Subscription Terms and Conditions

A Subscription to any West Australian Newspapers Ltd (WAN) publication is subject to the following terms and conditions. WAN publications include The West Australian, The Sunday Times, Countryman, Quokka, Kalgoorlie Miner, TABForm and West Regionals titles.

1. SUBSCRIPTION DELIVERY AREAS

1.1 Print Subscriptions are valid in the existing home delivery network in WA only. Delivery to addresses within security apartments or office buildings is subject to delivery capability. Please allow up to 10 working days from the date of application for subscription to commence.

2. FEES AND CHARGES

2.1 Prices quoted for Subscriptions are inclusive of GST and delivery fees.
2.2 Easy Pay (Direct Debit) Subscriptions: deductions will be made from Your nominated bank account either: (a) every 4 weeks in advance of delivery, or (b) every 12 weeks in advance of delivery, as nominated by You. The authority to debit your account every 4 weeks or 12 weeks (as applicable) remains valid until You notify WAN that You wish to cancel your Subscription by contacting West Australian Newspapers Subscriber Services at least 5 days before the end of your direct debit payment cycle. Subscription cancellation will be effective at the end of Your current direct debit pay cycle (either 4 or 12 weeks) for which payment has already been debited and no further debits will be made. You acknowledge that Subscription prices may be changed by WAN from time to time by giving You at least 7 days’ notice in advance. It is your responsibility to notify us if your direct debit account is cancelled or if your account details change before your next billing date.
2.3 Bill Me Subscriptions: the full payment must be made by the due date and is payable by credit card, BPay or cash at selected retailers. Subscriptions to WAN publications renew automatically. WAN will continue to deliver your selected publication/s after the expiry of your subscription period and you will be charged for all papers you receive until you notify WAN to stop delivery. Your subscription may be suspended if payment is not received by the invoice payment due date and you will be required to pay for all copies received until the date of suspension. Should you wish to recommence your subscription, you may be limited to certain payment options.  In the event of a cancellation of your Print Subscription you will receive a pro-rata refund for the outstanding portion of your Subscription to a minimum value of $5.
2.4 West Australian Newspapers reserves the right to suspend or cancel your Subscription at any time in its absolute discretion, provided that West Australian Newspapers gives You notice of such suspension or cancellation. In the event that West Australian Newspapers cancels your Subscription, you will receive a pro-rata refund for the outstanding portion of your Subscription.

3. CHANGES TO YOUR SUBSCRIPTION

3.1 Your Print Subscription delivery details can be changed, by giving WAN at least 1 business days’ notice.
3.2 To temporarily suspend your Print Subscription, You will need to contact West Australian Newspapers Subscriber Services or lodge your request online and tell us the date from which You want to suspend your Print Subscription, and also the date that you would like your Subscription to restart. You will need to submit your request by 12pm the day before to suspend your Tuesday to Saturday publications or by 12pm Saturday to suspend your Sunday or Monday suspensions. Your Print Subscription can be temporarily suspended for a maximum of 90 days on each occasion. The equivalent dollar value of the days for which your Print Subscription is temporarily suspended will be credited to the end of your Print Subscription.
3.3 Alternatively, when You suspend your Subscription we may invite You to participate in our Newspapers In Education (NIE) Program. If You choose to participate in the Program, then the funds WAN receive from You that are attributable to Your suspended newspaper copies will be used to send newspapers to schools. The suspended days will not be credited to the end of Your Subscription. We are not able to issue you with a tax receipt to document your participation in the Program. For the sake of clarity, if you do not choose to participate in the Program, the equivalent dollar value of the suspended days will be credited to the end of your Subscription as described in clause 3.2.
3.4 When You suspend your Subscription we may ask You if you would instead like to redirect your subscription, if you are temporarily visiting another location in WAN’s existing delivery network. You will need to submit your request for redirection by 12pm on the day prior to the change for Tuesday to Saturday publications or by 12pm Saturday for redirection of Sunday or Monday publications. In this instance, you will continue to be billed as normal.

