On March 28, 2016, New York City enacted Local Law 2016/032. The law amends the city's green building policy, providing that each capital project with an estimated construction cost of $2 million or involving the construction of a new building, and addition to an existing building, or the substantial reconstruction of an existing building shall be designed and constructed to comply with green building standards not less stringent than the standards prescribed for buildings designed in accordance with the LEED Green Building Rating System to achieve LEED Gold of higher rating. Certain building types will only be required to achieve certification at the Certified level or higher. If the mayor elects to utilized green building standards other than LEED, the mayor shall publish the findings demonstrating that such other green building standards are not less stringent than LEED standards described above for the achievement of a LEED Gold or, if applicable, a LEED Certified rating.

The Atlanta City Council unanimously voted to approve the Atlanta Commercial Energy Efficiency Ordinance on April 20, 2015. The ordinance focuses on overcoming information barriers to energy efficiency and to allow the market to utilize that new-found knowledge as a driver to reward efficient performance. At full implementation, this will require owners of commercial buildings over 25,000 square feet to benchmark energy and water consumption on an annual basis. Benchmark information will be reported to the City annually, where it will be made publicly available to inform the market. Every ten years, these buildings will be required to undertake an energy audit, where a professional walks through the building and makes recommendations on how to improve the efficiency and operation of the building. Owners are free to choose which, if any, of these recommendations to implement.

On March 19, 2015, President Obama signed Executive Order 13693, which aims to maintain federal leadership in sustainability and greenhouse gas emission reductions. The EO mandates that federal agencies must, where life-cycle cost-effective, beginning in FY2016, unless otherwise specified, improve data center energy efficiency at agency facilities. Federal agencies must also ensure minimum levels of renewable electric energy in their buildings starting in FY2016, and must improve agency water use efficiency and management by reaching specified reduction levels.

On July 29, 2011, the City of Mountain View approved Ordinance No. 8.11, establishing the Mountain View Green Building Code, amending the state-mandated Green Building Code (CALGreen) to include local green building requirements for private development. The requirements do not mandate LEED certification, but they do require that design plans meet specified LEED or Build It Green requirements. New commercial buildings occupying between 5,000 and 25,000 square feet must submit design plans compatible with the standards for LEED certification, and projects over 25,000 square feet must meet the intent of LEED Silver certification. All new construction must meet CalGreen standards and have energy efficiency requirements 15% above California Title 24, Part 6. The code also establishes regulations for construction activities in order to limit potential site disturbance. The code also requires that submeters be installed to measure indoor and outdoor potable water usage.

On July 17, 2014, the state of Arkansas adopted Reg. 140590, creating a Weatherization Assistance program that provides grants for weatherization services for Arkansas low-income residents. After a household is determined eligible, the local agency schedules an energy inspection of the home. A DOE trained Energy Auditor completes a full inspection of the energy and health and safety concerns of the home and completes a Work Order/Job Write-Up. A network of Community Action Agencies use crews or local private-sector weatherization contractors to complete the work at no cost to the occupants. Weatherization services vary depending on the specific needs of the home and DOE approved conservation measures. An average grant of $6,904 is awarded for each home for installed energy efficiency measures. No client contribution is required.

There are several ways a project can demonstrate compliance with this requirement, including: U.S. EPA ENERGY STAR Program certification; Energy code compliance modeling through approved software, along with test of the buildings' thermal envelope; Prescriptive energy efficiency option packages approved by Texas A&M Energy Systems Laboratory listed in the statute, among which include either a 4 kilowatt photovoltaic array or a solar hot water system combined with ducts located in conditioned space and 100% ENERGY STAR CFL indoor lamps; or Demonstrating improved compliance with Section R405 of the 2012 IECC.

On January 16, 2007, the Los Angeles County Board of Supervisors adopted the Los Angeles County Sustainable Design Program, requiring all new public buildings over 10,000 square feet to earn LEED Silver certification. The board also approved a motion instructing the Directors of Public Works and Planning to investigate and report back within 6 months on opportunities to incorporate LEED standards or similar requirements into industrial, commercial, and residential development standards. Additionally, another motion was passed requiring all new public buildings to use only drought-tolerant landscaping for projects authorized or fully funded after February 15, 2007.

On January 7, 2014 the State of Illinois adopted Public Act 98-0623, requiring that with respect to those school construction projects for which a school district first applies for a gran on or after July 1, 2009, the school construction project must receive Silver certification from the United States Green Building Council's Leadership in Energy and Environmental Design (LEED) Green Building Rating System, unless all of the following are met: (1) the application submitted can be categorized as a capital need prioritized under item (1) of Section 5-30 of this Law; (2) the renovation or replacement school construction project is less than 40% replacement cost, or the project has been granted a waiver by the Capital Development Board in consultation with the State Board of Education in accordance with rules promulgated pursuant to this Law; (3) the school construction project is located in a county that borders the Mississippi River with a population of more than 33,000 and less than 34,000, according to the 2010 decennial census; (4) the school district for which the school construction grant will be issued has no more than 1,100 students, with the relevant school facility housing no more than 700 students; (5) the facilities for which the school construction grant will be used have been condemned as of July 23, 2012; and (6) the application for the school construction grant has been approved prior to the effective date of this amendatory Act of the 98th General Assembly.
