Robert Xie's defence to the Crown case:

  • Xie had an alibi - he was at home in bed with his wife.
  • There were no similarities between a massage device found in Xie's home, and the "hammer like" murder weapon described by the Crown, therefore no implication he made them both.
  • Xie was not the only person in Australia, or in the world, to wear ASICS sneakers.
  • The jury could not be satisfied that the stain found in the garage was blood.
  • The jury could not rule out that the stain had the DNA of other family members in it, and therefore could not be linked to the crime scene.
  • There's nothing in Xie's conduct on the day of the murders, or in the destruction of shoe boxes that reveals a consciousness of guilt.
  • His conversations with WItness A at Long Bay jail do not reveal anything about Xie's guilt, and were "simply jail talk".
  • Xie did not admit to Witness A that he sedated his wife - that alleged conversation was not recorded.