4. PRIVACY

4.1 Western Australian Newspapers Limited (ABN 98 008 667 632) and its related entities (“WAN”), is collecting your personal information for the purpose of administering your subscription and understanding our audiences. WAN will otherwise handle your personal information in accordance with Seven West Media’s Privacy Policy which is available on our website at http://thewest.com.au/privacypolicy (and which contains information regarding how you can access your personal information, correct it and/ or make a complaint about our handling of your personal information). By providing your personal information below, you agree to the terms of the Privacy Policy. Without limiting the foregoing, WAN may disclose your personal information to its related entities, business partners and external service providers for research and profiling purposes as well as other purposes reasonably related to your relationship with WAN. In addition, by subscribing to this publication, you consent to WAN using your personal information for the purpose of WAN and its related entities sending you information regarding programs, products and services available through them and/ or through their business partners, and to WAN from time to time sharing your personal information with carefully selected business partners for the purpose of them sending you such information directly. We will always provide you with the ability to opt out of those communications.

5. WEST BENEFITS

5.1 As a Subscriber, You will gain access to West Benefits. The Terms and Conditions for West Benefits are available at https://benefits.thewest.com.au/help/terms-conditions.html

6. DISCLAIMERS

6.1 You agree that any errors made in entering Your contact information and order details are Your responsibility and West Australian Newspapers is not liable for any consequences that may arise as a result of such errors or incorrect information, including but not limited to sending the Subscription to the address as notified by You. If You change your address or any other relevant details or do not receive your Subscription, You should notify WAN by contacting the Subscriber Services Team.
6.2 To the extent permitted by law, West Australian Newspapers Limited is not liable to You for any loss or damage incurred by You in connection with your Subscription, whether direct, consequential, special, indirect or other loss or damage. In any event, West Australian Newspapers maximum liability to You is limited to the value of the Subscription fees paid within the previous twelve months.

7. GENERAL

7.1 You acknowledge and agree that You are entitled to purchase a Subscription from West Australian Newspapers for personal use only and that Subscriptions cannot be exploited for any commercial purpose, including on-selling Your Subscription to any third party.
7.2 You acknowledge that these Subscription Terms and Conditions may be modified by West Australian Newspapers from time to time, and agree that You are responsible for regularly reviewing these Subscription Terms and Conditions and your continued use of the subscription constitutes your acceptance of any such modifications.
7.3 From time to time West Australian Newspapers offers promotional items with its newspapers. West Australian Newspapers does not guarantee that newspapers delivered to Subscribers will include these items. From time to time, these items will be available for collection at a newsagent, retail outlet or West Australian Newspapers offices. At its discretion West Australian Newspapers will communicate with its Subscribers about the availability of such items.

8. DEFINITIONS

In these terms and conditions:
8.1 ”West Australian Newspapers”, “WAN”, “we” or “us” means West Australian Newspapers Limited and its related corporations (as defined by the Corporations Act 2001).
8.2 ”Subscriber”, “Customer” or “You” means a person who is a subscriber to any West Australian Newspapers (WAN) publication.
8.3 A “Print Subscription” means a standard fully paid subscription taken up directly with West Australian Newspapers, and for which these terms and conditions apply. A Subscription includes all parts and sections of the publication deemed part of the publication for home delivery in your area; this may change from time to time in accordance with West Australian Newspapers reasonable logistics and operational requirements. A Subscription may be made by direct debit which is an ongoing Subscription where West Australian Newspapers debits the cost of the Subscription from your bank account every 4 weeks or 12 weeks (“Direct Debit” or “Easy Pay” Subscription), or a fixed term Subscription where the full payment is made by you upfront (“Bill Me” Subscription).

Digital Edition Subscription Terms and Conditions

A Digital Edition Subscription to any West Australian Newspapers (WAN) publication is subject to the following terms and conditions. WAN publications include The West Australian, The Sunday Times, The Weekend West, Countryman, Quokka, Kalgoorlie Miner, TABForm and other titles in regional areas.

