A special prosecutor generally is a lawyer from outside the government appointed by an attorney general or, in the United States, by Congress to investigate a government official for misconduct while in office. A reasoning for such an appointment is that the governmental branch or agency may have political connections to those it might be asked to investigate. Inherently, this creates a conflict of interest and a solution is to have someone from outside the department lead the investigation. The term "special prosecutor" may have a variety of meanings from one country to the next, from one government branch to the next within the same country, and within different agencies within each government branch. Critics of the use of special prosecutors argue that these investigators act as a "fourth branch" to the government because they are not subject to limitations in spending or have deadlines to meet.
Attorneys in the United States may be appointed/hired particularly or employed generally by different branches of the government to investigate. When appointed/hired particularly by the judicial branch to investigate and, if justified, seek indictments in a particular judicial branch case, the attorney is called special prosecutor. When appointed/hired particularly by a governmental branch or agency to investigate alleged misconduct within that branch or agency, the attorney is called independent counsel. When employed by the state or political subdivision to assist in a particular judicial branch case when the public interest so requires, the attorney is called special counsel.
Robert Swan Mueller III (born August 7, 1944) is an American lawyer. He served as the sixth Director of the American Federal Bureau of Investigation (FBI).
Mueller was born on August 7, 1944, in New York City, New York, the son of Alice C. (née Truesdale) and Robert Swan Mueller. His maternal great-grandfather was railroad executive William Truesdale; his ancestry includes German, Scottish, and English. Mueller grew up outside of Philadelphia, Pennsylvania. A 1962 graduate of St. Paul's School, he went on to receive an A.B. from Princeton University in 1966, where he played lacrosse, an M.A. in international relations from New York University in 1967, and a Juris Doctor from the University of Virginia School of Law in 1973.
Mueller joined the United States Marine Corps, where he served as an officer for three years, leading a rifle platoon of the 3rd Marine Division during the Vietnam War. He is a recipient of the Bronze Star, two Navy Commendation Medals, the Purple Heart and the Vietnamese Cross of Gallantry.

Along with the Deputy Director, the Director ensures cases and operations are handled correctly. The Director also is in charge of staffing the leadership in any one of the FBI field offices with qualified agents. The Director briefed the president on any issues that arose from within the FBI until the Intelligence Reform and Terrorism Prevention Act of 2004 was enacted in response to the September 11 attacks. Since then, the director reports to the Director of National Intelligence, who in turn reports to the President.
When the Bureau of Investigation (BOI) was established in 1908, its head was called the Chief of the Bureau of Investigation. It was changed to the Director of the Bureau of Investigation since the term of William J. Flynn (1919–1921), and to its current name when the BOI was renamed FBI in 1935.
