans already have several plans in place to kill it. Unless you stop them...

Guest: ACLU's Theresa Lee | Also: Trump Jr.'s legal probs; Senate GOP health care repeal; 'Green News Report' returns for another heat wave...
By Brad Friedman on 7/11/2017 6:07pm PT

On today's BradCast, we're still trying to keep our eye on the ball, as Trump and the Republicans work to take away both health and voting rights even as the nation is otherwise consumed with new breaking news in the ongoing criminal investigations of Team Trump. [Audio link to show is posted below.]

First up today, a few comments on the news regarding Donald Trump, Jr.'s meeting with a Russian attorney during the campaign last year and the federal election laws he may have violated in the bargain. But, with everyone else in the world covering that story today, fewer are covering the ongoing plans by the Senate GOP to try and repeal the health care for millions of Americans in exchange for tax cuts for the wealthy, possibly as early as next week, according to a top Senate Republican. And, if not next week, shortly thereafter, as Senate Majority Leader Mitch McConnell has now cancelled much of the August recess in hopes of jamming both ObamaCare repeal and a major tax cut scheme through Congress before Summer ends.

Similarly, with all of the noise regarding the incompetence and/or corruption of Team Trump, it's important to keep an eye on their ongoing efforts at voter suppression via Trump's so-called "Election Integrity" Commission which has already resulted in voters around the nation removing themselves from registration roles for fear that Commission Vice-Chair and notorious "voter fraud" fraudster Kris Kobach will publicly release the personal information of registered voters, such as birthdate, social security number, military status, etc., as he recently promised in a letter to all 50 states seeking that data.

But, as Kobach has made a career out of pretending there is a massive voter fraud epidemic and threatening prosecution against voters for small and often inadvertent violations of the law, you'd think his Commission would follow the rule of law to the letter. That does not appear to be the case, however, as at least four different legal complaints, alleging violations of federal law, have already been filed against Kobach and the Commission over the past week, even as even more notorious GOP 'voter fraud' fraudsters are being quietly added to the Presidential panel.

THERESA LEE, staff attorney at the ACLU's Voting Rights Project, one of the groups which have filed legal complaints against the Commission, joins us to explain their lawsuit [PDF] charging multiple violations of the Federal Advisory Committee Act (FACA), how this Presidential Commission on elections is wildly different from those created in the recent past, and what it is that Kobach and friends are really up to under the sham Commission's pretext of combating 'voter fraud'.

"One of the main purposes of the Act was public accountability, the idea that if the government is getting advice, it should not be biased advice, and the public should know what's going into it," Lee tells me, describing the extraordinary imbalance of the Trump-Pence-Kobach Commission and the secrecy under which it has so far been operating.

Finally today, it's the return of the Green News Report with Desi Doyen after a week off over the holidays, and just in time for another heat wave across much of the country, embarrassment at the G-20, and both good news and bad in California...

Guest: Republican election integrity advocate and plaintiff Marilyn Marks | Also: The world moves ahead without the U.S. following G-20 summit...
By Brad Friedman on 7/10/2017 6:12pm PT

On today's BradCast: I'm back! With huge thanks to Angie Coiro for filling in for us over the past week! But, if you thought the June 20th U.S. House Special Election in Georgia's 6th District was over, well, it's not quite yet, as our guest today, one of the plaintiffs in the Election Contest filed last week in state court, seeking to overturn the results, makes clear. [Audio link to show is posted below.]

But first, the G-20 Summit which wrapped up over the weekend in Hamburg, Germany made very clear that it is now the U.S. (or, more accurately, the Trump Administration) against the world. Old allies like Germany, France and Great Britain are forming new alliances with nations like China, to move ahead without the U.S. in the wake of the Trump Administration's plan to pull out of the landmark Paris Climate Agreement to curb the man-made release of greenhouse gases that cause global warming.

Meanwhile, back here at home, Democrats continue to wring their hands about what they believe to be a hacked or otherwise manipulated Presidential election in 2016, even while failing to do anything about voting systems that are easily hacked, manipulated and otherwise 100% unverifiable.

With major security concerns about last month's U.S. House Special Election in Georgia's 6th Congressional District --- where Democrat Jon Ossoff reportedly lost to Republican Karen Handel by 4 points after leading in virtually all of the pre-election polls --- you'd think Dems would be raising holy hell about the fact that Georgia still uses 100% unverifiable voting systems. That is particularly alarming in Georgia, since the state was recently discovered to have kept the passwords for those easily-manipulated 100% unverifiable Diebold touch-screen voting systems (along with the state Voter Registration databases and much more) on a completely unprotected web server for at least 7 months between August of last year and March of this year. The revelation regarding the massive security breach reported just days before the June 20 election at Kennesaw State University --- which has long been contracted to program all of the state's voting, tabulation and voter registration systems. That breach, we have since learned, only became known after the data was found and downloaded by at least two different cybersecurity researchers in those seven months.