1. CONDITIONS OF USE

1.1 By purchasing a digital edition subscription to The West Australian, The Weekend West or The Sunday Times you are entering a Website owned and operated by West Australian Newspapers Limited (WAN) ABN 98 008 667 632. Your entry to this Website is subject to the terms and conditions of use defined below. If you do not agree to be bound by these Conditions of use you should not enter this site. The West Australian is published daily Monday to Friday, The Weekend West is published on Saturdays and The Sunday Times is published on Sundays. It is not ordinarily published on Good Friday or Christmas Day. All published editions are available as a digital edition. The digital edition will be available after 6am WST on the day of publication.

1.2 West Australian Newspapers reserves the right to change, modify or amend the Conditions of Use of digital editions of The West Australian, The Weekend West or The Sunday Times at any time and at its sole discretion. You will be notified of such changes, modifications or amendments within thewest.com.au/digitaledition Home Page. Your continuing use of the site will be deemed to be your acceptance of these changes, modifications or amendments.

1.3 Digital Edition Subscriptions are valid in Australia or overseas.

1.4 Digital Edition Subscriptions cannot be temporarily suspended. Digital Edition Subscriptions cannot be redirected to a different user. Your Digital Edition username and password cannot be provided to someone else.

1.5 If you experience technical problems accessing your Digital Edition Subscription, it is Your responsibility to notify WAN Subscriber Services to receive assistance.

2. FEES AND CHARGES

2.1 Prices quoted for subscriptions to the digital edition of The West Australian,The Weekend West and The Sunday Times are in Australian dollars and are GST-inclusive.

2.2 Access to digital editions of The West Australian, The Weekend West and The Sunday Times will be available on a pay for use basis. The full, fixed term payment is due upfront and is payable by credit card.

2.3 A digital edition subscription includes access to desktop, laptop, smartphone, iPad and android tablet for the one price.

2.4 Prices are subject to change.

3. CHANGES TO YOUR SUBSCRIPTION

3.1 Minimum subscription terms may apply to selected subscriptions, including one day or one week subscriptions. A pro-rata refund will be provided for monthly or annual subscriptions.

3.2 West Australian Newspapers reserves the right to suspend or cancel your Digital Subscription at any time in its absolute discretion, provided that West Australian Newspapers gives You written notice of such suspension or cancellation. In the event that West Australian Newspapers cancels your Digital Edition Subscription, you will receive a pro-rata refund for the outstanding portion of your Digital Edition Subscription.

3.3 In the event of a cancellation of your Digital Edition subscription, you will receive a pro rata refund for the outstanding portion of your of your subscription to a minimum value of $5.00.

4. PRIVACY

4.1 Western Australian Newspapers Limited (ABN 98 008 667 632) and its related entities (“WAN”), is collecting your personal information for the purpose of administering your subscription and understanding our audiences. 5.2 To the extent permitted by law, West Australian Newspapers Limited is not liable to You for any loss or damage incurred by You in connection with your Subscription, whether direct, consequential, special, indirect or other loss or damage. In any event, West Australian Newspapers maximum liability to You is limited to the value of the Subscription fees paid within the previous twelve months.

5.3 You acknowledge that while WAN and all contributors to The West Australian,The Weekend West  and The Sunday Times will endeavour to ensure that the material contained within the digital editions are accurate and up-to-date, WAN and its contributors accept no responsibility for any error or omission in relation to any material contained within this edition.

5.4 WAN makes no warranty or representation as to any material contained within the digital edition of TThe West Australian, The Weekend West  and The Sunday Times. All implied warranties and conditions are excluded, except those that by operation of law cannot be excluded.

5.5 You rely on the material contained within the digital edition of The West Australian, The Weekend West  and The Sunday Times at your own risk. WAN specifically excludes all liability for any loss or damage, which may be suffered by you by reason of reliance on this material contained within this website for any purpose or your inability to access material contained within this edition. Under no circumstances will WAN be responsible for any direct, indirect or consequential damage caused to you by reason of any use of the material contained within the digital edition of The West Australian, The Weekend West  and The Sunday Times or your inability to access material contained within the edition. WAN accepts no responsibility for loss resulting from viruses, internet access problems or hardware or software malfunctions.

