The U.S. Equal Employment Opportunity Commission (EEOC) is a federal agency that administers and enforces civil rights laws against workplace discrimination. The EEOC investigates discrimination complaints based on an individual's race, color, national origin, religion, sex, age, disability, genetic information, and retaliation for reporting, participating in, and/or opposing a discriminatory practice.
In 2011, the Commission included "sex-stereotyping" of lesbian, gay, and bisexual individuals as a form of sex discrimination illegal under Title VII of the Civil Rights Act of 1964. In 2012, the Commission expanded protection provided by Title VII of the Civil Rights Act of 1964 to transgender status and gender identity. In 2015, it concluded that Title VII of the Civil Rights Act of 1964 doesn't allow sexual orientation discrimination in employment because it is a form of sex discrimination. However, these rulings, while persuasive, are not binding on courts, and would need to be addressed by the Supreme Court for a final decision. The Commission also mediates and settles thousands of discrimination complaints each year prior to their investigation. The EEOC is also empowered to file civil discrimination suits against employers on behalf of alleged victims and to adjudicate claims of discrimination brought against federal agencies.
Equal opportunity is a stipulation that all people should be treated similarly, unhampered by artificial barriers or prejudices or preferences, except when particular distinctions can be explicitly justified. The aim according to this often complex and contested concept is that important jobs should go to those “most qualified” – persons most likely to perform ably in a given task – and not go to persons for arbitrary or irrelevant reasons, such as circumstances of birth, upbringing, having well-connected relatives or friends, religion, sex, ethnicity, race, caste, or involuntary personal attributes such as disability, age, gender, or sexual orientation. Chances for advancement should be open to everybody interested such that they have “an equal chance to compete within the framework of goals and the structure of rules established.” The idea is to remove arbitrariness from the selection process and base it on some “pre-agreed basis of fairness, with the assessment process being related to the type of position,” and emphasizing procedural and legal means. Individuals should succeed or fail based on their own efforts and not extraneous circumstances such as having well-connected parents. It is opposed to nepotism and plays a role in whether a social structure is seen as legitimate.
The Equal Employment Opportunity Commission was established by Title VII of the Civil Rights Act of 1964 to assist in the protection of US employees from discrimination. The law was the first federal law designed to protect most US employees from employment discrimination based upon that employee's (or applicant's) race, color, religion, sex, or national origin (Public Law 88-352, July 2, 1964, 78 Stat. 253, 42 U.S.C. Sec. 2000e et. seq.). Employment discrimination entails areas such as firing, hiring, promotions, transfer or wage practices and it is also illegal to discriminate in advertising, referral of job applicants, or classification. The Title is pertinent in companies affecting commerce that have twenty-five or more employees. The Equal Employment Opportunity Commission (EEOC) is section 705 of the title.
Equal employment opportunity was further enhanced when President Lyndon B. Johnson signed Executive Order 11246 on September 24, 1965, created to prohibit federal contractors from discriminating against employees on the basis of race, sex, creed, religion, color, or national origin.