But while the DNC seems to be "moving on" despite the unverifiable reported results of the the most expensive U.S. House race in history (in which the only verifiable votes in the race, the paper absentee ballots, reported Ossoff defeating Handel by a nearly 2 to 1 margin), a multi-partisan group of voters in the state of Georgia has now filed an election contest [PDF] in court, seeking to void the results and hold a new election on verifiable paper ballots.

I'm joined today by one of the plaintiffs in the suit, MARILYN MARKS, a former Republican candidate for office, longtime election integrity advocate, and Executive Director of the Coalition for Good Governance. We discuss the group's legal complaint, why they are filing it, what they hope to achieve, and if the GOP-majority House of Representatives will move to have her case tossed out of court on Constitutional jurisdictional grounds (as has been the case in similar Election Contests in recent history.)

The state's unverifiable equipment should lead the court to void the results of election, she argues, since it "absolutely cannot meet Georgia's statutes right now and it cannot be used going forward, not even in the municipal elections coming up in November."

Moreover, Marks explains, "we are asking that the court order Sec. of State [Brian] Kemp to re-examine the equipment, just as citizens [and more than two dozen world class computer scientists and e-voting experts] had asked back in May, before the June election...He refused."

She adds that "we want to see these paperless, unverifiable, anybody's-guess-who-won equipment gone from Georgia," and by "we" she means a coalition of Democrats, Republicans and the head of the far-right Constitution Party, who are plaintiffs in the suit. "We have members of our Coalition for Good Governance who literally also campaigned for Karen Handel, who very much support this lawsuit. So, it wasn't just about winning. They believe we're doing the right thing, even though it may very well overturn their candidate's victory. "

"Georgia is the poster child for unbelievably lax security and inviting in, with a welcome mat, any bad actors who want to walk in. Our experts have said...one after the other after the other, 'Look, the security is so lax in Georgia that you must presume the system has been compromised, you cannot rely on the votes coming out of these machines,'" Marks tells me.

But will Congress intercede to block the suit, as they have in the past after the declared winner has already been seated? (See their letter from 2006 here [PDF] that resulted in a contested U.S. House election in CA being dismissed by the court.) And why, by the way, are Democrats (and Republicans, for that matter) so resistant to stand up and demand elections and results that are overseeable by the public? I discuss all of that and much more with Marks today...

[This article was supposed to run last week, just after this video was released. But, alas, I dropped the ball in publishing it for Ernie before leaving town for the week! My apologies. But, of course, it's never too late to call out the "terrorist enabling" NRA. So, here ya go. - Brad]

By way of this deeply troubling recruitment video, Dana Loesch, the unhinged spokeswoman for the "terrorist enabling" National Rifle Association (NRA), may have crossed the line between protected free speech and unlawful incitement aimed at producing imminent violence against the many non-violent demonstrators who've taken to the streets as part of the resistance to the Donald Trump/GOP fascist-like, anti-egalitarian agenda.

In the video, Loesch, a former Breitbart "News" editor, who once equated feminism with advocacy for "female genocide," attempts to erect a picture of an ominous, violent leftist threat to "law abiding citizens," by which she means mostly white, often well-armed NRA card-carrying Trump supporters...

Guest: RJ Eskow, Tom Nichols, Kelly Macias
GUEST HOST: ANGIE COIRO of IN DEEP Radio
By Angie Coiro on 7/7/2017 7:00pm PT

On today's BradCast, guest hosted one last time by yours truly, Angie Coiro of In Deep with Angie Coiro.

Putin, Trump, and Tillerson climbed into the clubhouse today and pulled up the ladder, so no icky observers could get in. Angie reviews the already conflicting reports that emerged, when Donald Trump broke with tradition, bringing only the former CEO of Exxon-Mobile into his G20 convo with Vladimir Putin. Even their accounts of "confrontation" over election tampering conflict.

My guest Richard "RJ" Eskow, host of The Zero Hour, thinks Democrats are putting too many eggs in that latter basket, anyway. And he has very emphatic opinions about that New York Times opinion piece urging the Democratic Party to abandon progressives.