5.6 WAN does not warrant or represent that the digital edition of The West Australian, The Weekend West  and The Sunday Times will be available at all times. WAN accepts no liability for any loss or damage suffered by you if for any reason access to the digital edition of The West Australian, The Weekend West  and The Sunday Times is not available.

5.7 In the case of services offered to you by WAN within the digital edition of The West Australian, The Weekend West  and The Sunday Times, to the extent that WAN's liability cannot be excluded by operation of law, WAN's liability is limited to the supply of these services again or the payment of the costs of having these services supplied again.

5.8 The publishers reserve the right to alter or omit editorial copy and photographs in the digital edition where necessary to ensure that the newspaper is not exposed to legal action defending contempt of court or other legal proceedings.

6. GENERAL

6.1 You acknowledge that these Digital Edition Subscription Terms and Conditions may be modified by West Australian Newspapers from time to time, and agree that You are responsible for regularly reviewing these Digital Edition Subscription Terms and Conditions and your continued use of the subscription constitutes your acceptance of any such modifications.

6.2 From time to time West Australian Newspapers offers promotional items with its newspapers. West Australian Newspapers does not guarantee that Digital Editions will include these items. From time to time, these items will be available for collection at a newsagency or West Australian Newspapers offices. At its discretion West Australian Newspapers will communicate with its Subscribers about the availability of such items.

7. COPYRIGHT

7.1 ALL material including, but not limited to articles, information, data, photographs and artists illustrations contained within West Australian Newspapers publications is subject to Australian and international copyright laws. Subject to the provisions of such laws you must not copy, reproduce, re-broadcast or re-transmit any material contained within, whether in whole or in part, by any means or attempt to deal in infringing copies taken from this site.

7.2 You may make only one copy (whether a digital or hard copy) of WAN material for the purpose of personal and private use only. Any copying for commercial purposes, for distribution to third parties or other manner of use of WAN material is expressly forbidden without prior written permission of WAN.

7.3 Application for the use of published material from TThe West Australian, The Weekend West  and The Sunday Times should be made to the Syndications Manager on 61 08 9482 3206.

8. SITE CONTENT

8.1 It is the responsibility of any party whether directly or indirectly displaying material within TThe West Australian, The Weekend West  and The Sunday Times or thewest.com.au including, but not limited to, advertisements offering any goods and services for sale or otherwise to ensure that these goods and services do not violate any law of Australia, its Territories and international law pertaining to any form of abuse, malicious falsehood, violence, obscenity, pornography or objectionable social behaviour punishable by law or laws regarding weapons, munitions, explosives and other harmful materials, and do not promote the email activity commonly known as spamming and the Internet activity commonly known as hacking. WAN accepts no responsibility for any material displayed on this site by any third party. Any liability for such material is hereby excluded.

9. ACCESS TO OTHER SITES

9.1 Links contained within the digital edition of The West Australian, The Weekend West  and The Sunday Times may provide access to you to additional sites, which are owned, maintained and controlled by Internet service providers other than WAN. These may include free, public access information sites, restricted, user-pays sites and commercial sites including eCommerce sites. The material contained within these sites can change without WAN's knowledge. As these sites are neither the property of, or any responsibility of WAN, you acknowledge that WAN has no control over the maintenance of these sites and therefore bears no liability or responsibility for their content.

10. TRADE MARKS

10.1You may not use any trade mark, name, get up or other indicia appearing within thewest.com.au or the digital edition of The West Australian, The Weekend West  and The Sunday Times, whether in whole or in part, by any means or for any purpose without the permission of the owner. WAN accepts no responsibility for the use of any trademark, name, get up or other indicia by any person displaying material within thewest.com.au or the digital edition of The West Australian, The Weekend West  and The Sunday Times. Liability for such use is hereby excluded. Any person using a trade mark, name, get up or other indicia within thewest.com.au or the digital edition of The West Australian,T he Weekend West  and The Sunday Times agrees to indemnify WAN for any claim by any third party against WAN in relation to such use.

