In addition to the STANDARD APPLICATION LICENSE TERMS, the following terms apply:
SPOTIFY
a. The application is using the Spotify Embedded SDK. Through the use of the application, you will be able to access the subscription music service owned and operated by Spotify AB, which Spotify AB makes available to end users behind a paid subscriber wall (hereinafter referred to as the “Music Service”).
b. The Spotify Embedded SDK and the Music Service are proprietary to Spotify AB. All intellectual property rights and copyright in and to the Spotify Embedded SDK and the Music Service are exclusively owned by Spotify AB.
c. All rights and obligations regarding this application license are by and between you and the application publisher. They are solely governed by this Standard Application License Terms and any separate terms the application may come with.
d. Spotify AB is neither liable for the Spotify Embedded SDK, its merchantability, fitness for a particular purpose or non-infringement of third party rights, nor for the Music Service, its availability or its accessibility via the application.
e. Any collection of personal data is solely subject to the privacy policies of the application publisher and not to the ones of Spotify AB.
DISCLAIMER OF WARRANTY
The application is licensed “as is,” “with all faults,” and “as available.” You bear the entire risk as to its quality and performance. Should it prove defective, you assume the entire cost of all necessary servicing or repair. The application publisher, on behalf of itself, Microsoft, wireless carriers over whose network the application is provided, and each of our respective affiliates, vendors, agents, and suppliers (“Covered Parties”), gives no express warranties, guarantees, or conditions in relation to the application. You may have additional consumer rights under your local laws that this agreement can't change. To the extent permitted under your local laws, Covered Parties exclude any implied warranties or conditions, including those of merchantability, fitness for a particular purpose, and non-infringement. If your local laws impose a warranty, guarantee or condition even though these terms do not, its duration is limited to 90 days from when you download the application.
In any event, the application publisher is only liable for compensation or damages in case of intention or gross negligence.
