§ 244-1 Definitions.
As used in this chapter, the following terms
shall have the meanings indicated:
- SMOKING
- Includes the act of smoking and shall include the carrying of lighted pipes, cigars, cigarettes or tobacco in any form or the carrying of lighted pipes, cigars, cigarettes or other drugs or material commonly or frequently used for smoking.
§ 244-2 Hazards.
Where conditions are such as to make smoking
a fire or explosion hazard in any areas of warehouses, stores, industrial
plants, healthcare occupancies, laboratories, places of assembly,
schools and in open spaces where flammable, combustible or hazardous
materials are manufactured, stored or handled, the Fire Chief, designated
by the Township of White, is empowered and authorized to order the
owner or occupant in writing to post no smoking signs in each building,
structure, room or place in which smoking shall be prohibited. The
Fire Chief shall designate specific safe locations, if necessary,
in any building, structure or place in which smoking is to be permitted.
§ 244-3 Signs.
No smoking signs of approved sized lettering and location, required in accordance with § 244-2 above, shall read "By Order of the Fire Chief."
§ 244-4 Unlawful to remove signs.
It shall be unlawful for any person to remove
any legally required no smoking signs or to smoke in a place where
such signs are posted.
§ 244-5 Violations and penalties. [1]
Any person, firm or corporation who shall violate
any provision of this chapter, or shall fail to comply therewith,
or who shall fail to comply with or violate any order made thereunder,
upon conviction thereof in an action brought before a Magisterial
District Judge in the manner provided for the enforcement of summary
offenses under the Pennsylvania Rules of Criminal Procedure, shall
be sentenced to pay a fine of not more than $1,000 plus costs and,
in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this chapter continues
or each section of this chapter which shall be found to have been
violated shall constitute a separate offense. The imposition of a
penalty for any violation shall not excuse the violation or permitted
it to continue. All such persons shall be required to correct or remedy
such violation or defects within a reasonable time.