11. GOVERNING LAW

11.1 These CONDITIONS of USE are governed by the Laws of Western Australia and, where appropriate the laws of the Commonwealth of Australia. Your entry to thewestaustralian.com.au and the digital edition of The West Australian, The Weekend West  and The Sunday Times is subject to this governing law and you agree to submit to the nonexclusive jurisdiction of the Courts of Western Australia in relation to any dispute arising out of these CONDITIONS of USE, your use of thewestaustralian.com.au, or the digital edition of The West Australian, The Weekend West  and The Sunday Times and the material contained within. You agree that you will not at any time claim that Western Australia is not a convenient forum in relation to a dispute.

12. DEFINITIONS

In these terms and conditions:

12.1 "West Australian Newspapers", "WAN", "we" or "us" means West Australian Newspapers Limited and its related corporations (as defined by the Corporations Act 2001). West Australian Newspapers Limited Group of 50 Hasler Road Osborne Park, WA 6017, (ABN 98 008 667 632).

12.2 "Subscriber", "Customer" or "You" means a person who is a subscriber to a digital edition of The West Australian, The Weekend West or any other WAN publication.

12.3 A "Digital Edition Subscription" means a standard fully paid The West Australian, The Weekend West  and The Sunday Times digital subscription taken up directly with West Australian Newspapers, and for which these terms and conditions apply. A Subscription includes all parts and sections of the publication deemed part of the publication; this may change from time to time in accordance with West Australian Newspapers reasonable operational requirements. A Digital Subscription can only be paid for by credit card where the full payment is made by you upfront ("Upfront Subscription").

12.3 B "Digital Edition plus Print Edition Subscription means a full The West Australian, The Weekend West  and The Sunday Times  Digital Edition subscription taken up directly with West Australian Newspapers, in conjunction with a print subscription to The West Australian,The Weekend West  and The Sunday Times, and for which these terms and conditions apply. A Subscription includes all parts and sections of the publication deemed part of the publication; this may change from time to time in accordance with West Australian Newspapers reasonable operational requirements. A Digital Edition plus Print Edition Subscription may be made by direct debit which is an ongoing Subscription where West Australian Newspapers debits the cost of the Subscription from your bank account every 4 weeks or 12 weeks ("Direct Debit" or "Easy Pay" Subscription), or a fixed term Subscription where the full payment is made by you upfront ("Bill Me" Subscription). The subscription cost of both the 'Print Subscription' and the 'Digital Edition Subscription' are linked.

Digital Edition Plus Print Edition Subscription Terms and Conditions

A Digital Edition Subscription when combined with any West Australian Newspapers (WAN) subscription is subject to the following terms and conditions. These terms and conditions are over and above those outlined in the digital edition Subscription Terms and Conditions above and Standard Subscription terms and conditions (subscriber.thewest.com.au/subscription-terms).

1. CONDITIONS OF USE

1.1 The Digital Edition plus Print Edition Subscription is only available where Print Subscriptions are valid in the existing home delivery network in WA only.

1.2 Prices quoted for subscription to the Digital Edition will be made clear during the order process. You agree to pay the price stated at the time of your order. You also agree to the billing process frequency matching that of your West Australian Print Subscription frequency.

1.3 Prices quoted for subscriptions to the digital edition of The West Australian,T he Weekend West  and The Sunday Times are in Australian dollars and are GST inclusive.

1.4 This Digital Edition plus Print Edition Subscription includes a West Australian Print Subscription component. In the event of a cancellation of your West Australian Print subscription, your subscription to your Digital Edition Subscription will automatically be cancelled as well.

1.5 While your Print Subscription may be temporarily suspended (Holiday Hold) your Digital Edition Subscription cannot be suspended at any time.

Easy Pay Agreement

For all direct debit requests, the following is your Direct Debit Service Agreement with West Australian Newspapers Limited, ABN 98 008 667 632. The agreement is designed to explain what your obligations are when undertaking a Direct Debit arrangement with us. It also details what our obligations are to you as your Direct Debit Provider.