When it comes to Russia - or anything else, for that matter - you might find yourself confused by all those experts out there. That's probably because we've learned to conflate opinionators with actual experts. In an excerpt from In Deep, Tom Nichols, author of The Death of Expertise explains the decay of faith in people who actually know their stuff.

Finally, Kelly Macias, reporter with Daily Kos, parses some stories getting less attention this week: tenant marches on HUD, Texas as a scary barometer for the direction of the country, and how the noose has reemerged as a tool to terrorize African Americans...

Guests: Ari Berman, David Atkins, Jared Yates Sexton
GUEST HOST: ANGIE COIRO of IN DEEP Radio...
By Angie Coiro on 7/6/2017 6:00pm PT

On today's BradCast, guest hosted by my own self, Angie Coiro of In Deep Radio, we peer over to Poland to see Donny still on the election trail - reliving his November victory for a whole new crowd bused in just for the occasion. He took the time, too, to remind everyone it's us versus the boogeymen.

The Election Commission has acquired yet another sworn enemy of voting - Hans von Spakovsky, who once pulled a sock-puppet act on law journal articles, endorsing voter suppression under a pseudonym. And the League of Women Voters released a full-blast denouncement of Kris Kobach, de facto head of Trump's "voter fraud" commission.

That takes us right to returning guest Ari Berman, author of Give Us The Ballot. He's added to his excellent introduction to Kobach at The New York Times Magazine with a more encouraging post at The Nation.

Then David Atkins builds on his Washington Monthly deconstruction of what happened with California's effort toward single payer. He's got some very specific ideas about why the GOP will cross the public to push AHCA: because they don't care.

Then a follow-up on this week's earlier story on the "Donny Trumps CNN" wrestling video, and the anti-semitic rants of the man who created it. Turns out the by virtue of finding that (still anonymous) man's Star of David-emblazoned CNN photos, journalist Jared Yates Sexton became a target of online Nazis.

Finally, a plea to Gloria Allred: how about you take on this misogynistic obscenity on Capitol Hill?

Guest: Jane Mayer, DARK MONEY
Guest hosted by ANGIE COIRO of IN DEEP RADIO
By Angie Coiro on 7/5/2017 6:17pm PT

Sure, Brad and Desi can take the week off from The BradCast. It's a holiday - how big a news week can it be?

So much for that. Your guest host this week is me, Angie Coiro, and right up front I've gathered various reactions and opinions on North Korea's claim to have successfully tested a missile that could hit Alaska. More headlines: the American Enterprise Institute (!) has found that the gender pay gap has tripled since Trump moved into the White House - it's 37% compared to the national 17%; accusations of CNN's "blackmail" of a "15-year-old" ex-Redditor turn out to be wrong in both senses; and Rep. Maxine Waters has some deliciously spicy words for HUD's Ben Carson. And White House aides are - not surprisingly - nervous about Trump's pending meeting with Putin.

Trump's EPA got dinged by a DC federal court, leaving intact for the moment President Obama's plan to curb oil industry methane emissions. I talked with Jane Mayer not too long ago, about how demonstrably false "science" funded by dark money ends up part of mainstream dialogue, eventually yielding battles just like this. She discusses too the influence of Steve Bannon in the White House, and how investigating the Kochs compromised her own safety.

Finally, taco salad + Queen Victoria + Chris Christie = revelations about America's class system. You'll just have to listen.

Guests: Protester Jan McKim; Mike Hersh, PDA; Dr. David Reiss
Guest HOSTED BY ANGIE COIRO
By Angie Coiro on 7/3/2017 6:53pm PT

On today's BradCast, guest hosted by yours truly, Angie Coiro of In Deep Radio, we talk protests from a micro and macro view. Jan McKim adds to her history of San Francisco Bay Area protest attendance with this past weekend's impeachment march. We'll hear her from-the-ground report.

Those marches will be followed up with sit-ins on Thursday telling Congress exactly how thrilled Americans are at the idea of losing their health insurance. Mike Hersh is with the organizers of both actions, the Progressive Democrats of America. We go beyond the specific action events to discuss the thread of economic justice underlying everything the Left is fighting for.

Then, the hashtag that took over Twitter and made the jump to mainstream media: #25thAmendmentNow. Dr. David Reiss of DMR Dynamics was an early advocate questioning Donald Trump's fitness for office (or lack thereof). While he acknowledges the popularity of matching Donny's quirks to diagnostic lists of personality disorders, he advocates eyes on the prize: official assessment and proper followup action.

Also today: why Germany has unfriended America; and - sorry, Cheeto - more people approve of impeaching Trump than of his performance. Once again, his tweets have triggered a precipitous drop.
