Allison Baden-Clay's daughters to receive murdered mum's life insurance money

Published: May 8 2017 - 3:14PM

Allison Baden-Clay's three daughters will finally receive the $800,000-plus life insurance payout resulting from the Brisbane mother's murder, following a Federal Court ruling.

During a brief hearing in Brisbane on Monday, Justice Alfred Dowsett determined the sum of Allison's policies would be included under the control of the estate executor – her father, Geoff Dickie, and kept in a trust for her children.

The Brisbane Supreme Court ruled in February that Allison's murderer and the father of her children, Gerard Baden-Clay, had no right to her estate due to his conviction, despite being a beneficiary of her will.

However, the Federal Court was required to formally rule on whether the life insurance policies could be considered part of the estate.

Baden-Clay, 46, had tried to claim Allison's insurance policies soon after her body was discovered in a creek bed in Brisbane's west in April 2012.

He was found guilty of murder in July 2014 and sentenced to life in prison.

Allison's family issued a statement in the wake of the ruling, saying it "marks the end of a long and arduous journey through various court systems".

"And we are pleased to be at the official end of all of the litigation in our daughter's case," the Dickie family said in the statement.

"While this seems like a victory for our family, we feel that it is little compensation for the loss of a mother, daughter and sister.  Even though the past five years have been very difficult and stressful, we continue to move forward ensuring that Allison's three girls are cared for, and nurtured as Allison would have wanted.

"We appreciate the community support and interest in our family."