DEFINITIONS

account means the account held at your financial institution from which we are authorised to arrange for funds to be debited.
agreement means this Direct Debit Request Service Agreement between you and us.
banking day means a day other than a Saturday or a Sunday or a public holiday listed throughout Australia.
debit day means the day that payment by you to us is due.
debit payment means a particular transaction where a debit is made.
direct debit request means the Direct Debit Request between us and you.
us or we means West Australian Newspapers Limited, (the Debit User) you have authorised by requesting a Direct Debit Request.
you means the customer who has signed or authorised by other means the Direct Debit Request.
your financial institution means the financial institution nominated by you on the DDR at which the account is maintained.

Easy Pay Agreement

For all direct debit requests, the following is your Direct Debit Service Agreement with West Australian Newspapers Limited, ABN 98 008 667 632. The agreement is designed to explain what your obligations are when undertaking a Direct Debit arrangement with us. It also details what our obligations are to you as your Direct Debit Provider.

1. Debiting your account

1.1 By signing a Direct Debit Request or by providing us with a valid instruction, you have authorised us to arrange for funds to be debited from your account. You should refer to the Direct Debit Request and this agreement for the terms of the arrangement between us and you.
1.2 We will only arrange for funds to be debited from your account as authorised in the Direct Debit Request.
1.3 If the debit day falls on a day that is not a banking day, we may direct your financial institution to debit your account on the following banking day. If you are unsure about which day your account has or will be debited you should ask your financial institution.

2. Amendments by us

2.1 We may vary any details of this agreement or a Direct Debit Request at any time by giving you at least fourteen (14) days written notice.

3. Amendments by you

3.1 You may change, stop or defer a debit payment, or terminate this agreement by providing us with at least five (5 days) notification in writing to: West Australian Newspapers Limited, Subscriber Services, PO Box 1743, Osborne Park DC, WA 6916; or by phoning us on 1800 811 855 during business hours; or arranging it through your own financial institution.

4. Your obligations

4.1 It is your responsibility to ensure that there are sufficient clear funds available in your account to allow a debit payment to be made in accordance with the Direct Debit Request.
4.2 If there are insufficient clear funds in your account to meet a debit payment:
(a) you may be charged a fee and/or interest by your financial institution;
(b) you may also incur fees or charges imposed or incurred by us; and
(c) you must arrange for the debit payment to be made by another method or arrange for sufficient clear funds to be in your account by an agreed time so that we can process the debit payment.
4.3 You should check your account statement to verify that the amounts debited from your account are correct
4.4 If West Australian Newspapers Limited is liable to pay goods and services tax (“GST”) on a supply made in connection with this agreement, then you agree to pay West Australian Newspapers Limited on demand an amount equal to the consideration payable for the supply multiplied by the prevailing GST rate.

5. Dispute

5.1 If you believe that there has been an error in debiting your account, you should notify us directly on 1800 811 855 and confirm that notice in writing with us as soon as possible so that we can resolve your query more quickly. Alternatively you can take it up with your financial institution directly.
5.2 If we conclude as a result of our investigations that your account has been incorrectly debited we will respond to your query by arranging for your financial institution to adjust your account (including interest and charges) accordingly. We will also notify you in writing of the amount by which your account has been adjusted.
5.3 If we conclude as a result of our investigations that your account has not been incorrectly debited we will respond to your query by providing you with reasons and any evidence for this finding in writing.

6. Accounts

6.1 You should check:
(a) with your financial institution whether direct debiting is available from your account as direct debiting is not available on all accounts offered by financial institutions.
(b) your account details which you have provided to us are correct by checking them against a recent account statement; and
(c) with your financial institution before completing the Direct Debit Request if you have any queries about how to complete the Direct Debit Request.

7. Confidentiality

7.1 We will keep any information (including your account details) in your Direct Debit Request confidential. We will make reasonable efforts to keep any such information that we have about you secure and to ensure that any of our employees or agents who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information.
7.2 We will only disclose information that we have about you:
(a) to the extent specifically required by law; or
(b) for the purposes of this agreement (including disclosing information in connection with any query or claim).
